Hi Everyone,
My fiancee is 20 and has no family. Her mother died when she was one month old and she has never met her father. She has no brothers or sisters. She doesn't have a guardian. She does have an aunt who doesn't care about her and an uncle who she sometimes sees but rarely. According to what I read on the US Embassy/Manila website anyone who is 20 or under needs either a parent or guardian to attend the interview with her. She does have an older cousin who she is close with. If this older cousin came with her to the interview would this be acceptable? Any insight or advise would be very much appreciated. Thanks.

Wow, this is a good question, actually.

I would imagine it is acceptable to bring the older cousin...IF s/he has legal custody of your fiancee. Otherwise, I doubt it would help her case. Does she have her mother's death certificate? Were her parents married when she (your fiancee) was born? I would think presenting these documents would help establish that your fiancee is legally emancipated.

Out of curiosity, who was her last guardian?

I don't recall any rule stating the payment must be either from petitioner, beneficiary or a third-party agent. As long as the funds are drawn from U.S. dollars and on U.S. soil.
I would have your friend pay the IV bill, IMO. It will definitely save you some time. Perhaps others will chime in and give their advice.

Based on Visa Bulletin for June 2012, they are currently processing F2A (spouses and children of PRs) visas with priority date January 01, 2010.
So, your wait time is approximately 14 months. Realistically, be prepared to wait for two years.

NEVER wait for NVC to send you anything. As soon as a bill appears as PAID in the payment portal, you should send the respective package.

And the AOS and IV are two, separate tracks, so not paying the IV bill has NOTHING to do with the AOS track.

I strongly agree with this statement. It probably is the best single piece of advice for NVC stage.
I highly recommend reading this guide. I followed the steps exactly, and had no problems whatsoever. Just to emphasize: NEVER wait for NVC to send you anything. If you want a speedy process, you must be proactive.

I paid for my Affidavit of Support, filled it out and sent it. Then I paid the Visa Processing fee $404, now what happens? I know the applicant must get his civil documents, but will NVC send me a DS form to fill out, or do I just download it from the website?

Also NVC says that they require original or certified copies of documents. If I am living in the U.S. and his civil documents are in his home country how do I get certified copies? The postal system over there sucks.

You must wait until your payment clears. The IV status will be marked "PAID" when it does. In the meantime, start collecting ALL necessary documentation (ie original/certified copies of civil documents). Many postal systems in developing countries, like Pakistan & Philippines, suck. That is why many people use a better courier service, like FedEx or DHL. You WILL pay more, but you Will definitely receive a better service.

Do NOT wait for NVC to send you ANY forms. Doing this will consume much time. You can download all the necessary forms from NVC.

If you haven't already, I highly suggest that you read this guide carefully and thoroughly. Your NVC journey will go smoothly if you follow the outlined steps.

Plain and simple. There is no way to prove your case is in a particular package sent to any embassy. When you trace a package using this method does the information you receive say that your case is in the package you are tracing? - NO. Most likely it is but it could be other cases or anything the NCV sends to an embassy. I did traces when I knew our package was sent, but the tracking information did not include case numbers - thus just because a package was sent (even on the same day NVC says they sent your case) it does not mean your case was in a package you see on the DHL website. DHL does not keep track of NVC case numbers they just deliver packages. If you want to trace packages and assume your case was in the package you find on DHL's website and it makes you happy - great.

Umm, sure there is! You call NVC.

Applicant: I'm calling to find out the latest update on our case.
Operator: Your case was completed and was sent to the Embassy.
Applicant: Can you please tell me what date it was sent?
Operator: Your case was sent on Wednesday, March 16th.
Applicant: Okay, thank you very much!

There is no assumption about it. Applicants can request the latest information from an NVC operator, which includes the date their case was sent to the Embassy. No, you don't have an actual tracking number. But you don't need one. You use the art of communication and the gift of common sense.

Just because you were unsuccessful with it doesn't mean others will be. Maybe you didn't do it correctly. Many others have had success with it, including myself. And yes, it does make us happy! :D

Benzaclin
Most commonly in the form of a gel, Benzaclin is a drug prescribed to people with acne. Its affective ingredients consist of benzoyl peroxide and an antibiotic called clindamycin.

