is the name check the same as the FBI check?? and what would constitute a hit?? i am from lebanon and i wonder if just being from a middle eastern country would raise any flags.


An FBI name check is sometimes but not always performed. The IBIS name check is the primary security check performed. Just being from a middle eastern country shouldn't raise a flag, but possibly having a middle eastern type name is more likely to have a hit (match) with a name in the databases they use to check for possible terrorists, and thus require further investigation. If a name matches that of a suspected terrorist, expect a long delay. However I've seen many middle eastern applicants breeze right through the petition stage.

I don't remember the entire process but I know they do do a name check, which takes at least 2 weeks. If there is a hit, then they have to do further checking. Most of the time your petition will just be sitting there waiting for the name check, and then put in line behind the other petitions waiting.

There would be no troubles. The visa will be used upon entry into the United States, and she may go wherever she is able to until her arrival here. Don't forget a trip to Hong Kong Disneyland, my wife was absolutely amazed and loved the place.

It's true they still need to improve their processes, but it wasn't much more than 2 years ago CSC would take 6-9 months to approve a petition, and VSC wasn't so quick either. So they've improved quite a bit. My NOA2 was in 77 days, so I think yours should be any day now.

Ok I may get heat for giving you this advice, but what the heck.

I say go ahead and petition for the k1! Why??? You have about 3 months before they even look at your file. They should give you an RFE for not including the divorce paperwork. You get your RFE and you send back the required paperwork and you get your NOA2 a few weeks later. Sure beats waiting until you get your paperwork, then filing for the K1.

And then your petition gets rejected because the date of finality on the divorce is after the date the petition was filed. The requirements for filing the petition very clearly state that both parties must be free to marry at the time the petition is filed.

You must wait for the divorce to be final, as the final divorce decree must be included with the I-129F. I know its hard to wait, I was waiting nearly 2 years for my divorce so I could start the immigration stage.

My plane got into Manila at 5 am. My fiancée and I went straight to the embassy, getting there before 7 am. Though they don't officially open until 8, we were helped at 7:00, the CO saw me at 7:30 and we were out of there with the affidavit before 8. I am divorced but did not need to show proof. The CO did ask me 3 questions, one in particular about what the document I was trying to get was for. So be prepared for a few questions. Not really a problem and the CO was nice and helpful.

We went to a provincial priest to ask about the marriage license, and he offered to issue the license and perform the civil ceremony for us. For a price he also offered to take care of it all that day. We accepted and were married immediately, but we had to go back after 10 days when I realized the marriage certificate said the license was issued a day before I arrived in the Philippines. In all it took us 14 days from my arrival to be officially married. We did not need to take the seminar because we're older.

Be warned that the official NSO marriage certificate may take 6 months to obtain. My wife was only able to get hers last week, and we were married September 11th.

Oops I think Ken didn't notice it's the I-130 you are talking about. Your wife will receive the DS-3032 allowing her to appoint an agent to receive visa bill and application. And are you still living in PI with her? The petitioner usually receives the AOS bill and I-864 documents, but uf tiy are using an attorney I'm not sure how that works. I haven't gotten to that point myself yet so I'm not completely sure of the procedures but yes there is a packet your wife will receive from the NVC. I think it usually takes about 2 weeks but being it's going to the Philippines it might take longer.

My wife's Philippines police certificate says "valid for 60 days." But you don't need a police certificate from the Philippines, just the NBI certificate. The NBI certificate says it is valid for 1 year.

And yes, the NVC DOES collect police certificates for CR-1 visas, so this is the correct forum.

I bought myself a round trip ticket, arriving 2 days before the interview, and then 21 days later (maximum stay without visa waiver) my return ticket, along with my wife's one way with me. If I have to reschedule, its $75 each ticket to change the date.

We are not there yet. I've heard 2-5 days in the Manila area, 5-10 or more in the provinces. That's why I scheduled for the maximum time. The main problem would be if she's put on administrative review, it could be up to six weeks. But you said "think positive", so 1 week would be positive.

I got married in the Philippines just this last September. My then fiancée and I went straight to the embassy from the airport and arrived at 6:30. We were told by the guards to stand in the line on the right at the gate, which was very short. At the gate we were searched, then told where to go to get the affidavit. It was tricky finding the correct entrance door, but follow the signs and the green line and you'll get to the room you want to be in.

If you are there before they open the room may be empty. Take a number and sit and wait. At 7:00 the window opened and I presented my number and passport to the lady behind the window. She handed back the passport along with papers to fill out. Two other couples there seemed to be having trouble filling out the papers, but they seemed clear to me and I had no problems. I handed the papers back to the lady, she told us to take them to window C1 to pay the $30 fee. Window C1 is down the hall, turn left into the large room, and turn left again. We then went back to the original room to sit and wait. At 7:30 my name was called and told me to go to room K, which is right there. A woman officer asked me a few questions (what was the affidavit for? What is my fiancée's name? How did we meet?). Then she had me swear the statements were correct, stamped and signed the affidavit, and we were done before 8 am. She never asked for my divorce decree or birth certificate, both of which I had ready just in case.

It's an easy deal, relax and enjoy the experience.

My fiancée hasn't gone through the interview yet, but I've been reading this forum for a couple of years, and I'm pretty sure I've read that you CAN request a female (or male if you are male) doctor. Also, most of the accounts I've read from Filipinas have said that they were examined by a female doctor. There also used to be accounts of unneccesary internal inspections, but I believe that practice has stopped since people were complaining.

I know how you feel. I suffered the same nausea when I discovered the support issues. Things may not be as bad for you as it seems. If you have a job that pays $26,000/yr, that should meet the poverty level requirements. Though Manila is reluctant to accept co-sponsors, at the same time they are more willing than usual to accept your current employment status, even if it has only been a short time. There have been cases of sponsors working for only 3 months with a decent salary and receiving approval. Gather all the evidence that the I-134 requires, plus add any other evidence you can that documents your income, and likelyhood of continued income. Go ahead and let your mother co-sponsor, it can't hurt. The main thing is to convince the CO that you have suffient income and resources to support your beneficiary, and that she won't become a financial burden.

And if the very worst should happen, accept the fact that if she is denied based upon support issues, you two may have to get married and file the I-130. I realize you probably don't want to have to consider that, but if you learn to accept that now it won't be so bad in the case that she is denied the K-1. Do try to get some sleep, worry about this again in the morning.

It was about 1 1/2 years ago I discovered this "fact." I spent 6 months investigating the co-sponsor issue in Manila. I even contacted the consulate to get their official word on co-sponsors. They mostly avoided my question But I was able to discover that, 1) they do not have an official policy regarding co-sponsors for K visas, every case is judged based upon it's own evidence, and 2) in two years I have only noticed personally 3 cases of a K visa pursuer using a co-sponsor. One was denied, one was approved, one was denied and presented a letter from a Senator stating that a co-sponsor was okay, and the CO reluctantly reversed the decision and approved the visa. Perhaps others on VJ have heard of other K'ers using a co-sponsor.

My fiancée and I had decided we would go ahead and plan on using a co-sponsor, and we would overwhelm the CO with evidence that I could support her. Her co-sponsor would be her sister who lives in the US, I had evidence that I had no rent to pay, and other "benefits" which would help me support a wife. But, in the end, we decided to get married and file for a CR-1 visa. In that case, we can use the I-864 for the support issue, a legally binding document and one that Manila will (has to) accept with a co-sponsor.

I don't know if this helps you any, but I figured I should say what I know just in case.
