I have applied for a K-1 visa for my fiance and included her 16 year old daughter, Mae, on the visa application. They both live in the Philippines and the school system there is much different than the school systems here in Ohio. She attends private Catholic school in the Philippines and I think she is in her 10th year. Can anyone give me an idea of what will happen when the visa is approved and they come here as far as how they will determine what grade level she is placed in our school system?

I really feel a bit uneasy about Mae having to change schools and possibly being set back or something due to the changes.

I know this might not be the right Forum and please move it to the correct one if it isn't.

In the Philippines, students graduate high school at about 15-16 years old. This is because Philippines have 10 years of education (primary, secondary) before college...whereas, the U.S. has 12 years. I think your stepdaughter is in her last year and will graduate in March 2012. And even if she is a high school graduate, the U.S. will consider her as only completing 10th grade level (this is assuming all her classes are transferable).

I sent our I-129F and got the NOA1 on April 25, 2011. I know it states that processing time is 5 months, but I've seen quite a few people on here who filed on or later than that date and they have already received their NOA2. Am I worrying too much over not getting a N0A2 yet? Should I call them? I know I'll probably get the "its not 5 months yet" excuse though.

I checked the USCIS Case Status: It's still in Initial Review
Embassy in Manila
and processing center is Vermont

Were those approved NOA2s expedited? Maybe those cases were handled by a more efficient adjudicator. Maybe the background check in your case is taking longer. I wouldn't worry too much about it yet, since your case is still within "the normal processing time." I wouldn't rely too much on USCIS case status, either. My case still says, "Initial Review"

hi to all fellow vjers...i have a simple question to ask its about the affidavit of support..is the 125% above poverty line calculated based on annual gross income? or was it on a monthly basis? Yes. She would need to answer "yes" for having had TB, a communicable disease. But further explain that she was treated, which essentially makes her free from the communicable disease.
Providing her medical/vaccination/TB treatment documentation would strengthen her case.

I agree with the previous comments. 

Stick with DHL or FedEx.  It may cost more, but it is worth your peace of mind.  USPS arrives in the Philippines just fine.  But you're taking a huge risk relying on PhilPost to deliver it to its final destination.

Hi fellow Vjers!

My fiance is currently serving his mandatory army obligations for the Greek Army. There is a possibility that he will get stationed in Athens and if this is the case, then I am hoping to go back for the remainder of his service so that we are able to see each other every day/night.

I know that we have 6 months after the visa is processed for him to enter the states and for to get married, within the allotted 90 days.

I'm wondering if I am living abroad with him after the visa is processed, or even before the final steps, if it will mess anything up in regards to the visa?

I would be staying for 4-6 months I am guessing but would possibly have to establish some sort of residency in Greece. I have heard that you must maintain permanent residency in the USA?

I am trying not to get my hopes up for this to work, but I miss him so dearly and am praying for the best to come about. Any help would be greatly appreciated, thank you!!!

Hello,

I've filed while living in Virginia with the Vermont service center and have since filed moving. My curiosity arouse again now that I'm writing the letter of fiance intent that lists the local service center. I'm not sure to just continue using Vermont or to change anything at all. I've not received any notification of my move except that they've received that I filed a move. We had a bit of delay in the whole visa as my fiance is still finishing his service in Greece. They know that and are holding the case but I just didn't know about the service center issue. I've moved from Virginia since filing and now reside in Washington State which I think would be part of the California Service center.

Does anyone have experience or know anything that I could go off of?

Yes, there are a lot of acronyms at a glance that are confusing and unknown, you will learn them over time. Usually though, you can just ask biggrin.gif. AOS for example is "Adjustment of Status" USC is "United States Citizen". To be very honest, I just googled "AOS meaning" and it will put up loads of different meanings for various acronyms using http://www.acronymfinder.com/

I didnt send in the beneficiary's birth certificate. I read the guides(fiance 129F) and didnt mention it.

Do I need to send it?

My friend told me to have her get it and she got 4 stamped copies. I got 4 certified copies -planning to cover the bases but it's taking a long time to get everything "certified" copies.

The K-1 is a non-immigrant visa and that's why it's easier to get than a K-3. Seattle going to Cebu is definitely doing the right thing before subjecting themselves to the USCIS for any visa process or subjecting themselves to themselves for any LIFE process. Do the due diligence beforehand. Wish I could have done that in my early years.

Anyway, I went there 4 times. We used a video phone and voip phone (almost) continuously. We both didn't want anything but the real thing and we both knew of people that thought dishonesty and scamming were 2 or 3 degrees of better than actually doing it straight up. Still, the embassy held us up because we are all tarred with the same brush.

She arrived on a Sunday. We got the license on Monday and the judge wed us on Tuesday. We just wanted to be married.

Sounds good. Think of it this way (plagiarized). It is no less honest to fail to mention visiting a fiance than it is to fail to mention that you will visit a pubic library. A general but truthful answer to "Purpose of visit?" is fine. Having evidence of ties with you just in case is a really good idea though.


Ive also wondered this when we come to submit our K1. Would they have any knowledge of my K1 application at the POE, if so Im guessing that saying im visiting my girlfriend, rather than my fiancee woulden't go down too well? I last visited her 2 weeks ago and just told them I was visiting my girlfriend, he asked about where I met her etc, but was all very friendly and was on my way within a minute.

Ive searched and searched but can't seem to find an answer.