Benzoyl Peroxide - Benzoyl peroxide works by bringing additional oxygen to pores, which creates a more hostile environment for bacteria to grow in. Further, Benzoyl Peroxide helps rid skin of excess skin cells which keeps pores less cluttered and leads to less breakout in the future.

Clindamycin - Usually used to treat infections with anaerobic bacteria, clindamycin is a lincosamide antibiotic (drug which binds to bacteria and inhibits early elongation of pepticide chain).

The way Benzaclin works is by combining anti-bacterial action of clindamycin and benzoyl peroxide. Both of these ingredients have been shown to decrease acne abrasions.

Side Effects of Benzaclin and its ingredients -

Benzaclin - Side effects include photosensitivity, dry skin, pruritis (causes reflex to scratch), and dermatitis (inflammation of the skin).

Benzoyl Peroxide - Bleaching of the clothing, dry, itchy skin, redness, flaking and burning of the skin. Side note: With the discontinuation of benzoyl peroxide often comes an increase in skin bacteria (what the benzoyl peroxide initially inhibited).

Clindamycin - Diarrhea. Believe it or not, the use of a product containing clindamycin may cause diarrhea. Although this side-effect occurs with almost all antibiotics, it is classically linked to the use of clindamycin.

Conclusion - As with most all medications, adverse side effects accompany. Unfortunately Benzaclin has a myriad of side effects, most of which are not positive. It is up to the individual patient to decide if the hopeful effects of an acne free face are worth the dry itchy skin, and even running unexpectedly to the bathroom!

I went through several calling card companies with mixed performance. I tried Skype-in and Skype-out, which sucked audibly.
Vonage is the ticket. Very clear most of the time. When not, I suspect it's at the Thai end of the line. I've posted about this as a hot tip before because I thought it was a very useful tip if you want to hear your partner and save big bucks too.

Also, I went online and printed out all our call records and hi-lighted the calls to her. This is great evidence of a valid relationship.

Call logs to her should be fine. I was told to bring 60+ pics to interview. Don't skimp, bring it all! She even brought old phone cards and odd receipts. Vonage has a good website where I downloaded and printed out my phone records... it was a pile! You'll be fine and so will she. Good luck.

Some trouble. The amphur wants my wife to be present to sign for a more specific statement in her official document in lieu of original Birth Certificate. But of course my wife can't leave the country. I made an info pass appointment to review this website statement you gave me and we'll bring her school record with her birthdate and both parents' names on it.

Heads up for the next victim of a missing original birth certificate. The signed official STAMPED document got us an RFE and a major crack to fall into. Too bad they gave us the I-12F instead of the I-130, like we requested atop the forms when applying for the K3. This would have been moot.

Thanks Baboyz, for the info and the alert too! She had to be there in person, that was a 2nd trip for her mom. This time she's here and we can't go due to tough times. I hope the Thai official will help. I didn't know the doc needed to state why it was missing and that they confirm there is no other record.

Where a record does not exist, the applicant or petitioner must submit an original written statement on government letterhead establishing this from the relevant government or other authority. The statement must indicate the reason the record does not exist, and indicate whether similar records for the time and place are available. I filed an I-485 Adjustment of Status. We filed a sworn government document affirming her birth record and a certified translation.

Then we got an RFE!

Her mom brought her housebook (family tree record), my wife, and the village chief to the Amphur (County seat) and got a sworn government document.
The Thai official gave an official certificate of evidence affirming her birth record.
What should I do? This is all she has.

Anyone have similar experiences?

We got a formal Thai document in lieu of original birth certificate from wife's Amphur (county seat).
USCIS gave us an RFE stating we needed the document to state on it; there is no original, and why the original is not available. Our doc just affirmed that she is who she is, parents, and when/where she was born.

So grandma had to drag the village cheif to the Amphur 4 times. Each time the Amphur said that they don't give a damn what the USA expects to see, that this is the doc they provide.

What we did:
got 3 sworn letters affirming they know wife, her birthdate, and location.
got school record stating wife's b-day and both parents' names.
certified translations of all the above -a hardship to wife's Thai friends and family (thanks to all)

My wife was born before 1970 in the rural north and the document in lieu of original birth dertificate from the Amphur gave that information and was on official, stamped, letter head paper.

