US Citizenship General DiscussionI'm nervous about our filing
QUOTE (NickD @ Nov 25 2009, 04:13 AM) <{POST_SNAPBACK}>
Wife went completely brain dead and was shaking like a leave at our AOS, but after dealing with the USCIS for four years, she hardened. How much ####### can a person take until they really don't give a damn anymore? But she handled herself very professionally and no big deal if she didn't pass, had a recent foreign passport and a 17 day old ten year green card. They don't take your green card away if you fail the test, but given a second chance, worse case was an extra trip, so why worry?

We kicked the civics test around, kind of an interesting conversation with family, really non-political and interesting to learn how our country has deviated from our original US Constitution and does give a certain amount of pride when living here. But our real serious study occurred in the 4 1/2 hour drive to our field office, kind of like cramming for a college exam, heck you forget most of the stuff the day after. Wife is one of those people that can recall every detail of her interview, most of our discussion afterwards was her proving she was living with me. She said the English and civics test that you would consider the key points of your interview lasted less than two minutes, she was in for 43 minutes. Most of her time was spend going through the N-400 and digging out original evidence. Can only wonder why it was that way since we went through the same thing for her conditional and ten year card.

Like most that posted here, she got the first six questions correct and that ended that phase, and also remembered to get a commitment when she could expect her oath letter. And did ask why other field offices were giving the oath the same day. Just got a quick reply, we don't do that here.

Her first words to me after her oath ceremony that she never said before, she finally feels that she is now a part of this country, always felt like an outsider before. Then the conversation switched to all the things we had to do after her oath ceremony. After that, it was finally over.

No reason to be nervous, but do be prepared.

Thanks NickD. I'm going to start on gathering originals of car insurance statements, lease agreement, photos, etc. so that when we are ready to file we just have to pay the $$$.

I am so relieved I want to cry - I just did a search online and we did register for Selective Service in 2006 (the year he arrived). Thank goodness. Thanks to VJ also, I did not know that this proof of registration was required to file.

Jonesie; I was going to tell you to check online; I know that you can get a packet to study from and don't they have a CD...that's what my friends did. He has to take it seriously though....

Lawny I am just ready for all of this to be over and done with.

USCIS actually registers you a few days before your A.O.S. Interview. or if they approve you without interview. They still register you. How magical.

Arctic I do not remember registering. I asked hubby last night and he said he didn't do it - so I guess USCIS did it for us. Our interview for conditional GC was in August 2006 so the timing of our "registration" was September 2006 so that makes sense. I'm glad they did though.

THe packet they give you is really helpful. It includes a CD with a practice test and there is a link where you can print out your own flash cards.

Okay, thanks for the tip. We can use that as another method to see which works best (cd w/ practice test vs flash cards) good.gif

You could maybe try making up flash cards with the questions and the answers on the back?

Or have him practice writing the questions down and reading them out loud. Maybe put the questions and answers into some kind of song type of thing? Or maybe record the questions and answers then he could play it back and listen to them over an over? Im not sure how your husband learns, everyone learns things diferent but thos are some ideas maybe?

The flash cards sound like a great idea. He hates reading, so having him read the book would drive him insane. Thanks Inky smile.gif

He hates studing, he hates reading...no offense but it seems that he just needs to suck it up and do it. I mean this exam is waaaay easier than most of high school tests, let alone college ones. Kids also hate studing, but you kick their #### and take away their toys and they suck it up and study. Shouldn't be that hard to motivate an adult...

We all don't learn the same way. Reading is not something that he enjoys. Hands on learning works for him, as he does not consider that studying, it is more interactive.

I just want to find a way to make it easier for him to retain the information because we don't have filing fees to kiss goodbye if he did not pass. It's not about motivation, it's about studying smarter. I have my own areas of weakness (math is the biggest) so I can relate to where he is coming from. As a supportive wife I'm doing what I can to help.

OMG - we completely forgot to register for Selective Service. I know this is our error, but with everything going on in our personal lives, this was a slip up. How will this affect us when we do file? Hubby is now 27.

I don't feel that hubby understands how this process differs from our interviews for the 2 year and 10 year greencard. He hates studying and does not do well under pressure. Are there any tips you all can recommend so that he is prepared? When I reviewed the information that he needs to know, I did a wacko.gif
We need to find a way for him to retain the info so that he passes good.gif

Thanks everyone!

