was in the same situation but im sure you are not dealing with the MANILA embassy in the philippines coz they dont accept secondary sponsership or joint sponsorship. its good to explain the reason why you make less then the poverty guidelines as well as in the mean time have your fiance look for a second part time job so that way when it comes time for the interview, he already has a part time job and have some sort of means of income. they just want proof that you are on track to having sustained income...they just want to make sure that you are well supported by your future husband.

@nate....your bro and/or fiance can go and speak to a CO about the disposition....not necessary for petitioner to be present but it help me in my situation....i didnt even honestly know if i could go or not...coz that letter of disposition was in her name but i went with her anyway and they didnt mind at all. im not saying your brother HAS to be there but i can tell you, it helps ALOT...i didnt even have the extra finance to actually go back home to the philippines on such short notice but i love my girl, will do anything and everything in this world to be together...im sure everyone feels the same way. good luck guys and wish your family and everyone out there the best, for those who are awaiting a visa...stay strong and have faith, dont stress to much and always have a smile on your face =) everything will be alright....all i can say is WHAT A "VISA JOURNEY" FOR ME & MY WIFE! lol.

hi nate. i was in the same position as your bro. i am currently here in the philippines. we went to the embassy because my fiance had the same letter of denial. i made less then the minimum poverty guidelines and even had my parents co sponser....they did not take it. they dont usually allow CO SPONSORs for any k1 visa....but then again it depends on each person and the circumstances...in my case i am 24 years old, just my luck because at 24 years and above, they will not consider even looking at my co sponser paperwork regardless how many times we mentioned or showed it in their face but if you are under 24....they MAY acknowledge it, they dont have to...ultimately its up to the lucky consular that you are placed with to decide. sad to say but its in their hands. thats what the consular told me....straight from the US embassy of MANILA... anyways...this has been a hectic ride for me and for my fiance....WHAT A NIGHTMARE.

nate, all i can tell you is if your bro can go to the philippines for that dispostion of the case on the date stamped on there TELL HIM TO GO. you know what the CO told me? he didnt know i was coming....he interviewed me. i told him everything. my situation here, why i didnt make the income last year on my tax return...i told him. i lived with my parents in hawaii up till june 2009. i was a full time student there. worked only part-time so i only made $12,000. i graduated in june 2009 with my associates degree. i told him i moved to out and moved to washington state (thats where i live now). im independent. i establised residency here, i live by myself, no relative. i have 2 jobs, one part-time and one fulltime. i did not give him the chance to speak ( the CO) i was overwhelmed. (its good to show them how you feel)...the CO couldnt even say anything after i was done talking. i just tried my best to tell him how i felt. how much it hurt when they denied her visa. i told the CO, "through all this, i know we are nothing special, we are just like everyone else. we want to be together....i cant sleep, eat or do anything anymore....after reading the denial letter....im so stressed, crying at work....it has been tough....all we want is to be together and i will do my best to support her the best i can.....if you dont want to approve us now...i want you to marry us! the CO just sat there. he said you know what bryant, i want you to enjoy this "sudden" vacation, get some rest, you look tired, everything will be ok.........i approve this.......

have faith.....whats meant to be will find its way...... i know how your bro feels........i am thankful for that CO for reconsidering despite the fact that he could have easily denied us for good.......the CO did not expect me to be there, they thought just my fiance, since the CO was dealing with her from the start...the CO even said that it was good that i was present, he now fully understands our situation and he openly admitted that this is the one of the number one reasons why they deny many many k1 visa....not enough sustained income...and people always assume that they can use a co sponsor but they usually dont. it ultimately depends on the consular dealing with your case.
ULTIMATELY depends on the consular BUT:

24 years of age & older petitioner ==== no secondary sponsor, no ifs, buts, why, who, what...etc.

23 years of age and under ------ may considor secondary (more likely if you are in college, not a guarantee (DEPENDS ON THE CO HANDELING YOUR CASE)

Hi! Sherryl, Initially during the first interview the consul told me that he could not give me a visa coz of the tax return where my fiance declared a loss on his business. So he returned my passport. However they gave me a white paper which required me to submit the original affidavit of support coz I guess what I had submitted was the photocopy. The letter that was sent by the embassy was sent on a registerd mail. That was after I submitted the affidavit of support and his employment certificate , and other docs of his income source. It says that I need to call the embassy or appear on a specified date and time so the Consul could discuss why they can't give me visa. BUT it turned out otherwise. When I got to talk to the consul, I went there with my fiance who is my husband now, He just asked us when do we plan to get married and that's it. My Visa was approved. I was given a pink slip - to go and and pay for the delivery of my visa. You only pay AIR 21 for the delivery of your visa. When your application for visa is denied , they will return all your docs,your passport and they will tell you the reason why they can't issue you a visa. So you will resolve whatever needs to be done. Good Luck! By the way we got married on July 10.

