US Embassy and Consulate DiscussionDS forms
The DS forms we got from Abu Dhabi Embassy were also expired, and I would highly recommend simply using the forms available online below:

DS-230, 156, 156K and 157 are all available online at(forms we were required to produce, you may be asked for others which likely are found here as well):

http://travel.state....forms_1342.html

And using the online DS-156 produces a scannable document by automatically creating a bar code when printing, so there will be no errors having some consulate worker put your data into the computer system. It is simply scanned into the system!

I have read that the embassies and consulates will always accept the expired forms they provide, but why not use up to date forms and have the peace of mind of having neatly typed out documents, and of course the scannable DS-156 mentioned above?

Good luck at your interview!

The subject was barely mentioned at my fiance's interview. We worried a little about this as well. But since the internet makes the world a much smaller place, it stands to reason many international romances would begin online.

US Embassy and Consulate DiscussionInterview what to wear?
Business casual is the look he should shoot for. If he is used to a suit and tie, and this is normal for him, then by all means, he should wear one. But from everything I gathered (and I asked the same question for my fiancée for her interview) the response was business casual.

Many described seeing people dressed pretty down, even scruffy, but this is an important day for him. Good luck at his interview!

US Embassy and Consulate Discussionto make a letter or not?
Hi Faye! Good luck on your interview. The thing I am wondering is what your packet asked for? If your fiance is above the poverty line for his 2006 income, and/or currently earning above the poverty guidelines, and you have only been asked for last year's tax return just give them that. Did he file a return for 2006?

If they asked for the last 3 year's returns and he doesn't have them because he didn't file, then you will likely want a letter from the IRS indicating he was ok not filing taxes based on his 2004 and 2005 income level. He may also be able to prove he did not need to file by searching irs.gov and finding the income level rules for tax filers.

IF you are the fiance, and your USC is also a member, link your timeline to his by putting his VisaJourney ID # in the proper spot on the edit page. (Towards the bottom of the edit timeline form.) Then when people check your timeline his will pop up and assuming he is keeping his up to date, everyone will be happy and no stats will be skewed.

Otherwise it looks like you got great research advice from YuAnDan!

"You will not need a SSN in order to get married. The married license nor the married certificate require a SSN. However, I recommend applying for the SSN anytime after 10 days after the beneficiary arrives in the US.

Hope this helps...

Yes Sheriff, it does!

It will vary from state to state. You need to do like I did and call the county clerk where you live. Just explain the situation and they will tell you what is allowed.
Luz and I decided to marry within a few days of her arrival. Just a quick civil cerimony at the court house. Then we can apply for her SSN in her married name and apply for the AOS right away. A few months later, after we have a chance to settle in we will have a big wedding at my fathers farm. (outdoor).

I will do just that Gary! Good thinking, only applying for the SSN once and in her married name. Hopefully Washington state works like that.

We plan on a small ceremony, hopefully at a local, very old Catholic Church. The larger full wedding will take place down the road, in PI with her friends and family. :D

Good luck to Luz! And to everyone interviewing February 13th, hopefully my fiancee can save everyone a little good luck from February 12th!

hi all! just need help asap about getting an SSN "before" getting married... if i applied for an SSN, what should i typically bring??? (what kind of docs/proofs)... in their application form, page 2, stated:

if you check "legal alien not allowed to work" you must provide from a US Federal, State, or local govt agency that explains why you need a SSN...

im not really sure with that statement...just confused here... and how long should i wait after applying for one...

thanks all!!!

We took:

1. SSN Application
2. Passport/Visa

That's all...

Cheers!!!

Sheriff Uling

NOTE: The SSA requires two forms of ID from the beneficiary. So show them your passport and visa pages. By law, those are two different IDs and that is what we did. In order to play the game, you must either know the rules or get the handbook. Yeah Baby Yeah!!!

I already checked into what we have to do. If she puts her PI address down on the license we can get married without a SSN. Just show her passport and visa. If we put my address down then she would need a SSN.

