congrats Bani...so based on your timeline I see Mumbai consulate received your case on July 14th..and almost 1.5 month later is the interview date. Does it take usually that long?

I'm in big dilemma right now as my wifes PCC is taking long time from passport office so hoping her interview is done before November 15th that way it'll be before 6 months of her passport issuance. Do you think I shud also get PCC from local police station as well just in case? Getting a PCC from Mumbai is a hassle...

wait the extra 15-20 days now rather than spending extra time dealing with RFEs and trouble of sending documents later...god knows they might not make it to the correct file...better to send everything together.

I've already submitted my DS230 guys but without PCC as PCC was not sure when I will get it. Now I'm going to wait until NVC says they need PCC though I have written letter explaining why I cant submit now and both PCC will be submitted at time of interview. Lets see what happens. 1 of the operator suggested me to do this. If they dont approve, I will submit it regardless of RFE.

Nimche is absolutely right. There is something funky with their payment system but dont worry abt the status. the payment receipt has the correct status..and it will show either paid or in process... good luck!

I'd sent my DS230 initially without the PCC as it was taking a long time for me to get the PCC. Even though I wrote a letter to get it approved without it, they did not it seems but not a big deal.

I called the NVC operator today and she said there was a note from officer on my case about PCC missing but said they have not generated an RFE yet. I told her I already got my PCC If I should send it and she said yes as long as u have barcoded cover sheet.

I do have PCC + barcoded cover sheet... should I wait for RFE or generate one using James shortcut? she said just barcoded coversheet would be fine.

Any suggestions?

Do you have a co-sponsor? They do ask for BC of petitioner and co-sponsor, to prove relationships.
I recalled a Canadian VJ member was asked to submit original BC of petitioner.
NVC probably has a reason, if I were you, I would just mail it a.s.a.p.

No I do not have a co-sponsor. I really think NVC thinks me (petitioner) and my wife (beneficiary) has a different relationship and not husband wife, that's why both operators were like you need marriage certificate of petitioner as well. I'm like i'm petitioner and if you have marriage certificate sent by beneficiary its one as same as we're married. then the guy said oh yes, there would be only 1 in that case.

I dont know I will still send them the birth certificate even though it should not be required. I'm afraid since its my (petitioners') original birth certificate whether they will courier it to embassy in India and beneficiary will get my originals back at time of interview.

you dont need to wait till AVR changes. As long as you can print the bar code sheet for AOS, you can send them I864.

DS230 wont be invoiced until they enter choice of agent form. You can either email (in my case email took almost 10 days) or mail them choice of agent form.

The petitioner is already a US citizen. It is the beneficiary that applies to be given a visa to travel to the US. The beneficiary is the one interviewed

Hi,

 

If the interview will be scheduled after 2 years since you got married,the embassy will issue her a IR1 visa,because her status will change,but anyway,even if the interview will be scheduled before 2 years since you got married, her status will change anyway at POE(at POE she'll need to bring your marriage certificate and she'll have to tell CBP that she is married already for 2 years,that's what I did).

Hey guys trying to figure out how this works...at what time do they determine if the spouse will receive a IR1 or CR1 visa?

to my knowledge...

being married to your spouse for 2 or more years qualifies them for a IR-1 visa meaning no need to remove conditions.

my question is when is that decided?

at P.O.E ? At the consulate during interview? or when NVC forwards the case to consulate they forward  what type of visa consulate should work on?

Because I got married 10th of FEB 2012 so 10th of FEB 2013 was my one year anniversary... and this 10th of FEB 2014 will be my 2nd year anniversary...

so if my wifes interview is held after the 10th of FEB will she be getting the IR-1? or will they document the date that NVC forwards? or at the POE it is at the discretion of the officer? weather he wants to give IR-1 or CR-1.

Yes you can send DS-230 without PCC, just mention that you will provide it in India suring interview.

Dear fellow VJ'ers,

I paid my IV bill today and downloaded the cover sheet for IV package. The next steps as suggested on the NVC portal are to send a filled DS 230 form along with civil documents. Questions is, I have a signed & filled ds-230 document and missing a police clearance certificate from the list of marriage, birth, passport biographic page and records of continuing relationship. Can I just post packet over to NVC with what I have(w/o PCC) and wait until I get an RFE or wait until my spouse to send me PCC in next week and then post the document package?

I was reading an online post where NVC will ask for the document to be submitted before interview and still completes the case here sometimes. Just want to confirm which part is true. Thank Ya all!


PS:The docs I have are essentially photocopies of originals.

I am asking this on behalf of a friend of mine. She (a USC) and her husband (an Indian citizen and former green card holder) have been married for 28 years and now live in India. They lived in the US for 26 years and his green card recently expired.

