Another question that may be odd:

 

My fiance tried getting a tourist visa twice, once in January then once in February of this year and got denied because of the lack of evidence that he would return to Peru. I'm not sure if that will hinder us, but it is obvious that the USCIS will see that correct? The reason he tried for it was to visit me and get to know me. That is why I then decided I should go to him and when he proposed. So it plays apart in our relationship but I'm not sure if it would be wise to include his rejections in the proof packet as a sign that he attempted to see me? Plus they are going to see that in his records anyways.

Hi! What a coincidence to find another Peru-DC area couple! 

 

It looks like others have answered some of the more basic questions but having done a lot of research about the Lima embassy's preferences and spoken to various VJ couples who have gone through the interview already I figured I'd throw my two cents in.

 

As for the chat transcripts... if you're sending them to USCIS they need to be translated. It's not really necessary to send them though since they fall under proof of relationship. Do bring them to the interview at the embassy. Evidence that's brought to the embassy does not need to be translated from spanish to english.

 

In the I-129F packet, front load as much as you can! When you arrive to the interview the CO will already have an idea as to the "validity" of your relationship from what he sees in that packet. If you only send proof of having met in the past 2 years, the petition will be approved by USCIS but you'll have more work convincing to do when you get to the embassy. Put as much as you can in the initial packet. My fiance and I sent copies of my itineraries from each trip I made to Peru to see him as well as passport stamp scans. Plus lots of boarding passes/bus tickets from places we've traveled together along with pictures through out our relationship. We sent scans of post cards we'd sent to each other, pro-flowers receipts. My theory is to include as much as you can from the beginning, it can only help.

 

The tourist visa denial won't hurt his chances of getting this visa, however I wouldn't flaunt it as a proof of relationship. I see where you say it's proof that he tried to meet you but I think it's best to leave it out of the I-129F. When you go to fill out papers for the interview you will need to state that he's been rejected, but it shouldn't be an issue. Most people I've talked to say that in their interview at the embassy in Lima it wasn't even brought up.

What matters now is that the current pasport that you have , the issued to you in 2011, that passport should have the NIOMETRIC feature on it.

Even if you had your old passport and it was still valid, that passport would be irrelevant because as per the new immigration laws, the US will only issue visas to the new generation pasports that have the BIOMETRIC FEATURE

The passport on the LEFt is the new one,, look at the small sign at the bottom.. so in order for you to get a visa, your passport should have that symbol for you to know that its the newer technological passport

 

Could you please provide a link to a government website that says that a passport has to have this feature in order to have a US visa issued to it? My fiance's Peruvian passport is from 2010 and it doesn't have this. I'm wondering if Peru even has this technology yet or if he should be trying to get a new passport before his interview. But this is the first post i've ever seen about this topic and everything I can find on google referencing it says that only countries in the visa waiver program were mandated to begin using it and that it's only necessary if you are entering through the Visa Waiver Program... which would mean that it does not apply to a K1 visa holder.

I've seen in old posts that they ask for your old American Visas and in my old passport i was having my tourist visa. I was thinking it could be important for them to see that even though i know they have it in their system.

They don't actually want to see the visa, they just want to know if you've ever been issued one and when. You would answer yes to that question and give the date. They aren't going to request the physical copy of the expired visa.

Hello,

I have gathered some evidence, such as chat logs (which are in Russian, since both of us speak Russian and its our native language) and engagement ring receipt (which was purchased in Russia, and therefore the receipt is in russian, as well as currency) Do I need to translate our chat logs/engagement ring receipt? Also, I heard some people write place and date on the back of the photographs as part of the evidence, is that necessary or optional?

Is this for the original petition or to bring to the interview. For the original petition any evidence submitted must be translated for USCIS. If it's for the interview you would need to look into your consulate's requirements. My fiance's consulate does not require translation unless it is in a language other than the english or spanish. 

 

Do write the place and dates on the back of photographs submitted with the petition. (I also put the names of people in the pictures if there was someone other than ourselves ex)family members)  I'm not doing this for photographs we bring to the interview since there are a lot of them and we will be there to tell the date and place of the photographs provided.