My Representative's immigration liaison could do nothing but his source said I should've been fine with initial submission.
Info Pass appointment, officer said we should have been fine initially as well.

The Amphur in Thailand refused to do anything and wanted the wife to be present before discussing doing anything. This was impossible of course because she could not get Advanced Parole to travel there until this passed at USCIS. We were stuck between 2 bureaucracies.

After her family and friend ran all over, village cief included, and translation desks got their dough, and enough international mailing fees to pay the mortgage - we got it. 5 months after submitting it.

So on to the proving the unprovable at the interview.... that we love each other!

My wife has her 10 year green card! It's been the hardest, and also the most wonderful adventure for us. There were hardships and hiccups, and a bit of insanity. But we rode it out, hung in there, and it was over just about the time we were at peace with the whole process.

The struggles showed me that there are great folks here, and in my life. People really do care, and will go shoulder to shoulder with ya. We met in '06 and fell in love. At the close of '09 she's here with a 10 year green card.

Hang in there folks. You'll get there!
And if your trip is anything like ours, you'll grow along the way. Life is completely serene and content for us now - even with the economic troubles that are keeping us from travelling back to the land of smiles, that we both miss. But we'll nag tough for that too.

All humans make mistakes, that's so true. I imagine that a waiver would make the argument that she has made a mistake and a long time has passed without any further problems. Is there an immigration attorney there that can assist her? It might be a worthwhile consultation and if he's local he could help her directly and possibly know what local officers like to see -and maybe less expensive too.

I'm troubled by the black hole my cancelled petition is likely in - similar to your concern.

I was leaning toward both the I-130 and the I-129F, and paying the $200 (to somewhere?) to keep them both processing at the same time. But I still need to find out how to do it ahead of time to decide.
My wife-to-be will not need to work, we just want to be together sooner. We miss each other a lot. And the phone cards, airfare, and time off work are hurting my wallet anyway!

Tracking the application is online and from the number on the back of the cancelled check. It starts with 3 letters in CAPS.

As I understand it I send I-130 to NSC who forward it to CSC. But if I ask for consular processing do they then forward it to Bangkok embassy? If so, how long does that take?

And what about the I-129F for spouse, will that continue processing as well? What is the basis for NOT filing it? <-Economizing and AOS avoidance I assume?

As an aside, I'm a little reluctant to use red ink as it directs us to use black for the forms themselves (just paranoid maybe). But should I state that on the G-325A forms as well?

She doesn't need to work here and we want the QUICKEST way to get her here. I'll pay the extra fee (ding swallows hard). :D

1) Consular processing in Bangkok;

If you haven't filed yet, you clearly indicate on the I-130 that you want Consular processing of your I-130 instead of adjusting status in the US. Also put this in your cover letter. We have no history of anybody doing this successfully, (or not) so I suggest you make it as clear as possible. Maybe write "Consular Processing Please" in big red letters on every page of the actual I-130.

This is great advice from pushbrk, I'm sure, but I'm not clear on it at all. How does this work?

2) I've been advised to NOT file the I-129F. But then I read that it's quicker than the I-130 Petition for Alien Relative.

I just need some basic overview, I guess. I've studied the instructions but don't know what to do to get her here quickest. I'd like to do BOTH tracks and abandon the slowest, but how do I do that?

Did I read that the beneficiaary/OP is overstayed? I maybe misunderstand it, and there may be an allowable way to overstay, but:

"You must qualify to file for an I-130 in the US. Not everyone does, and in some cases doing so can be considered fraud and result in being deported and banned from re-entry into the US for a period of time. If you attempt to file and you do not qualify your legal status in the US can be placed in jeopardy. J1 Visa holders will almost always require a waiver and should consult with an immigration lawyer or the USCIS for more information. If you have any doubt, consult an immigration attorney.

If you are already married, and your spouse came to the US on a tourist visa with the intent of immigration and marriage, then he/she should return to his/her home abroad, and the I-130 (or along with an I-129f for a K-3 Visa) should be filed with the relative outside of the U.S. to avoid denial, deportation, or even being banned from re-entry to the US.

The above conditions are serious and can result in the separation of families for many years if not taken seriously."