K-1 Fiance(e) Visa Process & ProceduresFiancé has been on Canadian work visa, US K1 visa now approved...
Hello! I'm posting and asking on behalf of a relative - please help, any advice appreciated!

My Jamaica fiance works in Canada on visa and has been doing so for the past few years. We decided to finally file a K1 visa and it has been approved. The problem is that my fiancé is contracted to work and we need to know if there is an option for him to complete all necessary visa appointments in Canada or does he need to return to Jamaica?

National Visa Center (Dept of State)B-2/affadavit of support?

Hi,
I am a U.S. citizen recently married to Chinese woman. My daughter-in-law is Chinese and living in the UK as a student. She would like to visit the U.S. on holiday and so would apply for B-2 visa in London. Does she need an I-864 from me for her application packge or just general proof of income/funds (ie; bank statement, etc)? If I need the I-864 then would it be the long form or the EZ?

Thanks for your help!

BC

I applied for a B2 visa at the London Embassy in 2006. I mistakenly thought that if I provided an Affidavit of Support that it would assist my application. Luckily, I had proof of funds in my own bank account with me to show that I could cover my stay in the US without any assistance. The man who interviewed me informed me that the Affidavit of Suuport only hindered my application as it gave me more reason to stay in the US than to return to the UK once my Visa expired.
Your daughter-in-law needs to provide evidence that she can support herself and that she will return to the UK once the Visa expires.

Just to let you know...I successfully got a 6 month extension to my B2 Visa by showing that I was self supportive, even though I had no property or job in the UK.

Good luck with the B2 application.

US Embassy and Consulate DiscussionInterview Scheduled!!!!!
[font=Comic Sans Ms][size=3]That's some fast turn around! Good news on your end....congrats :)

One question I have is when did you schedule your medical appointment, or did you already have your exam performed? We were trying to figure out if we could do our interview and our medical on the same day or a day apart and still hear if we got the visa on the same day. My Fiance is here in the US on a B2 travel visa, so we will need to go to London and make it a one shot trip.......

Thanks for your input and again.....good luck!!!!!

US Embassy and Consulate DiscussionConcerned with Interview

The other bind is the requirement to list every place i have lived and dates . frankly i cannot remember each of them other than roughly - can remember and work out the years but getting more acurrate that that is going to be hit and miss.....is this going to be issue? ( this is 17 years of postings!)

You do not have to remember every address you have lived at...only every town you have lived in. If you read the form, it only asks you for the town, not the whole address. I had only lived in one town my whole life, although I had moved house several times, but all I put was the name of the town...and where it asks for the dates I put the date I turned 16 until the present day.

So, that should make it a whole lot easier to remember.

PS...My home town is Hull too!!!

K-1 Fiance(e) Visa Process & ProceduresHow deal with parents who talk guilt?
I am so sorry to hear that you are going through such a turmoil.

I am sure that a lot of what you are going through is to do with not knowing what you are going to be faced with. You are leaving the security of your family and home and going to a country that your 'soon-to-be' wife wanted to get away from!!! Of course you are going to feel like this!!

But...you BOTH want to be together, and marriage is about helping each other through the good AND the bad. A good marriage is also based on truth and honesty, so you have to tell her how you are feeling in a way that is not going to leave her with even more guilty feelings.

The one good thing about 'long distance relationships' is that you learn how to talk!!! Even if it's about nothing!!! There has to be some compromise on this...it is not fair for her to let her father dominate your marriage but it is also not fair for you to expect her to completely shut him out. Talk to her!!

You said this...

monday she was about to leave to book the reception place, but he forbid her of going. he changed his mind tuesday after his wife talked to the father.

If this is the case, then his wife obviously knows that he is being unreasonable, and you may have an ally in her. She obviously has some influence on him.

The worst thing you can do is to alienate yourself from her family as that will isolate you in a country you do not know and it will make her feel like she is in the middle and being pulled both ways.

Ideally you need to talk to her father also, to reassure him that you will take care of his daughter. Like some of the posts have said before, he is probably over protective which has been made much worse due to his injury (and the cause of it).

Anyway, I hope you sort this out between the two of you and I wish you the very best in doing so. I also hope you have the most wonderful wedding, regardless of family!!!

