I've been checking the website allll day, then when I just checked it again after 8pm EST, the screen suddenly looked different!!! It feels SOO good!

Wow that is really thought out!! good for you star_smile.gif How dumb is it that we can't just get married like normal people!! Before I got to the end of your response, I was going to ask if it would look suss coming over on the VWP after having cancelled a K-1. Would that show up in the computer for immigration officials? I mean, he WOULD probably be able to show ties to his country.... That was going to be our back-up - the VWP - but then move back over to Australia after the wedding (I really don't mind where we live as long as we're together!) - since a spouse visa to AUS takes only 3 months TOTAL (p.s. I hate USCIS)!

Quick question - Jeraly, I see on your countdown that you are getting married in about 4 months. What are you going to do if your K-1 isn't approved by then? My parents and I have already made a TON of wedding plans for April 19 because when we started VSC was taking about 2-3 months to process applications! mad.gif I will die if I have to wait that long to see my man and even worse, if we lose all the money we put into the wedding... I think I remember reading you have a backup plan - what is it?!

Hi All,

I've been reading on Visa Journey for a while but just decided to register as I think it will give me some more support! I filed in July as well and have been really frustrated at how long the I-129F's have been taking. Has anyone had a congressman contact USCIS? My mom had talked to someone in a PA congressman's office and they sent her some authorization forms to fill out as well as a letter from the congressman saying thanks for her concern and that they would contact USCIS as soon as the forms are sent in. She forwarded them to me and I am about to mail them! So, hopefully I can get some more information as to what exactly is going on over there at the VSC.

Affidavit of Support question...

Hi All!

I am just wondering - I keep reading people talk about having 3 years tax returns for the interview, but on the I-134 it mentions nothing about these unless you are self-employed. Are these just a back-up that is sometimes requested? If so, why would this not be listed on the I-134 directions?

Random question -

Not sure if it has already been asked, but is it ok to get the medical (for K-1) before the consulate sends the packet 3? I want to speed up the processing time as much as I can, but I read on Sydney's Consulate website that only the original medical forms may be filled out - that the doctor will not accept faxes or copies. Maybe it's different for different countries?

Also, is it ok to have the police check done before packet 3 is sent out?

Congrats to all those who have received approvals and are making their way through the end of this process!!!

Just a lil update...

Steve arrived in the US about a month ago now, and everything is great!! He came in through JFK, so he got a work stamp (although it looks reallly dodgy!). AND, he already got a job working with a company called Australian Landscaping and Construction, which is actually owned by a couple Aussie guys so it is perfect for him! He manages groups of workers and sort of oversees different projects. He really likes it, and they gave him a company truck and fuel card as well. Plus, they are really easy about the work stamp stuff and getting time off for the wedding because at least one of them has been through this whole thing before. He also went in to apply for a S.S. number a couple weeks ago and all went well, so should be arriving any day now.

We're so excited to finally be together!!!! I'm loving every minute of this.

WOW content.gif just yesterday I was on here whining about us not receiving our approval notice (receipt was back in late February) .... then a half hour later I decided to check the status of our application online 'just in case' and *ping!* approval! I couldn't believe my eyes. Perhaps it was good luck, writing on this forum! This is clearly a good sign for all Feb filers.

They received our package May 5th, but we didnt actually get the receipt in the mail till June because they had some problems with the receipts at that time. We filed at the Texas Service Center but it was sent to California. I really recommend using the RFE trick if you think it's about time for yours to come in. Best of luck to everyone. It will come in, just be patient. ha ha, the other day I was crying saying how it would never come and something must have happened to it. Well, it came.

It was transferred to CSC. But I highly recommend calling. It was uncanny how soon we got the approval after we called.

Thank you, and also thank you for your response, I actually just spoke to DOS, and they said as of today, my fiance' is eligible but there is no date in the system as of yet..:( ....it's funny that you said that, someone else on here told me to call DOS, and inquire about a date. But they told me there was nothing in the system as of yet...to date we just received the approval on April 27th, NVS sent our case/request to SDO on May 3rd.. :(

Check my timeline and others with similar ones. It my case it took about 2 1/2 months to receive our interview date. I called the Department of State and spoke to the Visa Specialist to get my date. They told me when the date was and when the interview was mailed. I wish you the best with on your journey. Let me know if you have anymore questions.

