Does it say SPECIFICALLY "engagement ceremony photos" or "proof of having met in last 2 years"?

in the instruction list, there are two separate items:
- proof of ongoing relationship
- engagement or wedding ceremony pictures

unsure.gif

engagement pictures are unnecessary but can be used as secondary evidence such as phone call, IM, e-mail logs, pictures, etc.

In most cases, proof of having met in the past two years and/or proof of ongoing relationship are necessary to prove that you are engaged and that the beneficiary is coming for the purpose of marrying the petitioner. My fiancee and I got engaged officially after we sent in the K1 so we sent pictures of our previoous trips as well as letters from all parents involved stating our intentions to marry along with our own.

I don't recall the W-2 being necessary proof for the I-134. Instead, a bank statement and proof of employment of self-employment is needed - in the case of the former, a letter from the current company stating full-time position, salary and start date should suffice.

Thank you so much... That was a relief because I feel half crazily insane about W2 and I only have few days from my interview...

Once again, thank you so much.

No problem. It is not until your U.S. spouse files the I-864 in preparation for your adjustment of status that he will need to provide more detailed informaiton about his citizenship, sufficient income to exceed the U.S. minimum poverty requirements, and at the very least, the most recent year's income tax return, among other requirements.

US Embassy and Consulate DiscussionIs there any way around a co-sponser?
you can use savings and assets as collateral.

I am not sure about a letter "guaranteeing" employment for your fiancee would work because there is no guarantee when he arrives in the US of him getting the necessary stamp in his passport temporarily allowing work. You would need to file an EAD which takes approximately 3-4 months to receive from date of petition. This form is typically filed jointly with the AOS after marriage, which is much farther down the road.

Only thing the needs to be notarized is the I-134 form.

You do not need bank statements unless your income falls below 125% povertyline.

Only need one employer letter.

One thing about I-134, the directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.
  • I-134 signed and notarized.
  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html
  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

If your income exceeds 125% of the povertyline when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME.

Fee for K-1 visa at all consulates is $130 US

Oh and one last question for this. The $130. Does it need to be in US dollars or in Euros (as he is in Ireland)? Cash, Money Order, or Check?

Thanks!

Ok I just reread the poverty guidelines which is $17,112 for 2 people. I make well over this; however, should I continue to have a joint sponsor since this is a brand new job and I don't have fed income tax info on my own for the past 3 years? I feel like I should have the joint sponsor just to secure the issue due to the fact that I don't have 6 months of paystubs and I don't have 3 years of tax return.

Thanks!

-Dawn
By the time you interview you should have your 2007 return filed, and you can use that, that along with employer letter, and a few recent pay-stubs should be fine.

You only need to provide past year's IRS return, and by that time it should be 2007's return.

You only need joint sponsor if your income does not meet 125% povertyline.

The problem is I will not have a 2007 return. For 2007 I am claimed as a dependent again by my mom. Hence the issue. I only recently began working and my first paycheck fell on Jan 2, 2008.

US Embassy and Consulate DiscussionFinanical Questions
More questions - mine never end and I apologize for that.

As I have been a student for the last few years I have no fed tax returns for myself but rather been a dependent on my mom's. She is is going to be a joint sponsor. I do have a job now but I only have 1 pay stub so far but by the time of the interview I will only have a couple months if a few months worth. So I am getting a employment verification letter.

My question is because I haven't found a clear response - does the employment verification letter need to be notarized? I know to have 3 copies.

The bank statements - I should have 3 copies and notarized?

Also should I have a letter of when I opened the account? I am a bit confused on this.

Any federal income tax returns for my mom - should these be original or copies as we only have 1 original of this.

I can't find a straight answer but the visa application at the Embassy - is there a fee for processing the K-1 Visa application for my fiance?

I want to thank EVERYONE here who has helped me! It has been tremendous.

I didn't need one. It does send an automatic response that it was deleted; however, this doesn't seem to be true. Just don't email them repeatedly. It takes from what I understand about a week normally for a response. Ours was just over 24 hours.

US Embassy and Consulate DiscussionPolice Certificates - Ireland and UK
Hi everyone! smile.gif

I am trying to get everything prepared as I know police certs apparently can take some time, especially in Ireland from what I understand. So here are my questions:

1) As my fiance has only returned to Ireland 3 months ago and previously lived in England for 5 years, how does one go about requesting the cert from outside the country? I know if you are in the UK to go to a local station - but we do not have that luxury. Can we just call up and request the forms?

2) How do we go about getting them in Ireland? Should he go to the local station and request it? Is there any special requirements needed?

Thanks so much!

Thank you for this, it gives me a bit of hope. I am concerned; however, as we are trying to catch this file before they send any packages to our old residence. Long story of former terrible flat mates that still reside there. I hope I get a response sooner. I will be calling the Dublin Embassy tomorrow when they are open to see if they can also request it themselves. Originally the told me to request NVC to send it to them; however, NVC wouldn't play ball. sad.gif Very frustrating for something that should be simple. USCIS passed it to NVC to handle and now NVC is passing it to the Embassies to handle.

Has anyone had experience emailing the London Embassy for requests? I submitted the subject with "Urgent" as I was instructed to by the Embassy operator. I got the autoresponse email back that says it was deleted (as apparently this is normal). How will I know if the request has been handled? Will they contact me via email? K-3 Spouse Visa Process & ProceduresK-3's Moving Forward!!
Hey everyone. I just thought I'd share a little bit of good news!!! I just got my NOA2 (I-797) in the mail for my hubby who's in Ethiopia. Things have been going very smoothly so far and I'm pleased with that.

I'm embarrased to admit this but i haven't prepared my packet of information to send to him but I'll be moving at lightening speed to get it done. (I work well under pressure).

Anyway, thanks to everyone at visajourney for their good advice and information on how to do this process the right way. When I submitted my K-3 application I felt very confident I'd assembled it properly. My NOA2 was finished in less than 60 days. And now I have to follow through on the final leg of this process to bring my husband to the states.

I just realized I hadn't updated my public timeline via the signature.

Let me clarify what I mean a little bit more.

i know that the cosponsorship is an option but asking a friend to enter into a contractual agreement and a financial one at that isn't something i take lightly. So I am trying to understand a little more what their obligations would be. For example, if i got a job a month that meets the income requirements would my cosponsor still be bound to me and my husband? Are they responsible for years?

I had a good job with an above average salary. And I intend to find something else as soon as possible. But i would like to learn alittle bit more about what my cosponsor's responsibility would be.

K-3 Spouse Visa Process & ProceduresK-3 Update/Ethiopian Embassy
Hi all. I just thought I'd give people an update about me and my husband's visa process. As you can see from the info below the visa was approved in late March but unfortunately the Embassy "didn't have" his mailing address (although I included a section in my package for his postal address in addition to his address).

Instead of mailing packet 4 to him in Addis, the embassy said they'd mail it to me in the US. To make a long story short, they scheduled a meeting with him on May 2nd pick up his instructions. He met with the Embassystaff on Tuesday and was pretty pleased with everything.

As for the affadavit of support, the Ethiopian embassy requests either the I-864 or the I-134. If anyone has any recent experience with the Ethiopian Embassy please contact me.

Otherwise, I just thought I'd pass along this information and to update everyone on my current experience moving forward with the K-3 visa. In one day, my husband has gotten his medical test and says that he will be able to get his police report by the end of the week.

Even with the delay, I'm excited at how things are moving forward.

Best.

K-3 Spouse Visa Process & ProceduresSultan's K-3 visa was approved!!
Hi everyone. I'm sending this information slightly after the fact but I just wanted to let everyone know that Sultan's visa was approved on TUESDAY of this week. He picked up his visa yesterday.

Everything moved so fast that I just wanted to wait until Sultan had his visa in hand, in case there was a mistake or something.

But, alas....its REAL......Sultan's got his K-3 visa!!!!!!

So here's what happened from last week.

Last week, we found out that the US Embassy in Addis Ababa interviews people the same day they submit their visa application. I was very confused because everything I'd read -- and even was told from a good friend who came here on a K-1 visa -- indicated that you have to submit the paperwork to the Embassy, wait for an interview date and then find out their decision. No so in Addis.

The interview was pretty easy for Sultan. They asked the following questions:

1) How long ago did we met?
2) How did we meet?
3) Where did we meet?
4) How we maintained contact?
5) When did we saw each other since the 1st time/for the wedding?
6) Where did I say? address?
7) How long was I in addis before the wedding?
8) How long after the wedding did I leave to go back to the US?

For our evidence of support I provided tons of information (email, phone, cards, travel docs) but the official seemed impressed mostly with the internet chat transcripts. i won't lie. She was very impressed with how organized and through everything was. (I made a powerpoint of our pics) :)

Thanks to everyone here for their support, instructions and advice. I wouldn't have been able to do this as successfully without the people here.

Sultan will be here in about 30 days!!!

I can't wait!!!

BTW. I need to update my timeline.
