Here's a tutorial to get you started. As others have mentioned, some cases show a touch...while others don't. So don't place too much faith on them.

Congratulations on your approved I-130!

I highly suggest reading this guide. Please follow the steps to the letter. I did and had zero problems.
The key during NVC stage is to be proactive...to anticipate the steps and prepare for them before they happen. You'll breeze through if you do.

Hi,

I received an email from the NVC today and there was a checklist cover letter attached to it. The attachment said that, while they have received the DS-230 package, they have not yet received the AOS package and they are requesting it to be mailed out.

Now here's why I dont understand why i received this email. Both the DS-230 and the AOS package were mailed out the same day via fedex. And both packages were delivered and received by the NVC as per the tracking number on the fedex receipt. So I dont understand why they would be stating that they have not yet received it and would be requesting for it to be sent again.

Any help or advice on the situation would be greatly appreciated!

Don't worry too much about NVC's email about not received the packet.
I, too, received that email. As long as you sent them, tracked them and they were delivered...you're fine. Give them some time to update the status in their system.

Recently I paid the fee for the visa application and it took me to a few pages to read. Within these pages it said I need copies of basically every document I have sent in thus far. Do I need to resend all these again or is it just going over documents previously sent in? I dont know why they would want me to resend them all over again. So before I go and spend all this time gathering certified copies again I would like to make sure.

If anyone has information about this they would like to share, I would appreciate the input.

No, you do not need to resend any documents. However, it is wise to have at least two copies of every civil document (ie NSO birth certificate, marriage certificate, CENOMAR, etc).
Sometimes, when a case is transferred from USCIS-NVC or NVC-USEM, document(s) may go missing. If this happens, they will ask for it during the interview.
I highly suggest reading this guide, if you haven't already. It provides some very sensible advice during this process.

Paragraphs 2B and 2C are addressing Lawful Permanent Residents who are filing the I-130. As a US Citizen filing for a foreign spouse, there is no derivative visa for the foreign spouse's children, they MUST be separately petitioned or they will not be able to accompany your wife.

Read the instructions again, and see that your cases DO NOT fall under 2B or 2C.

2B = LPR filing for an unmarried child under 21
2C = LPR filing for an unmarried son or daughter 21 years or older

If he is a naturalized U.S. citizen, he would need to show a copy of his naturalization certificate.

You would need to physically mail the packets. IIRC, only a couple countries do electronic processing. Philippines is not one of them.

We currently got I-130 approved, my wifes address in the philippines changed, who do we notify of that change? Im assuming we notify someone right away before they send packets to her, but who would we call? USCIS? my understanding once approved everything is out of their hands. Any help would be appreciated.Thank you in advanced

 

That's correct.  Once your I-130 petition is approved, it is sent to National Visa Center (NVC).

I would definitely call them ASAP, regarding your change of address.  You may contact NVC via phone or email.

By anticipating the steps during this process, and preparing and sending the necessary documents, you can drastically reduce the processing time.

You're welcome!

No, you should not be receiving an RFE because of the marriage certificate.  The one you sent is actually the original.  The ones issued by NSO are scanned certified copies of the ones with the red documentary stamp.

No, that's not a problem.  The one with the red documentary stamp is actually the original, not a copy.  My first marriage certificate was the one with the stamp.

Sorry.  We're having some confusion. 

NSO is the only recognized agency that certifies civil documents for USCIS and NVC.  If you had a certified copy of your marriage certificate elsewhere, it will not be accepted.

You sent the original marriage certificate? 

 

IIRC, that is issued by the Office of the Civil Registrar General...with the red documentary stamp?  If so, I do not believe you should have sent that.  That is the original marriage certificate.

NSO issues their certified copies of the original documents.  They are scanned on their security paper.  USCIS and NVC accept NSO civil documents as original

 

Honestly, I would try to get that original marriage certificate after your interview at USEM.  Just my opinion.

It sounds like the U.S. consul is just waiting for that evidence to make a decision on your case.

I personally do not have any experience with this.  But I would imagine the sooner USEM receives the evidence requested, the sooner a decision can be made.

IMHO, I would follow up with your lawyer every day. 

 

Hopefully, within 1-2 weeks you'll hear something from either your lawyer or USEM.

Hi all! I finally had good news after calling the NVC. They gave me the case number and the invoice ID but said (again!) to wait 10-20 business days and they will e-mail us. The lady was bit robotic I felt and couldn't really answer my questions...so I was wondering, what are they going to e-mail us with, instructions? And since the next step is to send them the DS 3032 Choice of Agent, couldn't I just download that and send it without waiting for any e-mail? Thank you!

I agree with many others never to wait for any correspondence from NVC.  If you want this process to be speedy, you should already anticipate all the steps. 

