I completely understand your wanting to get married as well. Don't do it!

While on my brief visit with J, believe me, thoughts of just abandoning my life here and staying with her there crossed my mind. I wanted to marry her a long time ago... I have no idea how much longer we will be apart, but I came home, filed, and am in line with the rest of you couples.

Hang in there, you are lucky you will be going to visit her. Have fun, do the documentation thing to bolster your case, and who knows? Perhaps you will come home to an approval and she won't be far behind you with her K-1 visa in hand!

So, where I stand now is:
1.) DEFINITELY waiting until October when she turns 18 to fill out paperwork.
2.) Figuring out if I need to satisfy the requirements of a Thai marriage (parental consent under 20) even though I am not getting married in Thailand. 18 is fine for my state.
3.) Continue gauging the discretionary attitudes of the age situation, which from the board seems to be reassuring that it will be OK.

1.) Yes, very wise! She must be eligable to marry you when she writes her letter of intent.
2.) Parental consent strengthens your case! So if they are happy with the idea, add a letter from them and it can only assist your efforts.
3.) There are much larger gaps in ages which have been approved. You are young as well, and there is not going to be a huge issue with your case that she is young.

Sticking to points 1 and 2 will do wonders for your case. Good luck on the journey! :thumbs:

As others here will tell you, the guides at this site, together with careful preparation by yourself should be more that sufficient to get through this process without the need to shell out cash for someone else to prepare the documents for you. There are more than a few horror stories here of people who spent the cash, only to have their attorney botch the filing process.

That being said, if you have a complicated case for some reason, or feel uncomfortable doing the paperwork yourself then you could go that route.

If you have a straightforward case, study the guides here, download the latest forms from USCIS and go for it! And of course, quadruple check everything. A lot of folks run the list of documents they intend to file on here to have a few extra eyes double check if you forgot anything. Then copy everything, hard copy. Scan it if you can. Unless your case is complicated, you can do this process yourself, with greater peace of mind. There are good lawyer's out there, and some folks feel like they just would prefer someone else do it for them. But when you hear the horror stories of attorneys who file the wrong forms, sit on RFE's until it is too late, etc. you have to figure that doing it yourself is the way to go.

The guides here on this site are great. And you can get any questions you have answered here as well by posting them [double check answers of course!]

It may or may not be a problem. That is a fact... But the K-1 visa is based on being engaged, not married. And yes, it has messed some folks up down the road to have even a nonbinding ceremony, especially if there are photos involved etc. and they come to the attention of USCIS. You don't want to get involved in explaining why something that looks like a duck, walks like and quacks like a duck is not a duck.

If you already had the ceremony you might at least consider a 'legal' marriage and opt for K-3. This is an extensive, time consuming, expensive process, and you don't really want to get too far down it and realize you shafted yourselves. If you have not done the ceremony, then put it off until after you successfully get a K-1 visa to the USA. Good luck to you on the journey!

Hey husker, been reading through this huge and rapidly growing thread. I chose this post to quote in my welcome because although we are through in our particular case, a similar situation happened to our case. It seemed for a few weeks like we simply had filed on the wrong week. The week before, and week after our petition were seeing approvals, and those who filed on our week were left behind. I did my best not to feel too discouraged, and our week eventually caught up and approvals rolled in. I guess this is more for the poster who is feeling left behind, you will get your approval in time. It is hard to wait, I know!

I guess since you didn't work at CSC husker, I can't ask you what sort of glue the adjudicators there used for handling petitions! :lol:

Short answer this morning. Basically, because congressional are such a pain for the cIS folks to respond to and a very serious matter, I would nottake them lightly, and give them the serious consideration they deserve. Sounds like you appreciate this fact.

So, Iwould never encourage a person to just file a "congressional" to jump the line" or move ahead of everyone else. Thats not the purpose. I only recommend you use this last resort when the system has broken down for some reason in your case or there are extraordinary circumstances that require an immediate intervention by your representative (ie deportation hearing etc...).

