Hello peeps!

 

I was starting to think I was an old hand at this malarkey, but USCIS just keep throwing me those curve balls (US)/googlies (UK).

 

I received an RFE yesterday for my ROC stating that I had failed to demonstrate to a sufficient degree that we entered into a "good faith" marriage. General annoyance and furiousness that this is suddenly an issue after 3 years aside...

 

The RFE specifically states that the application did not show sufficient co-mingling of finances and residence. Here is where the problems start.

 

My OH has a checkered financial history and bad credit, so I made the conscious decision to keep our finances separate from the get go. There is pretty much nothing with both our names on it. I was an authorised user on one of his credit cards, but I had myself removed as it was dragging my fragile new credit score down. Even our lease is only in my name because they ran a credit check on application.

 

I already provided health insurance cards, our 2012 tax return, utility bills in individual name showing the same address, and photos.

 

Here is what we do have:

 

- One joint bank account that has a nominal balance and is rarely used (i.e. neither of our paychecks goes in there and we pay no bills from it)

- We are beneficiaries on one another's life insurance policies offered through work

 

Here is what I can get:

 

- My husband's name added to the lease, but that will be dated after the RFE date

- Wills drawn up in both our names showing one another as beneficiaries, but again, will be dated after the RFE date

- Affidavits testifying to the true nature of our relationship until the cows come home

 

 

I guess my question is - will this be sufficient? And will it cause more problems if I provide documents dated AFTER the RFE, as they will assume (and they'd be right!) that they were only produced because of the RFE?

 

At this point I am so fed up of USCIS I almost don't care anymore, but I suppose I ought to at least try and avoid deportation :)

In terms of the practicalities of filing, I would follow the same rules you did when you filed your petition in the first place. Having been on the receiving end of 3 RFEs now :), here is what I do (and will be doing, as I have to send my response to the third one soon):

 

- The original RFE letter (on the coloured paper, not a copy) MUST be included with your submission. It should be on top of everything else.

- Underneath the RFE, a cover letter stating what your submission relates to (i.e. response to an RFE pertaining to case XXXXX and conditional resident A-XXXXXXXXX), and a list of what is included in the package. Both you and your spouse should sign it, ideally.

- Next comes your evidence. Write or attach a post-it to each document stating exactly what it is.

- Bind all the documentation in the same way you did for your original submission. I followed VJ's advice and used a two-piece fastener (like http://www.staples.c...roduct_ACC12995) at the top of the page.

- Send it, with delivery confirmation. On the front of the envelope I usually write "NATURE OF SUBMISSION: RESPONSE TO RFE PERTAINING TO XXX"

 

I have a lot of opinions about USCIS, but the one thing I will give them credit for is that the RFEs are usually extremely detailed in terms of what they need from you. Follow those instructions exactly. Highly unlikely you would be denied at this point (although can't say for certain without knowing what your RFE was for). The only thing that would definitely cause them to deny you is if you fail to respond within the timeline specified on your RFE (usually around 90 days). You say your wife is abroad, but I would suggest doing whatever you can to get that submission in by the deadline. Good luck!

This is a question of outright lying vs. simply lying by omission. The I-751 form requires you to submit a list of all your address since conditional residency was issued. I would say that if you hadn't moved any of your bills, etc, then omit. As you registered the change in address with government agencies, you should include it.

 

As Navyk says, you could say you moved for work or some other reason, but that would be an example of the outright lying. Lying to the USCIS is a big deal - if they find out, it could cause you more aggro than if you had just been honest in the first place. This is just my opinion of course. 

 

Also my opinion, but I would say that if you can provide plenty of strong evidence of a bonafide marriage both before and after the trial separation then just tell the truth. It happens. USCIS also cannot deny you on the basis of (non-legal) separation alone. Here is a link to the memo pertaining to this (I have been going through similar issues and had asked a similar question):

Definitely make sure you send as much evidence as you possibly can and a note explaining your 3-month hiatus living somewhere else. Joint tax returns are big winners, and in this case I would say affidavits from friends, family, etc, who can attest to your genuine marriage throughout the years, would be very helpful also. Worse case scenario you will go to interview and can tell your story. Just because you've had some troubles doesn't make it not a genuine marriage.

Just checking in. Responded to our RFE on 7/30 and it was signed for on 8/1. I agree with weescotlassie, very stressful this time around. I am hoping just to have the GC issued rather than going to interview, but ultimately I was not able to add my husband to our lease so I had to send a letter from our apartment management company explaining that we'd been living together and to call her with questions if they had any. So not ideal, may trigger an interview. On the other hand I did send a full house of joint tax returns and I always feel like those are really strong evidence, so maybe I'll get lucky...

