Early November filing for 'us' too. 6th i think it was. NOA received in about 2 weeks with a date of 2-3 days after it was sent.


On the USCIS website you can create an account which allows you to receive email and/or text updates on your case - all you need is the case number.

Once you've added your case number to your portfolio you will see a 'Last Updated' date listed next to it. If this changes, but the case status doesn't change, it's a 'touch' - basically USCIS have done something administrative with your file, but haven't approved or denied it.

So for example - our NOA1 date was November 20th. Since then, our 'Last Updated Date' has moved from 11/23/09 to 11/24/09 to 11/25/09 - but we are still at NOA1. So our file was 'touched' on those 3 dates.

In line with my motto of 'I take the small victories', our check was cashed yesterday (found out this morning) and we got our case/number/NOA1 date/had our first touch, and I am now going to massively fail to get any work done for the rest of the day cos I am far too overexcited biggrin.gif:D:D

I couldn't find anything to confirm, nor deny it but the first posting it seems that a "second rule" has to be published.

Non-immigrant visa fee increase

I haven't seen anything yet. My fiance' will likely get stuck with the higher fee since we have a 4 to 6 month wait for the Montreal consulate for an interview but it is NOT confirmed anywhere that I have seen. I am going to keep checking the Department of State website about news. Until I see something published there, then I know it is still $131.

The proposed rule was published 14/12/09 with 60 days for public comments which takes us to mid-Feb.

So it could come in by March 1st but they'd have to be pretty swift turning it around.

Safe to say they're going to get a fair few of us. Pretty fed up of the US government punishing me for who I fell in love with. :bonk:

I agree that a september date is quite risky... i wouldn't put any non-refundable deposits down. My fiance and I filed in Nov 2012 and we weren't comfortable with making any wedding plans final for anything earlier than next spring... we have a venue reserved for April 2014 but were trying to wait about booking any other vendors until we have confirmation about the visa...

the official government website also says that california is still processing from July 18th 2012 and we've all seen that many people past that date are getting approvals, we really can't put much faith in what USCIS posts as their processing times... the good thing is that at VSC they seem to be processing approvals first come first serve while in CA that's not the case.

vsc is not really processing in 5 months, the timeframes posted online are a joke... according to igors list recent approvals coming through are from end of oct/beginning of nov... our NOA1 date is Nov 27th and i'm expecting at least a month more to wait (and that's a very optimistic estimate), honestly theres not much you can do to speed it up at this point

That's good to know... i'm hoping to go also, even if i have to fly down for just a few days... i just got off the phone with a Tier 2 rep and they put a service request in and said if i don't hear back before June 8th to call... i really hope it comes before that!

Thanks everybody.  My fiancee and I are super excited right now.  I have been in touch with the embassy, I have already started on the affidavit of support and she has begun to coordinate the docs she can get now.  

 

I hope the rest of the journey is quick.  I hope it is quick for everyone else too.  If you haven't gotten your NOA2 yet, keep the faith, but don't be afraid to whine and moan and kick and scream.  It is your case, it is your life, stand up for it smile.png

have you checked your status on USCIS today? many Dec and Jan filers were transferred to another service center and received notice today. As for the deal with VSC we really only know what's going on from igors list... they're finishing oct and processing nov... but even if your application wasn't moved and is still at VSC it's a good sign for you because many of the people who were before you in line from December have been transferred elsewhere. Our NOA1 date is Nov 20th I called today to speak to tier two and they put a service request in and told me to wait two weeks and if i didn't hear to call back.

On May 24, 2013, we transferred this I129F PETITION FOR FIANCE(E) to another office for processing because they now have jurisdiction over the case. We sent you a notice of this transfer. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

 

Note: My case was in Vermont... so I'm not sure why they are moving it... also is this normal in the process for the K-1 Visa? I'm not sure what office has my case now, I have not received the notice yet through the mail.  

 

It's not normal but it is good news, there were a lot of people from Dec/Jan at Vermont who were transferred on friday... there's a thread about it here:

It means Vermont has realized that they're a mess and is trying to fix it and get these petitions processed faster. No one knows yet where the petitions were transferred to... you'll probably get the notice in the mail in the next week or so if not I would call to inquire

Hi everyone!  I just called in to Vermonth this morning and ended up having a service request be put in for the confusion of all the transferring of cases. My question is does a service request do any good for a case or just have someone look at it and give an answer for the confusion(or whatever the reason was for other requests)??? Has anyone put in a service request and seen an approval shortly after?

