CONGRATS EVERYONE ON THEIR APPROVALS!!!!!

Ok, now I have some questions/concerns. I have scoured and read the boards on these subjects and now just want to know others experiences. First we receive our NOA1 on November 27th. Since then he came to visit me in the US during Christmas and I went back with him to Germany in January. Fast forward – He is coming back to visit me at the end of March. Could this really be an issue for him to visit me since we are in the K1 process? And if we did receive our NOA2 before he visited will they let him in the country to visit? I read conflicting stories on this but can’t find any rule saying you can’t see each other during the K1 process.

Second, question. Is it really an automatic red flag if the woman is older than the man? I am 7 years older than my fiancé but no we know, including ourselves, has ever questioned this or thought we were an odd couple. Could this really be problem with getting an approval? Should I plan to attend the interview with him in Germany?

Any insight would be appreciated. After reading the boards more and knowing NOA2's approvals are rolling, I'm starting to worry that something will get screwed up!!!!!

To be honest I think there IS no hard and fast rule.

I went to see Mr. Jess in January i.e. after we'd filed. I ended up entering via Miami as my flight to Orlando was cancelled. I was asked the purpose of my visit and I said 'to run the Disney Half-Marathon' - the truth, but I just neglected to mention I also had a fiance to spend time with too ;)

I have asked this question myself and the advice I received overwhelmingly was - don't volunteer any more information than necessary, but DON'T LIE...if they ask him he should tell them. He should also bring plenty of proof of ties to his home country - return ticket is obviously good start but if he;s asked he'll probably need more. I took my lease on my apartment and proof of employment, as well as a (large) unpaid credit card bill...I wasn't asked for any of those things but it's worth having just in case.

Apparently the Immigration Officer can only tell you've filed for a K1 once you have returned your Packet 3 to the embassy. If (hopefully!) you are at this stage by the end of March make sure he has all of the above plus a copy of the I-129F application and your NOAs. Ultimately it is at the discretion of the IO to let you in - plenty of people who have posted haven't had any problems visiting, but some have.

I'm visiting in April and worry about the same thing, so you are not alone :)

oooo oooo oooo.. our application has been "touched" today.. that just sounds wrong.. but still im soo excited.. its not an approval/denial but its something and that is WAY better than nothing.. :-) :-)

You're a Nov 20th NOA1 right?? Send the good touching vibes my way!!! (hehehe sounds dirty......)

YAY to everyone with NOA2s, every one I know who gets one gives me hope and I feel almost as good as if it was our own :)

We didn't see too much activity for today yet, nobody has updated a NOA2 for today on Igor's list, I hope they're still working as hard as they did this week, especially yesterday! My case hasn't even been touched yet, come on VSC keep it up!

lots of the nov 25 noa2s came through overnight and this morning - there's still time :)

aww so sweet, it is 26 :) tee hee thanks again!

I think it's set up specifically to work for our day cos only returned 5 cases :( 3 of those were post-decision activity though so that's a 60% success rate ;) based on my very limited and unscientific assessment your time is coming!!!

Also - some interesting news:

http://www.uscis.gov...000b92ca60aRCRD

Filing location for AOS and EAD is being moved from the service centres to lockboxes, effective immediately.

My initial thought is that this must be good news for us given that it means fewer cases going into VSC?!

Well it finally seems there is some forward momentum. So now it's just to wait. So in the mean time, what have you been doing to be prepared to show proof of on-going relationship during the US embassy interview?

I've sent her a letter a week, and I save all the letters she's sent to me.
I have chat logs, emails, and have phone records (I call twice a day).
I have a duplicate copy of the entire I-129f packet I sent to (boo) VSC (boo).
I have printed out as many forms as I can to send her.
I have a stack of pictures I took when I visited her in Phil.

Question:
Will you have new passport photos taken to send before the interview or just send more copies of the ones you have now?

I've sent off for my police certificate and I am going to try and get to the docs in the next week or so to get my vaccinations record....and a letter stating why I haven't had most of them (allergies).

I've started filling out some of the forms I'll need for the Embassy (which is how I realised I'd cocked up my G-325A!!) - that way all I need to do is print them and sign them and we're good to go.

Mr. Jess has requested his financial info from the various places to time how long it takes to get them all - nothing seems to take too long so he's just going to request fresh up-to-date copies of everything as soon as our NOA2 hits.

I already have a full copy of our I-129F package so good to go with that. Went to see him in January so obviously kept the boarding passes and took lots of photos while I was there :) Other than that just going to be a case of printing out my Skype records, Facebook records, and emails - I don't phone him direct that often as it's just not the cheapest way :)

On the passport photos front - going to get new ones done. Aside from anything, I looked stoned in the one that went off to VSC - plus my hair is now 3 inches shorter and several shades darker ;)

Yes, a Happy Monday, the beginning of the last week of February, to all! Before long, we'll be wishing one another "Happy 4-month filing anniversary!"

