Tbone is right. Everyone along the way has made mistakes for us. Especially on the Thailand side. My wife's family name spelled two different ways in the same sentence on a certified translated document, and four different ways on the same family's ID cards. If the OP can't initially post here with basic spelling then he may not catch the careless errors of others, including a spouse's errors.

It seems we're free to marry who we wish in the land of the free... IF we can jump through spinning hoops like a circus dog!~
A lawyer will make mistakes too, however, and any problems may mean you run out of funds and have to take it over anyway.

I'd suggest doing it yourself if it's straight forward and documents are easy to gather and official. And read the guides read the guides read the guides ... ad infinitum

They've been married for 3 years, and she only recently joined him here in the U.S. via K-3 (2 months ago). I'm of the understanding that she doesn't have her GC yet. I don't know why. The most important thing for her is her immediate needs. She has something like $50 to her name and no credit cards. She either uses the airline tickets to get home to friends and family where she has support, or she stays here and finds a women's shelter or something and tries to get an attorney.

My wife has made friends with a woman in town who recently entered the United States on K-3. She has a small son. Apparently they had a falling out a few days ago and he's kicking her and the boy out. He's bought them a one way ticket back home and says he wants a divorce. He's refusing to give her money or anything and she doesn't even have a credit card. She's worried if she leaves the country on the ticket he bought her that it will be pretty much impossible for her to get any financial compensation out of him in the future. She's at a loss of what she's supposed to do and since I'm no lawyer I told my wife I'd post this here to see if we could get some good advice for her friend.

My first thought would be that she needs to visit with an immigration lawyer, but that might be difficult since she has no money. Does anyone here have other advice we could pass on to her?

I just got done doing this. I sent your fiance a copy of the electronic packet three a few days ago. Once Seoul receives her package, they will send her an email with the electronic packet three. She can complete the 230 and fax it. I had my fiance fax it from Korea...there wasn't any problem. It doesn't matter who faxes it. I told your fiance this...Susie went to Lolo's Shop and had him fax it for her. Then I completed the online interview request. The following Friday, I checked and she had an interview date. We did all this on a Wednesday and her interview was scheduled on that Friday.

I had Susie complete the 230 before Seoul even recieved the package...I then checked DHL and found out when it was signed for, waited a day after that and then faxed over the 230 before she even received the packet three in the email. Then she checked her email the following day and she had three emails...packet 3, packet 3.5 and packet 4 from Seoul. :lol:

The checklist from packet 3 is completed and the rest of the documents are brought to the interview by your fiance.

Now we're just waiting. I gave your fiance my phone number if you want to give me a call...

Getting close to our K1 petition reaching Seoul and am looking for some guidance... Please let me know if I have this right, or am missing anything:

1. Petition reaches Embassy via DHL
2. Embassy sends Packet 3 to my Fiance (Here's where I'm getting confused...)
a. Can I fax a completed DS230 and a copy of my Fiances VISA to the Embassy at this point and then request an interview on-line? If so, does it matter if it's faxed by me or my Fiance? Would make more sense to me if she faxed it, as she's the only one who signs the DS230 and has the passport.
b. If this is the case, when would the rest of Packet 3 be sent to the Embassy? Or, does my Fiance bring it with her to the Embassy at the interview time?
c. The Embassy needs all Packet 3 info to review prior to the actual appointment?
3. She already has the Medical completed. But, normal process is just to ensure it's completed by an Embassy approved doctor prior to the interview right?
4. Then there's the interview, hopefully approval and then issue of VISA.

Am I missing anything?

Sorry if some of these questions seem redundant. I just need to understand all the steps and I'm a "list" person.

Mornin' everyone (depending on where you are...), just have a few questions and hope someone has some experience with them...

- If in block 8, I list a partial dependent, do I have to have supporting documentation? I pay child support, but don't have custody of my child.

- For block 9: I previously submitted (and had approved) a K3 VISA for my ex. It's listed on the I-129F along with copies of divorce paperwork, etc... Should I provide support documentation?

- For block 10: I of course did an affidavit of support (long ago). Basically same question as block 9.

- Supporting evidence, specifically for military. I have copies of tax returns, pay stubs etc... Is it necessary to provide a letter from my employer? Being military, is it necessary to get letters from banks? My income and history with the military (16 years...) should prove I have sufficient income right?

