Same here, being home doesn't bother me in the least. A billion e-books, American cable and WoW do the trick just fine. Not to mention that I've basically done the bulk of our paperwork on my own, so that keeps me busy gathering updated info when I'm visiting.


I think the trick may be to get my fiancee hooked on Warcraft!!! wink.gif

Also I haven't involved her too much in this USCIS nonsense.. sometimes I feel like she's better off not knowing all of the minutia.. although lately I've had to put her through some major CBP training (we practice all the time where I'm the border agent)! Hmm then again, if I can get her on Visajourney she could commiserate with you ladies during the day while I'm at work wink.gif

Hey everyone.. thought I'd start hitting up this thread as my frustration level with VSC continues to grow!

I guess I'm one of the lucky ones because my fiancee is with me right now.. visiting from Canada. She can't work here of course, which is really tough for us to deal with because she just graduated with an advanced design degree in May (she's so eager to get started with her career). But.. such is the journey called K1! At least we can be together more frequently since she is just a 7 hour drive away..

I am marketing director for a large mixed martial arts training organization based in NJ (we have schools in 5 states). I started that job in December. The bummer is, I moved from Las Vegas to NJ for this job.. if only I was going through this process this time last year, I would have been living in Vegas and flown through CSC! wink.gif

Hi there,

My fiancee and I just went through the same anxiety. She is from Ottawa, and I live in NJ. We sent in the I-129F last month. She just finished university in Ottawa and decided to come visit me for a while. She doesn't own real estate in Canada, she lives with her mother. She really doesn't have any of the strong "ties" that they allegedly look for at the border.

I was very nervous when it was time to try to cross (she was with me in my rental car). I read a lot of posts on this board and I made sure that my fiancee only packed things that she would take if she were coming on any trip to visit me - clothes, toiletries, anything she'd need if she were staying for a few months. But not bring things she wouldn't need for a 6 month trip - i.e. her birth certificate, all of her jewelry, lots of paperwork that she wouldn't otherwise need, etc.

When we got to the border, we told them right away that we are engaged and she was coming to visit. We explained that she was just coming for a short visit and was going back to Canada in a few months. We got more questions. Then I whipped out the magic word.. K-1. As soon as we said that we were in the midst of the K-1 process and I had the NOA1 with me, they let us through. No search, no nothing. The border officer actually said "OK, I just had to make sure you are doing it the RIGHT way."

I would advise you to do like we did. If she can leave her things in Canada for a while, do it. Don't risk it. If she has no place to leave her things, it's worth it for her to get a storage bin until you get the visa. Again, I can't say it enough, don't risk it - it can be a ####### shoot when you get to the border, minimize your risk, play by the rules, and odds are you will be together just like you want.

Welcome! Your story is so similar to ours.. I am 34 (in NJ), my fiancee is 26 (from Ottawa), and we met while we were both traveling in Egypt. We applied for the K-1 in April and we're hoping to get the NOA2 in August. We're expecting the full process to take at LEAST 7 months, probably longer. If you read every guide on this website, and read other people's stories in the forums, it will prove invaluable to your journey. I highly recommend it.

Also, I considered hiring an attorney at the beginning of this process as well, but seriously - don't waste your money. You and your fiancee can do this yourself. It's just a matter of filling out a few forms and paying attention to a few details. Save the money for plane tickets to NC smile.gif

Thanks, I guess the thing is.. September is when the petition would hopefully get approved. It may not be until November or December when we get our interview and (fingers crossed) visa. Then another 30-60 days for EAD. That would put us into February 2010. Alternatively, if she gets a job offer in the US, she can basically get the TN visa immediately (after which I BELIEVE we can get married and file for AOS - please correct me if I'm wrong).

Seems like a bit of a grey area, would appreciate any guidance at all. We definitely would prefer to have her living and working in the USA now if we can (obviously).

Greetings, and thanks in advance for your advice.

I (USC) sent off our I-129F package in April and based on current processing times expect it to be approved in September. In May, my fiancee (Canadian) graduated from university with an industrial design degree and is now looking for a job in the US that may sponsor her on a TN visa.

If she finds a company to hire her on a TN visa before NOA2, will the I-129F petition cause problems with the TN? Or vice versa? Not quite sure whether to encourage her to find a job asap, or to advise her to just wait until we get the K1 at this point.

It helps a ton if she also has an exact date (and reason) for when she plans to return to Canada. For instance, when they ask "How long will you be in the US?" she answers "I will be here until August 15, I am returning to work on the 16th." Or, a round trip airplane ticket is even better to prove that she will be returning.

Don't worry, as long as she's telling the truth, she'll be fine. Honesty and eye contact generally work very well at the border.

My fiancee has traveled back and forth from Canada to USA several times. Mostly without incident, however it's important to remember that your fiancee is just "visiting" you when she comes here, and it helps a ton to have an exact date on when she'll be returning to Canada (as well as your NOA1 - notification that the I-129F/K1 is in process). If you're married already, it's very hard to prove to the border agent that your "wife" is only planning on "visiting", not "living" with you.

Does anyone know if a home foreclosure in the past few months be held against a K1 petitioner if the rest of their financial situation is still in order? (exceeds income standards, bank accounts, credit cards, etc.) The only way it would turn up during the process would be through a credit check or other search of court records, not sure how "in depth" they get once the process reaches the consulate.

Wow - reading through this thread, I'm realizing that it exemplifies everything that VJ should NOT be about - passive aggressiveness, belittlement, very unsupportive undertones - basically, flaming.

My fiancee just had her K1 interview yesterday so we're still fresh coming out of this process. The inevitable wounds caused by mistakes made during the K1 process are still just as fresh for us as the sweetness of our success. It's hard for me to believe that some "veterans" here feel so jaded, self-righteous, and "knowledgable" that they would try so hard to make an "injured" newbie feel like sh*t.

This really makes me very sad.

(Mods, sorry, I had to say it. There is so much value to the supportive nature of this board that reading this really troubles me. You can delete this post if you feel it's inappropriate.)
