Hello all,

This is my first post and I'm hoping for some advice. I am a US citizen, recently engaged to a UK citizen who is residing in Belize. We are planning a formal wedding ceremony for next summer in Belize. Short of having a civil ceremony before I leave Belize in two weeks, is there any way to start the spouse visa process before the June 2009 wedding?

And is there any legal problem with having "two" weddings abroad?

Hi Friends,

I am new to the forum and have read through many posts here. I really appreciate the community spirit on the forum and willingness to help.

I am an American woman engaged to an Afghan man. We met while I was in Afghanistan. We both worked on the same USAID project. I had to return to the US because my assignment was over.

We applied for a I-129F visa and just got notification that the NOV2 (petition) was approved. I am trying to anticipate the next steps so I was wondering if anyone had any experience. Btw, the embassy in Kabul only processes diplomatic visas so every other type of visa must be processed in Islamabad which is why I am on this forum.

I understand that my fiance will get a packet in the mail but Afghanistan does not have a functioning postal service and there is no DHL to Jalalabad where he lives. He could however designate a place in Kabul to have it sent for him to pick it up. I had my lawyer send a message to NVC about it. But I thought I would tap into some of the wisdom here in this form.

So here is my question: Does anyone know if they can send the packet out by e-mail or if they would email him notification of next steps? It seems that almost all communication is done through the post. :help:

I just wanted to check in to let you all know that I called DOS and my fiance passed the security clearance. YEAH!!! The visa specialist said that the case has been forwarded back to the embassy. I thought it would be good to share this with you all especially since there was a few others that had their interviews at the end of March.

I'm hoping this part goes quickly. When he was interviewed he was told congratulations, your visa was approved, we just have to go through administrative processing.

Fingers crossed things will go quickly for us and others. Allah akbar!

If you want to try and call them do so but I know when I was in the processing calling the embassy was a joke. I was put on hold transferred to endless ringing and no one answering the phones. When I emailed them I had a reply the next day or the second day at the latest. Good luck.


I really agree with Mary on this one. Any communication with the embassy should really be by email. I have also found that calling DOS is helpful and gives some indication of what may be going on at the Embassy, mostly just clues, but it is better than being totally in the dark. It seems they update an interagency database fairly regularly. And they can tell you limited information in advance of what you may hear from the embassy.

hmmm... I agree with you guys about calling. I have been calling the embassy ... some days are better than others. My fiance emailed them like 3times and 2/3 time he never got any reply. But I will try emailing tonight and if no response by Thursday then I will try calling them. Thanks alot you guys for your input!!

KJO ... since our cases are VERY VERY similar .. I was wondering if you contacted the embassy and what did they say about sending the visa... and about how long it would take ...


Desparado - the major difference in our cases is that my fiance is Afghan so sending his passport in is not really an option. He will have to just stay in ISL while they process it. So we are hoping that we impress upon them that it would be nice to do it quickly.

Actually my fiance had an enormously stressful time making it to his interview from Afghanistan. He was hitting all kinds of police blocks, etc so he missed his medical exam and lost his police certificates en route. At the interview they just told him he would have to provide these things before the visa is issued. That's the story KS.

Zaki Congrats!!!! :thumbs: I really think all this is because they got a new Ambassador in March. It seemed like before then, things were moving at a snail's pace or not at all.

I have some good news too. Looks things are really moving!!! We got this from the Embassy today. We knew that we still had these things pending. We are just excited that they are asking him to bring the passport. :dance:

I just got an email from the embassy today so they are working even though it sounds kind of tense in ISL.

On our case, apparently DOS just COMPLETES a security/background check but it is still the embassy that gives CLEARANCE. Here is the response we got from our inquiry about what we thought was DOS security clearance.

"Our record indicates that we have a response from the State Department and that is in review. However, it is difficult to predict that the response is a clearance. We will immediately contact the beneficiary once a clearance is received. Please check back with us after a week

My fiance was told congrats the day of his interview....that he was approved for the visa but would be placed on AP for 45 days. The CO said if 45 days passes and he hears nothing from them to call or write. So in terms of AP, nothing out of the ordinary.

Hi All,

Good news my fiance finally got an appointment date for the K-1 visa! Yeah! Thought I would share our timeline with everyone as encouragement that thinks are moving along (albeit at glacial speed) in the ISL embassy. :dance:

The stars seem to be aligning for us though. I'm getting ready to start a new job with the federal government, but before my start date I knew I could take 3 weeks to go for a visit. I was sure I was going to have to make a second visit for the interview because we had not heard back from them yet. Happily we got the letter and the appointment is the day before I was scheduled to return back to the US. Really incredible!

Btw - XStrangerX2007, my lawyer and numerous people on VJ suggest that the spouse/fiance go to the interview. Even if you aren't allowed to talk much. I understand that your mere presence strengthens your case.

I have two questions, First does anyone know what triggers AP/AR? I'm living in fear that my fiance (a man) will get put on AP/AR. I would just like to understand if it can be avoided.