Hi all,

 

I'm preparing to send my fiancee the documents required after we receive NOA2. I have almost everything ready based on the VJ guide, but I'm stuck on this one:

 

 

 

What exactly does that mean? Do I need to send my original certificate of naturalization? She already has a copy of it from the copy of the I-129F package I gave her, and copies of all the evidence we submitted with the I-129F petition.

If you submitted a photocopy of any certificate, document, boarding pass, photo, receipt  etc you need to bring the original copy to the interview with her. Original certificate of naturalization idk if i would trust sending that via mail. If there is no way to deliver it yourself in person I would make sure she has a color copy (if the original is in anything but black and white)

Hey i think the question says it all. What needs to be included word wise in those statements? Is it enough when they are dated and signed? Maybe somebody has an example.

We got our noa2 yesterday and I'm planning on loading the papers that I need to send to the frankfurt embassy with evidence of our relationship. I didn't do that with our petition and died a thousand deaths, reading what other people sent.

I'm on my way down to Peru for my fiance's interview and we're bringing a few of these with us. I've seen it done different ways. Some people do it very formal and straight forward, but we went the personal route. We asked both of our Moms and also friends who have spent time with us together to write letters basically being a "witness" to the relationship was how I explained it to them. It would be easy to give someone a form letter and have them sign and date it saying they swear that two people are a couple, i think the personal (and maybe more emotional) route says a lot more... the one my best friend and maid of honor wrote for us had me in tears. I would tell people though to keep them short and to the point because the consulate probably won't take the time to read a lot of long letters... make sure they're notarized though!

I ve red through the page for a while now and as my fiance and me have decided to file a K1 visa I have a few questions, I am sure most of them have been asked a billion times before and I apologize for that already I m trying to keep it short!

 

My fiance would like to hire an attorney as we ve had a rejected B2 visa already in June (Yeah I know no visa with a bf in the states we should ve known it), I m searching for an attorney right now and I m starting to get a bad feeling that either it ll cost a few thousand dollars on top of all the costs already or be a scam/ wasted money. I ve been looking through so many and none of them really seemed to be convincing to me or cost ~4500$ just for the filing stuff. Does anyone here know an affordable and competent lawyer?

 

So I thought about doing it on our own, do you think it will be too complicated with the already rejected B2?

 

We ve been living together here in Europe for a while now because my fiance was stationed here. So we have plenty of pictures etc.!

 

Next thing is my fiance managed to get his divorce done only now that he s back to the states (they ve been seperated for about 2 years now though) will that cause any issue because we ve been together although he was still officially married?

 

Is it true my fiance can come to the visa interview to the embassy with me if he happens to be here at that time?

 

I am very very scared of this process because I still feel like I messed up with the B2 visa, I am so scared of this process!

If you have the time and patience to dedicate towards preparing your petition yourself there is no need for a lawyer, do your research well (which this site will help you do) and you'll be fine.  As for the B2 visa, it won't cause any issues. My fiance was denied the tourist visa twice and it caused no problems at his interview, and he's from a much higher fraud country than germany. My advice would be to take your time send in a well prepared package on your own. There's no need to spend the extra money on a lawyer when it can be done DIY.

I'm confused.  Why would you apply for a K-1 visa when you are not ready to follow through with it?

 

You can settle your affairs at home within a couple of months and then you are free to go.  Are you saying that 6 months is not enough?  Honestly, it sounds like you are having second thoughts and if your parents are suggesting this "vacation" before you commit, either they, you, or both of you have some doubts. 

 

The whole premise of your question is very strange and confusing.  Pretty much everybody waiting for their K-1 is ready to go as soon as they get it.  If there is something they need to close/cancel, they get it done quickly to be able to go.  Most people who are sure about it, they start to tie up their affairs as it gets closer to the interview, so your situation is a bit unusual.

 

It sounds like you are having doubts about this decision.