 

My online status updates do not seem to be working this time round, so I'm just eagerly checking the post every day. Really would like this to be over now.

Same here. I got a RFE and I was feeling like "well at least they are working on it"

Now we sent the response so we are back to "who knows when we will get an answer." and who knows if they are going to like our response to RFE or decide to interview.

 

Oh well

wait...wait...wait....and more wait ....then wait again

LOL

 

 

I've received RFEs before. The good news is they generally mean you are close to being adjudicated. The way I look at it is, "if they had all the information the wanted when they reviewed my case, I'd be approved right now" - not as negative as it sounds, because at least you're one step closer. Usually an RFE = something WILL happen when you get the information to them. In my case for AOS, I got 2 RFEs; my case was transferred to CSC about a month after the first one, and I was approved 10 days after the second one.

 

AND - I'm surprised to have heard anything at all. Last I checked VSC were taking 12 months, so anything at this point is a step forward!

This is actually quite interesting as I have been thinking about it with regards to my husband. As we live in DC you can imagine we have many friends that live what we call a "secure lifestyle" aka security clearances. Because my husband is a foreign national many of them due to their level must list him as a foreign contact. He is now on several lists because of this. He also had an extensive background check due to his employment and has to go through this routinely for rechecks. We make jokes about how checked out he is but I am wondering if this will hurt or help him. I am hoping help him considering. Guess we will see. *Crosses fingers*

There have been cases where getting the 10 year green card has taken over a year and filing for citizenship will bump the process. So this is nothing really new but usually more geared towards red flagged files. But do not discount the backlog either.

The form extending her green card a year is just that. That is her proof she is legal. I'd be skittish carrying around the original because if it is lost that would cause problems. Make a copy of it and carry it around with the Green Card for now.

On an odd note, as we have all my hubby's past apps listed as well I noticed 2010 dates on his 485 and 765 forms. I guess they go back and look at these? I dunno. Just weird.

oh my god.... i knew something was wrong. Our entire packet got returned today with the check!!! I am so mad at myself I could scream!!!!!!!!!! They want me to send all the evidence back (nice of them to neatly pack and rubber band it together for me) along with my CORRECTED check. Do you know what I did.................... I wrote out the check I made it out to US Department of Homeland Security, wrote 545.00 in the box....... signed it......... but I FOROGT TO SPELL OUT FIVE HUNDRED and FORTY-FIVE DOLLARS and xx/100. in the second line. I am so mad at myself and in fairness, I really wish the agent at uscis would have told me on the phone. This is so unlike me to do something so stupid! I remember though that day was really really stressful and I was racing to get everything done, and I mess up the gosh dang check. arghhh. now I have no car tonight and can't mail back until tomorrow which seems like an eternity b/c we go on vacation on friday so I won't know what's going on till I get back on May 6th if we are lucky.... what horror :-( my only stupid fault.

I so need a hug. And a tall glass of scotch... wait I don't like scotch... make that a pina colada.

Ouch! If it makes you feel any better; though I doubt it ;P, when I sent our I-129F way back when I sent them a check which happened to have a picture of Big Ben on it as I had these checks that had famous places from around the world. They sent it back saying it was drawn up on foreign money even though it said USD and was an American bank (Wachovia). So I had my mom send it back as I was in London at the time with a letter from our branch manager confirming that this was a legitimate check. They sent it back again saying it was already endorsed (BY THEM). I was furious. Thankfully my mom at the time had power of attorney for me while I was in Grad School and she got a certified check and sent it in and the 3rd time was the charm. I learned from that point forward to just do a certified check from my bank as I could still track it being cashed by just making a call. Funny enough we got the NOA1 before the most recent check was cleared.

The receipt number shown on the NOA #1 won't work in the USCIS website. You need to wait for the ASC (Bio) Appointment Letter to get the correct number.


AH HA! Thank you very much. My anxious state of wanting to know things immediately as they happen got the better of me. Any word on the average time between the NOA and the Bio letter? Didn't see it in the timelines.

I do have a quick questions because it's just a curiosity.

The VSC looks to be having a very quick turnaround with the NOA1. Roughly 3 days as dated from receipt. Did any of you keep tracking if payment was cashed and cleared while waiting to actually receive the letter? I am just wondering if they are sending the NOA before checks actually clear.

Like I said, just curious and hoping we get ours just as quick. :)

I realize in my haste to get that thing out the door - because I've been so busy at work and delaying it ...I think I forgot to sign my N-400 cray5ol.gif and It's THE perfect package too!  Im so angry at myself...and the unnecessary delays I've caused myself now! Has anyone here ever forgot to sign their form or know someone with a similar experienc. what can I expect? an RFE? return of my package? what would be the turn around for this ClockWatch2.gif

Find yourself lucky, I waited 9 months before i got a RFE for new fingerprints except instead of a new Bio appointment they made me go get one from my local fingerprint place (50 dollars later). 