I was feeling frustrated at the petty feud that seems to have developed between the Nov. and Dec. filers. I nearly deleted my VJ account (admittedly, this was after an evening at the pub's customer appreciation night, where there was free beer; not my most rational moment), but settled for changing my name/avatar/whatever you call that thing. I hoped this would signal, if only to myself, the turning of a new leaf. Most of us have been through the roughest period. We're well past the halfway point of our waiting, at least for NOA2, and it seems everything goes easier from that point. It's hard to hear every week "it's just around the corner" etc. only to be disappointed, so I won't bore you all with any of that. I humbly suggest we stop all the infighting and inter-month feuding. None of us came here with guns drawn, looking for a fight. Tensions are high (of course they are!) and tempers flare, but we came here looking for support and answers to our questions. I think we've been doing a good job of focusing on these things, so let's keep up the good work, and fight the good fight.
Good luck, November!

Amen to that. I'm cranky enough as it is ;)

We hit our 90 days yesterday, which unfortunately coincided with me realising I'd cocked up my G-325A (if you've see my other thread you can have a good eye-roll at my stupidity). So positivity is hard to find at the moment as I'm so convinced we're going to get RFEd - not a disaster in itself, but knowing my luck we'll still be waiting for a decision in July...sigh :(

Does anyone know if VSC works weekends?

They don't, but the subcontractors who do the electronic status updates seem to. A few people have received their email or text message notifying of NOA2 at the weekend, but their NOA2 is dated from the Friday.

K-1 Fiance(e) Visa Case Filing and Progress ReportsNovember 2009 filers

I've been in contact with my senator the past week and a half. I made a letter and a quick report showing the results from the spreadsheet. My senator forwarded it to VSC and this is the second response I got:

"As explained previously, we work cases in date order and according to our processing times. The posted processing times for I-129F cases is 5 months from the date we receive a case and it is properly filed. This case was received and properly filed on November 4, 2009 and will be worked in date order. We would like to take this opportunity to thank your office as well as your constituent for providing the information regarding other I-129F cases. I brought this information to our supervisor, D*** B**** who has turned it over to management. I have been assured that this information will be reviewed by management to ensure that date order processing is being used appropriately.

Again, we would also like to point out that the report provided by Mr. P****** is not an accurate way to determine if the Vermont Service Center (VSC) is processing cases in date order, as each case is worked on its own individual merits. In addition, some cases that are approved for special handling (example: Haitian cases) do not appear to be differentiated in the report sent by Mr. P******.

Please feel free to check back periodically with our office for updates and/or should you need anything further.

Sincerely,
Congressional Unit
Immigration Service Officer
DHS/USCIS/Vermont Service Center"

....I can rest more easily, as long as I know they are aware that the data shows there might be discrepancies in their systems. I guess there is nothing else I can do, but wait (sigh).

It does kind of prove the theory on Haiti, but disappointed that congressional intervention didn't elicit more of a response. Still, I guess 5 months it is, so I guess it's time to try and chill out for a bit.

On a slightly unrelated subject, can someone please explain why we are moving DOWN Igor's list instead of up? I know it doesn't really mean a damn thing, but it's still irritating me, lol...

Maybe that person is in the military and being deployed soon, or their partner has some terminal illness or something, and they got theirs expedited. If VSC is dipping into the Jan. box just because, though... start contacting the media, because I'm seriously going to start a hunger strike. Maybe a hunger-and-fireworks strike, as it will attract more attention...

ok, combustion delayed. It's an expedite so I take it back. My bad. This whole thing is not good for my sanity :(

I take it that it is not worth checking the USCIS site on a weekend as they dont work it.
Best to check Friday evening and then Monday evening.

I've seen Saturday and Sunday updates, but backdated to the Friday. USCIS don't work weekends (although they should!!) but the contractors who look after the updates on the websites apparently do. Some of the October people got their electronic NOA2 notification on a weekend. :)

I wish I had the courage to simply not look and stay away until 2/21/2010. Perhaps I'll try. I've got alerts to notify me on my cell phone if I have a change, and I know it works, because I just was forced to change my password at uscis because its been so long :( and I received text because I received email from UScis due to the password change. So I have no reason to continually look. Hmm, I guess I'm weak.

I stayeds away for a week and it did stop the rollercoaster ride of emotions actually....but coming back to absolutely no news, not just for me but for anyone, was possibly even worse.

So I'm just trying to be a little less obsessive at the moment :) It does sound like things are moving though, albeit slowly...