This is an extremely unfair accusation. Not everyone is ready to just pick up and go the second their K-1 is granted. The whole process is extremely lengthy and moves very quickly as you get closer to the end its hard to tie up loose ends as you're scrambling to prepare for the interview. Not to mention the fact that it would be foolish to begin cutting ties with one's current life (ie quitting a job or dropping out of school) until the visa is officially stamped in the passport given that you never know what will happen at the interview. Many people want to use the 6 months to wrap up their lives in their own country and prepare to move/spend time with their families before making such a drastic life change. The OP's question is not at all unusual, in fact it makes sense, not ready to move permanently yet, but wants to visit in the mean time. Don't make accusations and judgements without having a full understanding of the situation.

Yup, I found it! 

 

But it seems these posts are from when the visa was still pending for many people. I have mine in my hand right now, wouldn't that make a huge difference as it is said that as soon as you enter the country (within 6 months of approval) you have to get your K1 activated?

 

I've never heard of this being done, but my suspicion would be that it's not possible. May I suggest your fiance come to visit you instead and bring your stuff back with him? If he can get vacation time off?

Me and my fiance (he is the US Citizen) have been starting to look into the process and I am still a bit puzzled over somethings. 

The USCIS' webpage didn't really helped... xD 

 

So, I'd be very grateful if some of you could help me out... 

 

For What I have read thus far, the first step is the petition which includes:

  • the I-129F
  • G-325 of both of us
  • G-1145
  • both of our passport photos
  • a cover letter by US citizen
  • a declaration of how we met (here is my First Question, how we met the first time ever which was online or the first time we met in person?)
  • Statements from both declaring we will marry within 90 days
  • Proof of having met in the past 2 years
  • His Birth certificate
  • My Birth certificate (Second Question Do I need to translate it? It's in spanish)

We need to pay the filling fees (Third Question  Do we pay it on the back and send the receipt? Or do we send a money order?) and after getting two copies of everything,  we mail all that to the Dallas PO box. 

 

Forth Question What is an A number? 

 

Following we should the 1st NOA and some months after the 2nd NOA. While we wait we need to start gathering the interview package documents.

 

Eventually our case is forwarded to the embassy processed and they will send a checklist to the fiancee. 

Fifth Question More less what will we need? 

 

I send back some forms, attend a medical exam and go to the appointment with the rest of the checklist, the copies from the petition forms and prove of our relationship. 

 

The interview happens and I either get approved or not. 

 

Sixth Question I'v been reading something about a D-156K form, a D-230 form amd a I-134 form, where do this one fit? Or do I don't have to fill em?

 

 

Now, did I miss anything?

I am SO sorry for the long post but we are just getting started and all this can be overwhelming and confusing. @_@

Your list looks good, you DO need BOTH of your sets of visa size photos (two each) with the initial petition. You don't need the beneficiary's birth cert until the interview. A word of advice though, include as much proof of having met and proof of an ongoing relationship as possible in the initial packet. It's very beneficial to front load at the lima embassy, it will make the interview go smoother. Anything in spanish being sent to USCIS needs to be translated. 

 

Don't worry about the A-Number for now, if you don't have one leave it blank. The I-134, D156 and D-156K and if the beneficiary is male then the D-157 do not need to be filled out until the interview. Along with them, and proof of ongoing relationship, you'll need the beneficiary's passport and police certificates, they have a period of validity though so don't worry about getting them until your case has been forwarded from NVC to the embassy

Yeah, both hubby and son came together and it took 5 months for approval. His mother kind of abandoned him and left him with his father and great gandmother. Because granny is climbing up in age, hubby didnt want to leave son there and who will be able to fly with him if he were to follow. Next week we will apply for social security cards for both so I can get him on some kind of waiting list for 3 year olds. I hope there will be space for her, but it looks like people pulled their kids out of daycare and placed them in public school immediately to cut costs and I don't blame them, but I want a spot for him to go to school.

box 3 you would put the childs name but the bottom part i don't think you need to fill that in because no child or spouse is accompanying or to follow. as long as you placed the childs info on the first affidavit when you filed for you fiance.

box 8 it would be you because until your husband becomes a US Citizen you are still financially responsible for both your husband and step-child.

box 9 & 10 it would be your husband

box 11 you could put until his father becomes a naturalized US citizen

have you got some schools lined up for the child because i am finding that there are some long and short waitlist for the 3 year program here. just something to think about while you are doing the paperwork.