Take care, and remember..."You can't change the past, but you can ruin the present by worrying about the future"!!!
:)

K-1 Fiance(e) Visa Process & ProceduresMarrying in USA on a B1
Well, we applied for the K1 while I was in the US on a B2 Visa. I then applied for an extension of that B2 Visa once my 6 months was up and got another 6 months. My interview for my K1 is due in London on February 1st so we will be flying back to England together!!!

Therefore, it is totally legal to go through the whole process, from start to finish, on a B2 Visa!!

Now the B1 Visa is a tourist Visa for Business, so I am not sure about that one...but I'll tell you now, I was told, unequivocally, at my poe "DO NOT GET MARRIED WHILST HERE ON THE B2 VISA"!!! I took that as a warning that there may be consequences if I disobeyed!! :bonk:

Anyway...whatever you decide to do, I hope it all works out!!

Regards

Jenni

US Embassy and Consulate DiscussionTax Return for I-134
Hi All,

First, thanks so much for this wonderful website. I used it as my primary guide in filing my I-129F for my fiancee earlier this month and I am so thankful for all the great guidance and advice!

I'm getting prepared a early for the K-1 process, specifically the I-134F and had a question. I graduated college in 2006, but went straight to graduate school for my MBA. However, my parents supported me through the entire process and I haven't filed a tax return as I have had no income from any employers. I currently hold a job earning over $50k USD a year, so I'm wondering if my not having any previous tax returns from 2007-2004 will be an issue, as it seems from reading the comments on this forum that they are mainly concerned with CURRENT income.

Am I going to need a co-sponsor, and if so, would my sister work (I haven't told my parents that my fiancee isn't a USC or PR yet and I would catch hell from them if they found out...)?

Any advice you could give me on the subject would be sincerely appreciated. Thank you so much, in advance!

US Embassy and Consulate DiscussionUnemployment and the I-134
Oh, you guys are absolutely fantastic and have really helped calm my nerves. Thank you so much!

And, as she is here with me right now on a travel visa (going back on July 29th, a day I hope takes ages to come), my fiancee would like to offer to send you some homemade cookies she bakes here in our kitchen. Just PM me your address and we'll cook you up a batch!

As a testament to how good they are: I've gained about 8 lbs. since she's been here... tongue.gif

Thanks again, guys!

US Embassy and Consulate DiscussionUnemployment and the I-134
Hi There,

I think it's becoming clear to me what the biggest hurtle is going to be regarding my I-129F petition...

About 4 months ago, I filed my paperwork to receive unemployment after being laid off from my software company. My unemployment request was actually denied because, at the time, I hadn't worked enough hours at my job to qualify, and I never received any money or benefits whatsoever from the state. In short: I have never been a public charge.

However, I'm wondering if the fact that I have applied at all will be a factor in my fiancee's K-1 visa approval. I have a current income well above the 125% poverty line, but I don't have a long history of employment as I only graduated a little while back (i.e. I don't even have a tax return from 2007 - I'm that fresh off the line).

I'm going to have a co-sponsor, my sister, I make more than enough to satisfy any concerns about my fiancee becoming a public charge, but I'm worried now that my past history might play a detrimental role in the approval process.

Any thoughts?

K-1 Fiance(e) Visa Case Filing and Progress ReportsJust excited to see our case was touched!
Congratulations! Hope it gets approved soon!

Still waiting for another touch - they cashed the check and touched it once on June 13th, so I'm hoping we'll get a touch on July 12th for my birthday present! *crosses fingers*

Aww, filed through the CSC center on June 9th and not a touch after the NOA1 sad.gif... I know I'm being greedy and unrealistic, but an NOA 2 approval this Saturday would make a WONDERFUL birthday present *hint hint, nudge nudge USCIS*

K-1 Fiance(e) Visa Process & ProceduresSupplemental employment history G 325a??
Oh dear God, I'm panicking.

I just realized I made have made a big mistake and am starting to worry that I just cost us a few months more apart! I graduated college in 2006 and did not work during school, so I gave them my full job history from 2006 on. Also, there was a period of unemployment for 2 months that I didn't mention, so my answer looks like this:

xxxx job 2/08-present
xxxx job 8/07 - 2/08
xxxx job 2/07 - 6/07

But no mention of my unemployment or school prior to 2006. Did I just screw us?

