Wow almost done,,, but now the trip home. Avianca or America Air will not sell a one way ticket for Vanessa because she is not an American citizen. Do I need to buy her a round trip ticket??? She has a CR-1 visa, can I buy her a one way ticket(i'm using my miles, I do not have enough for a round trip, just one way),, please help. I called NVC but they cant help.

This happens when you pay your AOS and then you pay your IV Bill before its actually sent out.

It will show as paid.. Once they generate the bill to you it resets to Un-Paid. I didn't even bother with it. It corrected itself a few days later.

I think it depends on the country.

We applied for my wife twice. China denied it twice saying that she needs to apply for an IV visa.

The first time was before I put in an IV application.

The second time she was still told the same thing after I had applied and they received notice of the IV application.

She explained we have done that but they denied her none the less.

She had a job, recommendation from her boss, bank account information, vacation request and family information.

They simply say she has to wait for the IV Visa to complete.

Other countries are not so hard on it. In our case we just have to survive the process. I make a point to fly out every 6 months to visit.

Hopefully you have better success.

I posted on tuesday or wednesday that my wife called and they told her the interview was scheduled June 8th and the p4 and interview letter were sent out May 18th.. Lots of time to prepare there ><

Me: I met my husband on a website called Asianpromise.
I put our photo albums in front of the window, VO noticed and asked: can I have a look of your pictures, please?
Me: Sure! We had been to many beautiful cities in China and took a lot of beautiful pictures!
I handed in a handmate photo album, which was a birthday gift for my hubby’s last birthday, and introduced to the VO: this is what I made for my husband’s birthday last year.
He read the words on the b-day photo album for a while, then I gave him another 4 photo albums. he stopped at a picture, I told him: that is fairyland Guilin. We took a hiking by the Li river. Fantastic scenery, isn’t it? VO nodded and smiled. And then he stopped at a picture where we drawn our hands and wrote our love anounment on the note book, I introduced : that is our marriage vow written on a notebook at a cafe of yangshuo. We were engaged in that cafe. VO smiled again. He turned all the pages of the albums roughly and quickly , then returned to me.
I waved my husband’s passport , said: my husband is waiting for me downstairs right now.do you want to have a check of his passport? VO waved his head. I asked?“how about his driving license? I have it here as well.” He waved his head again, and said?“No,thanks!”
VO checked the documents for a while, then asked :“what do you do for a living?”
Me?“I am a secretary in a trading company”, I stoped for a while and added“it is actually an American company, my boss is from Portland, US. ”
VO nodded and asked?“what is your education level?”
Me?“I hold a colleage degree.”
Vo then asked in Chinese:“ is it a bachole degree or post-graduate degree?”
Me replied in English still?“It is a 3 year college degree.”
VO nodded again,asked:“can I have your passport,please?”
I gave him my passport, he checked on the computer and asked?“ did you apply for a non-immigrant visa before?”
Me?“yes, I applied for a visitor visa to see my parent-in-law in the US last June, but they told me to apply for an immigrant visa instead. That is why I am here now. ”
VO nodded, said“I see. ”then he took out a read slip from the drawer and stapled it with my appointment letter, he asked before he gave me the red slip: by the way, your husband is working in the US,right?
Me: Sure. He is working for a company called K12 in Herndon ,Virginia.
VO then gave me the red slip and said: You are approved.
Me: Thank you.
VO: have a nice day!
Me: Thank you. The same to you.

Thank you all,

I am having my wife prepare the question by question review complete with her answers. Hence the delay. We are at the post office right now picking up the visa and getting it in our hands smile.gif

By the time we get home we should have the review completed. It was a quick interview process for the 6 people we went with. All 6 got pinks.

The worst two things to happen. I ordered coffee at the shop on the 4th floor and they brought me sunflower seeds and crackers so instead of spending 5 CNY it cost me 50 CNY lol.. no biggie but a bit frustrating.. make sure you tell them you want the coffee only.. they do not speak english so be prepared tongue.gif

Second thing.. my wife took a friends umbrella in with her because it was raining. They make you throw the umbrellas in a big box. when my wife was finished she could not tell which of the 100's of umbrella's it was. So it was lost..

Interview details and experience from start to finish is coming. Thank you all for your best wishes and support.