& sherryl; magmay is right on target. the only time you'll need to pay for anything is when the visa is approved. i hope they got your address right coz its been awhile now and you havent got word of anything. if push comes to shove, i recommend going back to the embassy physically, if possible to settle this. my fiances mother got the letter for her when they carrier dropped it off, do you live with family? and like i said if you recieve the dreaded letter of denial, have your fiance with you when you go for the "disposition" if you can, not saying you need to but it helps alot, but then again lets hope you dont have to go through what magmay and i did, lets hope you get that VISA as smooth as k1member. take care. keep us posted.

tnx sherryl...i know you and your fiance must be frustrated too...dont lose hope....if anything honestly i dont see why they are still denying you guys....your husband makes alot of money, i only make half what he makes!!! your husband is a realtor, what do they expect...i dont even know the in depth details of that job but it is common sense to know that the market is always unstable in the realtor world....but anyway dont worry too much ok. keep your head up...we both know how picky they are, manila embassy is one of the most strictest....and they are so frustrating too...especially if you get the picky CO....

it took us about 2 weeks till we got a response from when we submitted the so called required proof of more evidence of sustained income....the CO that initially interviewed my fiancee made it seem like we already got approved (hence, the last post from here stating we were waiting in the mail). they claimed it would take 3 business days if the "outcome-visa/no visa letter" is mailed in manila OR 7-10 business days if mailed to the province (anywhere but manila). we had ours mailed to the province since my fiance lives in the province.

and thats when we got that dreadful letter stating the denial...."likely to become public charge" and to go to the embassy at a stamped date to discuss why the CO did not approve it.

i encourage you and your fiance to go, that way you can explain to them your particular situation....even the consular stated that it was good i was there coz he even said himself that after hearing what i had to say....he was convinced that i was more then capable of supporting my future wife....he stated that what matters is now....our current situation and my current situation back in the states. he told me that if i was not there to state my side, they would have outright denied her the visa....tnk goodness the CO that finalized everything was very understanding. my fiance told me that previous to that when i was not in the philippines, her previous encounters with them were ridiculous...

Hi! Bmagno23, Me and my fiance have gone through what you were experiencing right now.My fiance declared loss in his tax return due to loss in his business.During my interview CO said he can't give me visa coz my fiance's income is not enough to support me.But I was given this white paper asking for my fiance's original affidavit of support.When I submitted the affidavit,I also attached his certificate of employment.After two weeks I got I a letter from them,saying that I will not be granted a visa due to inadequate financial support and if I wanted to discuss the matter , a date was given for the disposition of my case by the CO.Don't you think mine is more stressful? Don't loose hope. What you need to do is get a certification from your employer of your year do date income.That's what the embassy needs.To show them a proof that you have ongoing income that will support you and your fiancee when she comes over eventually. By the way during the disposition , i went to the embassy with my fiance.the CO said "Everything's solved". No questions whatsoever about my fiance's finances.We were able to get the PINK SLIP. I am sure you will get it too.


congratulations to you, my fiance finally went to on monday to the embassy to give them what they needed. i had prepared for her tax transcripts dating back since 2006, paystubs (a whole lot of it!....12 pages if i recall), diploma and even a statement letter from me stating why i had made less then the poverty guidelines from 2009 tax return. i also had prepared my current bank statement, plus my part-time job verification letter and paystubs and last but not least the w2 from 2009 (most current).

come to find out all they took from all of that was my paystubs from my fulltime job, current bank statement, my partime job verification and paystubs from that, my letter statement to them and the w2 from 2009. thats what they said was more then sufficient as evidence of sustained income.
they saw my diploma but said they didnt need it as well as the tax transcripts since 2006. they already had a copy of my w2 from 2009 but took this other one anyway...the new reviewer told my fiance that the initial reviewer overlooked it, can you believe that?

this time they took her passport from her and stated to her that a authroized air carrier will bring it to her with the visa.
they told us to wait 7-10 days. we are waiting.

well i am getting paid 11.00 per hour and am fulltime so 11X2080(min.annual amount of hours as fulltime) = $22880, to meet the poverty guidelines i only need $18000...well here in the us anyway...its not much of a job but at least i have something. when i was working part-time i only had $11,000 annual gross income.

i wrote a letter as well as am sending via email for my fiance to print and give them to the embassy 10 copies of my paystubs and tax transcripts and a copy of my college diploma. in the short letter i explained why i was not making enough income, how i was only working parttime and was a full time student and that i was living with my parents too. i wrote that now i have a fulltime job and am independently supporting myself now that i graduated from college. I hope that they will accept it. I have my college diploma and they will see that so im sure that it would make sense why my income was low and because i have that diploma for them to see they will know that i am educated and would be able to support her. i hope they accept it, i really hope so.