Before that happened, my friend petitioned for him to get back into the US. Here's where things get funky. She said that she filled out all the paperwork and the USCIS was supposed to send her Packet 3. I asked her if she was sure that this is what they said she needed to fill out (I knew she had to do packet 4) and she confirmed. She sent it in and hasn't heard from them since... that was a year ago.

I suggested that she contact her home senator, but I honestly think she needs to start from scratch. What should her next course of action be in order to get her and her husband back to the US?

In this particular case, what is the best option?


I am thinking that your friend should be able to submit paperwork using Direct Consular Filing ( DCF) process if she got recognized herself as US expat in the local FRO. DS-130 and IR1 are the next steps to follow.

Couple of things affect the date of validity for CR-1 visa :
>Time when you attended the medicals.
>expiration of passport.

Your application for GC will automatically will be triggered by the CBP at POE. They will process to send the card to the US address you mentioned in either DS 230 and takes anywhere between 3-6 weeks.

The interview wait time depends on case backlog at the local consulate in Stockholm. I have heard of people complaining to have to wait from anywhere between 1 month to 10 months. You will be notified aleast 3 weeks before interview, allowing you to prepare and attend for medical examination.
Unless you were told by NVC that the case is completed and your case is being sent to local consulate, you should not be sure about guestimating the wait time. Ppl experienced delays waiting for interviews only to find out later that NVC has not marked the case as complete due to missing paperwork. So do confirm this first.

I'm expecting our case will be completed this week or next, and because I'm planning a trip I'm wondering how long it usually takes after that to receive an interview date, and how far in advance I'll be notified. I'm interviewing in Stockholm and I have heard of one very long wait, but hopefully it doesn't reflect the norm!

What some incorrectly call an Islamic marriage can't be enforced because it is only between the two of you and you gain nothing from it, legally or spiritually. Even if the community knows, they have no say over your acts. This is not even the way it was done by the Prophet. It is a fable some believe.

You are worried that if you do a fake marriage in Egypt that it will hurt your chances to marry legally and correctly in the US. You should know that it is actually insulting to knowlegable Muslims for people to go to a Muslim country and flaunt their laws, but then worry that they must obey the law of a non-Muslim country to get a visa. Don't treat Islam and its requirements cavalierly. It is not a toy; it is a real faith with real obligations and should be treated with respect.

Most of the women here are not Muslim, and no one comes here saying they're going to have a fake Christian or Jewish marriage, then do a K1. They know better than to disrespect their own faiths. I don't understand why any honorable Muslim man would even suggest a fake marriage to a women he respects, much less call it "Islamic".

I'm also surprised that no one who answered this thread informed you correctly about any of this. I am not trying to be harsh, but Muslims should know better than to allow others to do this. We suffer the burden of the sins committed by those we mislead. So, have an engagement party, if you wish, but don't do what others who know less have done before you.



I don't think the person who asked the question is talking about FAKE marriage or breaking the law or anything of the sort. It's a simple question that needs a simple answer.

Yes, people can have an Islamic marriage without documenting it, and it's 100% Islamic, though it's more advised to have everything written to protect every ones rights.
The conditions of the Islamic marriage according to most schools are:
"Full consent of both partners to the marriage, and expressing the above consent through ijab (offer) and qabul(acceptance), the presence of two reliable witnesses, and in the case of females, their guardian’s consent has been considered essential for the validity of marriage according to the majority of imams and scholars."


Many people had to go through this path before applying for the K1 visa to avoid many unislamic things.

Thanks again! That's a good point, that I don't want to make it into a mountain if it really is a totally common little molehill....which I have to think that coming out of Morocco it is. My fiance and I have discussed this quite a bit for months and it does sound like "everybody does it."

I'm interested if anybody else had that in their SO's past and whether or not they disclosed it separately or if it came up at the interview or if they feel it impacted their petition in any way.


First, if you wanna disclose this information I don't see where on any form you can do that. A DV entry is not a visa application, so I don't see where you can disclose it.
secondly, in my opinion disclosing, a detail you are not asked about gives the feeling that you are trying to "come clean." Don't answer a question you are not asked.

My fiancee had at least one DV entry prior to our K-1 application. We didn't give this detail any attention and she was not asked about it.

Don't pay any attention to it, but if your fiance is asked (which I doubt) he just tells the truth.

Apparently the fees depend on whether or not you apply for them all at the same time or individually. If you dont do them all at once you can end up paying individual fees per application.

Not necessarily. You can send I-485 first and pay the 1010 fees, then when you receive the notice of action, you can send the other applications with a copy of the I-485 NOA without paying any fees.
