I would recommend running with the suggestions of Aussiewench (always a good advisor as far as I can see) and not worry too much that you have not been able to travel to France since filing the petion.

We can't all afford to jet set across the globe because USCIS is slower than molasses in January!

Good luck, and don't worry too much about the lack of a visit since filing, USCIS should be ashamed, not you be worried... Just my thought on the matter!

K-1 Fiance(e) Visa Process & ProceduresHow should I submit pictures??
Sounds like your idea is sound.

I submitted 4 photos, printed from the computer, which showed date and time and photo info automatically, two photos per 8.5 x 11 page. 3 pictures were of my fiance and I together, 1 was with her sister who I also got to meet during my visit. Photos are secondary evidence, but good to include, don't feel like you need too many, a few of the two of you and others you were with are fine.

Good luck on your journey!

K-1 Fiance(e) Visa Process & ProceduresTime between NOA2 and receipt at NVC
Hey there buddy. Just an FYI for you and anyone else checking the NVC automated phone system, K-1's are not at NVC long enough to make it into the system, so the only way to confirm NVC has or doesn't have your case is by email or by talking to someone live.

It took about two days to get an email response for us, but it was a positive, and our case was being processed by NVC at the time in preparation for sending it on to Abu Dhabi.

NVCInquiry@state.gov is your best bet, and include your names and USCIS case number. They will eventually get back to you.

I never tried the phone system, but again, according to a number of previous posts that I read, NVC never puts K-1's into thier automated phone system so if you go that route, wade through the BS until you get a live person on the line.

Like Luzy said, sometimes CSC sits on approved cases for a while before sending them on to NVC... Sorry it sounds like that has happened to you, but they do eventually set them free!

Good luck to you two!

K-1 Fiance(e) Visa Process & ProceduresWhy 4 pages of G325A?
It is a bit retarded, your petition only needs one page for each of you, but the G-325A is an ancient form used for many other types of things... Filling out the first page online autofills the other three, then when you print, you just sign and send in all 4 pages.

I printed them out blank, and my fiance and I filled them out by hand during my visit. While there, I didn't notice that each page had a different footer, and we each just did one page. I wondered why I had so many copies!

Fortunately we got through CSC without an RFE for doing just one page each, but this meathod is not recommended!

Since you can't save the forms, fill them out when you are ready and know that all 4 will be autofilled, and print out ready for signing, and send all 4 along with your application for best results. They will either shred the 3 unneeded copies, or clip them all together, who knows? But you will have done the G-325A properly.

Good luck on your journey!

K-1 Fiance(e) Visa Process & ProceduresG325A question
For you G-325A put your information. For your fiance's G-325A put their information... Just remember, your fiance has to sign (all 4 copies) of the G-325A his or herself. You can fill out the form if you know the correct answers, but only they can sign it!

Also, your fiance won't have an A # yet, so don't put anything down for his/her A #.

We didn't include my fiance's birth certificate, and did not get an RFE. A few people have gotten RFE'd requesting a copy of the birth certificate for the benificiary. If you were about to file and had a copy, you could consider including it. If you already filed, don't sweat it, you will likely be just fine.

K-1 Fiance(e) Visa Process & ProceduresI-129F Questions

Thank you Sol ... I loved the Van Gogh museum. I especially loved just spending a lazy afternoon in Museumplein. So beautiful. I would visit Holland quite a bit while I lived in New York.

I think I've got a handle on the Circumstances letter now ... and thank you both for clarifying the Intent letter. I did download the sample as well a while ago but I had thought it was just signed by me.

I guess I'm also reading into the ongoing relationship evidence ... I just had a hard time differentiating that and proof of having been together in last two years. I'm thinking cell phone bills ($100+ in text messages monthly ... yeah, OUCH), redacted emails, and passport stamps. Anything else?

Another question though ...

Can I, as petitioner, provide just a copy of each page of my passport? I was not born in the U.S. but moved here when I was 3 yr old and became naturalized.

