K-1 Fiance(e) Visa Process & ProceduresI-134 Affidavit of Support

Mo, I've noticed with Jamaica they ask for more than the prior year's return. I'm sending 2010, 2009, and 2008 just to be on the safe side. In addition my employment verfication (detailing salary), three pay stubs, last three bank statements (with bank verification letter), and 401K quarterly statement. I don't want to hear a blessed thing about insufficent financial documentation lol

They just nosey!
Brownie you sound WELL PREPARED!
I didn't file taxes for years prior. I was in grad school , not working at all. Do you think it is a good idea to send in a letter stating this?
They already have the last 6 paystubs along with the letter from my bank about my MMA, etc. ... I just want to make sure I have enough.

K-1 Fiance(e) Visa Process & ProceduresI-134 Affidavit of Support
Hmm... I am confused.

@Sus- you're saying they'll ask for 3 years tax returns for i-134 on a K-1? I was under the impression (per the instructions) that you only need a copy of the last income tax returned filed ONLY IF you are self employed. If not, only A and B (see the instructions: http://www.uscis.gov.../i-134instr.pdf) were to be adhered to? (I did give my last tax return filed just for extra info though) but I am concerned if it will be enough?

And I thought the K-3 is what required 3 yrs tax returns? But Travel State says:

The sponsor is required to submit an IRS transcript or photocopy of only the most recent Federal income tax return with the I-864. However, the sponsor may, submit Federal income tax returns for the three most recent years if that helps establish his or her ability to maintain the household income required in the poverty guidelines. The consular officer determines if the income claimed by the sponsor meets the poverty guidelines. If the claimed income does not meet the poverty guidelines then the consular officer may additionally request current year income information.

I'm confused...

to get the police certificate she doesn't need the report. but keep in mind its a 30 day valid paper. so get it in the right time.

Not quite sure if this applies to DR, BUT, for Jamaica you are in fact allowed to email the consulate requesting packet 4. You may have to email them ma few times, but its possible. I'll google around and see if you can do it for DR and post back..

K-1 Fiance(e) Visa Process & ProceduresEmail received from Kingston consulate

Hello All! I sent in our Packet 3 via email and via Fed Ex. I received a letter from the Kingston consulate saying that they have used the information I sent and updated the records and that we should expect an interview letter in the postal mail within four weeks. Is this normal? Will it come via email or via postal mail? This thing is dragging on tooooo long!

You are able to email them and request that they send you packet 4 via email. Aside from JA post being crappy, my fiance and I requested it email because his work schedule doesn't coincide with when the post office is open. He's yet to have gotten it in the post (we were approved the 1st of this month). It took several weeks and incessant emails to consulate to get it by email but it was worth it.

Be sure to include 2nd Inquiry- your case number in the subject line. Best wishes!

They never looked at phone records for ours either. In fact, my fiance said all they paid attention to was what they already received in the I-129, the tax information, the police cert, and the non-imped. They didn't look at Moneygram receipts, Phone records, letters, or any of the other evidence prepared by him/on his behalf by me.

K-1 Fiance(e) Visa Process & ProceduresEmployment letter help!!!
Hey Lexi!
Just tell your company that you need an employment verification letter that includes your title, salary, and the date you started until present.

It has to be on company letterhead.

For example, the first paragraph of my employment verification letter read:

To Whom It May Concern:

This letter is to confirm employment of _________. Ms. _________has been working as a Project Administrator on a full-time basis since June 1, _____. Her current annual salary is $________. This
position is full-time and year-round, rather than of a seasonal nature.

The next paragraph is a bit about the company itself.

Lastly, its signed by the HR Generalist.

The instructions state one, but to be on the safe side it would be good to send 3.
I only submitted one year's worth along with a letter of why I didn't send 3 years worth (I was in grad school full time)along with 6 months worth of pay stubs. Had no issues.

K-1 Fiance(e) Visa Process & ProceduresKeep Copies of POE Documents!

As we prepare to get another original copy of my fiance's birth certificate and as I wonder what other paperwork we may have lost to the "sealed envelope" handed over at POE I just wanted to remind those who haven't been to their interview yet to make sure they keep an original copy of such important paperwork. I got tired of making copies and didn't know they were going to take my fiance's birth certificate and not give it back. It is my understanding now that they would have accepted a photocopy. So...just another thing to think about as you prepare. Look ahead to what will be needed for AOS and what might be difficult to obtain once your significant other is no longer in their home country.

Great advice. My fiance purchased 2 copies of his Birth Cert from Kingston and kept one for himself and gave in the other. It comes in handy.

K-1 Fiance(e) Visa Process & ProceduresTraveling on Tourist visa while waiting for a Fiance visa
It's worth a try, my fiance' got a 5 year Toursit Visa and she visited me in the US in May, but that was before I applied for the K-1 Visa, which I did in July. I think as long as she sounds honest about going back, the Immigration desk at the airport will let her into the US. We have yet to try this. One immigraton lawyer told us not to state anything about the K-1 submision, unless they ask about it. Why complicate a situation when it is not necessary.

QUOTE (dalmatino @ Nov 3 2007, 10:14 AM) <{POST_SNAPBACK}>
Hi guys !

I was wondering if anyone has experience with that? Can one travel on tourist visa while being processed?

Probably it is hard to get a tourist visa if mentioning that one has a fiance in USA. So , what if one lies at embassy about that and they discover it. Can it have an influence on the fiance visa that is being processed?

Let`s assume I manage to get a tourist visa though. Will they let me across the border with it since I am in the middle of process of getting the fiance one...

Does anyone have experience with anything like that?
Any help is welcomed.

