K-1 Fiance(e) Visa Process & Proceduressending certified copies of birth certificates . . .
I got a few extra certified copies from the county courthouse and sent them in, and also brought one to her. Cheap peace of mind. I also sent the letter that I swear all photocopies are true to the originals.

We never fought about immigration issues. But I wish that was the problem, we could have worked that out. Turns out there was a deal-breaker of an issue. You will be fine, this will pass.

Sorry to hear that. Keep looking, keep trying for more income too. Is there another way... DCF already married maybe? I just don't know.

I'll bet the beer didn't make it go away at all (only made it worse for me). Only time and continued trying until you succeed. Keep the hope, you still have love. They can't take that away.

K-1 Fiance(e) Visa Process & ProceduresHow long is it taking CSC to mail NOA2 to NVC?
I'm told (by a visa lawyer) that a letter should be sent to Homeland Security -USCIS- and they will then forward a copy to The Department of State. A reason is not required, just that the engagement has ben cancelled.

He has 4 cancellations for Thailand right now.

Maybe have the religious ceremony, and don't file the paperwork. Call it something else, family engagement ceremony, when you refer to it with the USCIS.

I don't understand about the J1 timing, myself. But good luck!

K-1 Fiance(e) Visa Process & ProceduresShould I cancel my I-129F or let it fade by doing nothing?

Ding,

I'm so sorry for what happened. Just a couple of days ago you were excited about getting the NOA2 after the long wait, and now this. I cannot imagine the pain you are going through right now. Just keep in mind that for every door that closes, there's a window that opens for you. Good luck!

David and Mae

Thanks. Help from friends is good.
There was trouble and red flags. Glad it happened before she came here. I have a buddy that kept telling me she wasn't a liar, that I was thinking too much. I had to let go of that too. It's hard enough without his misdirected comments. And I was injured at work too and can't work. So yeah, it's raining. And I'm learning something. Let go, let god.

Can't even function well enough to close this application down effectively yet. Wait time I guess.

Damn, I am so sorry for you Ding.

Yeah, thought I was beyond getting devastated like this. Been around in the world just enough times to fool myself I guess. I thought it was good and trusted too early. Can't quite pin down what lesson I'm supposed to be learning with this.

Thanks Yodrak. I'll wait time. I sent a snail mail last night to NVC, not a return receipt requested, however.

K-1 Fiance(e) Visa Process & ProceduresShould I cancel my I-129F or let it fade by doing nothing?

If you send off to NVC include the following

USCIS case number

Petitioner Name
DOB
Beneficiary Name
DOB

With this information they will be able to find your case file

I tried to send this to Bangkok Consular office Visa sectio and got this autoreply;

"...For Immigrant Visa (including Fiancée) Cases: The subject line
must contain "2nd IV Inquiry", and the case number (with prefix of BNK..."

Well I only have the USCIS # starting with WAC######
And the auto voice response center at NVC (603-334-0700) has no record of my WAC case yet.
Maybe next Tuesday morning?

So I have a snail mail going out to:
NVC
32 Rochester Ave
Portsmouth, NH 03801-2909

Is there a pit I may fall in until then?

And thanks for all the encouraging words. Really, it helps somehow. I've had to literally use the things some of you have said here to keep me from calling and crawling..

You already received your NOA2 so you are finished with the USCIS, so it makes no sense sending the cancellation request there (NSC or CSC). Your petition is now with the Department of State... You need to send your cancellation request to NVC or directly to the consulate......

Of course! That makes sense, I should have figured that out. I am going to send an email to the Consulate's visa unit. > visasbkk@state.gov

Your gut doesn't lie, even when your heart entreats you to hang in there. What a horrible turn of events! Remember, over the next few weeks, lots of TLC. I know men aren't big on TLC, but you can do it(!). Whatever it takes, treat yourself with great care. You've got lots of people rooting for you!

In terms of next steps, send a letter advising USCIS that the engagement is off - whenever you're ready.

Thanks. Yep, the phone gets pretty heavy for some of us, but I'm talking and praying a lot these days.

Here are the addresses I have but I don't know if I send it to NSC where I sent my I-129F, or to CSC who processed my I-129F.

ding,

I recommend that you notify the consulate to return the petition to USCIS when they receive it, with the simple explanation that the engagement has been called off.

Here is the email address I have for the US embassy in Bangkok. Does anyone know if this is the best place, or way, to contact the consulate? do you refer to the Bangogk Embassy when you say consulate?

