Hi,
well I will finally go to see my man again in September and will be flying in at Seattle-Tacoma International.
Since I had an experience from hell in Atlanta just this passed February I was wondering if anyone could tell me how Seattle Immigration is.I plan on having a freind of ours waiting at the airport as soon as the plane is scheduled to arrive there......just in case.
The reason I got in trouble in February was because I answered the question of whom I was going to visit truthfully with "my boyfriend".Endless questions and an "Interview" at Atlanta Airport followed....Never had any overstays or anything.Haven't even been to the US for 5 years by Feb 2006.......
So,now I'm worried it'll be bad again.........
Also is Seattle a good POE once we get the K1 next year,which we will put the petition for in by October or November?

The US Citizen lives in Olympia Washington,so usually it would be Nebraska,but with all the transfers is it California now and for how long if so?We want to put our petition in by November but I would like to do as much as possible in paperwork(as in writing it) and need the Service Centers Addy for that purpose.

I also receive the NOA1 hardcopy in the mail today. I have the patience as long as I know what is going on. :D

Although it may be completed much earlier, me & my wife have both set a date of 1 year for the whole process. We have all the documents ready except a second original copy of the marriage certificate - which she will get later.
Although I have my W-2 & copy of my tax returns, I also requested (on July 24th) a copy of my tax transcript for 2008 & 2009 - I also received in the mail today.


That's good you are getting the next step going...I will be in the next few days getting my tax transcripts request sent off and putting a fire under my co-sponser LOL...I wish I had more time...Life and my mom being sick puts alot of stress on this whole journey...But Keep Smiling :)

same here. I received the email & a text message telling me that the application have been routed for processing. I would say give it a week or so for them to cash the check.

Looks like we are one day away from getting our texts and checks cashed...Next is the hard copy in the mail...

If your Mother is still living I believe a notarized statement by her stating her maiden should take care of the problem. Not sure though on how the Govt. would look at it but worth a shot. If your mother is not living a statement from a family member. That is what is mentioned by my lawyer in a letter he wrote concerning birth certificate from China as they did not log those when my wife was born. My wife went to notorial office and made her own statement regarding her birth record and parents names, etc. We have been approved and waiting for packet 3 to be sent to her should be anytime now. Then the wait for packet 4 and interview. Things have gone good to this point started in late Nov 2005 with first application.

There's really nothing one can see in a timeline that would indicate a petition that has a chance of being rejected.

However, Vermont usually processes more quickly than they are going with your case. Have you signed up for online case status updates using your case number on your NOA1?

Cases can get expedited. Yes, this is true. But normally, no, it would take longer than one month to get you into the U.S. I think your lawyer is very optimistic, but hardly realistic. Just my thoughts.
Maybe others can share their advice and experience.

Agreed. Never wait for NVC to send you the forms. You can have them prepared in advance. :thumbs:

Filling out can be done anytime. Do not mail anything but the DS3032 to NVC unless the fee has been paid and you have the applicable cover sheet. The IV fee will change from in process to paid. When it does, you can download the cover sheet and send the applicable documents.

This topic has been clarified and reclarified to death on this board. I know that, even if you have a CR1 visa, if you enter the US after your two year anniversary you can get an IR1 status stamp on your passport. Many people have said this and I know it's true because it's what we did :-P

My question is where in the law/regulations/guidelines/etc is this specifically written? I can't find it on the USCIS website.

I ask because we were given the IR1 stamp at entry after explaining/demonstrating to the POE officials, but now several months later in the mail we were issued at a 2 yr conditional GC. I'm scheduling an infopass appointment to get it fixed but I've already bumped into a USCIS official that doesn't know about this. I'd love to have something written somewhere that I can quote.

Any help would be appreciated.

I found what you are looking for on Dept of State's website:

It states that "if you have been married for less than two years when your spouse enters the United States on an immigrant visa, the permanent resident status is considered “conditional.” The immigrant visa is a conditional resident (CR) visa, not an immediate relative (IR) visa.

You and your spouse must apply together to USCIS to remove the conditional status within the ninety days before the two year anniversary of your spouse’s entry into the United States on his or her immigrant visa. The two-year anniversary date of entry is the date of expiration on the alien registration card (green card).

My husband and I got married in the Philippines last October 23,2010. It shows on the IR1/CR1 guidelines that my husband (US Citizen) needs to include our marriage contract in the packet. I just want to know if we need to have the NSO copy of our Marriage Certificate or the original one (the one that we signed during the wedding and was registered to our local municipality) would be enough. We really want to be together as soon as possible and NSO said that it will take 3-4 weeks (expedited/endorsed) before we can get our NSO copy.

Please help...

If you are applying for IR-1/CR-1 immigrant visa, I would strongly recommend getting your NSO certified marriage certificate. The original wedding certificate may be accepted in USCIS, but NVC prefers documents issued by NSO. According to DOS's Philippine Reciprocity Schedule:

"Documents issued by the National Statistics Office (NSO) and the National Bureau of Investigation (NBI) are preferred...Documents from these sources are centrally registered and are considered more reliable than documents issued by local registrars...Certified copies of originals can be obtained from the local civil registrar of the place where the marriage occurred. These are less preferred than Marriage Certificates issued by the NSO."