I would say if your application has not been worked with its normal date group within a reasonable amount of time taking into accountthe additional time a security hit mighttake to resolve, then it might be appropriate. But, I would err on the side of patience and use it only as a last resort. I saythis to be fareto all the other people waiting patiently in line with you.

That does help - thank you. I guess my only other question would be what you mean by 'normal date group' - to me, I see cases on Visa Journey that have a NOA1 date around or after mine which have already been approved, yet here we sit.

Are those folks considered my 'normal date group', or what other barometer should I use to determine that?

It FEELS like I'm languishing, but it may just be my heightened, emotional perception (moreso than reality). And I don't want involve my congressman if it would be out of order for me to do so.

If you read the instructions for the employer using the new I-9 you see they are to examine either one document from List A

OR [and this is critical to my argument the original post, and arguments that using the steps suggested by me, K-1 visa holder's can't work with the Temporary Work stamp from JFK assuming they can and do get one.]

One from list B AND one from List C.

Included in list B, the first document is:

1. Driver's license or ID card issued by a state or outlying possession of the United States provided it contains a photograph or information such as name, date of birth, gender, height, eye color and address

List C the first document is:

1. U.S. Social Security card issued by the Social Security Administration (other than a card stating it is not valid for employment)

My wife had both of the above, to go with the Temp Work Stamp from JFK, and under the new and required updated I-9 forms own instructions, those documents continue to satisfy the eligibility to work.

A. Forms I-94 Marked With a Temporary I-551 Stamp



Current regulations at 8 CFR 274a.2(cool.gif(1)(vi)(cool.gif provide that if an individual presents to his or her employer the arrival portion of Form I-94 that the Service has marked with a temporary I-551 stamp and has affixed the alien's picture in lieu of a Permanent Resident Card, Form I-551, the individual must present the actual Form I-551 within 180 days from the date of hire or, in the case of reverification, the date employment authorization expires even if the temporary I-551 stamp on the Form I-94 contains a later expiration date. At the time of the September 30, 1997, interim rule, when this provision was added to the regulations, the Service determined that the 180-day validity period would be a sufficient amount of time for an individual to obtain the actual Form I-551. Since the September 30, 1997, interim rule, the Service has determined that in some cases, it may take longer than 180 days to obtain the actual Form I-551. In addition, the Service determined that employers may be confused when the expira tion date written on the Form I-94 itself and the regulatory validity period of the receipt are not the same. It is likely that employers will rely upon the expiration date of the stamp on Form I-94, rather than count 180 days from the date the employee presents the receipt, since the date of the stamp is more obvious. To eliminate this confusion, this interim rule amends the regulations to provide that the receipt validity period for the Form I-94 marked with a temporary I-552 stamp and affixed with a pic ture is to be the same as the expiration date of the temporary I-551 stamp written on Form I-94. The Service issues some Forms I-94 marked with temporary I-552 stamps with a validity period that is less than 1 year. Some are issued with a validity period that is more than 1 year. However, most are issued with a 1-year validity period. Given the Service's current card production capabilities, 1 year is a sufficient amount of time for the individual to obtain the actual Form I-551.

Again, pretty sure this is much ado about nothing [the OP,] and you follow the steps we did today, with Temp Stamp on your I-94 from JFK then likely you can get hired and work legally.

The rules 'changed' last in 1997, which was considerably prior to our experience, and my wife worked legally with an I-94 and temp stamp [no picture on the I-94,] Washington State picture ID card, her K-1 stamped passport, and a Social Security Card clearly marked "If Work Authorized." As long as Uncle Sam is collecting the taxes, and you find and employer wanting to hire you, all is right as rain.

well we can FINALLY put our papers in while I'm visiting my Fiance in September!!
Now here's my question,
since Jim is a Truck Driver who hardly ever is at home (he will switch to a local position once I move to the US though) he doesn't have his own place.
Up until now he's been staying with friends of our in WA,that address also is on his Driver's License.
Well,we will be living in MN though and actually we will move all of his stuff up to his parents and sisters up in MN when I'm in the US in Sep.We will list his Dad's address as for where we will live when I get there,but which adress are we supposed to list for him RIGHT NOW?
The WA addy is on his Drivers Lisence as I said,but he will spend the two days he's off a month at his sisters in MN,not actually LIVING there.......
All his mail is for now being send to WA,but we'll change that in Sep I guess,he wont change the Drivers License and the Truck to MN yet though.
Any advice??