I know about all of the associated fees and as I said he has the money to pay for the exams and forms he has to get completed in Jamaica. I now (with new employment) reach the poverty guideline on income and dont think there will be any issue in the support affidavit. My question was solely based and related to the initial fee. I'm not saying I don't have any money or that I won't get the money to pay the fee in appropraite timing. I'm saying I have student loans to pay back and additional bills, so I wanted to know if this was an option due to previous unemployment and whatever other burdens I could display. I mean... can I get something back from the US Government for a change? Hello!!!!

It doesn't matter if you have a new job know and meet poverty guidelines. They go by last year tax returns. I believe BajanKutie was in the same position where she was filing for her husband and she didn't work much of last year and although her current job now is well over the poverty line she was blue slipped until she could find a co-sponsor. Also, you could try to defer your loan payments for try to consolidate or extend the years of the loan for a lower payment.

You definitely need a return ticket - also, immigration laws in JA have changed - the maximum stamp you will get now is a 3 month stamp, after 3 months you have to request an extension of the visa, which costs about $10000JA. I think you can get it in Mo Bay, but if not you have to travel to Kingston. Also, the max you are allowed to spend per calendar year in JA is 6 months on a tourist visa.

Ditto the concern about the I-134 - Do you have a co-sponsor or a job that you can work while in JA to meet the income requirements?

Believe me, I know your frustration, and hope it works - but please make sure you consider all the factors.

I always book my ticket online so, when I go to the airport I just show my passport. When I fill out the Customs form, I put my estimated time of stay and they are me why am I visiting and who I am visiting. They never ask me about a return ticket. When I go through Montego Bay, I don't get much of a hassle. If your Customs card is filled out completely, its pretty much two questions stamp and a Welcome back I get.

I filed k-1 and k-2 and k-2 was ready in 12 days and k-1 was ready in 26 days. Your fiance may have answered a question inconsistent in what you have on the application. Depends on who is doing the interview they may be satisfy with a little information or better with a lot of information along with the sponsor there. I saw another couple, where the interviewing officer just asked the beneficiary questions and didn't ask the petitioner and she was there. So it just depends. Good Luck!!!

No the RFE will provide everything missing.

The USCIS is not the DMV, they did that to me and nothing I can do about it because they had all the power. Hate that!

When you have your divorce decree it is better if you have more than one copy. You will need one for USCIS and one for the interview.
I would suggest a few more for records and just in case projects. Problem is that it costs lots of money to get the official stamp but worth it in the end.

It is cheaper to order 2 at once than one then one.


I ordered 3, one to submit with RFE, one to pass on to Fiancee for her interview packet, one to keep if things go to hell. :)

I'm one of the ones who didn't know about VJ until after I filed.
I didn't understand the difference between a Divorce Journal, and a Final Decree. !@#$%^&*() (pardon my ascii)

The RFE ONLY asks for my final divorce decree.
My concern is if I send this in (I've already ordered it from http://www.vitalchek.com/home.aspx ), can they hit me with the next thing they find?
Do they have to look it over, find ALL issues, and send you the letter stating all outstanding issues. Or can they nickel and dime you, one issue at a time?
i.e. Ok you fixed the divorce decree, now we noticed you didn't include the birth certificate number and place of issue on the application, so here is RFE #2.

I'm a little paranoid at this point, since if I hadn't botched this, I'd have had my notice by Valentines day. How much does that suck.

I'm about to be in the same boat. I got an SMS and email saying an RFE is on the way. !@#$%^&*()
I was pretty darned careful about everything I included. The real pain is they could have included the info in the email that's in the letter. Then I could be working on getting whatever they want that I'm lacking. I HATE not knowing what the $%(*) it is that I messed up on.

