I'm getting all my docs ready for NVC stage. The I-864 form expired last month. USCIS has not released an updated version of the form.
Would I be risking an RFE when I mail in my AOS packet?

I sent my paper work about 2 weeks ago, and was going through some video and realize that I shouldn't have sent some of the picture of me and my wife kissing and what's worst is I think there are like 2 picture of us in bed. The big one, she was wearing a dress and it blew her dress up and made it look like she was pregnant which I thought was cute, but now stupid mistake. All the imagines are innocent no XXX or rated R, but now I think its a big mistake on my part. I guess I was in the loving mood when I had the pictures printed out, didn't think it could bite me in the #### later or soon.

Should I be prepare for backlash? I did write down all description of each picture if that help the USCIS figure out what was going on in the pictures.

Did you call them first, or just print the privacy release off the website and send it? What documents did you send with it? I tried to call for almost an hour a couple of days ago, to no avail. I don't know how many times I hit redial. Should I just fax it, or is it better to actually talk to someone? Thanks....we are going on 7 months now, with no touches, emails, nothing. I called USCIS last week and they put in a service request, but still nothing......

No, I didn't call them. I found the privacy release forms from my congressman's and senator's website. I attached a short letter explaining my situation, as well as my I-130 NOA1. Initially, I was planning to mail it. However, I read on one of their pages that faxing it has a much better response time (mailing it goes through more screening?).

Yeah, if you're not getting anywhere by calling your representative's liaison, I would recommend faxing your request.

Hey MarkieBoy... Congratulations..

It took me 2 weeks to recover from the excitement after getting NOA2.. It was ok, but lost time.. I don't know about PI, but our Consulate allows us to send P3 without waiting.. And we can email it direct to the Embassy. So check out PI Embassy Web page and see what you need for P3 and get moving on it so you don't loose anymore time.. We had our interview and our approval 45 days after sending P3 but could have been sooner if I hadn't take so long to get my act together... If I had sent it sooner, I might had gotten an september interview instead of a October Interview..

Anyhow no goofin around get your stuff ready to go so when the Embassy is ready for you, you can be ready also..

Thanks, Kenny! US Embassy in Manila does not use Packet 3 anymore, IIRC.
In my case, I would have to wait till case completion. Then, call and attempt to schedule an early interview using NVC case number.
I have all my documents ready to mail! Too excited...I called NVC twice today to check my case number. Yes, I know it's too early as they haven't even received my case from USCIS. But I'm making it a daily routine to call and check.

No need to apologize. This is how you know you were touched:
First, you'll have to Sign-in to My Account. If you don't have an account, you'll need to create one.
Second, you'll have to Add a Case to Your Portfolio.
The highlighted column "Last Updated" shows the date when your case was touched.

Yesterday, I faxed my senators and congressman my privacy release form with supporting documents. About an hour later my case had its very first touch. Later that evening, I received the approval email. :unsure:

Like others have said, it varies. Some cases get touched everyday, while others have no touches...then their NOA2 shows up in the mail.
But if your case is nearing the 5-month mark, I highly recommend you contacting your senator or congressman.

I think including a letter of explanation is great. In our case, we included a letter explaining why neither my wife nor I filed Federal income tax. And therefore, did not have tax transcripts for the previous 3 years.

However, I do feel that the letter from your employer is important. Your employer is usually an unrelated, third-party. USCIS will see the contents of their letter as an objective, unbiased assessment of you as an employee. Your letter may contain all the elements of a letter of employment. But I still believe that the same letter, from your employer, would weigh more.

No, the 5 months processing time is from NOA1 to NOA2, IIRC.

If you have her fill in the date of signature, why don't you just fill the the day when she signed it? There's no rule or regulation that says you have to sign it on the day you are sending it. She could sign it on the day she mails it to you. You'll get it in few days. Then you fill it out and mail it to NVC. Keep things simple 'n' clean.