Now, do I contact Department of State and close my application or just let the case close by doing nothing?
I got my NOA2 just 6 days ago.

K-1 Fiance(e) Visa Process & ProceduresWhere to write' "Do not canclel petition" letter -at USCIS
That's good advice, I agree. It's a bit long and complicated. It was my gut that caused me to ask some questions when things didn't add up. My gut was right, she was lying... a lot. But she lied about nothing big, just lots of needless lies. Maybe the only questionable thing was her regularly talking with her ex-boyfriend, but I was never worried about that/him. Still it was just all the lying in the end, and it didn't stop after I told her my feelings again about honesty and trust. So I eventually decided to accept the facts and let it go.

Thais often lie to not lose face, to avoid conflict, and to just take the easy way. I knew this and thought we talked it out. I was mistaken.
She didn't REALLY understand that westerners need the truth more than not hearing "not nice things". She's never done anything bad in her life. Funny thing is, I told her ALL my baggage and still she hid what was going on in her life. Also, she's 39 and never in a committed relationship before. She works 6 days a week to send money to her mom upcountry. She never experienced having someone in her life like this.
She loves me deeply and it depressed her a lot. She really hit bottom on the lying and came clean. She isn't lying anymore either, and my gut agrees 100%

I agree, listen to your gut.

K-1 Fiance(e) Visa Process & ProceduresWhere to write' "Do not canclel petition" letter -at USCIS
We worked it out. But not before I decided I had to let go and cancell our K-1. Pretty embarassing, but it took what it took. I figured I tried all I could, but had to accept she was just that way -and let it go. Anyway, she hit bottom on the whole lying thing and here we go again:

Where can I write to the USCIS to "please disregard the request to cancel"?
The NVC already sent me a letter last week saying they sent my request to cancel to the USCIS.
It's odd that the NVC letter said to contact the Bangkok Embassy with further inquiries.

I'm pretty sure we have to refile with a waiver request. I spoke to customer service and the officer said "You probably shot yourself in the foot". I bit my lip and refrained from saying "Yeah, but someone else was holding the gun!"

Anybody know how this sort of thing goes?

For better or worse, you do need to have been in the same place, at the same time within the past two years. So until he can visit you, or you him, you will not be able to file for K-1. As I read your timeline, he filed just past that set in stone rule.

Really sorry, hope you can work something out. I would think the only real solution would be him visiting again and re-applying.

K-1 Fiance(e) Visa Process & ProceduresVisiting with a twist
From everything I have read on here, I would say she should simply plan on bringing documentation that her visit here is exactly that, a visit. If she is flying to the USA, then she will have tickets with her for all stages of the visit, including home after your visit to Mexico.

She should be honest and up front if asked about a K-1 having been filed, but the purpose of her trip is to visit and go on to Mexico, then back and on home.

She should bring documentation of her ties to Canada, such as a letter from her employer. Things that indicate she will return to Canada when the trip is finished. Otherwise, being Canadian, she should expect very little hassle.

Oh... And do NOT get excited and elope either in the USA or Mexico! Beyond that, have a ton of fun!

Good luck on your journey!

K-1 Fiance(e) Visa Process & ProceduresDivorce Decree vs Certificate

I guess i may have misunderstood the last comment. A copy of my divorce decree was notarized along with other documents as true replicas of the original documents. Are you saying notary publics are not meant to do that?

The copy of divorce decree currently in Nigeria with my fiancee is one that has been notarized. I guess i am wondering if that notarized document will suffice or if they will insist on a certified copy. Thus far, i guess i may have to do a last minute rush to try and obtain a certified copy. Gosh and i thought i was done with mailing of documents....oh bother!!!!!!!!!!!!!

I work for a court. The court clerk can "certify" by stamp that your copy of the divorce decree is a correct copy of the original on file with the court. That would make your copy "official."

I am also a Notary, and the purpose of notarizing is simply to declare that you have witnessed the signing of the document. It does not make the document "authentic" nor make what is in the document "official" but simply means the person claiming to have signed the document did indeed sign it.

K-1 Fiance(e) Visa Process & ProceduresHow risky???
I would imagine your son staying behind in Germany would be excellant proof that you intend to visit, and return. Seems those from the UK and Canada report few problems visiting while a K-1 is being processed and while this is just a guess, I would imagine German citizens would also have very few problems doing so.

Be honest at the point of entry as to your intentions for visiting. Don't offer more information than you are asked for.

All the advice indicates that you should bring plenty of proof you intend to return, have ties which would indicate you will return when you state you will etc.

Good luck!