Thanks again, folks.

Just remember, you don't want to bury them with too much information. They are looking for pretty simple proof that you two have actually been in the same place at the same time. And that you have a current (on going) relationship of a fiance' nature.

I don't have a great answer for what you should provide as a naturalized USC. I would think you would need to provide copies of your naturalization papers, and perhaps attempt to get a birth certificate from your native country. Perhaps one of the VJ veterans or someone else who is naturalized has a better answer for you.

Curious, were you getting your passport stamped for your visits to Tijuana? I used to go there a lot when a high school friend of mine lived in San Diego, I didn't even have a passport back then!

K-1 Fiance(e) Visa Process & ProceduresI-129F Questions
You're very welcome. Proof of ongoing relationship is pretty much done by showing that you have been seeing her as regularly as you state. For longer distance relationships, phone records, emails and snail mails work just fine. In your case I don't see you having a problem showing the ongoing proof.

The dated and timed photos over the last two months should cover that.

The older photo's might not be time stamped, for our photo's my program prints the picture information out below the photo and that worked out just fine.

Any older card she sent, or you sent, and a newer card with the date stamped on the mailing envelope is a good way to show ongoing relationship as well.

K-1 Fiance(e) Visa Process & ProceduresI-129F Questions

Hello all ... I've tried to search for these topics but could not find sufficient answers. I apologize in advance if I was not looking in the right places.

1) In regards the "Circumstances of Meeting" letter, I've tried to address what I would think are the obvious questions - what was I doing in the foreign country, what was she doing where we met, where did we meet, how did we meet. Try as I might, I can't condense this all into one page. My concern is that friends of ours had submitted a very brief letter and they got a RFE to expand on the letter delaying their process by 3 months. Am I reading too much into this?

Remember they are referring to your physical meeting, not how you met. How you met initially can be answered in a sentence, for some such as our case, that is online. However you met, give them one or two sentences.

They are really asking for a description of how you two were physically in the same place, at the same time. And yes, they give you a very tiny box, especially if you have been visiting her every weekend for the last two years. Type up a page or two regarding your actual visits together, and in the box, put see attachment.

Since she lives in Tijuana, it is unlikely you were getting your passport stamped every weekend. Consider asking the border gaurd to stamp yours for you the next time you visit, perhaps the next few times. They will likely laugh a little, but hey it is "proof" you crossed the border into Mexico.

2) Shoud letters such as the "Intent to Marry" and "Circumstances of Meeting" be signed by both of us?

You should sign your letter of intent, she should sign hers, and your respective letters really don't need to be any more elaborate than the sample letter here on VJ. Signing your attachment, the circumstances of meeting is not a bad idea, but probably not absolutely necessary.

3) The same friends had also been asked to submit a copy of her (foreign national) birth certificate along with a translation. Are there other things that people have submitted although not specified? For example, copy of each page of her passport?

If she has a passport you can copy it. Yours is more important than hers at this stage.

4) What constitutes "proof of ongoing relationship"?

Any documentation of your weekend visits. Phone records, emails, snail mails etc. And of course recent and historic photos of being together which are also secondary proof of having met.

5) The latest forms appear to expire at the end of December. In all likelihood, we will hopefully have submitted our forms by then. Are there any risks in submitting it so close to the expiration? Will it be determined by postmark as opposed to when it actually gets "touched"?

Not sure which forms you mean, but if you haven't already filled them out, going to the USCIS website and downloading their latest forms is one sure way of getting an approved form. If you printed one up, especially the old I-129F and use it, you will guarantee yourself an RFE!

Thanks so much for any advice. By way of background, I am a naturalized U.S. citizen and she lives in Tijuana, Mexico. I have been making the two hour drive to spend weekends with her for the past two years. We're ready now.

Hang in there, there is nothing fair about this "process" and it is a huge waiting game. You will get your approval in time, and just need to focus on not letting the stress of waiting ruin the love you two share for each other.