Gary, really? If that is the case, and we can get married before getting her a SSN, we may do that as well. Although I see no reason to delay getting her a SS card ASAP as well.

US Embassy and Consulate DiscussionK1 visa denied section 221(g)

The consular denied her because there were only 2 letters and 1 trip to Vietnam and said our relationship was a sham.

It is starting to seem like the COs are taking a hard look at the number of visits and length of relationship...

Well we are going into our interview with just one visit, and brief at that. Not Vietnam of course, but I would think that not everyone can afford to jet set across the globe repeatedly, nor can everyone who happens to love another from half way around the world drop everything and spend the time they might desire with their SO.

I had in incredibly hard time leaving, and had wanted to visit J for a very long time. Not at all sure what I would do in your position, and sincerely hoping the same fate does not await us.

I sincerely hope that you can turn this around, and either get this petition back on track or drop it and start another. Good luck to you!

If you mean can she go from Hong Kong to PI, and visit there then travel the the USA, yep! No problem as long as she does not have any sort of legal issues in PI.

Once she is here in the USA she won't be able to travel out of the USA until you get AP or she gets her greencard, so this would be a great time for her to visit home before she comes to you.

copies are available at the courthouse where your marriage was registered... a bitter or amicable divorce is irrelevant..... i doubt the clerk at the courthouse will give you a lot of grief...

I should have pointed out ...
The marriage took place in Israel, and was registered there with the religious courts (Bet Din), who do not have computerized records as far as I know. Meaning that getting an extract would involve a personal visit to the court in Haifa, Israel (I'm in the US, so I'd probably ask my brother to go on my behalf), then getting it translated from Hebrew to English and certifying the translation, and then mailing it to Thailand. Which I can do, but this will take time, effort, and money. That's why I'm asking if it's likely to be necessary before going to those lengths.

Always better safe than sorry. Probably going to owe your brother big time, but getting the marriage certificate should not be overlooked. Good luck! good.gif

the threshold is typically 125% of that number

US Embassy and Consulate DiscussionQuestion about I 134
Hey all,
my Fiance is a Truck Driver and never has the same Income as it depends on his mileage..........He makes enough money to meet the 125% required but I would like to know whether (once we get to that stage) we have to submit Pay Stubs or what to show his Income. The Company can only state an estimate average of what he makes annually, since as I said it all depends on his miles.
And also,he was unemployed from May until November of last year so that W2 definitley doesnt meet the required Income for 2006,is that gonna cause problems?
His Income NOW does meet the 125% so the W2 for 2007 will be fine .(For the I 864 at AOS stage).
Thanks for any info

US Embassy and Consulate DiscussionI 134 and Income being a Trucker
Yodrak I'm sorry but it was still in my head when you told me in the past that his paast Income is not as important that his current Income. And yeah he has switched branches from being a Helicopter Mechanic to being a Trucker. He has tried for months to get a Heli Job last year ,but since he never had an A&P License that was impossible to get and the when he decided on going Trucking I visited him for a month.Due to the CDL School being in CA and him living in WA it would have been stupid if he would have left before I came to visit.Especially since he's an OTR Driver and hardly ever home.......So yeah he could have been employed by August but choose to wait because I came over.
Any advice on how to explain that situation in case IT IS causing problems at the Interview???
I know one thing for sure,we DO NOT have a co sponsor and no chance to get one since my son has ADHD(ppl are afraid of med bills for him)......so in case his low Income in 2006 is a problem then we have a MAJOR problem............

To Yodrak:
If I remember it correctly you yourself has told me not too log ago that all they care about is what he's making NOW (when we file) and not so much about the past.........
So are you trying to say that we will get problems later on because of his low Income in 2006? That by the way is the ONLY year (out of the past 10) that he didn't meet the 125%.As far as I know we have to provide several years of Tex Return at AOS stage right?
And as far as me mentioning anything-
By God I will only answer question I have been asked or will be asked and NOT give out any further info that might be harmful to the visa.