Second, if I am a USC by birth does my fiance have to wait for his case to become current? I didn't know there was a quota for fiance visas, or am I confused?

Other than that we've hit a similar snag as Fazel (?) and have been waiting for almost a month for Packet 3.5 to be sent to our lawyer here in the US since there is no functioning postal service in Jalalabad Afghanistan. I called last week and they are apparently sent another one out to us by regular post. Fingers crossed it will arrive shortly!

Otherwise, anyone can say they have $100K in savings but if their bank statement shows $5K, it doesn't add up.

Hi,

There are 2 versions of the IRS transcript. One for $39 is an exact copy whereas the free one will meet "the requirements for lending institutions for mortgage verification purposes." I assume either one works so long as it is not a photocopy of one, correct?

How do you know if only yours was shipped and there wasn't other petition shipped? For all of the DHLs I looked at, they each said 1 shipment and ranged in weight from 3 lbs to 13 lbs. Could the one shipment mean there are other petitions included?

I know it is an assumption that our petitions are included since it does not actually say, but it is a good resource to give an estimate.

Sorry, I didn't catch that the cosponsor was in addition to your own Income. I know for the K-1 it's recommended to bring the tax records, last 3 months pay stubs and a letter from the employer... if you have original supporting documents for your own income then you may be fine with just the copies. I still think I would try to play it safe though, what is mail like there? is there any chance it would get there in time?

Like a letter from their employer or check stubs? if that's the only supporting evidence you have I may look into fed-exing it or sending it down with another courier that could possibly get it there in time... I wouldn't want to risk it

I called NVC yesterday just to see if my package had arrived. I wasn't expecting a case number or anything. I received my NOA2 on May 30 and after seeing on these forums how long it takes to send the I-130 to the NVC, I requested rhe USCIS expedite shipping it to them (I also was approved expedite of the I-130 itself). So my USCIS case status now states that it was shipped on the 4th. Well the NVC guy said, that doesn't matter, it still takes 15 days just for the NVC to receive it. Really?? It takes 15 days for the mail to get there?? Is he just spouting off standard answers or what? Thanks for the replies.

 

I received my NOA2 May 28th and I received the same response from NVC when I called on Thurs except he told me 15 BUSINESS days and then added on for good measure that it can take up to 20 business days after that for them to get it into their system! I'm not sure if they realize how incompetent they sound stating that it essentially takes them a month and a half to pick up an envelope, open it, put the info into their computer, and then mail it out again haha... as for it really taking that long, i'm skeptical. I think this is the generic answer they give everyone in order to deter people from calling nonstop to check. I think the average time is much less than that... i hope : ) 

 

But where did you see that your petition was shipped out on the 4th? does that show up when you put your case number in on USCIS's website? Mine still shows the message from the NOA2.

NVC still has no record of it. 3 scans and emails have been sent, not response other than the automatic "we process all requests in the order in which they arrive" reply.

 

USCIS says they have up to 90 BUSINESS days to get it from CSC to NVC...I could walk from Cali to NH faster with the damn thing in my hand. 

 

Any suggestions? I call 2x a week...but am getting burnt out of hearing nothing.

I'm so sorry it's taken so long, that's ridiculous... it's been over a month, have you tried asking them to inquire as to it's location? When i was first calling to see if it had arrived they told me to give it 2 weeks to arrive and up to 3 weeks for them to get it into their system... you're well past that timeframe so I would think you have the right to ask them to do some extra work to find it. I know i've seen someone post on here this week about how they got someone to look for their case. When they found it it had been sent to the NRC instead of NVC. Keep insisting until you get someone to listen to you!!

 

On another note... for those of you whose petition has left NVC for the embassy...when the embassy receives it will the case status on the ceac web site change to at the embassy or will it not change from in transit? I'm wondering if I have to contact the embassy directly for confirmation that they have it or if the status will change once it's entered into their system...

You will need to call at least until you get the LMA number.  Then you can track it online.  However, the amount of info on the NVC site is kind of sparse, so if it doesn't change much, I will probably call on Friday or so to see what is going on.  Maybe someone from another embassy might chime in on what their experiences were.

They gave me the LMA number when i talked with them today... is there a way to track it with that? she told me that there's nowhere to do it on their webpage..

I just feel if someone really loves you, they would not expect or demand money. And they would trust you. After all we are doing alot to get them over here. He should understand that. If he doesnt, then I'm not sure what to do next. I'm sorry you are going thru this..My thoughts and prayers are with you.

Amen. My husband NEVER asked for money before moving to the US. He certainly had high expectations when he get there but that's another story.

The idea of your hubby pressuring you and laying guilt trips doesn't sound good. You gotta do what you think is best...but believe me....don't get sucked in the feeling too much American guilt. IMHO, if people don't want to hear negative stories on VJ they shouldn't read threads about immigration fraud. This message header was 100% clear about its stated purpose: to give people a space to talk about international love gone bad via fraud.

Now if you're not in a space to read that, then skip over it and focus on something else. Simple. There are lots of different topics and postings here on VJ. There's plenty of room here in cyberspace for people to read happy stories and sad stories.
