K-1 Fiance(e) Visa Process & ProceduresFew questions on the way to NOA2
Hi all,
well we have received our NOA1 back in October and last week have been touched a few times probably due to the address change for James (USC).
But I have a few questions while waiting for NOA2.
First of all,I know on one form in package 3 I have to list all my former employers from the past 10 years.Well-1 of them doesn't exist anymore. They left Germany overnight and went back to the US abandoning the business here in Germany (very nasty situation, luckily I wasnt working for them anymore when they left). So for that employer I can not list an address or phone number except for the old one when they were still here....
Is that gonna cause problems? Or should I state on an extra sheet that they have moed back to the US and the address is unknown to me?
As for the Medical,
does anyone know how much it currently is in Munich/Germany??
Also,my son has ADHD and is on Ritalin! Any problems to be expected from this condition?(Reason for denial I mean??!!) My son is 6 years old right now, will be 7 for the Medical.
He's at a special Day Care Center here in Germany but is of NO danger to himself or anyone else.
My Fiance is about to join the National Guard so we will have very good Health Insurance (Tri Care, which is new that they now also insure National Gurads and their families for 250$ a month, before you had to be active duty to be eligable for Tri Care)
And last but not least, how long does the German Police Certificate ake and do you need a new one for AOS?
Thanks for any helpful replies

K-1 Fiance(e) Visa Process & ProceduresCan /should we gather USC documents before NOA2
Hi all,
well we're guessing to be approved some time in February and I was wondering if it would be ok if my Finace send me all the documents like Divorce DEcree,BC,Tax stuff,I 134 and so on by early/mid February?
What EXACTLY do we need in Tax Papers. Some say Tax Transcripts ,some say 1040's or W 2's.I'm confused and so is my man.
Also what documents would we have to send to the embassy and can I fill out all the required forms ahead of time and just send them in right after I got Packet 3 from Frankfurt?
How long are my man's papers such as the letter from his employer valid?? And the I 134?
Any input?
Ya I know it's soon but hey CSC is working on end of July Petitions right now so who knows if they keep the speed up maybe we get approved by the end of Januray?!

I need to know whether I can enter the US for 5 weeks NOT using the K1 that is in my Passport (valid until mid October) and eneter on the VWP instead since I know I HAVE to come back to Germany and AP is not an option since it would take too long and emergency AP would not be granted since it is not a life and death situation.

If you're married you should file for a K3 and not a K1 fiance visa.
I'm missing something here maybe?

Please add a timeline so we can help you. Are you done with her visa and on to AOS?

I agree that this was childish to put our laundry out for all to see. I appologize to one and all, and ask for your forgiveness.
I did not create this number from my imagination, and I am very saddened to hear that it is believed to be my creation and not a mistake or a sad joke on someone else.
I have called USCIS repeatedly to acquire our number on my fiancee's aggressive behest, and I have verify called on my own to verify that we had a number(while waiting for my bank to mail it to me). The telephone representative gave me this number.
I believe that trust is a problem here, and it is my fault. Even as i have strived to live above my mistake. I have endured everything to show my sincerity and devotion, but I guess it does not prevent me from recieving the full penalty of my mistake.
I am sorry one and all,

K-1 Fiance(e) Visa Process & ProceduresFIANCEE WANTS TO RETURN TO KOREA!!
From Uzbek and is familiar with Korea, which she prefers. That's tough. I wonder how you would do there... maybe pretty well, I don't know. If she wants to buy stuff more than be where you are and you two can be together... I dunno. But what does she do there for employment that earns her more than in the US? I thought the Asian economies were pretty closed to foreign workers unless they can't find that skill from a citizen.

Also, I've heard that you may get looked at more carefuly by DHS with a O/W ticket.

aitian,

Interesting, and it confirms what I wrote in my post.

So you're saying - indirectly - that your fiancee was previously 'married Thai-style' to some guy?

Yodrak

Attached is the 3rd page of the checklist I received in my packet 3 that mentions "verification of unmarried status." It can be found under the "other" section.

I think we may have to head up to her hometown to get one of those letters real quick. Maybe they will let her mother get it for her and save us the trip up there.

I asked Lek to go to her village and take the "Cheif" (or whatever) to the Amphur with her -where she got 3 stamped copies stating that she hadn't been married. Certififed translations after.