And if I did, is there anyway I can amend the answer without waiting for them to delay it by months and send me a request for information?

K-1 Fiance(e) Visa Process & Procedureswhat about co-sponsors?
PS2: The other wonderful thing for you, but unfortunate thing for them, is: nursing facilities have a very high employee turnover rate, especially for "floor" staff like CNA's; i.e. they're always hiring, and if you work hard, don't skip shifts at the last minute, and do your best, you'll be valued beyond belief by charge nurses and department heads. Because nursing facilities are typically small - 100-200 patients, with a staff around 20-30 - it is very easy to make a good reputation for yourself, and if you are dependable, you'll be the first person a DNS calls when she needs someone to pick up an extra shift.

I agree with hyacent she is a working citizen who does not have enough income. She is trying her best . I think you all BASH people to quick You all are a bunch of BASHERS. Stoop the bashing on here and get a life

I don't see anybody bashing the OP in the least. Sometimes the best way to help somebody is to get them on the track of helping themselves.

We have very little information about the OP or her situation, so lacking information, we know only that she has too little income to sponsor a fiance. Until recent posts, we had no idea there were children involved (evidently at least two but actual number unknown) so could only assume the income was under the quite low threshold for a household of two. When left to form impressions based on limited information, people will often come to the wrong conclusions.

We are not going to be able to help her find a co-sponsor but with enough information, we may be able to help her figure out how to qualify. For that to happen, the OP will need to focus on providing facts instead of lashing out at people trying to help.

All that said, we're still talking about two adults here who need to figure out the financial aspects of immigration and marriage. We can help, but the problems and solutions belong to the two of them.

Maybe it's my overactive sense of empathy, but I do feel a lack of sympathy, not necessarily anger, and it seems like a lot of the posts responding are just: "You're s*** out of luck, deal with it" style comments. I'll offer my opinion and a little background and hope it will help.

First, I am actually a Department Director at a facility and we employ over a dozen CNA's; they work incredibly hard and are often short-staffed, and the instability of income comes from the patient census, itself; if the Admissions Department isn't generating enough patient admits, everybody's hours, nurses, CNA's, even other Directors get their hours cut to meet budgetary guidelines - that's a corporate decision of which the actual facility, unless independent, has little to no control over; most facilities are required by corporate to meet and NOT exceed the MINIMUM guidelines for staffing; in my state, the guidelines mandate only one CNA per every 8 patients, and if those patients are all high acuity and require a lot of attention, that's a full day on your feet with no breaks tending to the 70 call lights that come on at any given time. It honestly seems like she's doing the best she can right now and I would never tell someone that money should be a prohibitive factor to two lovers being together; I know that you, specifically, aren't saying that, but it seems like some of the others are at least implying if not directly saying it.

In terms of the problem itself, if you can't find a co-sponsor, I would highly recommend looking at other facilities in your area with higher patient volumes; it's guaranteed hours, and the option to pick up extra shifts and working doubles is almost certain. This might not be something you can manage with your children, but if you haven't already, I would do some research. Another option is to contact the local medical staffing agencies in your area and pick up extra shifts to raise your income; you do not have to leave your current job if it's stable and you wish to stay, but an agency might be able to help place you in additional assignments "moonlighting" at other facilities. Agencies also typically pay higher than the actual facilities do. It may mean working 6-7 days a week, and definitely working 40+, but it should very easily be able to get you over the minimum requirements in time for your I-134 filing. Think about it in terms of the number of shifts you'll need per week to make your minimum requirements.

I am not sure what state you're in, but if you want to send me a PRIVATE MESSAGE, I might be able to help you find more resources if I have time. I definitely empathize with your position, as I was worried I wouldn't make enough either after having been laid off from my last company in a massive downsizing. Please don't panic, just focus and plan. The sooner you can calculate some numbers, the sooner you can find either a new job or an agency position that can help you meet your needs.

If you put in the effort and get a little luck, you can do it, I promise.

I know it sounds trite and meaningless, but hang in there. You'll be in my prayers.

PS: Cham is right, nursing facilities pay very well, and agency placements in nursing facilities (i.e. skilled nursing, ICF, or hospice care) pay ridiculously well, at least in my state.