Hello kids :)

I decided to take a week away from checking VJ and USCIS because my other half (yensid) said that I was on the point of spontaneous combustion...I now know what it must be like to give up smoking!! ;)

Deeply depressed on how little progress we've seen though :'( Great news that there's been a few NOA2s but looks like California is sprinting ahead :(

My mum pointed out something to me this morning that I hadn't thought of as well.......although she is a British citizen and always has been, she was born in Venezuela and held dual nationality when she was a child. So that could ####### my background check right up :'(

And to top it all, I've got in to work this morning and SOMEBODY'S STOLEN MY CHUFFING MOUSEMAT!!!! lol

Still, trying to stay positive, let's have some more good news this week :)

Oppppsssss I used my mouth (or fingers in this case) before engaging brain. I havent any evidence of january filers getting NOA2's yet!

A more realistic comment would have been I wouldnt be surprised if there was activity for January filers.

Important lesson learnt. Back comments with evidence before opening mouth.

Sorry!

Phew!!!!

LOL...I was about to unleash 'angry Jess' on USCIS...and, as my friends (and Mr. Jess. And my roommate. And my mother.) will testify, 'angry Jess' is a scary phenomenon.

Still, if I see many more December applications going ahead of us October and November souls she may resurface...the end of my tether is definitely in sight ;)

K-1 Fiance(e) Visa Case Filing and Progress ReportsNovember 2009 filers

Looking at the spreadsheets Oct is well on its way to approvals. December is starting to move well. And things are happening for January.

Has the US Federal Governmet declared November to no longer exist? Maybe Presidemt Obama has cut it in his budget to save money?

No, I got it the Box for November has been abducted by Aliens and now resides in Area 51.

Or the box has been kidnapped by someone so p1$$ed off by the USCIS and is demanding their application is processed first or the box gets it.

What kind of 'things' are happening for January?? Can we get some examples?

If stuff really is moving for January filers I think that's going to be the last straw and Mr. Jess is going to be under immediate instructions to phone his senator's office. I'm patient, but being totally forgotten altogether is too much!!! :crying:

Ok, After reading all the posts I have question regarding the 5 month approval time line. I thought the 5 months represented the entire process from NOA1, NOA2, Interview, Get Visa and finally arrive in the US. Is this not correct? Is the 5 month span the time frame between NOA1 and NOA2? Please!!!!! someone tell me the latter is the case!!!!

Afraid not. 5 months is USCIS's standard lead time from NOA1 to NOA2.

Cases had until recently been processing from NOA1 to visa issue within that timeframe but unfortunately it looks like we got in there just as the world ground to a halt!!

Removing Conditions on Residency General DiscussionGeneral FAQ's for Removing Conditions
Our date to file the I-751 is early February. We are going on vacation out of the country for 3 weeks at the end of December. Two questions I have are: 1. is it fine for my wife to leave the U.S. and return at anytime before the conditional 2 year green card expires (even without having the NOA1 receipt that the I-751 was filed)? 2. seeing how recent members had received their NOA1 within days of filing and receiving their biometrics appointment around 3 weeks after, is it advisable to wait until after we get back from our trip to file, so as not to miss the biometrics appointment?

Thanks for your input!

my 2nd bet: she's going to do just fine.
my 3rd bet: you're both gonna be really happy in a few hours.
my 4th bet: she's going to gain a lot of self confidence by doing this on her own.
my 5th bet: you're both going to look back & laugh at how nervous you were.

i don't lose very often...don't bet against me. good luck! try not to worry too much!

She is definitely more nervous than me, but I did my best to let her know everything is going to be alright.

Just kidding.

No seriously, whereabouts you moving?

LOL. I have a job there at Mcleod Regional Medical Center. We're not sure yet if we're really going to move. I'd prefer the weather in California, but I am also hesitant to let go of my job opportunity in SC. Oh well, nothing is set in stone yet, really. My fiance and I still have time to think about it. =)

The only worthwhile advice I can give is do what is best for you and yours. Sounds simple, and often isn't, but in me and my SO's case, we've given up a great opportunity in her country for her to come here since it's the best option for us both. If SC is best for BOTH of you, why not give it a try? If CA is best, maybe consider sticking around more.

Simple, right? wacko.gif

Part of the equation, of course, depends on his job, since he is the petitoner, right?

its up 2 u. the latest one u need to submit it. the other two is optional.

For AOS it is three years to be filed with the I-864, and bring your last ITR to the interview.

i just submit the latest ITR... good.gif

d other two is optional innocent.gif

good.gif I agree, it is unnecessary to submit all 3 years of tax returns. The most recent tax return will also include a comparison from the previous two years anyways. It might be a good idea to submit prior year tax returns in the case that most recently filed tax return is borderline or it would be necessary to file prior years in the case that the recently filed tax return is insufficient to meet minimum requirements.