- For "Oath or Affirmation of Sponsor". Can I get this notarized by a legal officer on base?

I expect this will happen to my husband and I also. It was a issue with me also for awhile but we have so much in common and we get along great. I am 22 years older but I feel young when we are together. I was rather shoked at first most my friends attitude was positive about the age gap. After 40 you start over so your husband is only 20. kicking.gif

My fiancée’s interview is scheduled for tomorrow. She had her medical exam today. She did not receive her medical packet and was told that she will need to have a test done which is scheduled for Thursday. She had this same test done a month ago and the results were negative. Needless to say, she is very upset just the same. She attempted to contact the embassy in Moscow after she was done with the exam, but it was late in the day, and no one answered. She does not know what to do. I told her to go to the interview and explain the medical situation. Has anyone had experience with this type of situation? Will the embassy conduct the interview and accept the medical documents at a later date? She was told the results of the test wouldn’t be available until next Tuesday. Is it more likely that the interview will be rescheduled? Since interviews in Russia are conducted only at the embassy in Moscow, it will mean another trip there, which for her is 1 ½ days each way by train. That is a major inconvenience, and she has already taken this week off work. I realize these questions will be answered with her visit to the embassy tomorrow, but I would like to hear other people's experiences with this type of situation.

You need to talk to an operator at NVC or email them at NVCINQUIRY@state.gov The automated system only tracks DOS case numbers, and wont tell you any thing about status of K type visas.

To email them provide them with CIS case number and Name and DOB of petitioner, and beneficiary.

I have a question about the I-864 and DS-230. Do I need to send this forms with my documents together? (such as tax information, wedding papers (from the beneficiare, police certificate from the beneficiare and all the documents I checked on the "LingChe NVC ShortCut".

I already payed for the AOS and IV Bill, I already sent the DS-3032 with the cover sheet.

I recommend using EZGuideSpouse. It is a much simplified version.

Yes, you would need to send documents like tax transcripts, original/certified marriage certificate, original police clearance, etc. You also will need to send photocopies of all the civil documents you send. Again, I recommend following the EZGuideSpouse for a clear and concise overview of what to send NVC.

I am grateful to God that He gave me an opportunity to do something for my mother. I’m afraid that something may prevent her (i.e. visa denied) coming here and live with me.

I'm glad to hear she can walk, even if it is slowly. Honestly, I really don't see her case being denied.

No, my mother does not smoke or drink (never). Her only problem is that her left hand and leg is kind of disabled. She understands her situation and yes she takes physical therapy three times a week since she had the stroke. That’s pretty much everything she currently deals with. Other insignificant issues like minor back pain, dental issues, and so on.

It is the stroke and left hand being non-functional is my primary concern. I know I’ll support her as it’s a holy duty given to me by God, but will the visa people feel the same?

You're very welcome. When I read your situation, I immediately empathized with you.

So her extremities of the left side are completely paralyzed? Or partially paralyzed? Is she wheelchair-bound? Or does she use a walker of some type? Patients with complete sided paralysis usually will require more medical care and attention. I'm sure the physician will discuss the costs involved, but again, this should not be an issue.

The back pain, dental issues, loss of hair, etc are all part of aging. We will all be affected by some condition with age, eventually.

We can only hope that those reviewing your case are sympathetic to your situation. It is a blessing that you are well above poverty line to you, your mother and the rest of your family. BTW, I'm very happy to hear you say it's a holy duty given by God. I, like many others, feel the same about our families.

Hi All,

I am trying to make sure I cover everything regarding my mother?s immigrant visa. I am concerned about the medical exam that will be done before the interview. Here is the thing:

My mother had a stroke and her left side was paralyzed and never fully recovered. She also has diabetes and high blood pressure and taking medication. Will any of these be a factor for her medical exam? She is 64 years old and otherwise healthy.


I am providing the I-864 and my income level is six times more than the amount required. My mother also has significant cash in her bank, which alone is enough to over come the poverty guideline (5 times more than the minimum required).

1. Should she reveal all her medical history during the medical exam? Or only highlight the big things (i.e. Stroke, Diabetes, and High Blood Pressure.
2. Should I go through a lawyer in case they make a big deal out of it?
3. Is there anything that I do would make the medical exam easier for her?

