USCIS Announces Transfer of Form I-129F (K-3-spouse of U.S. Citizens only),
Petition for Alien Fiancé
Beginning October 23, 2006, U.S. Citizenship and Immigration Services (USCIS) National Benefits Center (NBC) began transferring Form I-129F, Petition for Alien Fiancé(e), (petitions for K-3-spouses of U.S. citizens only), to the California Service Center (CSC) and the Vermont Service Center (VSC), depending on the location of the related Form I-130, Petition for Alien Relative. This transfer is being implemented in preparation for Phase 3 of the USCIS initiative to use centralized filing and bi-specialized adjudication. Through this Bi-Specialization effort, USCIS continues to align similar workloads between two “sister” service centers, CSC and VSC, to better manage cases and improve customer service.
USCIS will continue to forward approved Form I-129F (K-3) petitions to the National Visa Center (NVC) for consular processing. However, it will retain approved Form I-130 petitions, based upon a mutual agreement with the Department of State. USCIS will retain all approved Forms I-130 for retrieval upon the beneficiary’s eventual application for adjustment of status (Form I-485), unless the petitioner clearly indicates on Form I-130 that the beneficiary will use the consular process. USCIS will store approved Form I-130 petitions at its National Record Center (NRC).
USCIS has implemented this process change because most K-3 beneficiaries apply for lawful permanent residence by filing Form I-485, Application to Register Permanent Residence or Adjust Status, following their arrival in the United States, as opposed to using their approved Form I-130 petition to apply for an immigrant visa abroad. By retaining the approved Form I-130 petition at the NRC, USCIS will reduce unnecessary file movement and eliminate applicable costs and fees associated with immigrant visa processing.
If the beneficiary should later elect to consular process instead of applying for adjustment of status, Form I-824, Application for Action on an Approved Application or Petition, must be filed with the USCIS office that approved Form I-130. Upon favorable action on Form I-824, USCIS will send Form I-130 to the NVC.
This internal transfer of work does not alter the existing filing instructions for any of the forms. Accordingly, USCIS customers who file Forms I-130, I-129F (K-3-spouses of U.S. citizens only), and I-485 should continue to follow the current filing instructions on these forms. Customers affected by this transfer will receive a receipt notice from the NBC notifying them of the location to which their Form I-129F has been transferred.
USCIS customers can utilize the following methods to obtain case status information about their pending applications and petitions:
• Calling the National Customer Service Call Center at 1-800-375-5283
• Using the USCIS web-based Case Status Online located at www.uscis.gov

Odd that USCIS said that because the Public Notice refers to approved I-130 forms, not pending. It says they keep I-130's at USCIS on an agreement with State Dept. until AOS form I-485.

Unless!!! the petitioner clearly indicates on the I-130 that the beneficiary will use consular :D process.

I checked online at the US CIS to see if we got a NOA2. Not much you can do until you see an RFE or the NOA2. Calling delays things, I hear, unless it's already past due that is.

I second that recommendation but please be aware you'll be needing to convince a Consular officer in a personal interview that your relationship is bona fide and ongoing. Wedding pictures and a marriage certificate would be presented by anybody with a sham marriage. Your evidence of having actually lived together will go a long ways toward showing bona fides. You'll want to include evidence of multiple visits if you have them, pictures taken in multiple locations, on multiple dates and with differrent family members as well as evidence of ongoing communication via email, letters, cards, chat sessions, and phone bills.

Further, you, the visa applicant will need to be prepared to answer questions about why you love your wife, and details about her family and life history. You'll need to show a preponderance of evidence that your relationship is bona fide to overcome the presumption that it is for immigration purposes only.

I noticed in your timeline that you sent a cancellation letter for K-1. Did you received confirmation that your K-1 petition had been cancelled? By the way, you need the I-130 NOA to file the K-3.

I haven't received a cancellation notice. That worried me too.
But I've been advised to go ahead with the K3... -That the cancellation notice will take months. I plan to write a letter of explanation when I answer "yes" to having an approved K1 inside 2 years (same person).

Anyone know if NOT having a cancellation notice is going to be a problem for sure?

I'll pay the extra fee (reluctantly) and get her here sooner. She doesn't need to work or drive right away, she just wants to be together. Me too!

NVC is processing your IR-1/CR-1 even though you k3 might be in your wife's country. The same thing happened to us, my wife received the Choice of Agent Form and I got the AOF fee bill. So I called NVC and they said that yes they are process the IR-1/CR-1 and you have to send a letter informing them to hold the I-130 till you file for adjustment of status.

Call NVC ASAP….don’t pay it yet!

The K1 used to be faster, not always the case now.

K3 has 2 components to the application process. It uses the same I-129F form as the K1 but is for a spouse vis-a-vis the K3. This K3 for spouse is quickest os the 2 K3 components. The other component of the I-130 is the CR1 which gives her a green card and a SS# soon after she gets here and saves the hassle and expense of Adjustment Of Status. So the I-130 lets her enter as a citizen, so to speak.