We're currently putting together our I-129F package and I need a US size (2x2 inches i think) size photo. With them being a diffrent size in Europe does anyone know where I could possibly go to get this done? Ive thought about taking my own photo then taking it into snappysnaps or somewhere for them to possibly resize it and print me a load off, would they accept that? Does anyone have any better idea's?

They don't accept electronic media of any kind. Their computers probably couldn't even read them. blush.gif

Generally, when they say "originals" they mean they don't want photocopies. Just get your digital photos printed on photo paper and you'll be fine. Also, don't bother to put them in a photo album. Most consulates won't accept anything in a binder because they can't be passed through the curved slot under the window.


Great thanks! We were thinking along the lines of getting them done on photo paper but we wern't certain. We were just a bit baffled as the guide said they wanted 'originals' of everything, so by that we assumed the photo's as well, and being on a memory card we had no idea what they ment!

Ron, i dont know what to tell you my fiance and i were with the Cali center and we sent our petition on the 18th of august and was approved the 23rd of oct.. call and find out whats going on with it.. my fiance says that it will take 2 to 3 months after your NOA2 approval..

Hi again guys,

We're currently gathering our next pieces together for the interview stage after receiving our NOA2 for our K1 visa process and we are currently trying to fill in the I-134. We've done a bit of research but can't find the answers to a few questions we have, so if anyone could be great enough to shed some light we'd really appreciate it.

Firstly on the form there is only room to fill in one job - my fiancee has two and is both needed to pass the required poverty line - where should we put the second job down?

Secondly, if we are going this route then do we just need two pay stubs as evidence for each job, or would we require bank statements as well regardless?

Lastly on question 10 and 11 can we literally fill it in as shown in the example form on here (obviously changing the name) and put N/A ( K1 visa process for permanent residence ) as its shown in the example form? On another example form we found they had wrote out that the expenses would be room/food/board etc.

Sorry if these have already been asked before, we did do a search beforehand!

My fiancee sent the NOA1 in a letter about 2 weeks before christmas from the US - however its still not here yet. Understandibly with the christmas post being what it is im crossing my fingers that it'll be here in the next week or two, however is the NOA1 needed when I go to the interview or at any other stage now between packet 3 and the final bit? If so does anyone know how much it costs to replace, and where should I go to do this as ive been all around the USCIS website and can't find a thing, just replacement NOA2's.

Just from my experience I visited while we had started the K-1 process a few months earlier. Had no problems at the boarder, guy just asked what the purpose of my visit was, told him I was there to see my girlfriend, asked a few more routine questions and that was it, took my fingerprints, photo as standard and went straight on through. He was pretty friendly and we were joking about the diffrences between American football and rugby as I was going to see my soon to be brother-in-laws match while I was there.

Ive no idea if they have access to the databases that hold if we had a K1 visa in process or not, he certainly didn't give any impression that he had any idea that I was. I took alot of paperwork with me though just incase, phone bills, letter from my manager to say I had to be back at work the day after I departed etc. A return ticket from what I gather is usually all they need to show that you won't be staying there, he didn't even look at mine, just my passport and that was that.

Personally I think as long as you take enough evidence with you showing you have strong ties back home, commitments such as bills, a job etc then you should be fine. But as others said theres no guarantee, you can be turned back so be prepared if you do intend to take the risk.

You can't combine incomes between sponsor and co-sponsor, in other words each sponsor has to demonstrate their current financial situation and their own dependents.

Your co-sponsor has to demonstrate that their income is 125% of the poverty line for them, you, and however many other dependents they have. This is usually anyone they claim on their tax returns, plus all children under 18 even if they don't live with the co-sponsor. If they have already sponsored someone, they need to include them too. This is more often the case where people have obtained relative visas for their parents, and are now doing the same for siblings. If they don't claim your fiancee on their tax returns as a dependent, then you wouldn't count them in the household size (irrespective of whether they live in the same house or not).

In our case, my fiance will do an I-134 but falls short of the poverty line for 3 people (him, me and my daughter) so his mom is co-sponsoring. She is married and files taxes jointly with her husband. She therefore needs to meet the 125% for 4 people (her, her husband, me and my daughter).


Sweet thanks, thats what we thought just the other way around (me her and her mom) but instead its me her mom and her dad so its still 3 which would be fine.

Theres no other forms other than the ones ive already sent in for the interview?

Also do I go by the 3 people now for the poverty guidelines when calculating the 125% line? Would they take in both sponsors income for that or just the co-sponsors?

Candidly - it is entirely possible that the Embassy would review the affidavit of support (and all the stuff with it) and never make any comments about it. So it could 'fly' just the way it is - BUT - that might not be the advisable approach (all they'd have to do is ask "has anything changed?' and you're on the hook).

If it were me - I'd revise my affidavit (do a new one, with all new supporting evidence - which would be mostly copies of what you already have and based on what is CURRENT) AND secure a co-sponsor.

I'd have these new affidavits with me for the interview.



Gotcha, we have no problem getting a co-sponser - would they then accept both affidavits, her own plus the co-sponsers at the same time? Would that require sumbitting two I-134's?

Just out of curiosity what if we got another letter from her employer who laid her off stating what her salary was and that the position is still avalible if buissness picks up - or something along thoes lines and went in with that. If they didn't accept it and I took along the co-sponser documents and presented them as backup would they then accept that?