K-1 Fiance(e) Visa Process & ProceduresLengthy visits while waiting
Well, we met in Washington D.C. while she was on a study tour last year. I have been to Brazil twice, she came here to the US to visit, once. We also took a vacation in Europe this year. Thinking that the K-1 process would be fast, I applied in July, but now wish I had applied earlier. I don't think my petition would be reviewed unitl December, if the dates posted reflect, actuals. She is reluctant to quit her job unitl notification of interview. I do enjoy my trip to Brazil, but I am burning up lots of leave.

K-1 Fiance(e) Visa Process & ProceduresDo you think USCIS looks at this website?
I don't think the officers care to read what we have to say on this site. It is just a job and they have other interests they like to pursue after hours, just like each one of us have and do. But make no mistake about it, there are other in the Homeland Security Bureaue, who is tasked to search and read sites like our, and provide short synapses to the Managment, so they are aware of things.

Most probably one of the reasons for the increase in the K-1 processing fee is to defray the cost of Security and background checks on each one of us (USC). This background infomation is gathered by privite companies and are not cheap to the US Goverment..yes, they too have to pay for this infomation...it keep the economy going. Information is power! Don't you agree!

K-1 Fiance(e) Visa Process & ProceduresDeadline for K-1 (packet 3) application return to Embassy
QUOTE (CL79 @ Mar 3 2008, 09:18 AM) <{POST_SNAPBACK}>
I actually have the same problem. I have not gathered all my documents yet and one of my police certificates will only arrive in three months time and I am expecting my Packet 3 this week, as promised by the embassy. Worried about the delay to return my checklist, I wrote to the embassy and they told me this:

"There is no time period to submit the checklist but you have to do it immediately after gathering all your required documents."

Therefore I suggest that you should let the embassy know of your situation and apply for extension of your NoA 2. NoA 2 has four months of validity.

Good luck!

We received the NOA2 notice December 14th, so that would imply that my fiancé' would have to return the packet 3 forms (required forms + copy of Passport) back to the Embassy by April 14th. That would work, then they would schedule for an interview, at which time we can request for an delay in entry.

On the other hand it would be better to ask for an extension of the NOA2 from April14 say September 14th. Has anyone here requested for an extension of the NOA2. Would like to know how that process went. Any advise is greatly appreciated. thanks CG.

K-1 Fiance(e) Visa Process & ProceduresDeadline for K-1 (packet 3) application return to Embassy
Hello Everyone,
I have had a smooth sailing so far...but now I have a snag, but it is not with the Embassy. My fiance' got her Packet 3 from the Brazilian Embassy in January, but because of property settlement issues she won't be able to leave for the US until October of this year. She has yet to apply for the K-1 visa, we thought we would wait for a few months until she applies, so that October will fall within the 6 month window, after visa issuance, that she need to leave for the US. The questions is can she wait 4 or 5 months before she applies for the K-1 Visa...does it expire? I would hate to start this whole process with the INS here in the US again. Or should she just apply and then advise the Visa Office of her desire to leave later in October. Please advise, I just don't know which way to proceed.
Thanks much,
CG

K-1 Fiance(e) Visa Process & ProceduresNOA1 Not Recieved After 90 Days - Called for Status
QUOTE (Wyatt and Pim @ Oct 26 2007, 02:28 PM) <{POST_SNAPBACK}>
Hi All,

I just got off the phone with USCIS customer service to report that I haven't yet recieved an NOA1 after 90 days and they gave me a referral number after taking some info about me and the fiance with instructions to call back after 30 more days if nothing changes. I just realized with horror that I gave them the wrong birth year for Pim (fiance) as one of the pieces of info they asked for. Will this cause any problems? I know I'm probably being paranoid, but I definetly don't want anything to hold up this process anymore than necessary as I'm sure everyone here understands.

Can anyone soothe my worried soul?

Also, can anyone tell me what this call will actually do for my case?

Many Thanks.

Hi everyone,

I just received an email from the USCIS stating "On September 28, 2009, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E)." Can anyone tell me if this is this my NOA2?

I filed the I-129F ~Aug. 23 and my NOA-1 was issued on Aug. 25, so I was a little surprised by this email (seems early). The USCIS website has my case status as "Post Decision Activity" (it was in "Initial Review"). I'm a little worried that maybe I've just been denied or something, but both the website and the email state "approved" and I don't think there's a reason they would deny me. I haven't received anything in the mail yet (just got the email and text message tonight), so maybe it's just a glitch in their new website? I guess I'll cross my fingers for now.

The VSC has recently shifted a large number of its adjudicators to I-129fs to get "caught up"

I pray that I am apart of this "wave"

K-1 Fiance(e) Visa Process & ProceduresUSCIS to NVC delay
Since I got my NOA2 (Jan 22) I have called NVC EVERY DAY (at least once) to check the status. I have also emailed them 5 times and also gone to the USCIS office in my state 3 times and spoken to them. I finally heard back about an email I had sent out and they are researching it. I also called USCIS and talked to a second tier rep that put in an expedite request because it had been over a month. Don't listen to the reps that say 90 days. That is not true. I don't think they know what they are talking about. It is suopposed to take 15 business days (roughly 20-25 days) from NOA2. Sometimes things get lost I was told by the second tier rep and he said if I don't hear back in a week call again. So I will let you guys know what happens when I hear something. I waited over 7 months for the NOA2 and now waiting over a month for NVC to get the file. I think I will have gray hair and walk around with a cane by the time my fiance gets her visa at this rate. This is so pathetic. We are living in the information age when everything is done electronically and with a click of a button. There is no reason to make people wait this long to unite with their loved ones.