Well the thing with the tax returns is a "problem" because his 2006 Tax Return definitley doesn't meet the 125% since he was unemployed from May until November when he switched Branches and started Trucking. He does make good money driving and like I said we will be above the 125% which we will be able to show on the 2007 Tax Return for AOS.But can the 2006 Tax Return cause problems even though we can provide pay stubs showing his Income?

OKay here's what you do,(unless your Fiancee was married to the father of the child! then it wont work),she needs to go to the Jugendamt and get what is called a "Negativbescheinigung gemaess §58a SGB VII".
I just got the exact same thing for my son.
BUT,this does not work if she was married to the father of that child.

It has to read like this "Das Jugendamt der Stadt (City your Fiancee and her son live) bescheinigt hiermit, dass keine Sorgerechtserklärung gem. § 1626a Abs.1 Nr1 BGB verwahrt wird.

In very simple words,
that she has full custody for her son.

US Embassy and Consulate DiscussionQuestion about Income required for I 134
I just stumled across something in another thread so I will just ask this one real quick:
My man makes 8$ an hour for the first 40 hours he works,+ 680$ Per Diem (for those 40 hours) ,from hour 41-50 he makes 26$ an hour and from 51-60 also 26$ an hour + 25%.
So all together he makes right around 1600$ a week, which gets us VERY well abve the poverty level ,but not all of that Income IS taxable (as PerDiem isn't taxable). Now is that gonna cause problems?
Would be kind of a joke since he really does make enough.........Oh and yeah he is always working 60 hours a week,so he gets all that extra money all the time as in the Per Diem and the overtime Pay and bonus.
Also what in the world would his company have to State on the letter we need from them? Should they put it down the way I just did here and we add pay stubs and Bank Statments??
Thanks for any replies

OK,so now I'm confused. My man just looked at his W2's and his Per Diem Pay is not stated on them. Now without the Per Diem pay he doesnt meet the 125% we need.BUT,he does make over 6000$ each month when the Per Diem pay is included.
( He works 60 hours weekly, 40 hours are paid at 8$ an hour, from hour 41-50 he gets 26$ an hour and from 51-60 he gets 26$ an hour PLUS 25% so his average paycheck is 1500$ weekly).
We CAN prove his weekly Income with his paystubs and the bank statements that show the deposits made by his Company.
Still since his TAXABLE Income is slightly below the Poverty Guidelines do we need a Co Sponsor???
And what should the letter from his Employer state?? (Other then when he was hired, that the job is fulltime and that)
Also he is working for a Contracting Company and his current Contract is over on Sep 12th.Then he has 30 days of mandatory (unpaid) leave and gets hired on with the same conditions as before again.
Is that gonna cause a problem??
I have just talked to his Dad and he said he would be our Co Sponsor, but do we need one now or not????
Please someone explain this to me as I'm going crazy here and am confused as can be.

US Embassy and Consulate DiscussionCo Sponsorship
OK so to be on the safe side I have asked my soon to be Dad in law to Co Sponsor my son and me.....My man has made just under 21 000$ in taxable Income last year.
He currently has a VERY good job but the problems seems to be that whatever he makes in Per Diem Pay is not counted.........
Once he starts his second year working for that company he will have a TAXABLE Income of over 50 000 $ which that will be in October.
So can his Dad then withdraw his I 134 /I 864 ???
Somehwhere I believe to have read that as soon as the Petitioner meets the 125% the Co Sponsor can get out of the game,is that right?
Also what documents do we need from his Dad? Last 3 years of W2's,Letter from Employer and I 134 correct???
Does anybody here have any experience with Per Diem Pay and them not accepting that as ncome suitable for the I 134?? Maybe even someone going through Frankfurt Germany?
I was digging through the archives here yesterday and someone had a similar problem, their Co Sponsor was a Trucker and since he made 23 000$ in Taxable Income and 27 000$ in Per Diem they actually had to find a whole new Co Sponsor..........
Please someone help me out here!
