Thanks Yodrak.Yeah of course I 129f,somehow I always forget about the f.LOL
The reason why I was wondering,actually why I'm so worried is bc on the G 325a he will have to list his past employers and he has those two gaps in there from August 2005 til October 13th,2005,and from May 2006 until November 2006........
And I'm worried that they will deny our petition thinking "well we can't be sure he'll hold that job....." even though now the situation is a different one and he finally found what he really wants to do even though it's not in his old (beloved) aviation field.
It took him darn long to get things staright ,I know that and like I said I do worry about the two periods of unemployment in his work history since he got out of the Army in August of 2005.
So u r saying that it will (probably) not cause problems ,right?

OK now we just gor the news that our potential co sponsor is no longer able to be our co sponsor due to losing his job and now going back to school....
Here's the story:
my Fiance has been with the US Army until August of last year,has then been unemployed until mid October 2005,then he had a job (with one Company) until May 2006 (lost the job bc he got laid off).Now he hasn't been back at work since May but will sign a Contarct by November 1st of this year.
(In fact he could start now but seeing that I will come to the US for a 4 week visit next month and he has to go to school for a few weeks in CA ,he can't sign the contract before November 1st.)
His new job will put us well above the 125% of the Poverty Guideline .
We will put the paperwork for the I 129 in as soon as he has his new work contact in hand so like I said in early November.
My question now is how much of a chance to we have to get our petition approved WITHOUT a co sponsor seeing that since he got out of the Militay in August of last year he has had to periods of being unemployed (one as I said 2 1/2 months and one 5 1/2 months!!!)
My nerves are shot by now and looking at the site of the US Embassy in Germany hasn't been helpful since there I can't find the info I need.
Please can someone help me??????????????????

To your question,
nope it doesn't matter.Current Income matters to them.And that you only had your job for 6 months doesn't matter either.You will need the I 134 at Embassy Stage ,after you get your NoA 2.
And as far as I know gross Income.But I'm sure someone will correct me in case I'm wrong on this one.

Problem is that his Tax for 2006 will be pretty low since he's been out of work since May and didn't really know what he wanted to do until he decided to become a Truck Driver........So his Income for 2006 (on the Tax Papers) will definitley be below the Guidelines.The previous years are fine but 2006 is not.

Got a question regarding the Income Evidence for I 134 and I 864.....
My hubby to be is starting to work as a Truck Driver next month and will not be paid hourly but per mile.So depending on how much work they have and how many miles he's driving -that's how much his pay check will be.
It will without a doubt (added up) be above the Poverty Guidlines ,but what is he supposed to put down on the forms???
I know we can/probably even have to ,send in pay stubs showing how much he's making,but like I said I wonder about the forms since his Income most likely wont always be exactly the same each week/month.

Beginning October 23, 2006, U.S. Citizenship and Immigration Services (USCIS) National Benefits Center (NBC) began transferring Form I-129F, Petition for Alien Fiancé(e), (petitions for K-3-spouses of U.S. citizens only), to the California Service Center (CSC) and the Vermont Service Center (VSC), depending on the location of the related Form I-130, Petition for Alien Relative. This transfer is being implemented in preparation for Phase 3 of the USCIS initiative to use centralized filing and bi-specialized adjudication. Through this Bi-Specialization effort, USCIS continues to align similar workloads between two “sister” service centers, CSC and VSC, to better manage cases and improve customer service.
USCIS will continue to forward approved Form I-129F (K-3) petitions to the National Visa Center (NVC) for consular processing. However, it will retain approved Form I-130 petitions, based upon a mutual agreement with the Department of State. USCIS will retain all approved Forms I-130 for retrieval upon the beneficiary’s eventual application for adjustment of status (Form I-485), unless the petitioner clearly indicates on Form I-130 that the beneficiary will use the consular process. USCIS will store approved Form I-130 petitions at its National Record Center (NRC).
USCIS has implemented this process change because most K-3 beneficiaries apply for lawful permanent residence by filing Form I-485, Application to Register Permanent Residence or Adjust Status, following their arrival in the United States, as opposed to using their approved Form I-130 petition to apply for an immigrant visa abroad. By retaining the approved Form I-130 petition at the NRC, USCIS will reduce unnecessary file movement and eliminate applicable costs and fees associated with immigrant visa processing.
If the beneficiary should later elect to consular process instead of applying for adjustment of status, Form I-824, Application for Action on an Approved Application or Petition, must be filed with the USCIS office that approved Form I-130. Upon favorable action on Form I-824, USCIS will send Form I-130 to the NVC.
This internal transfer of work does not alter the existing filing instructions for any of the forms. Accordingly, USCIS customers who file Forms I-130, I-129F (K-3-spouses of U.S. citizens only), and I-485 should continue to follow the current filing instructions on these forms. Customers affected by this transfer will receive a receipt notice from the NBC notifying them of the location to which their Form I-129F has been transferred.

Well, the notice says to clearly request "Consular Processing" but maybe they'll understand. If so, you'll may be the first to report success. Please keep us posted.

