K-3 Spouse Visa Process & ProceduresSultan's K-3 visa was approved!!
Hi everyone. I'm sending this information slightly after the fact but I just wanted to let everyone know that Sultan's visa was approved on TUESDAY of this week. He picked up his visa yesterday.

Everything moved so fast that I just wanted to wait until Sultan had his visa in hand, in case there was a mistake or something.

But, alas....its REAL......Sultan's got his K-3 visa!!!!!! :dance:

So here's what happened from last week.

Last week, we found out that the US Embassy in Addis Ababa interviews people the same day they submit their visa application. I was very confused because everything I'd read -- and even was told from a good friend who came here on a K-1 visa -- indicated that you have to submit the paperwork to the Embassy, wait for an interview date and then find out their decision. No so in Addis.

The interview was pretty easy for Sultan. They asked the following questions:

1) How long ago did we met?
2) How did we meet?
3) Where did we meet?
4) How we maintained contact?
5) When did we saw each other since the 1st time/for the wedding?
6) Where did I say? address?
7) How long was I in addis before the wedding?
8) How long after the wedding did I leave to go back to the US?

For our evidence of support I provided tons of information (email, phone, cards, travel docs) but the official seemed impressed mostly with the internet chat transcripts. i won't lie. She was very impressed with how organized and through everything was. (I made a powerpoint of our pics) :)

Thanks to everyone here for their support, instructions and advice. I wouldn't have been able to do this as successfully without the people here.

Sultan will be here in about 30 days!!!

Yes, the Ethiopian Embassy requests proof of family relationship as part of the visa application -- not part of the interview. The pictures are clear. I included about a dozen photos.

I'm about to send my husband the necessary information for packet 3 (Visa and Affadavit of Support) per the request of the Ethiopian embassy.

For the evidence of family relationship is it acceptable NOT to send actual photos? I copied several scanned l photos onto a powerpower w/bullet points. Is this an acceptable alternative? Also are they strict about how you provide this information??

Also for the evidence of family relationship, I included a letter with a list of each individual attachment like so.

Attachment A - Form
Attachment B - Copies of Emails
Attachment C - Copies of Phone Records

You get the picture. I'm using a paper clip or binder clip for each attachment. Is seems organized to me but I just want to double check before I mail it.

I just got off the phone with my husband and have some AMAZINGLY good news He just called the Embassy and found out that petitioners applying for their K visas they don't submit their papers and wait for an appointment date. Their paperwork is reviewed the same day. I am so excited to hear this.

First of all, I can't believe that the process might be finished so quickly. Second, we were both hoping that Sultan would be in the states by July. And sure enough it looks like that's a realistic possibility. If there is anyone here who's dealt with the Embassy in Addis Ababa, please give me your thoughts. Is this correct??

I can't believe it. Thank God my husband will finally be here!!!

How long do you have to complete packet 3?...Like because we are waiting for a few things...what is the max time frame...On my noa2 it says valid between Jan 10th-May 10th...So would it be okay to turn the Packet 3 back in lets say March/April...as long as it is before the NOA2 expires...

As long as it is before the NOA2 expires is the answer. May 10th, 2007. Anything after that will probably require extreme actions to get the case reopened or you may have to refile your I-129F.

"i think the Doc was new to it, it wasnt a worry, but i think he said it was the safest option to have everything done seeing as we didnt have an interview date set anyway. he thought it would make the process easier for us. fair comment."

Sounds like the doctor was just giving Nigel personal advice rather than official policy instructions.

I just doublechecked the embassy website and it definitely states that the vaccinations are NOT required for the interview.

"Note: Fiance(e), ), Kii and V visa applicants will not be required to meet the vaccination requirements at the time of the visa interview. They will however be required to meet the requirements at the time they apply for an adjustment of status with the U.S. Citizenship and Immigration Services."

I'll talk to Nigel again and see exactly which doctor he went to and what he was told. He's not as concerned with details as I am so maybe he got something wrong :)

I know I read in another forum that someone was told they could get the vaccinations there for a fee. Maybe Nigel misunderstood that he needed them for the interview rather than just before AOS.

I didn't think they were a requirement but they told Nigel differently so we figure he's safest just getting them done. Plus he can get them for free in England whereas over here they'd at least cost a copayment. He has an appointment next week so I think it'll be fine.

I'm not sure if I should be posting this here or in general K-1 forum....

Nigel had his medical this morning and reported that everyone was very nice. He had a South African doctor who used to play rugby so they got on well (Nigel also used to play). He hasn't had vaccinations in years so was told he needs to get them done before the medical results will be forwarded to the embassy. This is different from what I'd read elsewhere but we're going to follow their instructions and Nigel will try to get his done next week. He could have done them today but they would have been about 60 quid a shot so he decided to save money and go through a regular doctor next week. At any rate, it seems you do in fact need those vaccinations before the visa is approved. I thought I'd read somewhere that you only needed them before AOS.

