You guys are so lucky!! I want to go to Mexico! So bad!! I did call Puerto Rico and it will take more than 6 weeks to get my certified copy. I wasn't able to get one here in Washington state sad.gif. OMG, please don't send your passport! Just copy all the pages and mail that with your birth certificate. At least it's easy and cheap to get another copy of your birth certificate, but with your passport... you gotta treat your passport the way you treat your SSN... ohmy.gif

I KNOW!!!!!!!!!! crying.gif crying.gif I don't want to send anything but I just keep getting told that he has to have ALL originals, even passport and certificate. I asked the dude if a copy of passport is fine, he said "no ma'am it has to be original."

Ok. Thanks! But I am still confoozled. What I have in my hands is my real birth certificate. I was born in Puerto Rico so I don't want to ask for a certified copy from Puerto Rico so it can cause weeks for me to receive it. Can I take my real birth certificate to the court house in my home town and they can provide me with a certified copy? I'm not really understanding the difference between certified and notarized wacko.gif Maybe that's why I am so confused.

hello again! Ok about the birth certificate~~~~ My supervisor is a notary, can she notarize a GOOD QUALITY copy of my birth certificate, and is that considered a certified copy? Will that be just as good? Also, along with the I 184 affidavit of support, should I include a notarized letter from my supervisor stating that I make over poverty level?

OOH ANother thing!! I am so excited because I may have found an apartment and MAY move sept 1. IF the landlord is willing to wait til then. I hope so! They have a pool and gymnasium and it is very private and beautiful. It's running at 750 but I think we'll be ok with that amount. I'm excited!!!!!

Hello-I sent jorge a very nice color copy of my Birth Certificate and a blown up color copy of my pass port with the stamp of when I went to MX to visit him. Do you guys think that will be sufficient enough for him to take to the interview? (along with all the other forms). I ask this because I will most likely not be attending the interview with him, and I do not want to send him the originals because I am afraid it will get stolen or lost. Will this risk our chances? Please give me a straight forward answer smile.gif

Also... how much money should he take with him for the medical and the interview? I'm also confused about something I have read before about paying for the visa in advance? Can someone explain that to me? I don't understand it wacko.gif

I called CDJ today and talked to a very nice man. He told me that they had our case, and that they've had it for less than a week. SOOOOOOO The guy was trying to avoid telling me how long it would take for us to get a Packet 3. He was very hesitant. I'm guessing because it varies so much on a case by case basis. Well, after asking 4 different ways, he finally said it could take 2-3 months laughing.gif The poor guy felt bad, I'm sure, because he didn't want to tell me an answer that he wasn't certain on. Anywho... so I'm not going to beleive that because I know it was a ball park answer. He also told me that the applicant (jorge/beneficiary) is the one who actually receives the packet, not me. OK *sigh* Well, what do you guys think? I confirmed that Jorge will not need an interview appointment, and that he needs to go to the medical at least 1-2 days prior to the interview, which I already knew of. I also asked him if I could use the applications for the fiance packet on the website, he said that would be fine, but that he wouldn't recommend me fill them out until we receive the packet because each consulate may have different information from us. Well... Just wanted to share my story.

Hello again! And hello CAITY! How is your vacation with your hubby? Are you having a great time? innocent.gif
I would like to start preparing for the interview.... It seems that NVC has shipped our case to CDJ (not 100% sure- I used the DHL website from another forum) ANYWAYS! tongue.gif After CDJ Receives my petition...how long after that will Jorge receive the packet. Another question...I talked to this woman lady who "helped" us at the beginning, and she told me that I'm the one who receives the packet, not him..... and that i HAVE to go to mexico. I'm probably going to end up going after all... on another (k1) forum, they keep telling me that I don't HAVE to go and that he does receive the packet. I just wanted to hear your guys' opinion as well. I am getting very excited but I keep looking at people's timelines from the past and it looks like it takes a month for him to get the packet after CDJ receives it? On several it was about 2 weeks. Does anyone have an estimate? I was hoping it would be like 1-2 weeks headbonk.gif

So far the only thing I KNOW i have to prepare is:

Fiancée Packet
Fee Information, form CDJ 446

Instructions, form CDJ 400
Statement of Intent to Marry, form CDJ 402

Form DS-156K

Form CDJ 430
Medical Examination Instructions, form Mexwide 202 K

Public Charge Information, form OF-167

I copied/pasted that from the website.

is there anything I am missing? I think my affidavit of support? But anything else?

