IndiaHindu Marriage Act

Not sure where to post this at and I figured this would be the best place since here soon we will start the CR-1 process.

 

I been doing lots of reading about the Special Marriage Act and the Hindu Marriage Act and decided it would be best to go for the Hindu Marriage Act. Now I want to make things clear before I head to India in April. As I was reading and to my understanding and please correct me if I am wrong, that I  can go to the temple convert to Hinduism, get certificate of conversion from the priest who is going to marry us and then we can get married, go and register our marriage and submit our documents to show that we solemnized our marriage. Now it mentions about a gazette officer who witness the marriage ceremony. So do we need to hire this person or can we have affidavit   from witness? Both my fiance and I don't want any kind of mistakes. I would love to hear how others went though this process! idea9dv.gif

 

 

I am sorry to bring disappointing news to you but from a strictly religious perspective you cannot "convert" to Hinduism, either you are a born Hindu or you are not a Hindu. You can "re-convert" to Hinduism if you had given it up for some reason but you cannot "convert" to Hinduism. I am from a family (North Indian Brahmins of highest order) with very strict Hindu values so I know what I am saying on this matter. This has been widely accepted by Hindu scholars since no widely accepted Hindu scripture talks about any formalities to convert to Hinduism. So there is no scripture to specify formalities for the process and hence it is considered not possible. The general belief is that either you are a born Hindu or not a Hindu at all.

 

However legally there might be some workaround/loophole to get around this because there are also no precedents in the scriptures against the conversion. So you might want to check these laws if any exist or else your "conversion" might be considered invalid. In general it might be better to avoid Hindu Marriage act in your case. Don't go by what a "common" priest says, he might just be trying to make some quick cash, go by what the law says. Consult a good marriage attorney if needed.

IndiaCan someone please share a PCC so I know what it looks like?

I went for PCC today. My passport doesn't have my husband's name but I mentioned my husband's name on PCC form. The Passport officer while checking my form changed marital status from married to single. I told him that I am not single and I have applied for immigrant visa based on my marriage. He said he can either issue PCC based on the information on my passport which says that I am single or else, I need to apply for reissue of passport with my husband's name on it & then apply for PCC. I told them that I am in a hurry & can't wait for this long process for which he adviced to apply under Tatkal. I have few doubts :

 

1.Does the PCC letters mentions marital status on it?

2.Is police verification required for adding spouse's name on passport under Tatkal.

 

Anyone with similar experience, please share.

Just thought I'd share my experience.

1. Medical: That was easy. I called Max Med center up, they told me to come the next day with photographs, my passport, appointment letter (email-ed appointment letter was also ok for them) and about 4000 Rupees.
I showed up at noon on a Saturday, that was a mistake. It was terribly crowded and it took me 4 hours to be done. They take your blood test and xray, and then you have to meet a doctor. The doctor wanted to see records of Dtap and Meningococcal vaccination. If you don't have one they'll ask you to buy it and get it done. Thats it. I picked up the report around 10 days after that. The 4k estimate included the two vaccinations btw.

2. PCC: I din't have police verification done for my passport so I couldn't get it on the same day. It was a LOT of waiting. At the PSK you can walk in for PCC's. You need to make an account online on passportindia.gov.in. Fill out your PCC application, and upload it back again, and take a print out of the receipt (ARN sheet with the Barcode) when you go to the PSK along with your passport copy, residential proof (they were not accepting Drivers license/ration card - i took verified Bank statements for the last one year) and your appointment letter. The APO did insist On seeing something for the visa.

This was the easy part. It took them 10 days to send it to the central office in my city by registered mail. i went there often to check on whether my application got there. Then I followed up constantly, with the local police, then when it was finally sent back to the Passport office, i went to the regional passport office to get a status of my application, which they cleared then, then i went to PSK, and finally got my PSK. Took 3 weeks, and a LOT OF follow up. If I hadn't followed up it would have take 5-6 weeks atleast i Believe.

My wife will be going to Chennai for her medicals. Please share your wife's experience at Apollo Hospital, Chennai. What questions do they ask at the medicals and do they ask for any previous records? Are there female doctors to do the physical examination? What exactly are they trying to find in the physical examination?

Thanks, Iwaiting and aanu.   No one ever bothered to ask x-ray at consulate (we did not get the one from Apollo itself)- may be all info goes in to medical report.

 

Anyways, my spouse and daughter were approved-no docs were asked at the time of interview including 2012 tax transcripts.

You have to send the DS 230 Part 1 back for an interview date. You can do this via mail or email...we did it both ways to make sure they got it. Packet three will come after the case clears the NVC and is recieved by the embassy. You can call the Department of State (DOS) to get an update on your case and find out when Kingston recieves it, when they mail out packet 3 ect. There number is 1-202-663-1225 Here is a shortcut for the system to speak to an operator (prob other ways but this is the way I use) press 1,4,2,3,2,0 in that order. Packet 4 is the appointment letter, you will need this for the medical exam as well. I am not sure if anything else is in packet 4...maybe ill post that too once we get it (this week fingers crossed) :)




When you sent the email, what do you write in the body of it? You just attach part one of the DS 230 and request and state that you're asking for an interview date?

Hi VJ'ers,

I am in US and my wife is in India. I got the AOS invoice ( Thank God after a 28 days of wait after NOA2) and I paid it ASAP immediately online. Now:

1)Will DS-261( email copy) be accepted for applicants from India with petitioner in US? Any VJ'er can confirm this?
2) Is it possible that NVC will accept DS-261 in the form of electronic signed copy instead of DS 3032 that is signed back and send from India to US in postal mail?
3)What is the next best step to speed up things? Sorry, but just like everyone else here I am bit desperate to rejoin my family member ;)

Just to mention, the guy in the video was attending the Non-Immigrant visa line which is why there are long waiting lines. Do remember, USC spouse is not required to accompany and can skip the trip.

This video helped my spouse to understand what is it like inside and how it works..Trust me it takes away 25% of stress( my spouse claimed).

I would agree with himm don't listen to anyone else...Answer honestly. The long line outside the embassy I wonder if thats what you encounter....So whats the point of coming early if your scheduled interview will be done at the same time?

IndiaIndia Passport- Spousal Name change after Marriage
It depends on RPO person at that time. In our case they didn't seem to care and issued the RPO PCC. The content of PCC is what matter, make sure there are no typo's in NAME, DOB and most importantly the passport #.

Hey Guys,
I am trying to get PCC certificate for my wife from Indian Passport office and i was told by someone ,when you apply for PCC and if your current status is Married you will be required to update the passport with spouse name added to it and it could delay the process. Or they just ignore it and provide the PCC. anyone experienced the same or i am just worrying for no reason.