I'll follow up with more info as I get it.

It's frustrating, I know. But some go quicker, some go slower. I got an RFE this Monday. Read what the issue was. Divorce Journal instead of divorce Decree. Used a vital records service Monday evening, paid for next day air delivery, and it was waiting for me today. Got one of the 3 copies I ordered, took it to FedEx, ant the VSC will have my response first thing tomorrow.

My point is this, most everyone likes to take some pride in their work. Including govt workers. Except maybe the DMV (just kidding).

We all make mistakes. I didn't send the right supporting document. I also didn't send a lot of stuff. Just what they asked for. So there wasn't a lut to go through.ie a fuick file to read. Maybe that helped?

Waiting sucks. But have faith.the worst part is knowing there is almost nothing you can do one you send off the packet....

So here is my exact timeline. We' ll see if it helps2/11 -- SMS and email TNT I have an RFE coming.2/13 --The RFE arrives. (I hadn't sent the proper proof that my divorce was final -- easy to obtain the document) ordered it online same night.2/16 -- The documents arrive. I ordered 3 copies, and paid for overnight delivery. I drove to FedEx and sent the original RFE with the proper document, before the nightly cutoff.2/17 -- The RFE Response arrives about 10:30 am at VSC2/24. -- SMS and email that they have received my RFE Response, and are reviewing it.
So best case, Monday for an SMS of NOA2 very likely be a week fom today. Ps, today is 4 months.good work VSC.

If a person went to Malaysia on a tourist visa valid for a month, and over stayed by say a year with a relative, how is this handled by the Malaysian Police when asked for a certificate? As far as they know, the person was here for a month and left. No record check needed. But oh no we say, I was there longer than I was supposed to be. But I left to go back home, and now require the police check.

Really in a quandary over this one.

Any advice would be appreciated.

My hard copy NOA2 came over the weekend. But it doesn't mention the NVC anywhere. In fact, they say it was forwarded to the consulate...
So when I check mine against the examples in the gallery, they don't match. Any ideas?

for future reference, I scan EVERY page I get which has anything to do with this K1 effort. Then even if I loose it later, I have a scan which I can print. I have a scanner at work which will just mail me a PDF, but you could do it at kinkos, etc. just a thought. Not everyone is the geek that I am. :)

Mine was the wrong document. I sent a Divorce Journal. (where it says who is responsible for what bill, after the divorce). It was stamped and entered into the county records, but it wasn't the Divorce Decree. Turns out my lawyer never provided me one. ( I now have 3 original copies. :) ) I thought I was sending the right document, the only document of my divorce that I was ever given by my attorney. But it wasn't the right document.

I'll echo everyone else here, read things very carefully, then have 2 or 3 people look over the form, what it asks for, and what you're providing. Make sure at least one or two of them are NATIVE english speakers, we might catch something a non native speaker might miss...

one more question if your still there :) At the bottom of G-325A sheet it says "Applicant print name and Alien registration number in box outlined by heavy border" She did not print with ink she typed her name in ther. Is that the same thing?


In this case, I think we can agree, yes it's the same. If it had asked for the signature, not so much. :) I'm fairly sure you're safe on this one. (we typed all our info too, and we just got our NOA2)

History has shown that some workers frequent VJ.
Many posters vent about the terrible system.
One wonders if cases ever get slowed down because their case worker sees them complaining on VJ?

I am having problems with Malaysia getting my fiancee a certificate of good conduct. She's already applied on their website, but got a phone call from some official trying to tell her she doesn't need it.
We know she does. and I did a search about 2 weeks ago and found a link to a US Gov Document designed to be given to other countries explaining the need for a background check, and I think the requirement to provide one under some common agreement.

I was going to bookmark it and just never did.

So, if someone knows where that link is, I'd really really appreciate it if you could post it as a response. :)

My fiancee is travelling to Manila on the 24th to go to the Malaysian Embassy there, and it would help if she had before she left.
