My hubby to be is starting a job on Nov1st and has been out of work since May.What do you guys think should we wait until he's got the new contract (to be able to list it on the G 325 ) or is it safe and ok to put the I 129 in now and not wait for the contract?
Sick and tired of waiting and just wanna get it rolling!

K-1 Fiance(e) Visa Process & ProceduresChanging addres to which Packet 3 is sent
Ran into a similar situation last month. Called the hotline and was told that only the petitioner can change address over the phone. They told me to do a simple letter requesting change of address for beneficiary. Ensure the letter shows new address and old address from the 129F. Also include dates of birth and a copy your NOA1.

Got touched shortly after and haven't received anything in the mail so I'm hoping it took and the touch was just them updating beneficiary address...

Definitely recommend calling the hotline to ensure there aren't any changes to info needed. Ya never know, they could have changed requirements in the last month ;)

K-1 Fiance(e) Visa Process & ProceduresNOA2 9/18/06. Touched on 9/19/06???

Good luck! At least you have a solid status change! Still no firm status change here... Just two touches and no status change, e-mail or snail mail. Don't want to get my hopes up too much! Fiance already contacted the embassy. Even though the package hasn't arrived there yet. They were actually pretty cool! She left with a very distinct impression that the interview would be a gimme :D

You are jumping the gun calling the embassy without an NOA2 but it's your choice.

Interviews are a gimme I don't know what you're talking about. The approval is NOT a gimme.

I guess that meant the case is done for them and they got it ready to send it off to the National Service Center.

Are they sending it forward by snail mail or do they collect a whole bunch of approvals and send them forward once or twice a month only???? Well, everything takes a little bit longer with CSC obviously.

It's the National Visa Center, not Service Center.

Petitions do take some time to get there & some time to leave as well, they do send in batches.

Hey Devilette, I said "impression" of gimme... She actually got to talk to one of the interviewers. Proof of relationship is pretty easy. We lived together for 4 months before the United States military moved me back Stateside. Affidavit of support should be pretty simple. I get my paycheck from the same taxpayers. Just have to stand in line with everyone else and hope there aren't any RFE's or things of that nature.

She was pretty impressed with the cordiatity of the embassy folks. They treated her extremely well. Especially considering she didn't even have NOA2 yet. Was more of a fact finding "mission".

K-1 Fiance(e) Visa Process & ProceduresNOA2 9/18/06. Touched on 9/19/06???

Congratulations! (F)

We got touched 2 days after status change and online approval notice once again too.
I guess that meant the case is done for them and they got it ready to send it off to the National Service Center.
Unfortunately it still hasn´t arrived in New Hamphire to this day yet. We just will keep calling every day to find out when it finally will get there.
Are they sending it forward by snail mail or do they collect a whole bunch of approvals and send them forward once or twice a month only???? Well, everything takes a little bit longer with CSC obviously.
Good Luck and all the best on all your ways

K-1 Fiance(e) Visa Process & ProceduresNOA2 9/18/06. Touched on 9/19/06???

I was notified of my NOA2 approval on 9/18/06. Today, I see that my "touch" date has updated to 9/19/06. That seems strange to me. Why did they touch me after I'm approved already? Anyone else notice their touch dates being updated after their NOA2 date?

Yes mine was approved and touched, with exactly the same dates as yours.

Thanks! Crossing fingers even more. Just got "touched" again. Two days in a row now. Funny... No action for a very long time and lots of action now. Still no change in status though...

K-1 Fiance(e) Visa Process & ProceduresNOA2 9/18/06. Touched on 9/19/06???

Just curious... When you were touched was your on-line USCIS status changed? I was touched on 19 September as well, but on-line status wasn't updated. Hoping... no praying I have an NOA2 coming in the mail....

Hmm.. how do you know you've been touched if you didn't check the on-line status? I check on-line status to find out I've been touched.

Touched means the date changed but not case status. You are checking the date!

Oh? I'm confused... I'm looking on the "Last Updated" date on the USCIS website under my Portfolio. Was under the understanding that if that date changes it means "some" action was taken. This constitutes a "Touch"? When I go to my receipt number for "Case Status" there's no change from NOA1.

Intent of posting was to check the likelyhood that I may be receiving an RFE or NOA2 soon. CSC seems to not be constistent with e-mailing (some don't get e-mail, others get three) and updating website.