Now here's my question:
What are the EXACT picture requirments for the G 325?? I know they have to be (American) passport style,but what about my hair,earrings and that stuff?? I heared/read somehwere that you can't wear earrings and that there's a certain requirment for long hair........what that is I don't know.Can I put my hair up or what?
And also on the G 325 it asks for our job history and the address of the employer.My Fiance (USC) has served in the US Army for 10 years and now my question is what address do you put for the Army as far as the employers addy goes and as far as HIS addy goes when he was stationed overseas.The unit address?
I know this might be a little weird but we had to wait 18 months to be able to put our papers in to USCIS so we want to do it right and not be delayed any further by RFE's.

My Fiance's middle name is miss spelled (Freemont instead of Fremont) on his Divorce Decree.
The reason this happened is because when he filed for divorce last year we went by his Social Security Card on which his middle name is spelled with two e's ,on his BC it's spelled with one only.
So now my question,will we get an RFE for this?
We CAN make a copy of his SSCard on which it's written with the two e's.........but is that gonna be enough????
We wanted to put the papers in next Monday,no time to get the Divorce Decree changed.........

OK so now we finally got this divorce done after an 18 months long nightmare,BUT
we don't have the Decree yet..........
We wanted to file our I 129 on Oct.1st (Monday) ,but so far it doesn't look like we'll get the Decree in time since the ex is sending it from VA to WA via snail mail............
The passport style pics we have for the G 325A's are dated Sep.10th on the back of 'em........so how long can we actually use them without risking an RFE??
Are they strict on the 30 day rule? And how do they count that? Let's just say the I 129 gets to CSC by the 10th of October,is that good enough even though most likeley it'll sit there for a few days unopened?
Please gimme some info on this!

Thanks Karin! Yeah it seems to NEVER end........And on top of all the other delays regarding to this nightmare of a divorce now the processing times are sky high........
We wanted to get married May 17th (exactly 3 years after we met) but that seems well out of the question now.......
Then the next propblem comes up,most airlines have a "Heat Embargo" for animals and that starts on May 15th and since I will be taking our black Lab and my cat back to the US with me I might have to send them ahead now...........
I'm SO frustrated right now................
I only hope and pray that we can still go home by the end of April.
But that looks like wishful thinking right now...............

well we decided to send photocopies instead of originials,since we have only one Certified Copy of the Divorce Decree (when we FINALLY get it after more than 3 weeks,lawyer sent it to the wrong address so ya we STILL dont have it crying.gif ),his Birth Certificate and my Birth Certificate.
What are the requirments for photocopies? Do we have to copy front AND back of the documents or just the front?

Well I went and looked at the back of the check again and there's actually two WAC numbers,one right underneath where it says that the check went to US Treasury INs and stuff that was the WAC TTL and the digits,WRONG ONE.
(tried to enter it several times and never got anything....lol)
And then when I looked at the check AGAIN it was right there about on the middle of the check on the left side .It's a WAC*********** number ONLY digits after the WAC.
And when I typed that in our case came up.
Touched yesterdayand this is what it read:

Receipt Number: WAC0800852172 Application Type: I129F, PETITION FOR FIANCE(E) Current Status: Case received and pending. On October 11, 2007, we received this I129F PETITION FOR FIANCE(E), and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. We process cases in the order we receive them.