But as our petitions were seperated by our lawyer until after NOA1 for I130 came, it seems like past practice will be used. The exception may be the concurrent processing instead of I129F storage, or extra fee to pay for dual processing. But I'm not clear, have others had their I130 sat on until after the I129f lately?

Looks like April for her I129F and May/June for the I130. I better change my timeline and sig!

It will be 90 days for me in 3 days for the I-129F on my K3. Should I call after that?
Oct. 10, 2007 USPS delivered it.

I will probably go with the I-130 because it had the NOA1 on Sept. 10, 2007. They seem to be 19 days longer than the I-129 at CSC.

I haven't got our NOA1 yet, but went online to see my cashed check and got our WAC#.
I logged onto the USCIS site and saw our case was received 9-10-07.
It was mailed from Thailand 8-8-07 by my lawyer there and I was worried it went into limbo from; being sent to the wrong PO Box/ sent from a foriegn country/ sent via FedEx not USPS... etc.

Also, we sent both the I-129F and the I-130 together to the USCIS (see my sig line) and requested 'Direct Consular Filing' on the I-130.

My lawyer in Thailand reveived a copy of the receipt notice Sept. 19, 2007. I haven't got anything yet, just the cashed personal check.

CSC has not received my I-129F and I sent the I-130 on 8-7-07.

After that NOA1 I sent the I-129F and it still hasn't been received. That was 10-9-07
I called, they said to just wait longer... then call if still nothing.
Service was polite and helpful in spirit but they cannot do a thing, or even tell you anything useful really.

In the spirit of the OP:

I put myself and Lek's name on the originating "lease" agreement/deposit. In Thailand this amounts to a small 4"X6" receipt. I signed it.
Also, I paid in-person when visiting 4 more times. I signed it and had the office stamp the Thai word "paid" over it.
Do I need this translated before interview 7-11-08?

We also have a joint bank account in Thailand. But the bank book is predominately in Thai as well.

Nah, he's always been great. This is a pretty unique situation, ya gotta admit.
There's a thread-the-needle 10yr green card timing situation with us that a CPA wouldn't need to know too.

It looks like the sage advice from John, option2, will be best.

Her K3 expires 13july2010 and the guides flowchart says:
"Apply for Adjustment of Status (AOS). You should file before the K-3 Visa expires. If you have not filed for AOS and your K-3 expires, you will be considered out-of-status until you file. Make all attempts to file before you become out-of-status. You may also file for your EAD and AP (if K-3 visa expired) at this time."

My CPA and the form W7 seem to say she can file a non-resident 1040 with her W7 -and can get a ITIN#. She's only been here 169 days. This would seem to allow me to claim her sa a dependant, as she hasn't worked. There's an Acceptance Agent nearby but I think we can do this thing... good.gif

We wrote "Consular Processing Requested" across the top of the I130. My wife was given a K3 at the Embassy and now we have to pay $1010 and file the I-485. Why did we get the K3 and is there any way to go for the IR-1/CR-1 ?

The I130 approval notice says to wait at least 90 days before calling the NVC at (603) 334-0700. Can I still get the IR-1/CR-1 calling them? We waited the 11 months and both were approved the same time, aaaargh!
Can I file form I-824 after she's here?

Review all history, names, dates, places, where each other works and lives - all info about your mutual lives could be asked about. They want to know it's a real marriage, all is disclosed, and that it's a valid relationship.

K3 is virtually a dead issue for the vast majority of couples and has been since November 16, 2006. The news is slow to spread, unfortunately.

Do a search on "If you want an immigrant visa, don't file an I-129F for spouse" and see how many hits you get. And that's just me.

"Where does this leave the I-129F for spouse filers?" you ask. Generally, it leaves them wishing they had never filed the I-129F.

I tried for the I-130 to CR-1 and was one of the eary ones. I wrote "Consular Processing Requested: acros the top of the I-130. Also, I put the link to the Public Notice from the USCIS about this. And still, when my Thai speaking wife went to the embassy she got the K3. Our I-129F and I-130 were approved the same day. What can I do now? helpsmilie.gif

Yep, still within the timeframe, then it doesn't pay to call. But do call AFTER the timeframe is up. They are professional but can only do so much.

I tried the I-130 but they went with I-129 anyway. They were aproved at the same time, 11 months later.

I was going to wait for the 10 yr card but the job market sucks, so I will pay now while I still have the cash. It means I don't have to pay for a new medical, just the vaccination supplemental so I save $80 - BUT we lose the $600 tax return stimulus because she wont have a SS#.

Then again, maybe she can get some kind of job and that earlier start-work timeframe will make up for that.

So my plan was changed for me by ... wacko.gif

Tbone is right. Everyone along the way has made mistakes for us. Especially on the Thailand side. My wife's family name spelled two different ways in the same sentence on a certified translated document, and four different ways on the same family's ID cards. If the OP can't initially post here with basic spelling then he may not catch the careless errors of others, including a spouse's errors.

It seems we're free to marry who we wish in the land of the free... IF we can jump through spinning hoops like a circus dog!~
A lawyer will make mistakes too, however, and any problems may mean you run out of funds and have to take it over anyway.

I'd suggest doing it yourself if it's straight forward and documents are easy to gather and official. And read the guides read the guides read the guides ... ad infinitum