More curiousity than anything else. Still just "hanging in there" and trying to be patient.

Thanks! Did check the on-line status this morning. Probably only wishful thinking, but am hoping that others have been "touched", status wasn't updated and then they got NOA2. Realize it's a long shot, but am still hoping.

K-1 Fiance(e) Visa Process & ProceduresTime between I-129F Sent and NOA1

Hi Mike & Jennie. I'm still new here and my responds is out of the question but I want to inform you guys that before applying for a K1 visa there is a requirement of a TWO YEARS relationship. My boyfriend & I is still waiting for our 2nd anniversary and we'll apply for k1 visa asap. Goodluck guys. ; )

Ms. Jasmine,
You don't have to wait for your two year anniversary, you just need to have met in the last two years, so if that is what you are waiting on, wait no more! File now and join in the waiting game!

that is correct, its medical, and I have tons of documents and letters. just to clear up the confusion, i am the 'her' and my fiance is the 'him' .
so i am ASSuming i send in just the evidences first? I can do that Monday mourning ( morning ). I have been ready for these tards...i had to occupy myself somehow during this gargantuan wait.

Ok! Well I am guessing that if you have medical documentation preventing travel that would be one reason for them to grant a waiver.

Good luck!

ok, wil do. The letter states : In order for this petition to be approved, it must be established that the petitioner and beneficiary have met in person and/or have been in each others physical presence at any time during the two-years immediately preceeding the filing of this petition. THIS REQUIREMENT MAY BE WAIVED IF IT IS DEMONSTRATED THAT THIS REQUIREMENT WOULD RESULT IN EXTREME HARDSHIP TO THE PETITIONER OR WOULD VIOLATE THE BENEFICIARYS STRICT AND LONG-ESTABLISHED CUSTOMS, FOREIGN CULTURE OR SOCIAL PRACTICES. TO WARRENT A WAIVER BECAUSE OF EXTREME HARDSHIP TO THE PETITIONER, THE PETITIONER MUST REQUEST SUCH A WAIVER IJ WRITING AND MUST ALSO SUBMIT EVIDENCE THAT INCLUDES, BUT IS NOT LIMITED TO AFFIDAVITS AND/OR DOCUMENTATION FROM DOCTORS, EMPLOYERS, ETC. ....
to warrent a waiverbecause of a claim that this requirement would violate the bebeficiarys strict and long established customs, foreign culture or social practices, the petitioner must request such a waiver in writing and must also submit evidence to establish that any and all other aspects of the traditional arrangements have been or will be met in accordance with the custom or practice.

Me, the petitioner is the one who has the hardship, not my fiance.

As I understand it, this will be the hardest thing to aquire for a K-1. Answer them as honestly and completely as you can why you have not and can not visit her. Good luck! Having met in the last two years is one of the biggest things to prove during the initial K-1 visa process.

Beg, borrow or steal, but you might have to figure out some way to visit her and perhaps refile after that!

Good luck though, perhaps they will find some mercy and grant a waiver. Is your basis for not going to visit her medical? If so, make that clear and get documentation from your doctor about being unable to travel!

You must have been pretty happy to get your NOA1 in the mail, and I know I will be here  and letting everyone know when I get ours! Congratulations to you filing buddy

I was indeed happy to get mine! I'd had this horrendously long day at work and was utterly exhausted when I finally dragged my butt back home. I flipped open my mailbox on the way in my front door to discover an envelope from the Department of Homeland Security. My heart just leapt! I felt totally rejuvenated. Now, of course, I'm back to wanting something to happen again, but it's great to know the darned thing is at least in a file cabinet or on someone's desk now and in line to be evaluated. Here's to as few RFEs for you and me as possible!!! I'll be right here waiting to hear happy news from you this week. And it WILL happen this week. I just feel sure of it! :D

Wonderful Kirsten! I bet it made your day! I can't decide if I should ask you exactly what it looked like, or patiently await ours... :pop:

Hey there, Ready4One! Since we're filing buddies, I thought I would encourage you a little. I bet you any money you get your NOA1 in the mail this week. It took me exactly two weeks to get mine; it arrived on the 14th. And I think you filed a few days after me. Hang in there! It's on it's way. Know what you mean, though. For a while the only way I knew my packet made it anywhere was because I sent it certified mail and tracked the item number through USPS.

Let us know when you've got it!!
