Just out of curiosity what if we got another letter from her employer who laid her off stating what her salary was and that the position is still avalible if buissness picks up - or something along thoes lines and went in with that. If they didn't accept it and I took along the co-sponser documents and presented them as backup would they then accept that?

(Obviously less money but does it impact her overall qualifications to meet the minimum requirements?)


Not enough to meet the poverty line, but that isn't taking into account unemployment insurance (not sure if they would include that or not?) but we don't know how much that will be yet as its literally hours ago she got laid off.

I'd love to say just give it a few weeks to see if she can get another job, but if we need to use our co-sponser we obviously need to move fast to get all the documents together so she can send me them before we get an interview date through.

Hi guys and gals,

Unfortunatly my better half got laid off today. She has two jobs which she works during the week so she's currently looking for another to make up the rest of her income. The problem is as we're patiently waiting for an interview date I already have all the I-134 stuff filled out with letters of employment detailing her salary from both employers. As the embassy already has packet 3 is it still ok to just go ahead as is with what we have already? We do have a co-sponser if needs be but we would rather not have to use them if possible.

As is this could get any more stressful.. lol

We had the same problem and I remember asking a very similar question here at the time. We ended up using her mother as a co-sponsor as with the current climate we had no idea when she would be able to get another job.

This is more just general advice on the topic of shipping legal documents than it is for the original poster. Keep in mind that, depending on the country, certain legal documents CAN be denied for shipment. Russia, for instance, restricts the importing of a birth, death, or wedding certificates. Will they confiscate them? Probably not, but they can if they want to. I sent my BC to my fiancee during our K-1 process and it got there just fine. Other people may not be so lucky.

I am an American and my boyfriend is British. He has been to the US twice now, but I have never been to the UK. We are going to file our K1 paperwork in June, but I would like to travel to the UK in October. Since we will be filing to have him come to the United States, would I have any issue traveling to the UK?
I know that he can't come here during the Visa process, but since we are filing to have him come to the US, could they possibly deny me entry to the UK? I am going to go, either way, but I wanted to know if anyone had had an issue with this before.

I've been reading through the posts, and I'm trying not to repeat any questions already asked/answered, but these are the ones that I have...

On the G-325A, I know that I have to fill out one set for me, and one set for my fiance. Do I sign on the bottom of both sets of papers? Or, does my fiance fill one set out and sign on the bottom?

Also, on the bottom of the page where it says "Be sure to put your name and Alien Registration Number in the box outlined by heavy border below" What exactly is the alien registration number? Would I just leave that part blank if my fiance doesn't have one?

Also, which box do I check when it says "This form is submitted in connection with an application for: Naturalization, Status as a permanent resident, or other." What category does the I-129F fall under?

On the I-129F form, there is a place to put my fiance's I-94 # and expiration date. He is not currently in the states right now, but he had filled one out when he came here last time. He said that they took it out of his passport when he left to go back to England.
Do I only need to fill that portion out if he is still currently in the states?

I think all of us can relate to some point. I haven't seen my fiance since March, and don't get to see him until October. The time goes by both quickly and slowly.
I understand your worries with the paperwork as well. I question every day if it will all go through alright.
Just knowing that by getting through this, you will be going through one of the most difficult things you can go through as a couple, and everything else will seem so easy when you are finally together. That's how my fiance and I look at it.

My fiance and I are tempted to fly him out here for a week and we were just looking for a little bit more information regarding traveling during the process.
He has a full time job in England right now, and has a week off. He lives with his parents, so doesn't have a rental agreement or anything like that.
How exactly do they know at customs that you are going through the immigration process?
I am going to see him in October, but he has this random week off, and we thought about making the best of it.
Any advice or travel tips if we decide to go through with it?
We are two months into the process, have received our NOA1, but no other info as of yet.

I have been looking all over every website I can find, but I can't find out if there is a deadline between when we received the NOA2, and when my fiance has to have all the forms filled out and sent to the Embassy.
We are filing with the Consulate in London (I am American, he is British.)
I just wanted to make sure that if it was going to take some time to gather the documents and get the forms filled out, that we weren't going to go over some sort of deadline that we are unaware of.
He has his medical exam scheduled for November 12th as well. Does he need to have all of the forms done and sent to the Embassy before then as well? Or can he have his exam, and then finish gathering what he needs?

A good friend of mine is just starting on the VJ journey, she lives in Moldova.

My question is, she will be required to get police reports for every name used
since age 16, from every country she lived in since age 16. She lived in Chile
for less than 1 year, so I am wondering, is it 1 year or 6 months residency that
triggers the requirement of a police report?

Hi, we just recently sent in our K-1 application, they received it in Texas on the 14th and forwarded it to the California service center.
I was reading through the step by step guide here on visa journey and found the bit about the affidavit of support.
At the moment I do not have a job, just recently returning back home. And I am uncertain as to if I will have one by the time I need the Affidavit of support, but I hope that I do.
I read somewhere about being able to use a co-support type thing, or using funds my fiance has saved as proof of support also.

My question is what if I do not have a job at that time, or if I am not making much? And how do I go about/what do I need to fill out to use co-support or my fiances funds for proof?