Did you receive both bills together, though? And are you planning on mailing both the AOS and IV packages in the same envelope?
The reason I ask is that some pay the AOS and IV bills and mail them on different dates. Just wondering. :unsure:

Make an appointment at the embassy to get an "Affidavit in Lieu of Certificate of Legal Capacity to Contract Marriage". If you were married previously, you'll need to present evidence that the previous marriage(s) was/were dissolved (divorce decree, death cert., etc.). I made my appointment for the day after I arrived. You can make an appointment using the online appointment system at: http://manila.usemba...v/marriage.html and clicking the link in step 2.

The same or next day you can apply for the license at the "civil registrars" office in the city where your fiance(e) lives. There is a ten day waiting period while the application is posted on a bulletin board in front of the office. This allows time for anyone with any grievances or reasons why the couple shouldn't get married, to make those reasons known. This is mostly just for show, but it is the law and must be complied with.

You should pre-arrange to have a local official perform the ceremony on the 11th day. I managed to get is done during a 14 day visit. The "Affidavit in Lieu of..." was done on the the Monday after my arrival and the ceremony took place on Friday of the following week.

This is of course assuming that all you want is a simple civil ceremony. A full-fledged wedding blessed by the Catholic Church is another matter entirely.

My case was approved and now it is in the NVC, I have been calling but the number is always busy, My understanding is I need to call until I find out that my case has been uploaded in the system and I have a case number. When I get the case number that means the NVC will email me? The Ling Che NVC shortcut guide is hard to follow.

Keep calling till you get through. When you get your NVC case number, you will need to call NVC.
Speak to an operator and give them the petitioner's and beneficiary's email addresses. Also, ask for your IIN (Invoice Identification Number). This will allow you to pay your AOS and IV bill online.

I use Loto's guide. Really concise and straight-forward.

I hope it won't be delayed that much. On my timeline it says that my I-130 should be adjudicated between november 25 and December 6, so crossing fingers!!!! :)

It has 2 purposes:
1) To prove the petitioner is a USC sponsor
2) Secondary evidences of the marriage relationship, because it had all my travel stamps to visit her

If you have already printed the passport pages with the stamps, I think those will suffice.
When my wife adjusted status, she included every single page of her passport, whether there was a stamp or not! Unnecessary? Probably. But she wanted to be 100%. :lol:

thanks for that. So far so good.. except I read some of the packages people are sending in and think geez we never sent half of that in.. like pictures, etc etc.. Just the forms and 3 letters from witnesses who have seen us together etc etc. So, to be honest, I am kind of expecting one. blah.

Some people include ALL their evidence with their I-130 petitions. Others send in just the I-130 petition, along with the required documentation. Then during the interview, they bring ALL their evidence (ie pictures, letters, etc).
It really is a personal decision.

But as long as you sent in the required documentation, you should be good to go! :thumbs:

We haven't gotten one.. yet.. but Ive seen a few RFE threads. I was wondering if there is a general point in the USCIS time-line that they seem to go out? We are at just over 2 months now and were wondering if it seems to be closer the the 5 month mark or if its 100% random. Also, if we are going to get one, do they send it to the petitioner or the beneficiary? I'm (the beneficiary) going to be visiting my Husband next week and we were wondering about whether one would be sent to me while I'm visiting or if it will always go to him. I'm not sure I'm wording this well. /sigh.

RFEs can come at any point during this process. Some receive the RFE early, some at 5 months, some at NVC stage.
Usually, the petitioner received the RFE notice, IIRC.

Ok, simple question..how long after your NVC file gets put into the system does it show up on the payment portal for your AOS and IV bill to be invoiced so that you can pay? Our info was put into the system on Nov 8, this past monday. I have the NVC Case # and the IIN #.

I'm in the same situation as you, CRN. My case was entered on the same date. I keep checking payment portal to pay bill. Hopefully, tomorrow it will be invoiced!
