Hello, VJ community!!

October 28, 2013 we attended the U.S. Embassy of Phnom Penh, Cambodia for my wife's CR-1 Visa interview. 

The last step in the process!!!!!
...wait...

No.

 

Our interviewer was young and seemed really frazzled.  The single and only issue he was concerned with was our wedding happening days after our first in-person meeting.  Fact is, we'd known each other for 9 months already; we had mountains of evidence proving both this and for every moment after.

 

We were told to return after about 2 weeks (tomorrow  now) for the result.  Since then, we've prepared affidavits from my wife's mother, father and three brothers stating that they all met me at the same time I met my wife, they have all been in near-daily communication with me and all approved of our relationship from day 1.  (I'd even asked her father for her hand in marriage - which is reflected in his affidavit.)  All affidavits were prepared in English and scribed by each family member by hand & signed with telephone number included.

We have also contacted the Embassy to inform them of this (as well as involving my Senators) and that every family member, especially her mother, are willing/wanting to attend the interview should the interviewer wish it.

We received near-instant response from the Embassy stating this wouldn't be necessary but thanks to everyone for setting time aside for it.  (It was a rather nice response, really.)

 

So, tomorrow our fate rests in the hands of the frazzled young man we faced 2 weeks ago. 

We, and so many others, believe that the fact we have been asked to return versus being simply denied is a great sign.

But, as I always do, I like to be overly prepared for the best as well as always prepared for the worst. 

 

So today we go again to ask for blessings from the unseen as well as from the many blessed living.

And any prayers from all of you great community members is of course appreciated!

Guys (Kenya, India posters) calm down! This is not the place to attack one another and be disrespectful. OP: just check mark yes, and if if they ask you about it you'll tell them the truth. Honesty is very highly valued and USCIS might going to be more forgiving if you honestly tell them what you have told us, including the fact that you signed forms without actually reading them through. You realized it now, you know you f-ed up on the I-485 back at the time, and you deeply feel c.r.a.p. about it. And like someone else mentioned, although your violations are not the one that you'll be ever proud of, they are not of what a criminal mind has in store. Good luck to you!

After having a friend lawyer see my I751 form is when he mentioned how Everything needs to be mentioned and I sort of freaked out....

Well, I don't think those are material misrepresentations. Misreps yes, material no. Material means that had they known, you wouldn't have received your GC. None of them really seem serious enough except you *might* have an issue with "good moral character".

You have to say yes, you have to send court paperwork.

Unfortunately, you admit that you remembered at the time of filling in the I-485 paperwork that they existed but that you thought they were "petty". So yes, you lied on the form. It wouldn't have been a lie had you not remembered them.

I agree with your analysis that you're better off having a chat with an immigration attorney to see what you need to do to save your status.

You lied on your application.  It was not fine print, but a simple question.  You did not tell the truth.  That is misrepresentation.

 

The question was, "have you ever been arrested or fined, etc.?"  And you decided that even though you have, it didn't "count?"  wacko.png

 

The answer is YES and this will come out and you will have to deal with it.  If the infraction is severe enough they can deport you.

Truthfully, it did not even occur to me when I filed it 2 years ago. If I had researched the questions I would have put it as it was....

Okay you did not lie, you committed perjury as the statement above our signature on the I-485 very clearly states "...that the information provided on this application is all true and correct." You should understand that any time you put your signature on a document for the US government and it has the I affirm that the information is true and correct or I am committing perjury, you need to make damn ceratin that the information is true and correct.  Bill Clinton was impeached and almost removed from office for committing perjury. I agree with Harpa that you should have stated "YES" before and should state "YES" now and let the chip fall where they may--it is too late to go back, but do not make it worse by continuing the perjury yourself.

Thank you Dave. It's been a saddening realization that consequences this could have. The bottom line is that it will be a perjury. I am going to go see an immigration for the first time. I did everything myself the last time. May be that was a mistake....

The answer is YES and should have been YES the first time.  Expect some trouble because you lied the first time.

Ever signed any waivers? Do you read everything? I did my I-485 on my own and just breezed over the terms as opposed to analyzing each and every term. It did not even occur to me.

 

But, this time I was actually reading it really well. And, I asked a Lawyer friend of mine. That's why I am more concerned and want to tell everything.