Any help would be greatly appreciated.

hello I am happy to find that there is someone else in a simular situation. I am a single mother and my youngest daughter is my fiances and mine. I am currently on SSDi and plan on returning to work soon , but waiting for one more surgery and then I have to find a job. Can you tell me how things are going for you as I have little money in the bank and dont want to get denied on our application. he has money but i read that we cant count his, what should i do my 5 year olds heart will be broke if her father is not here for the holidays. mammalooking43 thanks.

First of all I am severely disabled. I have a motor neuron disorder similar to PLS and ALS. We have an infant daughter and when I requested they expedite my petition it was granted within 24 hours. I had my NOA2 before I received word they approved my expedite and just so you know they don't give expedites in most cases. This should give you an idea how severe my disability is and the impact it has on myself and our family. I last saw my fiance in July and before that in Oct. I can't travel with our daughter there is no way. So he came to me. We haven't seen each other in 4months and he is waiting for his papers to reach the Embassy so they can mail out his visa. We are three weeks away from seeing each other and we are struggling with the four months apart. Not that we can't handle it we simply rather be together. To be able to be apart for two years well that for me just would not work. I think it raises some serious questions and your not following the rules. With a medical condition it would seem crucial to sort the documentation as soon as possible in order to have the help he can provide as a family caregiver. Disabled or not the rules are the same and you have to present and jump through those hoops the same as anyone else. You may not be able to travel but he can. I realize that South Africa is not a visa waiver country and prevents him from coming for visits. At the same token it is a high risk fraud country and the fact that your papers were not completed in two years time well it doesn't help your case. You had two years to complete the paperwork and it is very clear you must meet in person within a 2 year period. Either your really good at sabotaging what you want or your not being truthful. Excuses will not get you where you want to be and you will have to start over in order to meet the criteria everyone else is held to. I am sorry if that is not what you want to hear but I won't be doing you any favors encouraging you to hide behind a disability. There are things you could have done way before now. So begin again and this time follow the rules.

OK sure, the recent visit could be used, sorry. You will still need to re-file using the recent visit as evidence you have met within two years. Yes, it also nullifies any waiver for hardship when obviously you COULD visit (I did not focus on that in other's posts)

As Az said, you DID visit him so there's no hardship. The only way you can ever get the hardship waiver for the 2 year requirement would be extreme circumstance. I don't think I've ever seen one approved. There's usually a way around any hardship, how else is the immigrant going to immigrate? There is another member that replied to the RFE hoping to get it waived but he won't divulge his reasons for asking for the waiver (just keeps talking in circles) and he hasn't been approved as yet so only time will tell.



Just wanted to let you know that we got approved even thou we hadnt seen each other prior to filing in the two year period, but we did see each other after and there were other reasons that we could not meet. But wanted to let y ou know God is With us.

You have to re-file. You are not eligible if you haven't seen each other 2 years prior to filing. You have just seen him which proves you're able to visit him, so appealing 2 year rule isn't remotely possible.

Re-file based on your present visit being in the last 2 years. You'll start the waiting all over again though. Sorry!

I have a few questions I have filed for my fiance and recieved my noa and now our 5 months is up and now they are requesting evidence due to when i filed me and my fiance had not seen each other for over two years and now they want to know why well i have good reason , however i just came back from visiting him but it was after i filed.
I have medical reasons and am getting proof from all my doctors can anyone give me any advice on what i can do and if they deny us how do i appeal the action or will i have to refile again and i also would like to add we have a daughter together who will be 6 years old this coming year. I am at my wits end and very confused.
I would like to also add i am on disability but have a sponsor i am working as an independent avon rep and some hours at a macys store but that is hard on me and i would like to leave the position but scared if i do that will they count that against me. I really need advice any and all will help

I used a sandwich-sized baggie as well. I used a large binder clip to keep everything together for mailing and made sure that the baggie with photos was secured. I know they probably toss the clip right away, but it helped me keep everything organized. I think stapling the baggie to a sheet of paper sounds like a good idea as well.

We sent color copies with our petition. I thought black & white would be fine, but the fiance insisted on color. I think having the color made me feel a little more confident that everything would be just the way they wanted to see it. My fiance had quite a few stamps that were hard to read and the photo page was a little distorted in black & white. If it is legible, I'd just stick with black & white.

We included the pages from both of our passports that had stamps on them and included boarding passes and itineraries. I think the itineraries aren't as important, but I guess it doesn't hurt.

I used the examples back in October 2010. I haven't received my NOA2 yet, but I'm thinking that if you follow the examples and triple check everything you should be good. You don't need or necessarily want to send your packet along with tabs and in a binder or anything.

If you want to you can 2 hole punch all documents along the top, and use an ACCO fastener, beyond that, the service center will be taking your submission apart and throwing away the tabs etc.

Double and triple check everything, make 2 copies and/or scan everything submitted, and good luck on your journey! :yes:

I completely understand your wanting to get married as well. Don't do it!

While on my brief visit with J, believe me, thoughts of just abandoning my life here and staying with her there crossed my mind. I wanted to marry her a long time ago... I have no idea how much longer we will be apart, but I came home, filed, and am in line with the rest of you couples.

Hang in there, you are lucky you will be going to visit her. Have fun, do the documentation thing to bolster your case, and who knows? Perhaps you will come home to an approval and she won't be far behind you with her K-1 visa in hand!