With K3 you need to legally marry her there.

Wow, I got through!

They filed a "Service Request" over the phone for both address changes.
He said it would be as long as 60 days for the file to be updated.

Also, he said our newly filed K3 has 90 days to be accepted and only call after that. (I was getting curious since we mailed 8-8-07)

USCIS notified me that a nonimmigrant has to notify Dept. Homelenad Sec. within 10 days of changing address - except "A" or "G" nonimmigrants.

Seems the AR-11 is for nonimmigrants INSIDE the USA now.
My wife has not ever been here, and wont be - until they grant her visa.
Do we need the AR-11 change of address notice?

That's 35 or 36 days. I saw the online copy of the back of my check- but still have not received the NOA1 notice. But that's per typical.

Also, as pushbrk said (and I put the link in my sig line too) I sent both our I-129F and our I-130 to CSC directly. The website says they have started our I-130 and says nothing about our I-129F.

This means that we have a possibility to use the DHL website so as to check whether there are any shipments to those regions of the globe we are interested in. We will not find our names among the other pieces of info we may have access to while visiting the above-mentioned site, but we can get a picture of when our package could leave NVC if we know for sure that it had got there. This morning, Dinha - our very kind-hearted VJ fellow - emailed me and taught me how to use the DHL online tracking system. I am very grateful to her and I wish to show my appreciation for what she did by passing on the info and thus helping other people. So, here's what you have to do:

1. Insert this address in your browser's case:

2. Then put the word "correspondence" in the Reference Case and the code 03801 in the Origin Postal Code (which is in the Additional Information field).

3. Eventually, click the word Track written in red below the table and wait. You'll find many packages sent on the 13th and 14th to various countries, including South Korea (still, we don't know whether it's yours or not, but your fiancee can call the US Embassy in Seoul in the following two days to find out).

Hi VJ family sorry i havent posted since my husbands approval on Jan 11-10. its been crazy!! but finally good news. He was told to return and pick up his visa on Jan 22-10 only to be told that he needed to complete the DS230 form again, because they misplaced it somehow. Even though he signed page 2 during his interview, they lost the form. so my husband spent 2 hours trying to complete a government form, that he was not at all familiar with or even knew the answers too. for example, my parents date of birth, place of birth, etc. he had to call me at 230am to get this information.

after he finally completed the form, they told him they had to give him a new date to come back and pick up his visa (Feb 5-10). we were both so upset about this, i was even more upset when i realized what form it was!! because he had his file with him, with all of the copies of every form inside. he never thought to look inside his files. The DS-230 form, he had it with him all the time. However, even if he had given them his copy, they needed time to process it again. he was dissapointed in himself.

so thankfully all went well when he returned to the embassy on Friday feb 5-10, he received his visa!! I thought he would be jumping for joy, but he was so cool and calm, and emotionally devasted by this entire ordeal. we're both so happy this is over. I just want to thank my VJ family for your hugs and support.

Im so grateful to all of you. now i have to prepare for his arrival, im looking for the best airfares from ghana to sanfrancisco. i didnt realize one way fares were more expensive than round trip. pray for me.

I GOT TO THE AMERICAN EMBASSY ON MY SECOND INTERVIEW AT 1:30 PM APPOINTMENT WAITED TILL 5PM AND MY NAME WAS CALLED WHEN I GOT TO THE COUNTER THIS NICE GHANAIAN GUY TOLD ME THEY HAVE CLOSED FOR THE DAY IT WAS 5:00PM SO HE GAVE ME A NEW DATE WHICH WAS NEXT DAY WHEN I GOT TO THE EMBASSY THE NEXT DAY I WAS THE SECOND PERSON TO BE CALLED NO QUESTIONS WAS ASK THE CO JUST LOOK THROUGH THE DOCUMENT HE ASK ME TO PROVIDE THEN HE TOOK THE APPROVAL SLEEP WHICH WAS BLUE AND TOLD ME NOT TO MAKE ANY TRAVEL ARRANGEMENTS TILL I RECEIVE THE VISA IN HAND .I WAS HAPPY AND GAVE HIM A SMILE AND SAID THANKS ...WELL GOOD PEOPLE I PICKUP MY VISA THIS MORNING AND IT TOOK ME 10 MONTHS FROM THE DAY WE FILE THE PETITION TO COMPLETE THIS JOURNEY ...IF YOU HAVE ANY QUESTIONS TO ASK I WILL BE READY TO ANSWER WITH THE LITTLE EXPERIENCE I GAIN THROUGHOUT THIS JOURNEY ..I EVEN MEET A VJ MEMBER AT THE EMBASSY THANK YOU ALL . :dance: :dance: :dance: :dance:


Hello and how are u doing i wanted to know this part.when you were issued the blue slip and you date to pick up your visa and not to make any TRAVEL ARRANGEMENTS where you give your visa the very day you were ask to come and pick your visa which was on your blue paper.or how long did it take thank you.
