I'm wondering if my 5 year old son who's father is a US Citizen can obtain citizenship before we do AOS after my boyfriend and I are getting married next year...
The "problem" is that even though my son's biological father is on my boy's birth certificate,he refuses to sign any papers.
A German Court has ordered him to pay Child Support and proved that he is the father of my son.Yet as far as I can tel,the German Court Papers aren't worth the paper they're on.
He does not pay Child Support,nor has he signed anything(except for receiving the papers and since he never filed anything against the German Court Orders he accepted them).
Can my son obtain the US Citizenship or not?
I know he could if his biological father would sign the papers,but he doesn't and wont do so in the future since if he would he would agree to pay Child Support.
Are the German Court Papers valid in the US? There has not been a DNA or Paternity test since the biological father agreed to the Court Orders when he didn't do anything against them.(He was given 3 months to do so but never did say that he's not the father and also didn't reject the paperwork that was sent to him).
I will go through the Texas General Attorney to finally get him to pay Child Support once we are in the US and have settled in,but I would like to know whether my son has to do all the AOS stuff r not.

Ok it looks like my cousin got himself in quite some trouble...
He went to the US at age 8 in 1991 with his mother.Got his 10 year Green Card in 1994,was married to a US Citizen for a while and got divorced.He has two young daughters (of course US Citizens ) in the USA.
Come to find out now ,after his 10 year Green Card expired in January 2004 he didn't do anything to renew it or become a Citizen!
What is the legal situation now? Can he be deported? Is he out of Status? Does he have to do anything in order to get that situation straight? His father is NOT a US Citizen and his stepfather who is never id adopt him.
Please,if someone can give us helpful information do so as my cousin wants to get married on August 17th and that issue is hanging over the couple now.Unfortunatley my cousin thought that he automatically becomes a US Citizen after 10 years.....

I don't have the money for a lawyer and I don't want my son to keep the German Citizenship anyways since number one he would HAVE to serve in the German Army and number 2 I plan on spending the rest of my life with my soon to be husband and will not come back to Germany.I don't have any close family or friends here anymore anyway.
His biological father never signed the paperwork for my sons Citizenship bc if he would have signed it he wuld have agreed to pay Child Support which obviously he is NOT willing to do.
So thats why my man and I have decided to sue him once all our paperwork in the US (as far as Immigration is concerned) is done.
I know Ray will become a US Citizen anyway once I get my Citizenship,it would just have been nice if it would have been possible to let him have it without having to wait for years to come.
But that issue is not worth throwing money for a lawyer out of the window.
Like I said he will get the Citizenship when I get it and his "father" will sooner or later be forced by Court to pay Child Support for my son.
I just hope he denies being the father bc then everyone will see what a darn liar that guy is when they (finally! Germans wouldn't do it saying there was enough evidence of him being the biological father) do a DNA test.
He's well known for putting kids into the world and not wanting to support them in any way at all.
Actually last I heared he can't even leave the State of Texas right now since he kept not making his Child Support payments for his oldest two kids and the ex took him to Court all over again.

OK got a quick question here.
I want to take on the American Citizenship once all our paperwork is done and we waited the I think 3 years afetr the AOS stamp.
Now my question is,
does my sons German passport still have to be valid when we go for the citizenship?
He is 5 1/2 right now and his passport will expire in November of 2010.
We will put our I 129 F in by November 1st of this year and will hopefully be in the US by May 2007,file for AOS by about August 2007........so most likeley his German passport will have expired by the time I can get my Citizenship (and there for his as well).
My hubby to be is NOT my sons biological father,still my boys real "father2 IS indeed a US Citizen living in Texas.
He so far refuses to sign any papers as far as Child Support and Citizenship goes.
(we went to a German Court and they sentenced him to pay Child Support but it's not enforcable from here and I doubt the German Court Papers are worth anything at all in the US,though after that court thing he WAS put on my sons BC ,so yes on my sons Birth Certificate IS the US Citizen "Fathers" name.)
We will sue his Father for Child Support once we are in the US,going through the Texas General Attorney since the man owes me already 5 1/2 years of Child Support and really doesn't have any financial problems so paying wont hurt him or my sons sister (not my child so his half sister).
Does anyone know whether there is any way at all that my son could get the US Citizenship (and drop the German one) before we can obtain Citizenship after AOS (3 years after AOS I know).???