So in my opinion, it would be better to attain the NSO copies before sending your packet to the NVC, to avoid any possible RFE.

I and my fiancee is 100 percent sure to get marry this february. so instead of going to k1, we opt to go for CR1 since we want to get marry here in the philippines.. btw, I am the Beneficiary.. i have some few questions regarding the forms for CR1 as i and my fiancee where skimming all the forms..here are the questions..

i-130 form questions

1. assuming i and my fiancee got married. in filing the i130 form., on part B. Information about you ( USC) is she gonna use her last name when she was still
single? or my family name? for example, her single name is Jane Smith. then we got married. my name is John Dough. when filling up the form,
is she gonna use Jane Smith or Jane Dough?
Assuming that you are already married, the USC will use your family name for last name, and not her maiden name. It will then be, Jane Dough.

2. under the part b8. date and place of marriage, : there not much enough space for the place of marriage. unfrotunately , the address where we plan to
get marry is very long. what should i do?
Anytime when there is not enough space, just write (print, not cursive) the required info. The other fields you can use the computer.


3. under part c.19. phone number : is it ok to put none? coz we really dont have a telephone. we make use of our cellphone most of the time.
If you have a cell phone, I would use that number. Be sure to include +63 + area code + number. Remember, it is asking for a phone number. It does not specify a landline phone or a cell phone. It is better to include your cell number, in my opinion.


g325a form

1. the space for Place of Marriage is too short.. the address where we plan to get marry is too long. what should I do.?
Again, if that field is too short, write (print) clearly the information. The other fields you can use your computer.

DS-230 part 1.

1 if the address I put on number 10 ( permanent address in the US where you intend to live) is the same. should i still put that on the number 11 ( address in
the US where you want your Permanent Resident Card mailed) or just leave it blank or put the word ( the same with number 10?)
Yes, I would type the same address in both fields. I assume you will be living at that address, right?


2. under numbr 22. current address of father of the USC, should i still fill it up even if he died 10 years ago? or just put N/A then put the year of death on number 23?
You can place "N/A" If ever this is questioned during the interview, you or your spouse can elaborate.

3. under number 32. in what occupation do you intend to work in the US, am i just allowed to put one possible occupation? what If I am a Nurse, and also a Physical therapist and an Accountant? can i put multiple possible occupations? im bothered because the sentence is singlular in nature ( occupation, not occupations.lol)
Pinoy talaga! Multi-talented a. If you feel comfortable listing all your credentials, do it. I would place just one, your primary occupation. Are you really planning to do all three professions?

4. under number 33. list below all educational institution attented, should i start to fill up the latest? or the first as in my elementary ? and what if,
the spaces are not enough, I can only see four lines for the educational institutions. mine is 6. what should I do?
Yes, I would place the most recent on the top of the list, then work backwards. In the first line, the time from would be "month/year to Present", for example.


5. under number 35. list dates of all previous visits to or residence in the US, ( if never, write never) .my question is, which space will i write the
word never?. please help
I would write "Never" in all fields (ie From/To, Location, Type of Visa, etc)

choice of address and agent.

who should fill this up? me, the beneficiary or my soon to be wife who is the USC?
The beneficiary completes this. You, the beneficiary, can appoint your wife, the petitioner, as your choice of agent. She will act on your behalf, ie she will be designated to receive correspondence on your behalf.

He says he has called and USCIS told him that it is still in process. I live in NY and i believe the Vermont Service Center is processing my petition.

I would get your congressman/senator to inquire. They usually have more pull than attorneys. :whistle:

I applied for my wife in 2008 while i was a permanent resident, I become a US citizen in June 2010. According to USICS, my case has been upgraded
to reflect that i am a US citizen, but my I130 is still not approved. USCIS requested form G-325 for my wife and my attorney sent that form in the end of august.Over 2 months has passed and no word from USCIS on the status of my petition.
I am very discouraged at the moment, does it usually take this long.
I know of people who applied in march 2010 and their wife has already arrived in US
Hope it gets resolved soon, was wondering if there are others who are in the same situation as i am.

Hey, dont rely on getting automatic return emails from NVC, because you typically wont get one. I have emailed them several times, and have had a reply from NVC in about 12-14 days without ever getting an automatic response. I sent my emails multiple times thinking it wasnt going through, and now im getting multiple replies (Another one this morning in fact).. so just be patient they are getting through.

well actually i've been living here for the past 2 years. will be going home in February. Actually, Direct Consular Filing is faster most the time. The petitioner bypasses the National Visa Center process altogether.
Living outside the U.S. may pose problems. Can you prove you were still domiciled in the U.S.? USCIS and NVC may question that.

My wife's AOS was processed pretty quickly. I guess it was luck, because we didn't do anything out of the ordinary. With my stepdaughter's I-130, we actually contacted our congressman and senator to make an inquiry.

Yes, it is okay. It sounds like you are NOT residing in the Philippines, but rather visiting for a few months. Is that right?
It should NOT be a problem. However, if you are residing in the Philippines, you should file the I-130 at the U.S. Embassy in Manila.