Thanks everybody!!!!! I appreciate any input.

It's for two people because you'll be a two-person household. If you're borderline and don't have any assets, you might think about getting a co-sponsor.

My fiancee makes well over the 2 person household income - what do you mean by assets as she does not have a house, stock etc?

US Embassy and Consulate Discussion125% poverty line question
Ive done a search but can't seem to find the answer.

We've just got our NOA2 so naturally we're now going through the next stage - just a quick question though if anyone could answer it would be great!

We've checked up on the national poverty line and we are slightly confused - should we be looking up the line for 2 people in the household (me and her, we're not currently living together obviously as im in a diffrent country tongue.gif) or just for one person? The form on the uscis website http://www.uscis.gov...form/I-864P.pdf only lists for 2 people so which one should we use? If it is for one person household does anyone know where we could get these figures from for the 125%?

Thanks so much,

Mike

US Embassy and Consulate Discussioni-134 affidavit of support question

London will accept your argument about "current income" Use employer letters and pay stubs to show this. The employer letters should include a start date, so that will help explain any discrepancies.

You will want to have your TAX TRANSCRIPT for the most recent tax year as well, as they are used to seeing that there. If you order your 2008 one from the IRS (it's free) there is no scramble to collect W-2s and such.

If your interview is during or after April, then they will want to see the 2009 tax return, so just make sure you keep it all together in a folder when you file.

Awesome, thanks for that!

I think many people's tax transcripts from previous years are not the same as what they are currently earning. I included the 3 prior years of tax transcripts, several paystubs (and I emailed the last one right before his interview), to show current weekly/YTD pay. Also the letter from my employer also stating what I earn each week. Send everything, especially since you have already listed previous job history already. The current stuff shows what you are currently earning.

11:00pm and im running around unable to sleep.. trying to remember/figure out what jobs i had when and find the matching w2s.. thanks ill send him all that info.. my worry is the difference in pay from my current w2 to what my employers say i will make "this year"

Hello again!

As we're approching the final stage we're going through the last bits including whats expected at the interview. As my finance works two jobs she has sent me 6x paystubs from one employer, 4x paystubs from the other. We have letters from both employers stating what her salary is. We would include the W2 from 2009 however as she was in diffrent employment during the majority of 2009 which did not cover the poverty guidelines we have not included this. She is of course earning well beyond the guideline needed now, which is what the paystubs and letters show.. will this be enough evidence? Should we include the w2 regardless as this will contradict what she is currently earning?

Thanks for all your advice, i appreciate your help.
By May this year we should have around $5,000 saved. If i have that much in my savings account, would that help my case at all? With my fiances help I could have that much money saved, the only issue is I dont earn over the poverty line a year, but if I had that much saved would that change the cirumstances at all? Would they be more willingly to approve it, if I had that money saved?

I just want to make sure you know you need 125% of the poverty line, my fiance and i are going through the same thing you are.. i make enough now.. but last year i did not..so we are trying to figure out whats needed.. but you have to make about 19,000$ a year to be above the poverty line ( thats just a rounded number there is a site to find the actual amount)

We're sending Packet 3 back to London tomorrow. I wrote N/A (K1 visa process for permanent residence) for both myself and my cosponsor. I've done a little research and it sounds like it should be fine.

thanks everyone i sent out all of the paperwork last week, we did as you said and wrote the na k1 visa process for permanent residence for both mine and my moms paperwork, also we put that my dad was partially dependant, not sure but thats what we found would be the best, sometimes these paperwork just are as confusing as a rubix cube, so many different answers and ways to do it, and not everyone is in the same situation, now its just sit and wait for the interview

Yeah we just arent sure accoring to

"Write the names of dependents that you include in your income tax
returns. These will usually be your spouse and minor children. If your
spouse is not working you can check 'wholly dependant'. If your spouse
is working you can check 'partially dependent'."

It also says that she should also write N/A ( K1 visa process for
permanent residence ) as you did on your I-134 for question 11. As for
the tick box I think she should just tick intend.

see to me my father is not a dependent (over 18) but with this visa stuff everything seems to be backwards from normal thought process, and no one seems to be going through the same situation,

US Embassy and Consulate DiscussionI-134 Co-sponsor question

This is something I've recently come to actually. With question 11 I was thinking that the co-sponsor would check yes, and write something like "I plan to financially support the beneficiary of this fiance visa should this assistance be required in order to prevent her from becoming a public charge." where as I'd write that I plan to support her indefinitely and marry her within 90 days of her entering the country on the K-1.