Now we're just waiting on the police report to come through and then we'll start bugging the embassy for his interview date!

You only sent your forms a week ago so I'm not surprised you got the response you did. While they forms may be at the embassy they may not be processed for another 6-8 weeks as they mentioned. I would not be devastated at all if I were you. You just need to be patient and wait a few more weeks until they get time to process everything. We sent our checklist in late February and got the same response so they just haven't gotten to it yet.

As for your wedding I would say you are hopefully safe but it's not a guarantee. Check out some of the other timelines of people going through the same situation. We have our wedding planned for the end of September so we padded everything by a few months. We're not letting our family book any plane tickets until that visa is in Nigel's hand though. And we have also made sure with all wedding vendors that our date can be changed without losing any deposit. Maybe you can try this too.

American Lass - Nigel wasn't up to date on his vaccinations either and they offered to do them at the medical for about 60 pounds a pop. He opted to wait and got them done for free through his doctor and then just sent off the proof. Saves some money if you do it that way.

It may be that they have received it but just not processed it yet. This happened with us. They emailed Nigel back saying they hadn't received it yet and a week later he got packet 4 with his interview date. You can send a new one just in case but they probably have it in a pile of paperwork somewhere.

Nigel had his interview this morning and his visa was approved!! He couldn't believe how long he had to sit around and wait for a 3-minute "interview" but was very happy and excited that it's all over with. I'll put more info in the embassy review section but he had a very positive experience. Now we can sit back and relax until after we're married and the paperwork start all over again :)

One question for those of you who have already been approved in London.....The embassy is sending the passport to Nigel's registered home address which is also his parent's address. He won't actually be there later this week to get the package when it comes. Can his parents sign for it? He thought maybe he needed to send his license to them so they could prove that he lives there and they are allowed to accept his packages. Did anyone else have a similar experience?

we do have an aussie thread on here ..and there are a few in there still that are at the same stage you are at...
i know one of the aussie just got an interview date on 19th dec and her's was sent to syd at the beginning of november approx...

i would ring the doctors and the police department of his state and find out how long it take to get your paperwork in your hands before you go ahead and send in the readiness form...

also did your fiance know he can go to his local doctor and get blood tests done through medicare to find out what he is ammuned to for the vaccination sheet

good luck to you both your on your way to being together soon.. so it's really up to you if you want to send it in and take the chance that you wont have everything by the time you get an interview....

My fiance and I sent in our paperwork in early May, but didnt receive the receipt in the mail till early June. The case is still pending, though. But by the time lines it looks like we should have received some news by now. Does anyone know why our case might be taking longer? Or how to track it more closely? He's British, so I dont see why it would be that long.

I also seem to be finding wide time variations in the time lines on this site. Some say that after we receive this nao2 the rest of the process with the London embassy takes about a month, others say 3.5 months. Can anyone give me advice on how to find a more definite time estimate? Ive heard horror stories of people waiting over a year for this and am really worried that might happen to us. I would appreciate any information you could offer. Thanks so much.

Travel to London:
I left home at 7pm on 07/Aug caught the midland mainline service from Sheffield to London St Pancras I got there at around 10pm. I had booked a hotel near the embassy for the night at the Hyde Hotel Paddington (booked by: www.Londonnights.com). The hotel is not very far from the Embassy. The staff were polite and the rooms although small were of a very high standard (better than I have had in some higher ranked hotels). I ordered a car from Plazza cars to collect me at 7:30am from the hotel to take me to the Embassy. The hotel does not have any AC and it was very hot.

Interview day:
The day stated early at 5:45am. Got ready checked over my paper work, all present and correct, I took my other bags and left them with the reception. The rest of the day when something like this: Headed down for breakfast at 6:50am Breakfast finished at 7:10am. Car arrived at 7:15am. Arrived Embassy 7:30am. The entrance that you need for the visas is on the south side of the square and has Grosvenor St leading off it. (if you are stood facing the front of the Embassy with the Roosevelt memorial on your right you are in the right place).

I had a 9am appointment and strictly speaking you are not meant to arrive more than 30 minutes before. I had heard queues of 2+ hours so got there early. This did not seem to bother them. I was standing around talking with other people waiting for the queue gates to be opened. They all seemed to have letters that looked nothing like mine. They were all going for non-immigrant visas and these are handled by a different branch. (Technically the K1 is a non-immigrant visa but it is handled by the immigrant visa branch). Also there were people of other nationalities getting visas to visit the USA. I think I saw a Ukrainian passport while I was there waiting.

Security is tight, you are not allowed to take any liquids through and I had to remove my belt and put everything in my small bag. I walked to the security hut and put my bag on the X ray. I waked through the mettle detector. It went off, don’t know why I did not have any mettle on me!! The security guard looked longingly at the x-ray of my bag and spotted the USB pen drive I had on my key chain. That had to stay at security. (my cell phone would have also but I had left it back at the hotel).