Originally I posted this message on the wrong thread. I was just wondering if there is anyone filing their K1 paperwork this month? I will be sending my package from Udon Thani, Thailand to the CSC on May 24 :D . I have been waiting for this day since first meeting my fiancee back in September of 2004. Talk about a long wait but it was worth it. Even though I have learned to be more patient, I am sure this wait will be even more difficult. Good luck to everyone!

My wait was 77 days at CSC to get an NOA2 mailing from westcoast. Have you thought about a DCF in BKK?

Who is tougher on "official" documents that are not obtainable?
Would you folks say NVC expects things to be there no matter what?

I could see a document from a 3rd country being forgiven in Bangkok. But not a doc from the USA for a USC.

K-1 Fiance(e) Visa Process & ProceduresPacket Questions
I don't know if this a silly question or not, but I'm asking it because I don't know the answer! So if you know, share blush.gif I keep going over and over numerous forums here, and I see the packet 3 and 4 are part of the process after the NOA2 is recieved. I wasn't aware when I started this process that there are such things; in fact, this forum is where I found out about it. OK Here are my questions...

1.) Does the beneficiary recieve the packets?
2.) IF so, can he send it to the petitioner to fill out?
3.) What does the packet 3 and 4 have to fill out or gather?
4.) Are they in English?
5.) Does the petitioner have anything to do with filling/signing the packets?

I'm asking because I'm the paperwork fanatic in our relationshipt whistling.gif In fact, when he mailed me the signed G325 A forms, i had to type them up myself and send them back to him to sign because he filled them out incorrectly. SOO I want to make sure that I can fill them out, if necessary. I'm sorry if this question is rather sillY! But I know everyone here is so nice and will answer my questions no matter what!!!

**I filed through CSC starting March 18, i should expect (aprx) my NOA2 around middle-late July? ** It looks like they're taking about 4 months. I'm not exactly sure why the USCIS web page says Nov 17, 2007. Does that mean they are COMPLETELY complete? What I mean by that is the beneficiary is ALREADY in the US. I hope that my baby will be here in September. I'm starting to get very emotionally crazy rofl.gif Just kidding. I know I have to be patient. I just miss him a lot sad.gif
Is there anything else that I can do to prepare for the rest?
OHH I have another question!!!

When I callled the USCIS last week, she told me if they were to need more information from us, they would have asked about it within 10-15 business days from when i sent it? Is she correct? Or did she just mislead me? Maybe she was talking about something else?

THANKS EVERYONE FOR BEING SO AWESOME!!!! rose.gif

The fact of it is... It's insane to send Mexico my ORIGINAL passport. I will just mail him my real BC in case he does need it, i can replace it with another fairly quickly.. (not quickly enough for interview).

They do ask for an original birth certificate as well as any other documents like that (marriage certificates...death certificates) of the petitioner at the interview stage. But, as Carla already suggested, this does not mean the original one you got at birth...you do not have that. What you have is simply a certified copy (raised or shiny seal?). If you send the one you have and then just order another from the record holder of the county in which you were born you'll be all set.

I agree with the others regarding your passport. No way would I send that.

good luck

Thank you smile.gif

And everyone else. That is what I will do. I will order myself a certified copy and send the one I do have for Jorge. That way I too will have a certified copy in case the one I send to Jorge gets lost/stolen. Or if all goes as planned, I will end up with 2 certified copies. I will not send my passport. With my BC that should be enough to proof that I am a USC! smile.gif

K-1 Fiance(e) Visa Process & ProceduresI'm losing my marbles!!!
I am actually the petitioner. I live in Washington State, but I was born in Puerto Rico...which makes it difficult to get a certified copy of my BC. I called Puerto Rico and they told me it would take a "very long time" to get it. That is why I am thinking of sending my fiance in Mexico my real BC, which I have in my hands. He has a copy copy..not certified, but a xerox copy...but he needs the sealed one; therefore, i gotta send my real one.
As for my passport: the person I spoke with from Ciudad Juarez told me that I need to send my real passport too. He nees "all" originals is what he had told me.

I wonder if that guy just doesn't know what he is talking about. Maybe he does mean that Jorge needs HIS originals, not mine.

who knows?

K-1 Fiance(e) Visa Process & ProceduresI'm losing my marbles!!!
I am going coo coo for co co puffs about this birth certificate problem I have. wacko.gif I don't know, but I keep beating myself up about it because I keep getting different answers.

I have posted numerous times that I am afraid to send my original Birth Cert. Ok. So in attempt to fix the issue, I contacted Puerto Rico today. I really do have to send an original. I live in Washington State, but I was born in Puerto Rico. I called PR about BC and the nice lady said that it would take over 6 weeks to get. SHe didn't know how long but assured me that it would take a very long time.