I'm a Nov filer and put in a service request at VSC on Friday afternoon, my NOA2 email came on Tues afternoon. I believe 100% that the service request got it out, but i'm not sure how it would work with case transfer. I think in our case it was probably sitting on someone's desk ready to be looked at since they were already approving cases around my NOA1 date and the service request gave it priority.

Hello everyone,

 

I sent in the I-129f at the beginning of May and on May 16th i received the notice that the Alien Registration Number has been changed.  This happened after I had received the NOA1 which was dated May 10th.

 

Now, obviously the Alien Registration Number is a good thing since it is my understanding that this number is what eventually becomes your Green Card number, assuming everything goes smoothly and the visa is approved.

 

One thing I am attempting to determine is the timeline for the K-1.  It seems that the processing time can vary greatly, from 2-3 months to a year. 

 

I have read that files are processed based on the order yours is placed in a stack.  Yet, I have read that it may not be so straightforward since the main job of case officers is to simply determine that the marriage is legitimate and meetings the requirements.  With that being said, the CO's could very well go quickly through certain one's while taking their time on others.  I say this as I would hope and assume that they do handle more than one case at a time.

 

If it is the case that they all handle many cases at one time, does anyone have an idea of the average amount of cases a CO would handle?

 

Just a bit of background on my case.   Me and my fiance'e have been together since September 2007 and did the long distance relationship since then, travelling multiple times a year to go see each other, staying any where from one week to 3 months together at a time.  We sent in the standard information, plus, what is probably overkill, 60 time stamped photos of the two of us since September 2007, including some of us with her family and mine.

 

Like everyone else, I'm simply trying to determine how long we will need to wait. smile.png

I see you're from New York which means your petition will most likely be forwarded to the Vermont Service Center. Vermont is averaging a little over 6 months right now for USCIS processing of the petition...that does not include the time it takes to forward the petition to your fiance's respective embassy and the interview process. My Fiance and I sent our packet at the beginning of Nov 2012 and I don't expect him to be here before Aug. That being said Vermont has recently forwarded some petitions to other offices to get rid of some of their backlog so it's possible that their processing time could decrease, but I wouldn't count on your petition being out of USCIS in less than their 5 month processing "goal" that way if you are one of the lucky cases that gets processed faster it will be a very pleasant surprise... but don't count on it taking much less than 5 months based on Vermont's recent approvals. From what I have seen the "straightforwardness" of your case has no bearing on how fast it is processed other than the fact that if you take the time to prepare your case well and send extra evidence you will not receive an RFE which adds extra processing time.

yes. i called uscis yesterday too, and i was escalated to tier 2.  they told me it takes 30-90 days, even though sometimes it's faster.  i'm really bummed out that i happen to be one of those who falls through the cracks.  but i guess that's the way it goes sometimes.  i received noa2 faster than usual and got really excited, but now i'm getting a slower than normal service on the transfer to the nvc.
 

that's frustrating : ( If it takes much longer I would try pushing the subject with them and try to get them to inquire as to where it is...i think it probably depends on who you talk to because when I was calling last week they told me it takes up to 15 business days to arrive and up to 20 to be entered into the system... she didn't mention anything about 90 days... i know i saw a poster on here in the last few weeks who got them to search for his case but I don't remember how long he had waited

 

I hope you hear something soon! My fingers are crossed for you guys!

I received my NOA2 notification by email on May 13, 2013, followed shortly thereafter by notice in the mail.  I never received any notice yet from the NVC that they have received my case from the California Service Center.  I called NVC today for the first time, and they say they have not yet received my file, and that it takes up to 30 days to receive it.  Is that typical?  I had heard it should only take 7-10 days for NVC to receive it.  What should I do next?  I need the MNL case number so my fiancee can pay the filing fees and schedule the visa interview in Manila.  I appreciate any advice.

 

Have you tried calling USCIS to inquire as to weather it actually left CSC? they give the standard 30 day answer i think to buy time and keep people from complaining but that's not the norm... I got my NOA2 on May 28th and they told me yesterday that the've received my case.. i would try calling USCIS to ask

They are not incorrect for denying a petition that had none of the required documentation with it. Do not appeal. I did not include any passports, birth certificates, etc. I have all that suff ready to go.

Follow the link that the above poster gave you  and prepare the packet with everything that is stated in the guide and you should be fine. But don't bother appealing it will be a waste of time. Refile.

I am still waiting for approval NOA2, have not gotten it yet.  Guess I should have sent him a notebook full of multiple pages of intent to marry in 90 days for him to sign. So frustrating.