Please do read this guide thoroughly.  I followed it to the letter and had zero problems.

yes, she was previously married to the biological father of her two daughters, but her previous husband doesn't  sign any paper work for annullment , as she said her previous husband just sign a paper consent to travel for her two daughters. Her previous husband is now in Middle east working,  and her new husband in US starting to file the spouse visa for her and for her daughters, the problem is she cannot convience her previous husband to sign any paper works for anullment , so how can she grant the spouse visa and her daughter visa to come to the US,? but she got the divorce in Canada? is that strong enough evidence the her previous marriege already void? she believes that there's no any trouble getting her daughter in the Philippines, Canada divorce decree is recogniceable in the Philippines law? or US law  ?

Hi to all, I had a friend  living and working in Canada just 2 years for now, she been married in Philippines with a filipino guy and the previous married not annulled yet, but she got the divorced in Canada with her previously married and few months ago she remarried a US citizen guy , she's trying to apply a tourist visa from Canada to US but she failed and and got denied. Now her US husband trying to file a spouse visa for her so she can come and live with him in the US and she wants to get her 2 daughters with her along those petition. My question is , the divorced in Canada is legal to remarry another guy  even she's not annulled in the Philippines?  How can she get her daughter to bring in the US with her New husband? there's any big issue of this problem? those previously married is already void with out filing the paper work in the court back to the Philippines? is that ok to continue filing the spouse visa to come in the US ? Do you think guys she's can grant a visa to join her new husband with out any hassle to fix her previous married in the Philippines? any idea about this? any advice please! would very much appreciated ,. She's a filipina now working and living in Canada but not a Canadian citizen. Thanks

 

I really cannot speak regarding the divorce and annulment, as I do not have personal knowledge.

 

However, I can comment on bringing the daughters to the U.S.  I am assuming that she was previously married to the biologic father of her two daughters.  Is that correct?

If so, she does not have sole custody over them.  This means that without their father's consent and/or court order, the two daughters cannot travel to the U.S....much more leave the Philippines.

 

IMHO, she should really get her annulment in the Philippines straightened out first.  Then, worry about securing consent from her daughters' father.

We filed an I 824 to have my I 130 sent to the NVC- in my case- I left the US when I wasn't supposed to and had to go through the Visa process in Canada. We filed the I 824 in November, paid the $200. It just got approved a week ago. 9 months. It was knowing that the I 824 was at least a 6 month waiting time is what made us file for a K3.

I am back in the US now with a K3- my K3 took 5 months start to finish. The K3 path was worth it for us. Yes I have to go through EAD and AOS, but I am here with my husband and it is worth it.

That's the way I'm thinking. I need to save money as a single Dad and am not a paperwork guy. But we all need to be together, as a family. Priceless, like the ad says.

From times on this board I'm seeing 329 days for a CR1, and 187 for a K3. That's 142 days less. Could that be right?

Thanks folks! PRAISE applied. That's what I understood. But I didn't know about paying $200 to keep the I-130 going through.

$1010 + $200 would not be a problem to be together sooner.
She doesn't care if she works or not, and neither do I.

The hassle getting the AOS after entry is a bad thing, but I'll have her next to me as I sit here at the puter. Actually she'll be playing with my kid like as not.

We got the same email saying our case was sent to nvc on the 8th, but most of the people who were sent on the 8th got their nvc case numbers already and we haven't :( I hoped we would get it yesterday but nothing. So I'm not sure now if our case was really sent to nvc on the 8th? Hummm...
Those who were sent on the 8th, when did you get that email? We got it on the 9th saying our case was sent to nvc on the 8th. It has been 33 days already without nvc case number! :(

Here is another bump in the road of our journey...I was approved on the 1/10/11 and got the email it was sent to NVC on 2/03/11...I emailed NVC this past weekend and I hope to hear something soon...At this point I don't know what else to do...Does anyone have an opinion on what us that are still waiting for a case # at NVC can do? Did TSC really ship it?

Your Case Status: Post Decision Activity On February 3, 2011, we shipped this approved or re-affirmed case to the Department of State for visa processing. For more information, please contact them directly.

So I am assuming they have sent it to NVC and I should have a casr number in a few days...I will update you when I recieve my case #...

When I spoke to an operator at NVC, what Ron said is what she had told me but when you call and speak to the operators ask them... to be on the safe side...

Yes, it was actually sent to us by snail mail to both of us. My wife sent it directly to the NVC via FedEx and chose me as her Agent.
I see that you can download the form online, but not sure if you can use that because our preprinted one had a barcode. And the downloaded form asks you for that barcode. Contact the NVC if they sent you a hardcopy yet.

This is what we did according to the forums.
I-130 -Maiden name
DS-3032 -Maiden name (it was actually pre-printed out for us by the NVC)
DS-230 -Married name (In one of the fields called "other names used," put her maiden name in that field")

Passport -Married name. Then when she goes for medical, slec (St. Luke's Extension Clinic) will see her married name and annotate it on their forms.

Recently the I-130 was approved, and we received the AOS Fee Bill in the mail yesterday.
I paid the Bill online.

I understand that the NVC will mail me the AOS package to be sent back to them with some documents

One of those documents that I have to obtain is the "Original Employment Letter."

My question is, does anyone of you (who is going through the same process as my wife and I) know what this "Original Employment Letter" is?