I walked round the building to the other side, you walk in front of the building where all the flags of the states are. You go up the steps at the other side of the building and there is a person at a desk, they ask to see your paper work.

Here is where it stated to go wrong for me, the guy on the best looked like a workman and did not know what he was doing. He asked to see my appointment letter, I showed it to him, he said

“No the one with the bar code” (I found out later this was wrong, if you are going for a NON-IMMIGRANT VISA then the letter has a bar code on it. The IMMIGRANT ones don’t)

Trying to be helpful I said this has a barcode on and showed him a copy of the DS156, I had a copy with me thankfully. He said that was ok and gave me a printed ticket No. 1000**.

This was the second problem, this ticket was for a non immigrant visa, the ticket that you should be given begins 5000**.

Anyway oblivious to this I went up the stars to the left and sat down. The room looks rather like a large bank with windows that resemble the cashier counters. These are where your interviews will take place.

Did not wait long and was called to a widow. The Lady here was very nice, she looked at the DS156 and said “Relocation to the USA?” I explained what I was doing and showed her my appointment letter. She talked with one of her colleges and she said I had been given the wrong ticket.

Back out to the front desk I explained to the guy who put right the mistake. Right ticket this time back to sit down. Longer wait this time, I knew I was on the right track when someone who was also interviewing for a K1 sat next to me. Called after about 30-40 minutes I think.

Window 13, for finger printing, payment and hand over of copies of Police and birth certificates. All going well so far, fingerprints taken 3 times as the reader was not working properly. Photograph give over, (they take a picture of the picture and use that, they give you the picture back). Asked for a letter of continued intent to marry from my US fiancé. This was because it had been more than 4 months from date of filing to the date of the interview. Handed over the I134 and supporting evince.

Then paid $100 visa processing fee, I had $100 in notes but they would also accept credit cards. Sat back down and waited, longer wait this time. Then called to window 15 for the interview. They make you take to Oath that you will tell the truth, if you don’t like swearing you can affirm.

I was asked to write Tracy’s full name on the DS157 (or it could have been 156 not sure). There were other forms to sign and then came the questions:

How we met?
When Tracy has been to college?
What I planned to do for work once I got to the USA?

Here is when the problems really stated. He asked to see Tracy’s tax returns for the last year. This was IRS FORM 1040. I did not have them. He explained that he needed to see them before he granted the visa but he was accept Fax copies. I was informed that the case was suspended until he saw the tax forms. I was given a blue piece of paper telling me what I had to provide. I was instructed that I had to have them couriered to the embassy with my passport.

I was then informed about the conditions on the visa, I had to get married in 90 days etc etc etc…..


I left at about 9am and headed back to the hotel. I got Tracy to fax me the forms (Wal Mart don’t do faxing at 5am by the way, just in case you are ever in this boat)

I arranged for the courier to collect the paper work from my home address the next day. That was the Thursday, the paper work reached the embassy the following Monday. The following Saturday we got everything back from the embassy visa Granted!!!!!

There you go one very stressful experience but it was worth it in the end. If you are going for the K1 interview don’t forget your tax forms!!!!

Paperwork:
Police Certificate
Birth Certificate
Picture conforming to state department regulations.
Letter of continued intent to marry from US fiancé. (because it has been more than 4 months from date of filing to date of interview)
I134 affidavit of support and supporting evidence.
Passport.
TAX FORMS FOR LAST TAX YEAR (POTENTIALLY 2 TAX YEARS)

Costs:
Train ticket: £22
Taxi Station to hotel: £15
Hotel: (£55 + 9.95 breakfast): £64.95
Taxi: hotel to embassy: £12
Visa fee $100 (about £50)
Courier: 24.50
Total: £188.45
Knowing that I can be with Tracy: Priceless

Things to remember for the Interview:

Tax forms: It does not say it on any of the documentation that you will ever see but you should take with you the USC's IRS form 1040 and some supporting evidence (eg W2's or schedules)

Money: There is a little cafe where you can by drinks and some confectionary. You are going to be there a while so best be prepared.

Letter of intent to marry if it has been more than 3-4 months between filing and date of interview.


This has confused me slightly: when you say USC's IRS form 1040, what are you referring to? The USCIS? If so, where do you get this form from? My fiancee probably doesn't have one as I met her in South Africa where we were both studying and so she has only recently moved back to the US ans is now working. Her father is co-sponsoring our application by filling in his own affidavit of support, but no idea about this IRS form. Anyone able to help?

Well, I was in a very similar situation and I just sent away the checklist. In fact, I sent away a downloaded copy of the checklist before my packet 3 had even reached me. As far as I was concerned there was no point in waiting. If the necessary documentation (in my case a Police Certificate from South Africa!) had no come int time then the visa would have been (hopefully) approved pending their receipt of it at a later date. As it was, that came in time but as I did my medical the same day my visa was approved pending receipt of that.

Now im stuck in the AOS/EAD qaugmire :-(