OK so now I finally got the paperwork I needed to file the N 600 (Certificate of Ctizenship based on US Citizen Father)......does anyone on here now how long that takes at the Yakima Sub Office in WA ?? Anybody who has filed the N 600 for their kid is more tha welcome to respond !!

Have you consulted anyone regarding your son's citizenship? The fact that your son's biological father was a USC at the time of his birth, and that he fulfilled the residency requirements does not automatically confer USC to your son. In order to pass citizenship, the biological father must also (a) agree in writing to provide financial support until your son is 18, and (2) your son must be legitimated or paternity is acknowledged in writing under oath or paternity is established by a court by adjudication. Can you clarify if these requirements have been met?

Yes seeing that we have a case against the bio father with the WA Division of Child Support and that I have Court Papers that establish Paternity AND Child Support.
Also we had an Info Pass appointment at the Seattle USCIS Office and we were told that as long as we can provide a copy of the Court Papers,the bio father's Birth Certificate,proof of him being obligated to financially support the child and a case against him to enforce this pending, plus an Affidavit from someone who states under oath that the bio father has fullfilled the residency requirements we should be fine.

I have the Court Papers,proof from the WA Child Support Enforcement Officer that the case is pending and the Court Papers are valid and accepted,his father (my son's bio Grandfather ) sent me a Birth Certificate and the sworn and notorized Affidavit regarding the bio father's residency in the USA.

Trust me I don't have too much money . Filing the N 600 is not cheap and that's why we had an Info Pass to check WHAT we need to file.

if anyone who reads this has filed for an N 600 for their foreign born Child PLEASE get in touch with me.
My son was born in Germany,his Birth never was registered at the US Consulate in Germany because I have never been married to his bio Dad and bio Dad refused to sign the Consulate Papers to register birth abroad because he would have also signed to financially support his child which of course (yeah I am being sarcastic) he didn't want to do.
So to cut it short, I came to the US with my son on a K1,K2 Visa in January last year.Both of us are now Conditional Residents since October 20,2009 and we filed for his N 600 Certificate of Citizenship
(because bio Dad is a US Citizen who full fills the residency requirments so since my son was born before 2/28/2001 -actually he was born 02/04/2001 ha ha he is a US Citizen by birth due to bio Dad's Citizenship) this March.
Now we moved and I called USCIS yesterday to change our Address and they told me that there is NO NoA 1 for the N 600 at all ??
Never heared of that as that would also mean that if I don't have any receipt from them I can't check the Case Status at all.
Anybody out there who has any idea about the N 600 Process ???? We filed at the Yakima WA sub office by the way.

Hi,
we sent my son's N 600 and got an RFE on 03/24/2010 regarding proof of the father's physical presence in the USA.We obtained that proof and sent the Paperwork they requested the day before yesterday.
How long does it usually take for the USCIS to complete /approve an Application after you sent them the requested Evidence ?
We never got an RFE for anything so far so I have no earthly idea.
Our Field Office is Yakima Washington for the N 600.
Any Info???

Filed based on the child's USC Father.
Has anyone filed recently and with what what experience ?

A co-worker has a wife from England. She'd been here over 12 years IIRC, teenage kid together, working. But a couple years after 9-11 she found a notice to appear in the mail. She had to provide records she had thrown away of something... I think a birth certificate had been lost???

Anyway, it was a big hassle, time lost from work, almost lost job, family in England lost time too digging for docs. His wife was not deported in the end.