 

I just put in a service request on friday and it seems I was approved after 5 weeks.

 

 

Hi there, thanks for your quick response. I just want to make sure I understand what happened with you....you mean you were approved within 5 weeks of submitting your I-751 and your first set of fingerprints.......but never knew about it and instead got another notice to get your biometrics done unsure.png

 

What is a service request by the way ?

Removing Conditions on Residency General Discussion2nd Biometrics appointment- 6 MONTHS later?

Hi everyone, 

 

 

We applied for removal of conditions (I-751) in late January 2013, and within days got an NOA Extension letter for 1 year. Then I went to get my biometrics done in mid-February 2013 I haven't heard from USCIS since, but I knew my fingerprints had failed, as they sometimes do at the USCIS (surprisingly not at other departments).  

 

Now- 5 months after my last biometrics appointment I received an NOA to go back for a 2nd biometrics appointment in mid-August. Has anyone been through this during their removal of conditions ?

 

We have planned travels to see my family in October, and I'm worried that if they require us to come in for an interview we'll miss it. I'm curious if others had to wait this long for a 2nd biometrics appointment, and if so how much longer did you wait for your interview or green card ?

Hi All, 

 

 

We're in a similar situation except we haven't really been waiting that long, but definitely past the 6-month mark. We applied in Jan, got called for biometrics in Feb, then heard nothing till July, and went in for a 2ND Biometrics in beginning August. So it's been about 8 months and we're still in the 'biometrics phase' and initial review. 

 

From your experience do you recommend we take any action at this point so as to push USCIS to handle our case sooner than later? E.g info-pass appointment, or call to ask for info on delays...I'll be traveling in December and hope to have heard from them before then. what's the best course of action to take to encourage them to tackle our file sooner than later?

I'm unsure if it's to be obtained from a local police department, I'll call my local PD though to make sure. has anyone else had any such experience with an RFE for police clearance letters, and have local letters been sufficient.

Removing Conditions on Residency General DiscussionRFI: Police Clearance letters...State or city/county level?

 Hi all,  it's been a long wait (January) since we submit our 'removing conditions' application, 2 failed biometrics, and when we finally contacted them to see whats happening on September 26th, we finally receive a letter today to submit Police Clearance letters from 'each place you resided from the date you acquired conditional permanent residence status to the date of this request'. 

 

But it doesn't give any details about whether the clearance letters are supposed to come from a city level or state level. We've lived in FL (miami) and now VA (Arlington), but we're confused about which clearances to request for this. 

 

Has anyone had a similar experience with requests for police clearance records, and what did you provide?

 

Thanks any suggestions would help.

Have you tried to get in contact with NVC or whoever it is you are dealing with to find out what specifically they want from you instead of stressing out. Let them know what you have sent in and is it anything else apart from that they want so you can respond in a timely manner. Good Luck!!!

Here is my simplistic advice.

'Sealed' is NEVER sealed to the actual government itself. Period, end of story.

Explain what happened, explain that it was 'sealed' (this can be verified as well).

Accept the consequences either way.

Don't break the law, life is simpler. Many (most?) people agree pot should be legalized, and it eventually will be. Indulge then. :)

I'm a little hard line on it because I was a cop in the Air Force.
Black and white is very easy to understand. :)
Life is rarely black and white, but the laws unfortunately are...

Hello fellow VJers. My fiancee and I got word that our P4 was logged on Wednesday and we can schedule her interview. Now of course there are no available inteview times in Montreal. Anyone have any insight into when they will be posting more? Does it happen once a month, twice a month? Any input would be fantastic. Thanks.


Unfortunately, there are many of us waiting. :( The last time I saw some available dates were Feb. 10th and 11th. I wasn’t able to book one because my packet 4 was not logged in until the 17th. Just keep trying as I’m sure we will all get one soon!

CanadaBooking an interview at Montreal…

Congrats to everyone...I've been reading your posts and am anxiously awaiting too...however, in my case I can't rush into an interview yet...first need to fix up the house to get it ready for listing....then I can proceed with booking an interview and medical. Does anyone know if they've opened up more interview dates and what is the latest date available? I'm trying to stretch this to late May...maybe June. As much as I want to be with my man, there are still so many things I need to do here first..... I've waited 8 years for this, I can wait a bit longer.....well, maybe just a bit. Thanks a bundle!

I just logged into my fiances account and it looks like they currently have no appointments available and the calendar is empty. The best suggestions I have is to get a group of VJers and check the website as often as you can. When dates finally show up, either text or email each other...Best of luck to you!