Well all of the documents on my end are now on their way to my fiancé in Sharjah via DHL. A bit spendy, but hey, she's worth it! :D I decided it would be worth the peace of mind being able to track the documents and feel secure they will be delivered since it took excessively long for her to receive two Christmas cards I sent in December via regular United States Postal Service. (Of course when I called her today let her know our papers had been sent via DHL she let me know the two missing cards had finally arrived. :lol: )

Anyway, the interview is fast approaching, February 12th. She has her medical and immunizations planned for February 1st. And the only document she is waiting on is her birth certificate, which her sister still in the Philippines ordered for her, so not too worried. Everything seems to be coming together nicely! :thumbs:

I was also worried about her not getting it on time or at all. What i did is was i mail 2 copies. One I send United States Postal Service or the other UPS.

I have never lost anything by using USPS, but sure i wanted too be sure she got it on time. Sure during Christmas time it was slow, the first card i sent her on Dec 1st arrived 12 days later, the 2nd card and gift was send later arriving after new years.

I never used UPS before, but i am glad i didnt. UPS was $73 bucks :blink:

How much was DHL?

She has scanned copies of everything which should at least be usable to get through the interview. I imagine they could insist on new originals of the forms such as the I-134 which I have before releasing a visa though. I don't even want to consider that happening though!

DS-156 and DS-156K are two very different forms, and both are linked from the main page. Very good advice to print 4 or 5 copies of your completed DS-156. Actually make extra's of everything so you, your fiance and the consulate can all have originally signed copies of all forms asked for.

The Abu Dhabi Embassy sent us several forms, most of which were actually expired! You can never go wrong getting the most up to date forms from the above link. And typing out the forms, especially the bar coded DS-156 could save a lot of hassles down the road with things being far more legible.

DS-157 and in our case and perhaps yours, so is DS-230.

The denial at POE discussion is a bit off the topic posted by the OP. I know that I won't be comfortable, or feel like we are home free until J actually gets her citizenship... Getting her past the POE and actually here will be far more comfortable than our current status of waiting for her interview, which is slightly better than awaiting approval of our original petition only in as much as our wait has an end date, the date of her interview.

But the original post regarded a petitioner's suspicion that his fiancé had gone through the entire process, passed the interview, now has a K-1 visa in hand, but is not yet here in the USA... The fiancé has said or done something not mentioned by the OP but he suspects he was duped and used, and that his fiancé no longer has any plans to use the visa to come here and marry him.

I am not an expert, but stick by my post that I would be writing immediately, perhaps by email to the embassy which approved the visa, and to the Department of State. Here is what I gathered from searching the DOS website:

N7 Termination of a K Visa Petition Approval

BCIS regulations, 8 CFR 214.2(k), provide that the death of a petitioner or written withdrawal of the petition prior to the arrival of the beneficiary in the United States automatically terminates the approval of the petition. The consular officer should return the petition to the approving BCIS office with an appropriate memorandum.

Obviously it is a bit more complicated in this case, since the beneficiary has apparently gotten the visa, but it does sound like she has NOT gotten into the US yet. So again, my advice is email the embassy ASAP and probably the Department of State, the USCIS service center you filed with, and NVC as well, and lay out everything that has occurred to cause you to feel the K-1 visa was issued to someone who's sole intent was to use it to get into the United States. And notify them you no longer support the petition, nor do you intend to marry her. The K-1 is a very specific visa, and requires the petitioner to be willing to marry the beneficiary at every step in the process. Then mail off certified letters to all of the above.

You have nothing to lose if you truly no longer believe you will marry this person, and should put your unwillingness to marry this person in writing. ASAP. Emailing would be the quickest way to get the ball rolling on preventing her from entering the country, and be WRITTEN notice you no longer intend to marry her.

IF this advice is wrong as to how to go about properly notification of your intent, or potential fraud on the part of your beneficiary, then one of the four agencies you notified will quickly direct you to the proper channels, and/or do so themselves.