Her Thai birth certificate was lost and her document in lieu of BC was questioned. The Thai government said they don't care if America doesn't like it. :whistle:
We were going for a 2 year card at first, but after all the delays she ended up with a 10 year card!

We want to move to Thailand as soon as possible and need to learn of options, if any. Can't afford to fly the family back every year.

We're relocating to Thailand. Is my understanding right?...

My wife needs to be in the US 5 years for citizenship. But we can travel if she returns every 6 months and submits a form(#?) stating she hasn't given up her application to become a citizen.

Her Permanent Residence Card says, Resident Since 09/10/09 and it Expires 09/17/19.
We were legally married in Thailand in Sept. 2007.
She got here July 16, 2008.

We want to live in Thailand, possibly permanently, and not travel back if possible. Yet we want to maintain her PR Card and get her citizenship in case we need to return to the USA.

Any advice appreciated.

Update: The 120-days have been passed, and I have gone through the InfoPass at USCIS local office. Then they sent me to citizenship interview room, and one of the officer talked to me and gave me an answer with "Consolidation of file, review of a file, completion of all background checks". The officer also told me to wait another 1-2 months for decision.

What should I do?? Ask my U.S Representative for help? Should I sue them by Manda by filling a mandamus petition?

I've asked my Representative to have his USCIS liazon check on my case before. He couldn't change things but when we did present results of our attempt to fulfill an impossible request, everything went fine. In fact, the delay gave us a 10 year PR card instead.

I imagine you would not make enemies by asking your Representative or Senator's office to check on it for you.

Not so sure about suing.

To the best of my knowledge, passport pictures you can have earrings. Visa pictures, you cannot. It also depends on the country as well.

hi sandrajustin. what we did was i filled the i-134 (affidavit of support) and my parents filled the i-134 too. im sure your place is a lot less strict then south asia because the manila embassy didnt even acknowledge my joint sponser (my parents). tnk you and i wish you the best of luck too!!! =)

yes pushbrk, i dont know what they still need the evidence of the sustained income from me when i dont even qualify to begin with, there has to be an option where they accept my joint sponsor, i know i am not the only one in this situation, there are many out there that may need the joint sponsor too. they cant just deny us after all that we have done...if they only wanted the petitioners to be able to only petition with out the joint sponsor then they should have made that clear to begin with and i know that i may be below the poverty income now but they should know that times can change and i am most certaint that once she is here, i will do my best to support her through loving her unconditionally as i haved since we met and financially. i hope they will accept the supporting documents (tax papers, paystubs, bank statements) on monday and we will go from there. i just want this to be done with, its so stressful. i wish i could call them and ask them exactly what they need!!!!

hi pushbrk! tnk you for your reply. so do you mean they have rejected the whole affidavit of support because they dont accept my co sponser (my parents) and because i dont meet the proverty guidelines? so i must re-do the whole affidavit of support over? i assume i NOW CURRENTLY make the minimum $18,000 here in the us because i make $11 X 2080(full-time hours in 1 year)= $22880. but on last year tax return (2009) i only had about $11500 because i only worked part-time because i was goin to school full time. i will have my fiance go back monday and have her give them my paystubs and tax documents and current bank statement and will go from there. if they still dont accept that i dont know what to do. the only thing that check marked on the things they need is the EVIDENCE of SUSTAINED INCOME so im hoping they dont need me to send in a whole new affidavit of support again along with the sustained income. This has been a roller coaster ride that has stressed my whole family and expecially the two of us. I hope this will be resolved soon.

so to sum up this is what my fiance should bring of mine:

-pay stubs
-tax returns/w2's
-work verification lettter
-bank statement showing my savings

did i miss anything? i hope that this second time around will be a pink slip instead of this white & blue
im planning on scanning and emailing everything to her (thats the fastest route i can think of) so she can go back on monday and just give them that. i hope they wont ask for originals.....that would be too time consuming. those listed above is the only thing i can think of as evidence of sustained income.