We received our approval notice 4/27/10 so, I was wondering did anyone have anything to share about how long and what the process is like from here? We have not received our packet yet. I've heard some crazy things about waiting and a waiting list in Santo Dominigo. Does anyone have any idea where I can locate it? Any information would be really helpful. :yes:

I don't remember seeing that a letter of intent was necessary for the interview in the paperwork I got. Maybe, it depends the consulate? I did see, however, a form whereby my fiancee would have to sign affirming that she will not marry before she enters the U.S. No form for me though.

I think you need to decide if you want to stay with her because, as you said, you love her. If you don't want to stay, then find out the steps, but make that determination first. There's no point finding out the steps of removing conditions while married if you cannot wait until they are removed to get divorced.

they still have time to submit. I would recommend spending the next 48 hours getting all documentation and sending it expedited to arrive before 2/24 because they would be risking deportation proceedings and a date with an IJ if they do not submit the documentation.

You do not need to submit finger print cards unless you reside overseas because of Government Orders or Military or you have a dependent overseas for whom you are applying as well. If you are in the US with your spouse, just wait for the biometrics appointment letter.

My wife and I are traveling for 3 weeks and I understand that several people have received their biometric appointments during that time. My question is, is it advisable for us to file before our trip (about 2 weeks from now) in hopes of receiving the 797C with the appointment date so we can either walk-in or reschedule OR should we file after we return from the trip (we would have about 3 weeks before the conditional green card expires at that point.

Any advice is appreciated.

Sorry but this is incorrect.

A 2-year green card is only given in cases where the USC and spouse have been married less than 2 years at the time of the green card's issue.

According to your signature you were married in March 2006 and the GC was issued in June 2008. Therefore you had already been married over 2 years when your green card was issued, so you received a standard 10 year green card. Removing of conditions is not required, because you had already met the 'condition' of being married for over 2 years.

Relax and enjoy your time together, you're done with USCIS for a while :)

Unfortunately (usually fortunately giving the cost of living in DC, but not in this case!) our utilities are included with our rent so we do not have separate utility bills. I did send a cable bill in my name and the renters insurance/cellphone bill in his name, showing the same address; none of those bills would allow us to both be listed on the bill.

 

In terms of tax returns we submitted 2012; we have a copy of 2010 but could not find 2011. I think I thought having a missing year might look more suspicious than just the most recent one, so I just sent the most recent one. Admittedly I could have paid for a copy of the 2011 return, but if I'm honest I think I was suffering from "USCIS fatigue" when I submitted the application and was more lackadaisical than I should have been sleep.png

 

 

 

It will help if you add your husband to the lease and to the insurance policies.  Do not worry that these will be dated after the RFE and there is no shame in admitting to the USCIS you did what it took to prove yours is a bona fide marriage, well, because it is!  :-)

Car Insurance policy card - should show both of your names if you both are designated drivers

Car Title - If you are both on title

Life Insurance policy showing beneficiary details

Driving License showing same address.

 

Getting the life insurance policy info from my work. I believe I already sent our drivers licenses but I need to check (my copy of our submission has gone walkies in our apartment and I haven't had a chance to find it yet)

Hello peeps!

 

I was starting to think I was an old hand at this malarkey, but USCIS just keep throwing me those curve balls (US)/googlies (UK).

 

I received an RFE yesterday for my ROC stating that I had failed to demonstrate to a sufficient degree that we entered into a "good faith" marriage. General annoyance and furiousness that this is suddenly an issue after 3 years aside...

 

The RFE specifically states that the application did not show sufficient co-mingling of finances and residence. Here is where the problems start.

 

My OH has a checkered financial history and bad credit, so I made the conscious decision to keep our finances separate from the get go. There is pretty much nothing with both our names on it. I was an authorised user on one of his credit cards, but I had myself removed as it was dragging my fragile new credit score down. Even our lease is only in my name because they ran a credit check on application.

 

I already provided health insurance cards, our 2012 tax return, utility bills in individual name showing the same address, and photos.

 

Here is what we do have:

 

- One joint bank account that has a nominal balance and is rarely used (i.e. neither of our paychecks goes in there and we pay no bills from it)

- We are beneficiaries on one another's life insurance policies offered through work

 

Here is what I can get:

 

- My husband's name added to the lease, but that will be dated after the RFE date

- Wills drawn up in both our names showing one another as beneficiaries, but again, will be dated after the RFE date

- Affidavits testifying to the true nature of our relationship until the cows come home

 

 

I guess my question is - will this be sufficient? And will it cause more problems if I provide documents dated AFTER the RFE, as they will assume (and they'd be right!) that they were only produced because of the RFE?

 

At this point I am so fed up of USCIS I almost don't care anymore, but I suppose I ought to at least try and avoid deportation :)
