Since I got my NOA2 (Jan 22) I have called NVC EVERY DAY (at least once) to check the status. I have also emailed them 5 times and also gone to the USCIS office in my state 3 times and spoken to them. I finally heard back about an email I had sent out and they are researching it. I also called USCIS and talked to a second tier rep that put in an expedite request because it had been over a month. Don't listen to the reps that say 90 days. That is not true. I don't think they know what they are talking about. It is suopposed to take 15 business days (roughly 20-25 days) from NOA2. Sometimes things get lost I was told by the second tier rep and he said if I don't hear back in a week call again. So I will let you guys know what happens when I hear something. I waited over 7 months for the NOA2 and now waiting over a month for NVC to get the file. I think I will have gray hair and walk around with a cane by the time my fiance gets her visa at this rate. This is so pathetic. We are living in the information age when everything is done electronically and with a click of a button. There is no reason to make people wait this long to unite with their loved ones.

Hi everyone

I am petitioning for a fiance visa and applied in June 2012. Our I-129F was approved in January and we got a notice (NOA2) on 1/22/2013. Today is 2/22/2013 and it has been exactly 31 days since NOA2 and I have been calling NVC and DOS every day and they have not received it yet. I have emailed NVCResearch@state.gov with a scanned copy of my NOA2 three times (three emails) in the past 3 weeks. Still no responce. Furthermore, I have made an appointment at the USCIS office in our state and visited them. The USCIS officer told me it was approved on 1/22/2013 and was processed to be mailed out on 1/28/13. He said "I cannot see anything beyond that". Basically he told me it is out of USCIS hands and that I need to follow up with NVC at this point. The NOA2 approval letter says the petition has been approved and forwarded to the consulate (in Turkey). I think all finace visas go through NVC regardless of what the NOA2 says. However, I have also emailed the consulate about our file and they replied a few days ago that they have not received our file. I don't know what to do at this point. I call NVC every day and they tell me I just need to wait. It is not lost. I have looked at hundreds of timelines on this website and I have not seen a single person whose timeline indicates such a long delay from NOA2 to NVC receipt. This is really worrying me. Any tips or advice would greatly be appreciated.

I'm not sure if the answer to this question is specific to each consulate or standard across the board:

Is there a time limit by which a K-1 applicant must schedule their interview once the consulate notifies them that their application was received?
My situation is that I'm only able to travel to Ecuador during a small 2 week window in the beginning of May. I am currently 122 days into waiting for my NOA2, and it's probably reasonable to assume that even in the best case scenario, I won't get my NOA2, then get the application sent to Ecuador quickly enough to have my fiancee set up her consular interview during my 2 week window (I already bought my ticket months ago, and general consensus is that Ecuadorian K-1 Visa petitioners DEFINITELY need to be present during their fiancee's interview).

After my visit in May, the earliest I can return to Ecuador is the first week of August. Does anyone know for certain whether the embassies allow you to request an interview date 3.5 months into the future? Or do they have some stupid policy requiring you to immediately take advantage of your application's receipt and to complete all of the steps within a certain time limit?

I emailed the Guayaquil consulate but never got a response. Any insight will be greatly appreciated.

A&B states, stick to the guidelines for a K1 they jjust want evidence you have met in the last 2 years and at petition level all you need is 2-5 pictures is what they are asking as some of these may not be given back to you. You can hold on to your album to show at an ibterview stage maybe? I think sending 30 is excessive particuraly as the requirement is for 2-5 smile.png

 

 

Documentary Proof of Having Met in Person in the Past Two Years and an Ongoing Relationship:

Use as many of these items are possible. There is no minimum, but the more you can provide the less likely you are that you will receive an RFE. Additionally, please note that providing proof of your ongoing and genuine relationship in this package may benefit you by allowing the consulate to have access to this information prior to them formally contacting the non US Citizen fiance. Many high risk consulates approach cases with a skeptical eye and providing this information early on in the original I-129F package will help them in their preliminary review of your case.

1. Copies of all airline boarding passes, train passes, itineraries, hotel receipts, passport stamps (make sure you can read the dates on the stamps), and other documentary evidence that you have met within the last two years. You may want to highlight or place post-it notes indicating the dates and locations on the copies (to make the adjudication easier) for the person reviewing your file. 2. Color Photo's of you and your fiance(e) together. Make sure you write your names, date, and location on the back of every photo. Provide two to five photo's. If you only have a single copy of the photo, then make a color copy and send that. If it is a digital photo, have it printed at a local photo store such as Walgreens (if at all possible) or if not on a high quality printer. Place photo's in a plastic bag or photo sheet and label the sheet. Note that you may not receive originals of photo's back. 3. The following items will not typically show proof of having met in the last two years however will show proof of an ongoing relationship: Copies of land line and cell phone bills, appropriate letters and emails, stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

You are travelling from the UK I doubt you'll have much trouble. I too am waiting for my NOA2 but been going back and forth to see my fiancee, so long as yiu hsve your returned ticket you'll be fine.

crazysamurai.. ATTN is DR not DS. CMR is for I864.

Also yes you require originals or certified copies to sent from original source. certified copies are not same as notarized copy that we get any lawyer to stamp it... it needs to be from the original source who generated the document or any government agency.