I think the "Dependent" is if there's any one that the co-sponsor claims as a dependent on their taxes. I'm not 100% sure if that's correct though, but does make sense. Hope this helps some.

-J

Thanks for your help, it helps a little for the question 11, the question 8 has us baffled a bit, since my mom (not my mom and dad) is sponsoring us, my father and her file their taxes jointly, my brothers and I are all over 18 there for not dependents, and my father is not one either, thus we are confused on whether he has to be put as a dependent (cause he lives in the household and is included in the 125% above poverty)

Just as a follow up question as I can't edit, On question 8 for the co-sponsor would they be required to put down that they support anyone in their household, i.e husband. Her parents both work, no kids left at home, just the "dependant" part threw me as I would imagine that would be for younger kids/under 18's etc.

US Embassy and Consulate DiscussionI-134 Co-sponsor question
Hi guys,

For various reasons we've had to get my finance's mother to Co-sponsor for us, however for question 11 - I intend/Do not intend to make specific contributions to support the person(s) named in item 3 - we're unsure whether we should get them to tick the intend, or do not intend box. My US finance is ticking the intend box, and writing N/A (K1 visa process for permanent residence) underneath as the guide shows - does the Co-sponsor need to do exactly the same even though they won't be directly financially aiding me (unless of course my soon to be wife loses her job etc).

Has anyone else who've gone through this route using the embassy in London had a similar situation?

Thanks

BE THERE at the interview, even if you are on your deathbed.

While this is really good advice for some embassy's, it's not as necessary for others.
For example, I've never heard of an Irish applicant being asked to have their FI there.

As the OP plans on going anyway, it's not as big an issue in this case, but other people with interviews coming up, should check their local boards to see if request for the USC to attend are common.

It's also my understanding that in many cases, you're not allowed anywhere near the interview anyway. What good does it do except maybe to provide some emotional support to your fiancee' before the interview? I wasn't at my fiancee's interview. To do so would have required 20 hours of flying (just one way), just so I could be there for a day, and then return.

Am I wrong in this, or do we need to have the I-134 and all of the supporting evidence for it ready for the interview state before we get his Visa?
Thank you.

No, this has to be submitted when your fiance has his interview. During his AOS he will be submitting another set of documents and I think that is the 1-864 if I am correct. I am a K-1 petitioner as well and currently preparing my affidavit of support so my fiance can have it at his interview. So, you need to have the 1-134 and supporting documents ready during the interview. I would check out the embassy website for what is required for the support. Usually, an employment letter is required and paystubs.

US Embassy and Consulate DiscussionMedical Exam Snag
Just a little bit of background...
About 5 years ago, my fiance was into self harming (he was a cutter). After a visit to his GP and some other help, he stopped, and hasn't done it in about 4 years. However, it is on his medical record from having seen his GP. So, on the medical questionnaire, when it asks "Have you ever caused harm to yourself or others?" he marked yes, so as to be as honest as possible, and wrote a brief explanation regarding the situation.
So when he had his medical exam today, they questioned him on it. Now they want him to take a form to his GP to have them sign it to state that he is not going to need any psychiatric help in the future. Until he gets that form back to them, they won't send his medical results to the Embassy.
He called his GP immediately and they stated that they could not get him in until November 27th. I advised him to call the Knightsbridge doctors and let them know it was going to be a couple weeks.
I didn't think it was really going to be a problem as he no longer does it, and hasn't in some time. Anyone else hear about something like that causing issues? Otherwise, his exam was fine and all of his vaccinations were in order.
Are there any additional steps we should take except for notifying Knightsbridge that it will be a couple of weeks?
Thanks everyone.

was in the same situation but im sure you are not dealing with the MANILA embassy in the philippines coz they dont accept secondary sponsership or joint sponsorship. its good to explain the reason why you make less then the poverty guidelines as well as in the mean time have your fiance look for a second part time job so that way when it comes time for the interview, he already has a part time job and have some sort of means of income. they just want proof that you are on track to having sustained income...they just want to make sure that you are well supported by your future husband.