In our case, we filed while a great number of people were still waiting form March! A few even longer, due to the IMRA fiasco. Then we watched as approvals started flowing first just before out NOA1 date, then after... For a few weeks it seemed that filers on our week had been jumped over when we finally got our NOA2 too!

So just do what you can not to panic, and hang in there! It is, as many others here at VJ have noted, not a process for the faint of heart.

Good luck on your journey!

K-1 Fiance(e) Visa Process & ProceduresK1 Fiancee arrived ill what about extensions?
Only the two of you can decide if you want to be married. But if you do, seems to me the best thing for your situation is to get yourself to the local courthouse or county/state office, and get a marriage license. Get married in the simplist possible civil ceremony, so as not to tire her out.

You can get married with a larger, full wedding ceremony at any point in the future, but since your deadline is coming up rapidly, you don't have a lot more time to do much more than I suggest.

Or abandone the whole thing entirely, which it does not sound like you wish to do. Could you even get her out of the country and on her way home, with her son by Christmas? Probably not. And if so, at a huge expense due to the last minute nature of purchasing the airline tickets. (A quick wedding and quicky divorce could be more economical!)

Good luck to you to. I think you have tomorrow to decide and make a plan together. Monday morning to get a marriage license or plane tickets. Hope it is getting a marriage license.

Remember also, that while they are asking how you initially came in contact with one another, your main focus and their definition of "met" in this instance is your having physically been in the same geographic place at the same time during the last two years.

Most find it best to do an attachment answer for this question as that is very difficult to pull off in the tiny box they give you.

You may want to do another attachment with her complete city name spelled out. If the answer to any question does not fit in the given box, best to say see attachment #XYZ and put the proper answer there.

When you are ready to file, just make sure you go to USCIS website and download the latest forms. The online version of the form indeed expires 12/31/2006 but that is the lastest available form so you won't go wrong using it. On the other hand, if you don't intend to file until January 2007 they may or may not update this form, so just download it when you are ready to actually fill it out and file.

K-1 Fiance(e) Visa Process & ProceduresConfusion on what to send/which & when after NOA2 to SO

Personally, we waited until we knew when my interview date was, and then Jerry sent me all the required documents and forms from his end, plus he copied them all for me so I didn't have to. :luv:

Oh I see. What about the forms that the SO (you) had to send back to the US Embassy/Consulate? I'm assuming you mean just the required/other documents gathered by the petitioner.

Congratulations on your NOA2!

We expected that my fiance would get a packet in her mail from the embassy, but instead the packet came to me. Either way, you or your fiance will recieve a packet from your embassy or consulate which will list everything, forms, documentation etc. that particular post requires your fiance to have for her interview.

In our case, several of the forms sent were old and actually expired! So get your financial paperwork together now and wait a bit. It can take anywhere from a week to several weeks for CSC to get your packet to NVC, but NVC is usually pretty quick to pass along your paperwork to the proper embassy.

Depending on which embassy or consulate your fiance will be going through wait times vary. Some will set your fiance's interview date, others will expect your fiance to put together her required documentation then contact them. So for now enjoy the moment and get your back up documentation ready.

Good luck on your journey!

K-1 Fiance(e) Visa Process & ProceduresImmigration attorney needed ?

I am interested in peoples opinion on whether a Immigration Attorney is needed, or if used would speed up the process. My Fiance is in Hunan China, and that consulate seems to have very long lead times for interviews. I have been reading the support material on this site and generally understand the process, though this is all new to me.

Is it worth the ~$2500 for a Lawyer to make sure things are correct ? Do they know any tricks to speed things up ?

LarryC

Hiring an attorney is completely up to you. For the most part, since I have been visiting and a member of this site, attorney's tend to either mess up or slow the process. For sure there are good attorney's out there who haven't, but if you have not hired an attorney as of yet, consider following the guides here on VJ and doing your petition yourself.