Our papers have only been sitting in CA for 4 weeks,so this may be a little early.but I would like to know whether we can do the medical BEFORE we have NOA2??
I saw on here the other day that someone (from Germany) got their NOA2 on 10/17 and the Interview was scheduled already for 11/17 (and Jesus they were complaining and wanted it postponed.....Gosh I'd be so happy if that happened to us).
So since we will probably be approved (hopefully!) by early Feb I was thinking about getting the Medical done around early Feb.
Any suggestions?

It's just the proof of ongoing relationship evidence that worries me a little.But then again there's tons of ppl that can testify to the fact that he HATES e mails.

That's not fishy thats just my man.....
And nope I don't like it but he has ALWAYS been that way.In the 2 !/2 years we have been together I got a total of 8 e mails from him.He doesn't even e mail his parents,didn't even do so while he was deployed to Iraq......
We DO have a REAL relationship and ya I can provide lots of e mails ,cards and stuff from his parents.And there's dozens of ppl that know we have a REAL relationship but he doesn't see the point in changing for the USCIS.He's hard headed as can be.
Of course I can also provide my phone bills with his number on there........
Yep it's driving me insane but that's HIM.
So in other words I will ask his parents for letters ,our best friends and petty much everyone that knows about us TRULY being TOGETHER AND IN LOVE.
Gee I got an 800$ Engagment Ring,I manage his bank account ,talk to his family all the time,have met his parents ,siblings and even the Grandparents........

Ya I e mail him,send him snail mail and packages........call him and so on.
But he doesnt like doing any of the above,and thats not only with me.In 30 months I got maybe 10 e mails from him.
I guess around the time we get NOA 2 ,and he knows it aint long anymore until I'm home with him he will change again.He always does go back to "normal" once he knows I'm there soon.

Hey Guys,
I would like to know what do you need as proof of ongoing relationship???
My Fiance HATES e mails and we don't talk on the phone more than once a week (he says it's too hard on him cause it makes him miss me more.........)
I DO have e mails from my future in laws,his parents write to me at least once a week....
There's no way I could fly to the US again before we are approved and have the Interview and he can't come to Germany either due to not having a passport and work.
To be honest I'm worried we'll be denied.........
This IS a real relationship,I even have my Engagement Ring to show to them,but he simply doesn't write e mails much less letters or cards in snail mail........

A few Juy filer's have been approved so far and even 4 or 5 SEPTEMBER filers.Which that just blew me off my feet.
If I remember correctly it was Canada once ,2 times Philipines and Thailand.
1 of them was from VSC the others from CSC.
I have no clue how that happened but Gee I wish it would happen to us.Even though I'd be happy to be approved in January since I'd much rather use 2007 W'2 for the Interview and since my Processing times in Frankfurt /Germany are below 40 days January would just be great for me!

Good Luck on your NOA2 and don't worry about it cause your SO only needs a copy of that.If I were you I would go ahead and get the 134 ready now.

Hi all,
well we have received our NOA1 back in October and last week have been touched a few times probably due to the address change for James (USC).
But I have a few questions while waiting for NOA2.
First of all,I know on one form in package 3 I have to list all my former employers from the past 10 years.Well-1 of them doesn't exist anymore.They left Germany overnight and went back to the US abandoning the business here in Germany (very nasty situation,luckily I wasnt working for them anymore when they left). So for that employer I can not list an address or phone number except for the old one when they were still here....
Is that gonna cause problems? Or should I state on an extra sheet that they have moed back to the US and the address is unknown to me?
As for the Medical,
does anyone know how much it currently is in Munich/Germany??
Also,my son has ADHD and is on Ritalin! Any problems to be expected from this condition?(Reason for denial I mean??!!) My son is 6 years old right now,will be 7 for the Medical.
He's at a special Day Care Center here in Germany but is of NO danger to himself or anyone else.
My Fiance is about to join the National Guard so we will have very good Health Insurance (Tri Care,which is new that they now also insure National Gurads and their families for 250$ a month,before you had to be active duty to be eligable for Tri Care)
And last but not least,how long does the German Police Certificate ake and do you need a new one for AOS?