 

I don't want them to think exactly what you thought, which was I lied...even though I had explained above.....

Q20 on I-751 form asks, " Have you ever been arrested, detained, charged, indicted, fined or improsioned for breaking or violating any law or ordinance (excluding traffic regulations), or committed any crime which you were not arrested in the United States or abroad?

 

Before being approved of Conditional Residency, I have had:

  1. Open Container summons
  2. Walking through Emergency Door inside a Subway station without swiping/paying summons.
  3. Fine for having expired ticket in a NJ train summons

I believe the highlighted key terms above are relevant to my history. I just realized that I had said No to the same question on my I-485 application in spite of the violations 1, 2 and 3. Because, I thought these were too petty and did not apply. I was not trying to hide anything.

 

 But, since being approved of my Conditional Residency, I have had: 

 

     4. Public Urination Summons : I paid a minimal fine and pleaded guilty.

 

I don't want to say NO and receive a bigger penalty or even get my permanent residency revoked. These are all the violations I have EVER had.

 

So I should say YES or NO to the question on I751 related to Criminal History

 

Please help. II am putting together a package to remove condition on my residency. Thank you

Just checked the latest VSC processing times. The table was actually updated today and now they're processing applications from May 28th onwards...
Last month it said May 21st. I guess it takes them one whole month to process a weeks worth of applications :( This is sooo disappointing :(

Quick update about my Infopass...we cannot go today :( , hubby had an emergency at work and won't make it by the time we have to be there and he is the one who has the only car we have...On Monday my baby has to see his pediatrician, so I am going to try and schedule an Infopass for tuesday.
I'll post what they say as soon as I talk to someone. :star:


I went to my IO today, since the earliest I can get an infopass is for October 6 here in the Virginia office, and by then I hope to be overseas.
They told me my case was entered in the system on August 28th (the day they received it) and that USUALLY they send the NOA in a week. But also said that they might have a back up.They also gave me the receipt number, so at least that's something...
I asked if I could travel and get somebody to mail the NOA to me. They say that I can leave the country (that's no problem) but, I might have problems trying to get back in. They say they recommend waiting for the NOA if it's not an emergency.

So that's the last news. Good luck Lou Lou. It seems we're "about" to receive the NOA. :unsure:

Does anybody know what happen if you come back with an expired resident card? Will they let me in?
(My country is on the visa waiver program, so in theory I could reenter on a tourist visa....? or not?

I don't know what happens if you get caught out with an expired card. That is, I can't say definitively, although I suspect that you would be admitted (maybe scolded, but you ARE still a PR).

Since you are a PR, you may NOT use the VWP or a tourist entry; you must present yourself as a PR to be admitted.

Since this recent slowdown with the NOAs is just starting to affect people, I think it's in your best interests to hang on for a bit longer, tho I realize this hinders your plans somewhat, this is my thinking:

IF (big IF, let's not focus on that ;) ) no NOA shows up and you are in the last week of your card's validity. At THAT time, I'd go to my DO (InfoPass) with proof of mailing my I-751 and its reciept, evidence of the payment, my GC and passport and ask for a stamp. I have no experience to say that this does work, but it does make sense and would be AN option. This at least gives you a fixed date to purchase your tickets (after card expiration).

I have an Infopass appointment at the Baltimore office tomorrow in the afternoon, I will ask all these questons to the IO and then I will post here what they will say.

I have thought of another plan:
what if I go on my trip, and somebody mail me the NOA when it gets here? That way I could reenter legally.

I have another question. I sent a money order. Is there a way to know if they cashed it? Would the bank give me a receipt saying that they have cashed it?

I'm more or less like you, Churipu, I sent my I-751 to Vermont on August 26th, they got it August 28th, and I haven't get the NOA yet. I'm travelling overseas too, so I'm waiting for the NOA to get my ticket. I hope I would have got it by now.

Hey everyone,
I'm getting ready to mail my I-751 package in the next week or so and I was wondering if I should include social security statements for me and my husband as evidence of joint address - we lived in two different places.
I've been in the country since 2001 and paid and filed taxes and all, but married since 2008.
Should I include the social security statements or not? Is there any advantage / weight in application to remove conditions?
