May I remind you that a congressional inquiry is just that...an inquiry. Their liaisons can get the latest status of your case. They cannot force USCIS to make a decision.
IMHO, you should be more patient during this process. You're not the first person who has waited ~ 6 months for an approved petition.

I finally got the hardcopy of the RFE in the mail....We hired an immigration attorney to handle all the paper work for us to avoid any unnecessary delays. HA!   This was months before I found this forum unfortunately.  Well, the RFE is for my fiancé's G-325A (the beneficiary).  We did fill this form out and I took it straight to the atty.  Assuming (HA) that the atty reviewed everything before the initial filing, I hoped that we wouldn't have had any delays.  But, I guess the 8 years of school and the two grand I paid, didn't ensure that everything was signed properly.  My fiancé had typed in his name on the signature line as opposed to signing.   Yes, I should have caught it, but more so our so called advocate should have caught it.

 

Let this be a lesson, do not pay someone to do something when you can surely do it yourself.  I am a little bit poorer today but a heck of a lot wiser. 

 

Just reiterating was has been said a thousand times on here before, check your signatures even if an atty is hired!  I learned the hard way.

Nope, the visa WILL be coded I-551, this means the visa will act as a temporary green-card typically the stamp will indicate that it is good for upwards of 1 year. So once enter the USA you will essentially have green-card status, and can travel back home and then later use the visa/temp green-card to return to the USA.

Anyway for most the actual card tends to show up a couple weeks after arrival.

Sounds like your plan is quite sound.

And yes that notation about petitioner arriving at same time or before means that petitioner needs to be in the USA before or at same time as immigrant.

No, the petitioner does not have to wait for any NVC packets. I highly recommend reading this guide by PatiencePaidOff. By understanding the process and by being proactive, one can drastically reduce the processing time.

The beneficiary has a child, will she prepare the DS-230 for the child too, who is supposed to sign it?

The biologic parent can sign for the minor beneficiary. Parent can sign his/her name, then place "signed on behalf of minor child" in parenthesis. Wording need not be exact. But something to that effect is helpful.

Is the petitioner supposed to send original documents like the police clearance, marriage certificate and birth certificates, or should they be certified.

Again, please refer to this guide. NVC requires original documentation, as well as copies of each original.

Then does the petitioner have to wait for NVC to send the package or he can just send it after the AOS bill appears paid online.

No, the petitioner does not have to wait. Once the status shows "PAID," print the barcode sheet and send ALL required documentation.

Here is a check list of what the petitioner is preparing to send for the AOS packet:-
I-864
IRS transcripts for 2008,2009,2010
Letter of employment
Pay stubs for the last six months
Bar coded cover sheet

Your AOS packet looks good.

Will it affect the process if the petitioner and the beneficiary did not file joint taxes together?

No, it should not affect the process.

My wife and I are really confused about what is needed for the CR1 interview. The information provided by the Manila Embassy states that that the following is required.
I-134, I864, Birth Certificate, Wedding Certificate, Police Clearance Certificate, Visa photos and supporting documentation for proof of relationship and a few other things that do not apply to my wife.

We provided the NVC the Birth Certificate, Wedding Certificate, Police Clearance Certificate, and Visa photos of both the Petitioner and Benenficary along with the Affadavit of Support (I-864) and supporting documentation.

Do we need to again provide all the information for the interview at the embassy that has already been provided to the NVC along with a I-134 support documentation?

What does my wife actually need to bring to the interview at the Manila Embassy?

We recently had our CR2 (not CR1) interview. Most of the same documents are required.

Your wife will definitely need to bring an extra DS-230, completed and signed, to the interview. Yes, even if you already submitted one to NVC. At the prescreening part of USEM, they asked that from us. Fortunately, I brought 2 copies of EVERYTHING...but that is just me and my OCD. :lol:

Just keep on calling NVC. I highly recommend reading this guide, if you haven't already. Being proactive during this process drastically reduces the processing/waiting time.

I was wondering if you guys had any tips or any piece of advice when it comes to sending a whole bunch of paper to the NVC. Did you guys paper clip the tax transcripts for a particular year together or staple them? Also did you write down a page number or NVC case number on every single paper sent? (except on the originals of course)

I never stapled any documents, except for USCIS forms having multiple pages. I would suggest using ideal clamps to hold all your documents together. I printed NVC case number in the upper right hand corner of every page. For original documents, I wrote the NVC case number in pencil.

No, the interview is scheduled AFTER your case has been completed. When you call NVC, what does the automated response say? Did you speak with an NVC operator? They can tell you the updated status of your case.

But seriously...no, I'm 99.9% sure that USCIS will not take the 2012 Mayan prophecy into consideration. Separation of church and state. The Mayan beliefs are, by many, considered a faith and not a fact. USCIS is a federal organization. IMO, I don't believe the decisions by USCIS will be affected by the Mayan calendar. :D

My upcoming interview is sooo near (april 4 2011 @ 8:30am) and im so much nervous about it. My husband says not to worry too much since our marriage is true and not fixed or anything blah blah blah. (anyway weve been bf/gf for 6yrs&10 months, and were already married for more than 2 years now.)

Any tip or advise? please :help: me or should i say enlighten me :unsure:

My stepdaughter recently had her IR-2 visa. My wife (her mother) and I attended the interview as well. During the prescreening, they requested another completed DS-230 form. Fortunately, since I have OCD, I had copies of EVERYTHING. Remember that the CO can request any document (especially NSO documents, if they are more than 6 months old). IMHO, I would suggest you carry a set of original NSO documents. It's not required, but it sure adds a sense of security.

The interview questions focused more on me, the petitioner. What do you do for a living? When and where did you meet your spouse? How long have you been together? Have you been married before? Any children? As long as all your answers match the information in the documents, you should be just fine.

Yes, your wife should contact her congressmen and senators immediately. On their respective websites, there should be a privacy release form. You will need to complete this. It authorizes their liaisons to inquire the status of your case, on your behalf. Remember, they cannot force USCIS to make a decision. However, for cases pending beyond the normal processing times, they usually are approved immediately. I contacted my state congressmen and senators when my case was beyond 5 months. Literally, within a few hours, I received an approval email from USCIS.

It was the NSO certified copy but they say it doesn't look like it to the first reviewer. I have called and gotten the supervisor review for it(second eyeball test). But have sent another one in the mail to them as well. 

Really strange. According to Preferred Documents in Philippines Reciprocity Schedule, "Documents issued by the National Statistics Office (NSO) and the National Bureau of Investigation (NBI) are preferred."
Anyway, I hope they won't issue you an RFE on this one. Good luck and keep us posted! :thumbs:

Got RFE from NVC on Nov. 6, 2010 for the marriage certificate no looking as original as they want it to look.

That's strange. Did you send them your original marriage certificate? Or was it NSO certified copy marriage certificate?
I know NVC accepts NSO certified documents (birth certificate, marriage certificate, cenomar).