I'm going to send my real BC. I have no other option. (UNLESS YOU KNOW OF SOMETHING?) Oh BTW. My fiance is Mexico City. See why i am afraid? Lots of creep-Os!

Secondly. The dude at CDJ told me that Jorge has to have my passport, ORIGINAL..... He has a beautiful color blown up copy that I made for him. innocent.gif if I send the BC, is that sufficient? I am SO afraid. I hate when I'm this unsure and keep asking over and over. I apologize to those that I am bothering with this topic, but it really is starting to make me crazy. wacko.gif I wanna cry cray5ol.gif

I, too, think I will receive my packet last week of Aug, first week of Sept. So hopefully my love can be here by the end of Sept. (if all goes well). I will not attend his interview, i have no $$$$$$$$$$$$ unsure.gif

What should I do?

K-1 Fiance(e) Visa Process & ProceduresI quit my job! Co-sponsor enough??
Hello-
I had that same though go through my head earlier in this process. I thought about quiting my job to stay down in Mexico with him. I have to say that I am glad I decided to stay here and work while I wait. Even though it is very tough, sticking it out was the best plan for me. In your situation, sounds like you will be fine. If you would have asked prior to submitting your resignation, I would have told you not to quit, to keep up. I wish you the best of luck smile.gif I just thought you might want to hear a different opinion.

Overall- i think you will do ok because of your co-sponsor. I hope your journey doesn't take much longer. smile.gif

For me, though, it is important to feel in control and be able to have a set income for emergencies. I am very paranoid about what the worst scenario might be, so I always try to block it by going over the top and covering my butt. For me, it is important to have had something entertaining me and making money while i waited. I am glad... We're thinking my fiance will be back next weekend and i have enough money to cover that. I feel "safe." I hope that makes sense. I would have chosen to have stuck it out.... it is very tough when you are depressed. Perhaps looking for another type of a job could have been an alternative. I always think about the long run...what about when he/she comes to the US? Are you going to be ok financially?

Think 125% for both.

The 134 is "short term" for the time leading to the adjustment of status. As noted by limejello the 864 is a binding agreement that lasts for approx. 10 years. If you can't show a solid case with the K-1 petition you won't get a visa and not make it to the AOS. Check the UK regional forum for more input specific to your fiance's journey.

Thanks for everyones help.. we will basically make sure we have a sponsor or that i make 125% no matter what form we use..

Doh, was trying to edit my previous post lol. This is what we found on http://travel.state....2994.html#forms

QUOTE
Should K-1 fiancé(e) visa applicants use the I-864 or the I-134?

Since fiancé(e)s are nonimmigrant visa applicants, they should use the I-134. They will need to submit an I-864 to U.S. Citizenship and Immigration Services (USCIS) when they adjust status to conditional immigrant in the United States after they are married.

Do the same income requirements apply to all immigrant visa applicants even if they use the I-134?

No. The 125 percent minimum income requirement, the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA.

So, basically we will need 125% of the poverty line regardless really in the end? It still sounds compleatly weird to me, if a person has just over 100% then where will they find the extra 25% from in the space of the time it takes from the K1 to the AOS.

Is it just me or is the whole process compleatly designed to confuse you? It's like, we think we've almost understood everything then another spanner gets thrown in the works.

The income requirements are non-negotiable. So if the USC's income is below the 125% of poverty amount you will need a co-sponsor for the I-134.

If your income situation changes by AOS time then perhaps you will not need a co-sponsor for the I-864. The I-134 is just for the K1 process. The I-864 is the biggie where the co-sponsor does commit themselves for a 10 year (40 quarters of employment) period of time. Read through the I-864 instructions to familiarize yourselves with the requirements.

Good luck on your journey!!

Hi,

So, from I understand - as we are both now slightly confused, For the I-134 for the initial K1 visa the USC needs 100% or above poverty line from what we've researched. However when it comes to the AOS and the I-864 form after we marry the USC needs 125% or more. Now, this to me sounds slightly crazy, why the diffrence in 25%? Why not 125% for both the I-134 and the I-864?

Thanks again

Gotcha, and thanks for the welcome and the links smile.gif

We have discussed the co-sponsor option but really want to use that as a last resort, we would rather try and do it without though it all depends on our situation nearer the time that the affidavit is needed to be filled out.