I'd send originals only instead of going thru hassles of getting the certified copies. They will return the originals at time of interview to your spouse.

I tried calling NVC again but they wont budge infact the operator was so rude she's like forget October if November is also not available you have to call in November for an interview in December.

They should just send the application to embassy and let them schedule it. Why do they have to wait for a particular week in month I dont get it.....

NVC process with shortcuts is definitely faster but could be much more efficient.

Yeye. In my case I just submitted PCC from passport office only.

Infact they were saying you need 1 from local police station as well, I told them on the phone to review the passport copy as her passport was issued in May which makes us fall under 6 months so they accepted it.

They have to approve your DS230 without both PCC's and just from Passport office if your passport was issued within past 6 months. Its their own rule, they cannot deny it.

Guys here's the deal if you go into NVC's website which when you get your DS230 instruction packet will tell you to do:

It says:
IF the applicant…lived in a different part of their country of nationality for more than 6 months - PCC from that local office
IF the applicant... lived in a different country for more than 12 months - PCC from that country

Section 5: # Review the U.S. Embassy/Consulate General-specific information.

Section 5 when you review individual consulate / embassy instructions it does not say from all places.

I'd say ask NVC if you're really doubtful, but hey how do they know where all you lived? Its based on what you specify in DS230 right.. think think smile.gif

Either way, I'm no lawyer...i'd say if you have enough time in hand and patience of going thru the hassle of getting from each diffnt place in country you lived more than 6 months, get it. If not, just follow consulate information... thats what NVC seems to be requested in my case.

think abt it..if you're 30 and at age 16 you lived in a small town for 7 months, would you get a certificate from there? They will not have any records of you.... Not possible...

I'd say just get 1 from Passport office and 1 from Local Police station (if passport issued more than 6 months ago).

Just my 2 cents...who went thru so much hassle to get 1 PCC from Passport office in Mumbai..glad its over now..

What's the safe bet to buy tickets for ... i.e. how much buffer zone should I give after interview..1 week or more?

Can people share their experience of interview @ Mumbai how long before you get your visa..same day 3,4 business days. They charge your courier fees..so do they mail you the passport back.. if yes, how long do they take?

I'm unsure on which date to buy tickets for...but at same time I want her here early enough so that I get her SSN in mail so can apply in 2008 Tax returns haha.

1. They will send beneficiary a letter which you'll need to schedule medical. Can be done anytime. It usually takes 5-7 days for report to come..so early november should be fine.

2. Copies/Originals of every single thing submitted and also a duplicate copy of Affidavit of Support package.

3. Will need to pay courier fee...all instructions will be in letter...

4. No Interview they dont allow anybody but the person itself...

usually in most cases its after you send I864 it says missing documents and people think something is missing in I864 but the fact is they're waiting for DS230 to be received. Only If they accept the choice of agent fast enough then I864 and DS230 can go almost same time.

I've a neighbor who needs to file for his second wife. He recently had a child with her and also she has a child from her previous marriage so he has a step child.

So my question is does he need to apply 3 separate I130's and pay separate application fee for all of them?

USCIS I130 instruction says:
1. If you are a U.S.citizen you must file a separate Form I-130 for each eligible relative.

You may file a Form I-130 for:
A. Your husband or wife;
B. Your unmarried child under age 21;
C. Your unmarried son or daughter age 21 or older;


Also, wont USCIS combine all the I130s as it'd be kind of stupid to not give your wife and your child under 18 visa at same time.

Well even if submitting to VFS I will not fill out another one but just print the one I already submitted at NVC and have her sign it and give it.

Most likely we will be just taking that to consulate. VFS usually asks you for that as they want to verify if you have all the documents you need before interview.

You're right airline prices has not come down due to crude yet..but defn the conversion rate of $ has helped..same ticket i saw 2 weeks ago is costing me $50 less now but in terms of Indian currency its same.... $1 = 49.22 rs now smile.gif

Also you can make her come to any place in U.S man...its just wherever she enters they will take her sealed packet there.

Chicago and JFK...dude not much difference..Chicago is like 700 bucks...where as JFK 675.... unless you want kuwait or emirates airways..the shi.... airlines ever...

In our case beneficiary received both from NVC and VFS. Mumbai embassy does not send you anything. Its VFS who sends it.

Its funny though when we called VFS they said even though you submitted all the docs, you have to submit DS230 we sent filled out again with copy of docs if you sent original to NVC.

We will be giving them what they need so they dont create an issue with our application.

Has anybody who already went thru their interview had to submit DS230 again at the consulate?

My wife also got Packet 4 from VFS wihch had DS230 attached to be filled out and it asks for originals for all the other things.

And guess what it says courier fee of 365 where as their website says 394.

These guys are idiots as they have not updated their Packet 4 instructions as to if you submitted everything to NVC already no need to submit it again.

There is one good thing thought, on their instruction it says you may wish to submit all documents at your interview only but it is advisable to submit it to VFS for review and correctness.

I told my wife call VFS and find out more information but most probably we will just pay courier fee to avoid confusion and fill out a new DS230.

Anybody who had recent interview from Mumbai..what did you guys do?
