There is virtually no viable option for claiming exception to the having met in person rule for K-1. Before you file, you will want to buy a plane ticket and go see you significant other.

There are reasons which one could use to get around this rule, but getting USCIS to waive this requirement is quite difficult.

Most of the forms are available for download on line, you can always download them, and fill them out on your computer, DS-230 part 1, DS-156, DS-156K..

The forms that are specific to the consulate should be copied a few times, and you can practice answering on the copies, then carefully copy the answers neatly in pen to the original forms.

For phone number no + needed just start with the country code.

Yes you can use white out. I would still make copies to practice first on, and the ones that you can download I would download new copies.

My fiancee and I worked on them and used the online ones as much as possible, to avoid mistakes.


So did you guys just print the forms out from the internet then fill them in with a ballpen, or did you fill them online and print them out after you were done filling?


There are some huge advantages to doing the forms available online. Typing answers is always going to be neater. And the DS-156 available online generates a bar code automatically, which can be scanned at the consulate or embassy and avoids the dangers of someone at that end hand inputting your personal information into the government computer system and making an error.

I don't know about the forms you received, but our were years out of date for Abu Dhabi. :wacko: So we used the forms available online for all of my fiance's necessary forms.

My then-fiance was REQUIRED to purchase a return trip ticket before they would clear him to leave his country on his K-1. If you are unsure, check with a reputable travel agency who is savvy with the situation in your country or your consulate.

And why after getting your responses you might also wish to do a little bit of outside investigation to make sure what appears to be sound advice, and may be for many situations, may not work the same, or be appropriate, in yours. :thumbs:

This is not an expert response, and is in no way guaranteed, but it is very doubtful you or your uncle would ever be asked to actually post a bond. The I-134, like most forms you will fill out during the K-1 process, is used for many types of government purposes so this is probably an item which fits another type of applicant.

Having said that, I have also not seen anyone post here who indicated they were ever asked to post a bond.

Perhaps some of the veterans around will be able to tell you if this ever happens for K-1 filers, but I imagine you should not worry too much that a posting of bond will be requested.

For the record, we sent in just one page of the G-325A each and did not get an RFE. Others have as well. For the K-1 they only need one copy, and all 4 are identical. It is an ancient multi-purpose form and is used for many other types of things. So while it is possible to get an RFE for only turning in one page each, it is also quite possible there will be no problem at all. It is up to the adjudicator, and if he or she has a shredding fetish or not. (This is not a recommended meathod of filing of course.) :whistle:

Even when you think you double check, there is always the possibility of human error, so don't beat yourself up. If you think you see potential RFE's in your filing, work now to prepare corrections so you can turn the RFE around quickly. Otherwise, sit back, relax and who knows? You may not suffer any RFE.

I was thinking if we are going to have our RFE.. My boy sent me the photocopies of packet he sent to USCIS..

As I was checking, I noticed that there are few items he left blank in I-129F such as Part B item number 11 (Has your fiancee ever been in the US); though he answered number Part B, #12 N/A (If your fiance is currently in the US complete the following: blah, blah); Part C, he left items# 2 & 3 unanswered (not even N/A).. Duhh!

Another thing is the G325A (tsk tsk. Patience Julie! Heehee).. He left blank the city and country of birth; US SS#; employment last five years and he filled-up only one copy of that G325A.. When I posed him about it, he said its just the same thing and they (USCIS) will just photocopy it. Though I strongly doubt that, I just hushed myself coz I dont want another arguments.

I believe, CSC will send back to him the papers (right?).. How long would it take since we filed it last January?

You will get an RFE, there are 4 pages of the G-325A. And no, they will not photocopy it. It's YOUR job to fill our forms correctly AND completely. Same goes for the I-129F.

It is best in this long process to check, double check & TRIPLE check every form you send in. Saves time in the end & helps avoid RFEs. You should not hush yourself if you saw an error!!! :angry:

This has probably been asked many times but...

What makes a copy "certified"? Is it simply the institution (where the originals are held) stamping and/or printing "certified" on it?


You can self certify that all of the copied documents attached to your I-129F petition are copies of originals by including this form:

With some types of documents, such as divorce decrees, it is a good idea to go to the clerks office and have them make you a copy with their own certifcation stamp affixed, which indicates the document is true and correct with the original on file with the court.

FC-029 is an optional form, but I would recommend it. It covers all of the forms, such as the copy you make of your birth certificate, which you wont be able to get "certified" any other way. Just make sure you hang on to your originals, so if asked you can produce them.

They stamp your passport with a temporary EAD stamp, good for the 90 days of the I-94, after that you need an EAD card to continue working.

Also JFK can discontinue this practice at any time.


We are routing my fiance through JFK for exactly this reason, hopefully they don't discontinue issuing work stamps before March 6th. :whistle:

Your fiance will need to specifically ask them to give him/her this stamp when they go through customs and immigration at JFK.

I would recommend sending a copy of your marriage certificate, along with the original divorce (status only) order you initially recieved. That is what I sent, and my divorce had happened well over a year and a half before filing our I-129F.

The forms here are clearly marked as examples, and users are well advised to obtain their forms to ensure they have the latest versions from USCIS.

I suppose it is a good idea to give folks extra warning, but it might be asking a lot to continuously update the sample forms, since they often include sample answers as well. That takes a lot of very appreciated work!

The Abu Dhabi Embassy sent us a bunch of expired forms in our packet... We used the current forms from USCIS available online anyway...

The small possibility, remote really, of my fiance being turned away at JFK when she arrives is a small worry. Obviously it would be a disaster if it occurs, but it is remote. Still, I won't be completely comfortable until I pick her up at the airport.

The best advice I have read here, and I gave to my fiance, is to have your paperwork handy, in order, and ready to present. And to view the POE as she did the interview for the K-1, be prepared, game face on, ready to answer any and all questions truthfully, quickly and with conviction. Being turned around and denied entry is rare, but realize it is very important your fiance is fully prepared. Her visa isnt worth the paper it is printed on until she gets past customs and immigration.

Don't stress out too much, just realize how she presents herself is just as important as it was at her interview.

Those alarm bells were pretty loud. :(

It's possible that her concerns are about being stuck in a foreign country without enough money if the marriage fails. You could offer to put in a pre-nup that if the marriage fails, you'll pay the expenses for her and her son to return to Russia and maybe a bit more. If she doesn't go for that, then perhaps being with you isn't what it's about for her. When the question has come up in other threads, just about all the non-USCs have said that if it weren't for their USC fiance or spouse, they'd stay in or go back to their own country.


Vanee, thanks for the comment. I know that is her concern. I did tell her i would pay their way back and give them $1,000 if the marriage lasted less than a year and she was shocked and insulted but would never say what she expected from me. I think right now she thinks she would want to stay in USA for her son, but after being over here for a while, she might change her mind and want to go back.


Marriages can and do fail. Of any type. If she is apparently motivated by bringing herself and her son here, and not by the prospect of marrying you and spending their lives together with you as a family, then you should very seriously consider if this is a path you want to take. At some point, she may discover she can leave you and still stay in the USA. This will NOT mean you are no longer responsible for keeping her off of public welfare...

There are red flags all over your posts, concerning you feeling like the two of you will eventually love each other. You are swearing you love each other now, and are both seriously committed to marriage when she gets here. Concerning her apparently wanting reassurance that she and her son will stay in Russia whether you remain married or not. Some of your discussions could be tainted by the difficulty of the language barrier. Since she is Russian, English would be her second language, and even if she is reasonably fluent i.e. you understand what she says, that does not mean she is adequately expressing what she means. What may sound like a selfish demand for monitary assurance may only be her trying to express to you what she has been told by the agency you mentioned as being a good idea. Or it could well be your signal to run fast, run far, and withdraw from your petition immediately!

Only you can know how you feel about her. Only she knows what she is really feeling about you, and about coming here to marry you. I hate to read into your posts things that aren't there, but seriously it does sound like you need to take a step back and think about what you are doing. This is a very serious commitment.

Sounds to me like you two need to have a serious talk. Is she giving up a lucrative career? Bringing with her substantial wealth or assets which you might conceivably claim after divorce? She could just be concerned that she will come here, marry you, then you will divorce her and she will be left to fend for herself? Prenuptial agreements are more common when one or both parties to a marriage possess substantial pre-marital assets. You will be on the financial hook until she becomes a US citizen, married or divorced, so the best advice I can give you is to have a long heart to heart talk with her and find out what she is thinking.

I don't think you should enter the conversation with a worst case scenario in your head though.

I don't think the OP gave enough information in their post and I think it is rather one-sided. Still this raises some interesting hypothetical questions.

How does the requirement to keep a fiancee from becoming a public charge becomes a requirement to foot the bill for a ticket home for her after just two weeks? One can barely get over jet lag coming from that side of the world in just two weeks.

What if the guy just can't afford the cosf of a one way ticket to for his soon to Manila for his soon to be ex fiancee right now after just having shelled out all this money on the petition, visa fees, and the ticket over here? After all the Affidavit of Support doesn't require you to be even middle class to sponsor someone. It doesn't even require you to have a savings account.