Please enlighten me and help me to better anticipate all the challenges.

First of all, I am deeply sorry that your mother had a stroke. It is very devastating and emotional watching a loved one live and cope with the effects of stroke. My grandfather had one seven years ago, and it was a difficult time for him and the rest of our family. I can only imagine having a parent who has suffered from one. (F)

In my opinion, the diabetes and hypertension should NOT be a problem during the medical exam. People with diabetes and hypertension, controlled with medication, can function normally in life and without much restrictions. I don't see this as a problem during the medical.

I would only reveal medical history that is questioned during the exam. That's just me, though. What other history would you think is relevant? Was/is your mother a smoker? History of alcohol intake? Family history of stroke? Diet and exercise schedules? This is correlated with your mother's condition. And most likely, they will be asked during the medical.

I should hope you don't need a lawyer during or after the medical exam. However, if you feel that your mother is being unjustly discriminated against because of her condition; by all means, seek legal advice.

Bringing evidence documenting your mother's medical condition may help during the exam. If you have copies of her medical records, I would definitely bring those. It would aid the physician's evaluation of your mother's progression of the disease. I am assuming your mother has had/or is having physical therapy or occupational therapy? Bring copies of their notes or exercise routines they have your mom do. Most important of all, is your mother educated about her condition. Many doctors today just treat the disease and not the patient. It is the physician's duty to explain the condition to the patient. And also to answer any questions they may have.

Overall, I don't think your mother will have problems during the medical exam. Patients with stroke need to be treated and managed for life. And since you state that you are well above the poverty line, your mother will not be a charge on the state. And unfortunately, that is mainly what USCIS/NVC is concerned with.

It is highly recommended that, if you send in one envelope, you indicate on the envelope that it contains both AOS (I-864) and IV (DS-230) packets.
Loto, one of our senior members, suggests highlighting "AOS packet" and "IV packet"
Doing this will alert the NVC employee that there is indeed two separate packets, and not only one.

For NVC, I would recommend submitting original IRS transcripts. That's what I'm doing. In addition, I called IRS and ordered another set for the interview...just in case. :D

Ok, i will keep trying to call a live operator for my invoice number, but can you tell me exactly how you asked for it (the words you used)? When I asked, they again said I have to wait for instructions to be sent to my attorney.

The best time to call, in my opinion, would be evenings. Around 8-9PM EST. When I spoke to an operator, I asked for my invoice identification number. The operator was hesitant. My exact words were, "I would like my invoice ID number for my records." And then, the operator gave me it.

Some would flat-out tell you, "No, you have to wait 6-8 weeks for..." However, some are really nice and will give it without any problems. The point is: you have to keep on calling and trying. Eventually, you'll get it. :D

Another delay for my wife and child(2 months old) photograph. I dont have them here in the USA. My wife sent me photo via email. but walmart or walgreen doesn't print passport size photo(2x2) from CD or other device. Has to be person come in & take the picture. So, My wife has to mail those photograph from Bangladesh via DHL which will take another 4-6 days to receive by NVC. Now I am looking for the Interview in February or March 2011. Thats crazy..Cant wait to see my little boy....& lovable wife..

Walmart and Walgreen may not be able to print 2x2" photos, but they do print 4x6" photos. You would just cut them into 6 2x2" photos.
Do you need help getting the correct size/dimension of the photos? If so, I don't mind helping you. You can send me the photo via PM, and I'll edit it for you. Then you can have Walmart or Walgreen print them.

I hate to tell you this, but I don't think any have successfully processed their DS-230 without the applicant's photos. I believe you will definitely get an RFE for this. You can try calling and speaking to an operator about this. Maybe you can send them before the RFE notice. Otherwise, you will just need to wait for it.

Have you read this guide, by PatiencePaidOff? If not, I highly recommend you reading it. I followed that guide meticulously, and our case was processed very smoothly. Please do not wait for any NVC correspondence. Call NVC everyday to check on your case. You will need your USCIS receipt number. You then can speak to an operator and inquire the status of your case.

Holy Molly, USCIS and NVC sure add a lot to the petition that goes to the Embassy. The 2 packages that I am tracking are 15 and 16 lbs each. I certainly didn't send anywhere near that much when I filed my petition in October 2010. :blink:
