it seems to imply something should be done where the underscore is, but nothing comes out and says that. Do we initial? the place where we sign is clearly indicated, but this underscore just sits there mocking me. Posted Image

Thanks for the clarification!

She's here, we've been married nearly 2 months, and the I-94 expires in 5 days.
We have already filed for AOS, EAD, and AP, and completed the Bio Appt.
At this point, it's pretty much just waiting for the Feds to do their paperwork.

This is great, all very well written, however there is a little part which perhaps needs to be re-phrased. If you are entering the USA on a K1 visa, you cannot already be married - in the last sentence here you write that you could marry in the fiancé's home country before she/he arrives in the States. Perhaps you mean you can have a marriage ceremony without the 'legal' part, though, in which case I'm sure that is allowed! and I will stop nit-picking.

Otherwise, this is a great post, and I think I'll forward it to everyone I know who is always asking me how the K1 visa process works. Unless you are actually going through the process, it can all sound very confusing!

I was looking through the discussions, but could not really find info to answer my question. I submitted the k-1 visa in Oct 2010, but right before NOA2 expired, the fiancé and I separated. This was in June 2011 and NOA2 expired in August. We have since then reconciled and are looking to re-file. My question is can we reopen the case through NVC or consul or will I need to submit the k-1 petition all over again. Will we encounter any problems, with the petition, since the first one was approved, but we let it expire? Hope this makes sense. Thanks!

The letter should have been part of the inital package, durning the interview the CO doesn't have much time to evaulated the content of the letter. In saying this you can write the letter, there will be no harm if you do.

My fiance has his visa interview on April 12. I have gathered letters of support from friends who have met him and letters of support from my mom and sister who have talked with him on the phone. I feel like I should be able to express my perspective at the interview too. I wrote a very short letter of intent for our application to USCIS, but want to include a longer letter about my experiences with my fiance and my feelings toward him. Good idea, bad idea?

I also just predicted it would be at the embassy in 3-5 business days and emailed them. They use a different case number than USCIS, but I think they can look it up by your first and last name or your fiance's first and last name and possibly date of birth. You do need to put Second Request in the subject line or you'll just get an autoresponse.

I just read a post that recommended sending additional evidence of relationship with your 129F to USCIS so that it gets sent along to the embassy and they have the evidence in hand as they begin to review the other paperwork. I submitted a couple of photos of us together with my original application, but I've been back to visit since and have a whole photo album now. Has anyone done this? Recommended/not recommended? As we prepare to get another original copy of my fiance's birth certificate and as I wonder what other paperwork we may have lost to the "sealed envelope" handed over at POE I just wanted to remind those who haven't been to their interview yet to make sure they keep an original copy of such important paperwork. I got tired of making copies and didn't know they were going to take my fiance's birth certificate and not give it back. It is my understanding now that they would have accepted a photocopy. So...just another thing to think about as you prepare. Look ahead to what will be needed for AOS and what might be difficult to obtain once your significant other is no longer in their home country.

I received my NOA2 via email on 7/1, and it said it had been mailed on 6/30. Due to the holiday, I just received the hard copy yesterday. How long should I expect it to take for the NVC to receive my file? I know I should expect a delay from the holiday for them to get it as well, but what's the realistic waiting period there? They're telling me it takes 3 weeks to 3 months for them to receive it, which doesn't sound at all like the norm according to timelines here.

Any ideas?

Well, after 24 days at the NVC my case finally was sent to the embassy, so hopefully we can get an interview date in August. I hope my prayers are answered.

Yes, send all your originals to your benecifiary.  I did the same thing.  I sent him everything that was included in the original petition.  There are certain that should be orignals and copies.  Such as send the orignial of your birth certiicate, divorce decree, notarized tax transcripts, pictures, affividat of support, letter of intents, etc.  It should be okay to send copies of chat text, emails, skype logs, call logs, passport stamps, etc.

We recently had our interview and we did not need those other forms. Only required forms are the DS-156 and DS-156K. Remember one of them (I think the DS-156K ) must be signed during at the Consulate. Were these other forms required on your Packet 3?

Then call again, my case was processed in California and our NOA1 was January 20 and it's now in the embassy for visa process. So your case should be in the embassy by now. I met someone with January NOA1 in Vermont and their case was going to NVC last month.