If you've just spent $1000+ to fly your fiancee here, doesn't your fiancee have an obligation to at least make a reasonable effort at making things work? She made a big investment to come here too. Would someone who truly loves her let her throw it all away after just a couple weeks?

If she went to the CFO seminar like she was required to, she should be aware of what her options are. My wife went to that session before coming here and said they do a pretty good job of scaring the class particpants about everything that can go wrong and what they can do about it.

Perhaps a roundtrip ticket should be required for anyone entering on a K1 with the return date being 90 days after the date of entry. That would guarantee they could go home at the end of the 90 days if things didn't go as planned.

Then how about round trip for anyone entering the united states. Why should a k-1 visa holder be singled out. My fiance I believe is 99% certain she will stay. She is bringing more than enough money to return home any time she desires. How about a rule saying that anyone entering the united states needs say 5000 us dollars before a visa is granted . That is the way it is done in canada. If you desire to move to canada you need 10,000 to enter the country. At least my exgrilfriend did. several years ago. I do not desire to give an airline a 5-700 dollar gift because she MAY not be of a mind to stay here. I have other uses for that money.


Me thinks that smacks of favoritism towards 1st world immigrants. Those of us who happen to fall in love with 3rd world women are on the hook for virtually all of the financial burdons of this process (gladly! :D ) but that is how it is. At least in most such cases. My fiance won't be bringing along anything approaching that much cash, and if the worst happens and things don't work out, it will be up to me to see that she makes it back to the Philippines or United Arab Emirates. It will devastate me, but that is what I would be compelled to do.

This is a rough enough burdon for 1st/3rd world relationships, and would likely mean that petitioners also need to funnel a huge bundle, at excessive transfer rates, just so their SO can come here under a fiance visa, and return that money to them. And younger or poorer petitioners would be largely knocked out of the process.

There are enough barriers to weed out those who aren't serious about taking this journey.

It is impossible to say what is actually going on with the original OP who suspiciously has not replied to anyone after the first post and despite generating 5 pages or responses.

I don't think you got very good advice from the attorney who suggested your fiance lie. His previous K-1 applications will be on file, and easily appear when your case is adjudicated.

As others have said, there is a waiver for this.

I don't want to dump on your dream, but you might ask yourself why your fiance has filed twice in the past for other women? This is not an easy process, and I for one won't be putting myself through it ever again. Fortunately I won't have too!

But if you two proceed, he should definately disclose his past filings, and explain what happened with each (hope he has also explained adequately this information to you) and request a waiver. Also as others have said, this is an obstacle, but not a barrier.

Hindsight is always 20 20, but sorry to hear about your problem. It is generally a huge mistake to pre-plan a large wedding before the alien fiance is physically with you. The best idea is to get out of your head the need for a huge wedding, and if and when you paperwork clears and your fiance arrives, get a marriage license and take care of marrying in a small civil or private ceremony. You can always plan a big fancy wedding ceremony after that.

How did you wind up deciding to make huge plans between January 16th and January 31st when you did not know how long the delay might be? (Not giving you a hard time, but wondering how this happened.)

Hopefully the delay won't prove to be an entire year. And really sorry to hear the plans are getting messed up, it isn't fair, or right, but this is a rough process so you two will be having your commitment tested mightily by all of this.

I gotta say again--as the Non USC in the relationship--that it is a very very big step to leave your country, family, HOME. Even if it is for love. I can only imagine how much more difficult it must be and scarey when your family is not emotionally supportive on top of all that.

The question I don't think I have seen you answer yet is "DO YOU LOVE HER?" I know you've mentioned other women, more fishies in the sea, and having met online. Are you simply looking for a wife--any wife--any foreign wife? Or have you spent all this time with this woman and her child because you love them? I know that you must be heart broken about her sudden change of heart--but honestly, it may be the fear speaking on her part. She may simply need you to go and reassure her. It may not be fair to you emotionally-but she may be testing you to some degree. Or she may seriously be that afraid to go and abandon her family.

Personally, I wouldn't cancel anything yet. You are already going there, you have nothing to lose (not even the monetary since it's already booked and paid for) you may find that things can be worked through and- if not -at least you know you went down fighting.

As a citizen of Canada you should have no more than the usual problems crossing the border. Make sure though, that you bring documentation regarding your ties to Canada just in case there is an question.

You will likely get a lot of feedback from folks who have gone through exactly this. You don't have too much to worry about with a bit of preparation.

You will be fine, last I looked at the calendar it is only February 3rd today, not past Feb 18. You can use the older one until that date.

Does the posting of the new form mean that the USCIS posting that the 2-18-07 date is now void?

The USCIS themselves said the old I-129F could be used until 2-18-07.