Since she overstayed the visa for more than 180 days she cant leave the country otherwise she will get a ban and she wont be able to come into the US for a very long time (i think its a 10-15 year ban)
Get married and start filing for AOS. The overstay will be forgiven since she will be married to a US Citizen.

Getting her daughter to the US will probably take a little while. Like somebody said before, she needs to have her greencard first and then file for a visa for her daughter.

Why did she leave her 4 year old daughter behind??? If your fiance came to the US in 2003/2004 that means her daughter was only about 1 back then... Just wondering...


I read the AOS section and this process seems to be for "K" visa holders, does anyone know where I can find the process for what my predicament is?

As for her leaving her daughter back home, she came her on a misunderstanding about the tourist visa and ended up being stuck here.

Maybe I should explain the situation a little better as well, I'm not sure that would help any though...

I met my fiance through mutal friends (who probably has no clue about the visa process either) coming up on a year now. I knew she entered the US in 2003 (maybe at the end?? if anyone needs exact dates, I can provide them later tonight), and knew she had a tourist visa, but was unaware of how long a tourist visa was, although I am sure she did. (We will call my fiance Natalie) Natalie also came into the US pregnant, and gave birth to her son (I am not sure if it was in the time of a valid visa or after the expiration, but if it was after the expiration, then it wasn't too much longer after... if that helps any...) So, she has an american born son and a exipired visa. Sometime passes by and along comes me.. blah blah blah we decide to get married one day, i find out about this forum and now I am here with this situation...

I had no clue there was such a thing of fraud upon a visa... :( I actually met her here after she had already had been in the US, I did not know her before... So say if her visa is already expired, I don't want to tell her to go home and wait this long process so she can come back, is it possible for her to stay and file the proper paper work, and if everything gets approved then send her back home to re enter? (I'm not sure if that even makes sense...)

I have a peruvian fiance who is already here in the US, the problem is that her tourist visa is about to or has already expired. How do I approach this situation? I don't want to go to the embassy and say "hey my fiance visa is expired, but I want her to stay because we are getting married" and she ends up getting the boot back to peru. On top of this, she has a 4 year old daughter that is in Peru that we want to bring over. Folks, what do I do? :help:

Honestly, yes, a spouse is forgiven more things than a fiancee BUT how hard it's going to be depends a lot on your country. Please complete your profile with country of beneficiary so we know more info.

I notice from a previous thread she overstayed her B2 (but not enough for a ban) AND she worked illegally... personally I think you're safer with a CR-1, but, again, it really depends on her country because spouses are still denied for various reasons and some countries are harder than others due to high fraud.


The country is Peru. I understand that the fraud rate isn't that high there.

Is she currently in the U.S.?

Although working without authorization cannot be used to deny adjustment of status to the spouse of a USC, it does make a beneficiary (spouse or fiance(e)) inadmissible for a visa for 5 years. If the 5 year bar is still current, the visa will initially be denied. A hardship waiver would need to be approved to overcome the bar and get the visa. Hardship waivers are not so easy to get.


She is not currently in the U.S. The work happened less than 5 years ago (3 years, 3months.) Haven't heard of a 5 year bar, I'll look into it. Thanks.

The forgiveness you are eluding to is of no consequence when applying for a visa. Married or not, previous unauthorized work makes you inadmissible for a visa--regardless of the country.

Hello all, First off, I'd like to mention that I've been doing tons of reading on this website and have to say that it is unlike any other resource out there. With that being said, I have sought legal advice over my current situation, which is that my fiancee has had unauthorized employment in the US. I was told that the chances of obtaining a k-1 were 50-50, but a CR-1 would guarantee approval because they can't deny your spouse over previous unauthorized employment. I haven't been able to find any information that supports this. I was wondering if anyone had experience with being denied a k-1 over unauthorized employment.

Also if anyone is familiar with the counselor interview process, I assume that the trouble comes during the interview when they see the employment on he G-325A. I'd like to know if the officer then makes a decision based on the situation of the employment. It was a part-time job that occurred for about 5 months, personal checks, no papers, no taxes, no work permit. My fiancee was 17 at the time. Would the no taxes also become an issue on top the the employment?

I finally received my card today, the letter was dated from 10/18 but there was some trouble with my mail forwarding since the move in July. Apparently it was sent back to Vermont and they mailed it out again (?), but it's all good and I finally have it now.