I'm in the same boat as JBR. Filed with the VSC on 1/17/2012, haven't gotten my NOA2 yet. I call a couple times a week, and they have told me the exact same thing for a month: i.e. they are currently processing 1/16/2012. Just called today and was told the same thing. My Senator is working the case, but it's not exactly warp speed over there either. Best of luck to everyone still waiting.

Regarding tax returns, is there a requirement that they be physically signed? I have pdf copies of my tax returns as prepared by a tax software that I used. However, given that I e-filed my returns, they do not show my signature on them. Would such copies be acceptable if corroborated with respective W2 forms?

Some of the responses are are just laughable.
Some people cannot seem too give their advice without being snarky know-it-alls.

OP: Glad you were able to track down your 1040s from previous years. Submit what you've got, sounds good. Though you would've been fine with what you what you had.

On a tangent (to noone in particular): I would think that the transcripts would be preferable, as they show proof of the IRS receiving your returns. Any Joe can print out a 1040 form from turbo tax without actually filing the returns for that year, that's why if you turn in your 1040 copy they also want a copy of the W2, to verify the information. Just a thought.

Thanks for the reply JJ. Unfortunately, the software I used (not turbotax) does not indicate that. I'm going to order IRS transcripts as additional evidence.

If you used turbotax then it will show on the front "No signature form is required since you signed your return electronically"

My fiancee and I are in the middle of the K-1 process. We just learned that our case has been forwarded to the US embassy in Paris. I have already sent my fiancee an I-134 affidavit of support with a letter from my employer, bank statements, etc. I have read on this forum somewhere that they ask for tax returns in the Paris embassy, so I'm going to send her copies of the last three years returns + W-2 forms. It is not necessary, though, to get a lawyer and can be even more satisfying knowing that you both worked throughout the whole process on your own. On the other side, a lawyer could prevent you from not sending something important in the first place, but the lawyer will not make the process go any faster. We did it ourselves and got the NOA2 in 2 months, 4 days.

I only had a couple of ticket stubs for our trips back and forth and itineraries as well (though they didn't prove we actually visited each other). Make copies of visa pages in the passport since they show trips as well as possible bank statements showing the ticket purchase around the time of the trip or before. Pictures are good (especially if dated on them) but they serve as secondary evidence so the more primary evidence you have, the better.

AP or Advance Parole allows your fiance(e) to travel to and from the U.S. abroad during the AOS process (before the conditional green card is received). It takes about 3 months to get approved and is sent in with the AOS applicaiton. This is almost necessary unless your fiance(e) doesn't care to visit his/her home and can be used to fulfill religious wedding ceremonies or the equivalent abroad.

The EAD or work authorizaiton may be given at the port of entry (POE), but often isn't. It is another application to let your fiance(e) work in the U.S. before the green card is issued. It takes between 3-4 months based off recent processing times.

There is no extra charged if filed with the AOS, though that is expensive ($1,080) last time I checked.

For our K-1 visa, I sent 12-15 e-mails and 16-20 photos. I took the pictures using a digital camera (who doesn't nowadays) and put 4 on a page (MS Word) and included captions/dates for each and an overall title such as "August 2007 trip to..." I think more is fine (we got our NOA2 approved in just over 2 months, though from VSC). I wouldn't recommend sending 30+ pictures or e-mails, but a reasonable amount would help support your cause; too few would not.

I have read elsewhere in the forums that he can visit up until you receive the visa. The downside is that he might buy a ticket only to be rejected at the Point of Entry (POE) because the immigraiton officer might believe he is trying to stay permanently on a nonimmigrant visa.

I don't believe it will so long as her permanent residence is the address you listed for all 5 years. If you list other addresses then you might be required to get police certificates from those locations for the itnerview. And, if she has only rented an aprtment and not registered with the city, then it is unlikely there would even be a police report to get.

Just be sure that her permanent residence is at the address specified and that there would not be any reason to have her address listed elsewhere (i.e. on record with police at her school's city).

well you will want to give the address where she would have a police record for which is required for her interview later on. So, her permanent address would be fine, but I would put the address where her school is located if you are going to state that she has been a student in another city.