I do not claim to be any sort of expert. I am merely someone who has had the good fortune to find a truly wonderful woman, who happens to be a citizen of another country so we are forced to go through this process... Every step of the way feels like it has the risk of problems, from minor bumps to major disaster. While there is, of course, some risk of a fiancé being turned away at POE, I think the likelihood is low enough that it should be just another of the lower level worries along this stressful journey. J and I are going through this because we love each other and greatly desire to spend the rest of our lives together.

I suggest everyone going through the fiancé visa process choose to always remain hopeful about the ultimate outcome. But be as careful as you can submitting the proper paperwork and documentation, knowing you can and will make some mistakes along the way. From there the whole thing is out of your hands. At every step the USCIS adjudicator, consular officer, and immigration officer at the point of entry, all possess sweeping powers to delay or prevent your dream from becoming reality. Still, your chances of success improve at every stage. Be hopeful!

Advice from other members here can be very helpful, but every case is different, and all suggestions from others, even based on their own personal experience should be taken with a grain of salt.

Thanks! I had sworn I had read of such things happening, just couldn't locate posts to that effect. Hopefully she gets her new copy in time, and probably will, but of course it is a bit of a worry. Pretty major document to not have!

I am curious if there are any veterans out there with advice. My fiancé had her sister still in the Philippines obtain a copy of her birth certificate for her. It was put in the mail November 25th, and at this point we fear it has been lost somewhere along the line...

Assuming a worst case scenario, and her back up plan (getting a new one applied for and sent to her ASAP, which is now in the works) fails to get a second birth certificate to her prior to her interview February 12th, my thought is that with EVERYTHING ELSE in order and all other documents accounted for, the interview would still take place and she would receive a form saying she will get her visa after the embassy gets a copy of her birth certificate?

I am not suggesting anyone guarantee our application will be granted, but merely hoping someone will tell us the interview will occur despite the missing document instead of preventing the interview from taking place.

Could use Aussiewench, William33 or another VJ veteran to help ease our minds here. Thanks!

I did the bank letter a couple weeks ago. My bank is small, but they took it in stride, and an assistant manager asked what information I wanted the letter to provide and she made me three originals on the spot. Easy!

Your monthly bank statement likely includes a bunch of garbage you don't want to share, such as your $120 month double mocha late habit, so why provide that? It also is not likely to include the date your account opened, nor monthly tally your yearly deposit totals. So just head to the bank and ask for a simple letter with the information your embassy/consulate is requesting.

For the employer letter, same deal. Just ask your boss, supervisor, or whomever is above you qualified for a simple letter giving the information asked for. It makes a brief paragraph for him/her to sign. If you know the information, perhaps even type it up for them and have them print it out if they approve on company letterhead for signing. (I didn't think to at the time, so only had my boss make one original, ask for three. One for you, one for your fiance, and one to turn in along with your I-134 which I did get three notarized originals of.)

The sample letter in the guides here will give you the best answers for all of the I-134 questions.

Has anyone ever been asked, during the interview, to open their email account so the consular officer can look through the account for whatever reason?

Seems incredible to me, and an invasion of privacy. But my fiance says she has heard of this occuring at interviews in the Manila embassy. Has it happened to anyone any other consulates or embassies?

Seems like if they thought a fiance was a security risk, they would likely invade the email account with some sort of covert CIA type under cover investigation...

These and other thoughts going through our minds awaiting our interview and trying to anticipate what will occur in the dank halls of the Abu Dhabi Embassy... :lol:

We have some older emails, and have read about it being proper to black out personal parts when you print them up for inclusion in your interview documentation, if you think you don't want to share certain things. This is why we are asking.

Well when J gets up today, she will be on her way to Abu Dhabi with her sister. Everything is in place, all the forms, all the documentation, and most of the waiting... Fifty and a half hours till interview!

Mife called me,they have to return on Friday with some type of new birth certificate :angry: ,she already have original birth certificates but they want the new ones.why didn't they let us know before the interview :huh: . any way she said they fingerprinted her and had her sign some forms and she also noticed my son's paperwork stamped APPROVED.I'm so mad :protest: :ranting: but i guess as soon as she gets everything we will be ok.


Well the delay is a bummer, but it sounds like things will work out just fine for you three. CONGRATULATIONS!!! :dance:

I just got a call from my fiance, she is done with her interview in Abu Dhabi. Two and a half hours, no details as of yet beyond the fact that she has been approved for K-1 visa and will be picking it up Wednesday afternoon...