It is not nearly as daunting as it appears, and until your case gets complicated, say by a denial of visa after interview, and an attorney is truly called for, the initial filing is something easily done by yourself, eliminating costs, a middle man, and keeping your case in your own control. Again, there are quite a number of fellow VJ'ers with attorney horror stories.

Check out the guides here, decide for yourself what you are most comfortable with.

Good luck on your journey!

K-1 Fiance(e) Visa Process & ProceduresCertified Copies Of My US Passport

This may be a stupid question but I really don't know. I want to get a couple Certified copy of my US Passport I have on hand. Is this done by a court clerk? Do I need to fill out any other form and send my passport? I tried Googling it but didn't fine anything (mostly birth certificate, marrage, and so on but nothing on US Passport). I'm sure it's my lack of knowledge but please help me out.

For any documents you submit which are copies you can print and sign this form right from the example forms list or search on the USCIS sight if you want, there is no need:

http://www.visajourn...ples/FC-029.pdf

With it included in your packet, everything you submit as a copy is then 'certified' to be a true and correct copy of an original document you can later produce if requested.

K-1 Fiance(e) Visa Process & ProceduresFiance letter of intent

What exactly are we supposed to include in the letter of intent and are the different for the party in the US and the party outside? thanks!!!

These statements have been seen in many variations, but the one thing you MUST say in both statements is that you intend to many within 90 days of entering the US. Everything else is fluff, but it's a nice place to say nice stuff about your loved one and your relationship.

There is a second thing your respective letters MUST include, and that is a statement attesting you are each legally able to marry one another. That plus the statement you each intend to marry each other within 90 days of entering the US are the basics.

It is fine to add a bit more if you are inclined, but not necessary.

Hmm, okay. So "if your fiance is currently in the US, complete the following" I'll put N/A because he's not in the US now, so that doesn't apply. "If your fiance's native alphabet uses other than Roman letters, write his or her name and adress abroad in the native alphabet" would be N/A because his alphabet uses Roman letters, so that doesn't apply. Right?

I was very careful to leave nothing blank on the I-129F form, answering N/A and None everywhere!

But the A# issue is from the G-325A form, and the language there said: "Be sure to put your name and alien registration number in this box"

Me, I am not an alien. Didn't know what to put for J so I looked it up. It is something which later on gets assigned to her.

I internally debated N/A or None and figured there was just as good a chance it would get rejected as an improper A# by some cranky beaurocrat as if left blank... They give it to the alien fiance, so stands to reason they would know she/he does not have one yet... Hope it doesn't mess me up!

K-1 Fiance(e) Visa Process & ProceduresFiling buddies

Well, I JUST sent my packet off on Tuesday. Putting it together was a time-consuming venture, I can tell you. I'm sure you all have the same feeling.

My fiancé, Laurent, is also French, Angilla...and like you and some of the others, there has been some resistance to this relationship on the part of my family. My parents are finally starting to come around, but it has not been easy with them or my sister. The biggest beef on their part? Aside from the fact that he's a (gasp!) liberal Frenchman? Laurent's not a Christian. Until very recently, my family has shown amazingly little ability to trust the prayerful course of action I've pursued in my relationship with Laurent. God has already worked so many miracles in our situation that it's literally impossible that He is not the author of this relationship. Besides...WHEN, I ask you, has God EVER done anything but work in surprising ways? I know He's taking care of things. I trust him to do that. Why can't they? And I'm close to 40, for crying out loud! Parents always have a hard time letting their kids go to pursue their own way, I guess...no matter how old they are...

I pray for myself, for Laurent, for our relationship, and for my parents every day. And I'm seeing results. The thing that God has really shown me in all of this is that I need to follow him and no one else. I stay much calmer and saner emotionally when I do that, as opposed to giving in to the fear and discouragement that my family often slings my way.

Anyway, I just thought I'd respond to this thread since I saw some common issues with my own. And since my submission is literally just days old, I didn't think anyone would mind...Hope I'm right about that. :)

Hi Kristen... just reading my story in your post here lol My parents were often tickled by my little long distance relationship going all the way back into 2004... Told them I was working on and looking into the fiance visa process with J early this year and BAM! Suprisingly strong negative reaction! Oh well, I am certain that J will win them over once she is here, and like you I am 40, and capable of making my own choices with regards to my future.

Texas and Nebraska no longer process I-129F petitions. Petitioners in their service area's still need to send their K-1 packet to Texas or Nebraska, where they are then shipped off to California for actual processing.

Don't sweat it, it is stupid, but how they have chosen to do it. And it is my understanding, if you think California Service Center is bad, Texas and Nebraska were even slower.

What you wrote is exactly what they are asking for, specific dates, specific places you met IN PERSON. So your paragraph is virtually verbatim what they are asking for, and you just need to make sure your passport stamps match those two meetings, and dig out any documentation for the two trips to Thailand, proof you were in her city, and/or proof you were together at those times. The site guide has a great list of items which suffice for this evidence. Plane tickets, ATM receipts, hotel bills etc. to name a few.

K-1 Fiance(e) Visa Process & ProceduresEntering With a K1
An expert here may have a better answer but your clock starts ticking towards 90 days to marry your fiance when you enter the USA on a K-1 visa.

Are you saying you want to visit or conduct work once in the USA, then return home? Later coming back on the K-1 visa to marry?

Not totally sure I understand your question but it sounds like you plan a trip to the USA before you want to enter on your K-1. Not sure how well that will go over with immigration as they will probably guess you are coming to marry your fiance once the visa is issued. Before the visa is issued, many have no trouble coming for visits assuming they come from the right country such as Canada or the UK for example.

K-1 Fiance(e) Visa Process & ProceduresHow risky???
Meauxna-yeah it will go through this time. The (soon to be) ex was served with the papers by the Pulaski Sheriffs Department last week, which means my man is divorced by the end of January.!!!!! Thank GOD!
He can't come to Germany to visit us because he'll start working as a Truck Driver next week and therefor wont be home much.(4 days out of 30).So that's why I'm planning on flying to the US in March to see him for at least 2 days. Two days are better than none.I know it seems insane to pay 600+ $ just to see him for 2 days but hey ........that's called love and being crazy about the one you love.lol.
I could fly by the end of January to be there for his divorce but then we'd be apart for 6 months again and that's just such an awful long time..........I just left him not even 3 weeks ago and such a long ti,me stretch seems so horrible to us right now........This has been going on for so long now with all the delays and problems we had to face (nothing in the relationship itself, just very unfortunate events that kept delaying everything.....).Maybe I'm just being foolish right now but I'm just not complete without Jim and it feels like half of me is in the US while I'm trying to get things straight here...........

K-1 Fiance(e) Visa Process & ProceduresHow risky???
We plan on putting our I 129f in on Feb 1st...and I would like to go visit my man again by mid March (just got back from a 4 week visit Oct12th).This time, since I would fly over there (WA) for only a week I plan on leaving my son here in Germany. My boy of course will be listed on the inital I 129f.So now I would like to know how possible is it to get through, trying top fly in for a week before we even get NoA2 and without my son who's listed on the paperwork as coming to the US with me????

K-1 Fiance(e) Visa Process & ProceduresI-129F is expired on website
The USCIS website, and VJ too, has the expired I-129F. It expire 12-31-06. Is there any concern here?

K-1 Fiance(e) Visa Process & ProceduresNebraska does not list the I-129F in its processing times

do you all believe that because of this the petitioners that are in the nebraska section being sent to california are being delayed in approvals? Its a theory of mine, because i haven't seen anything from the CSC and its getting extremly fustrating..

February would be your predicted date with today's wait time. Is it past due with September's date?

That's what I was afraid of. I hear bad things about California's service center. Has it improved?