 

I know the feeling! we waited over 6months for our NOA2 it was terrible... but definitely start getting the documentation for the interview together now while you have plenty of time! It will let you celebrate once you receive your NOA2 with out the added anxiety of preparing the I-134 and documentation and feeling too rushed! Hope you get a response soon!

We are April filers so we are right behind you.  I am wondering if this is something new.  I heard after the NOA2 that we are supposed to send an updated intent to marry for the interview. So strange!!!! We both sent one with the original I-129 I thought that was going to be it. I guess we will have to wait and see if we are next.....   We have a age difference too and I hope that this has nothing to do with it. I am looking forward to see what happens next so that we can prepare too. Tthanks for any updates you can give us.  Best of luck and I will pray all goes great for the both of you.

You do have to send a second one with the documentation that is brought to the interview. It needs to have a date closer to the interview and say something like "I am reaffirming my intent to marry within 90 days"... it's silly, I guess they want to make sure you didn't change your mind during the eternity that it took them to process your case.

They also gave us our interview date via email... but I've heard that's not always the case. It seems like the flexiblity you get from the embassy depends a lot on the person who ends up reading the emails on any given day. Another couple who's petition arrived to the Embassy in the same batch as ours was told they had to wait for the packet to arrive in the mail and that they couldn't pick it up in person... and that was literally the day after they told us we could. I've found you get a much better response when you email them in spainsh rather than english...

After being transferred I have been checking my status at least twice a day. I went away for 3 days this weekend and came back to find out that we were approved on Friday!! smile.png So many things to celebrate right now! We are so excited!!

 

I do have a question though for those who have been there....Will the NVC Packet be sent to my fiance in Peru or to my address in the US? I am still in Peru with him until the beginning of August...I wasn't expecting to be approved so quickly!

The letter from NVC confirming they've received it will be sent to your  address in the US... a quicker way to get your LMA number though is to start calling NVC for confirmation. Once they give you the LMA number you can track it at the link that the poster above gave. The status will change to "In Transit" once it's been sent to Lima and "Ready" once the embassy scans it into their system.

 

Here's where it gets tricky... I was told by many couples that the packet sent from the embassy (with the interview letter and instructions) took forever to arrive to their fiance's address in Peru and that they didn't have much advance notice/time to schedule the medical. I think it depends a lot on where he lives and weather mail is reliable. My fiance lives in Ate in Lima and it got to his house about 2 weeks after our status changed to "Ready" and the interview was set for about a month later. The embassy also gave us the option though to pick it up in person when I expressed concern about the reliability of Serpost in delivering the packet in a timely manner... which is an option worth exploring if youre concerned about it getting to him. 

 

Let me know if you have any questions! My fiance had his medical exam yesterday and I'm flying down Aug 3rd for the interview on the 6th!

Note that we haven't been married before and as for the proof we met, i sent pictures of the two of us in different settings as well as the emails of all our flights (there is a lot) as well as a lease we both signed.

 

If you didn't send a photocopy of your passport that's probably what theyre looking for... the emails of the flights are fine as long as they're supported by the passport entry stamps otherwise they have no way of knowing you actually got on the plane. 

 

you won't know exactly what they're looking for though until you get the letter in the mail

It will definitely be sent to NVC, all they are though is an intermediary between USCIS and the embassy, they only assign your new case number and send it onward, which is why the standard wording on the NOA2 says that it's been forwarded to the consulate. If it's been a month I would start being insistent with NVC and USCIS. Start calling both and see if they can get someone to confirm that it did leave USCIS and it didn't get lost in the shuffle... what the above poster put is correct though, it's possible it's sitting in the NVC mailroom and hasn't been scanned into the system yet, NVC won't have record that it's there until it gets processed... good luck!

Yes that's what he wants to do...bring her hear on a tourist visa.while she is here file for fiancee visa and at least that would knock off three months. Is this ok????
And second part, how long it would take her for a tourist visa cause I will be leaving to get my love in October or November If all goes well

 

It's ok as long as she only stays on the tourist visa for the time allowed. Does she already have the tourist visa? or would she have to apply? The application process for the tourist visa is quick, but as others have posted it's highly unlikely that she will be granted one.

I have a friend who is dating a girl from the philippines. Soon my visa journey will end and around October will be traveling to phillippines to pick her up for the USA. Question is he wants to fly with me there and bring his girl back with us on a tourist visa, then once here file the i129f. Is that possible?
I dont know what to tell him. I mean the meeting requirement would be there, they will meet but dont know while she would be here, if he could file for a petition.

Entering the United States on a tourist visa with the intent to stay and immigrate is visa fraud. He could of course bring her to visit, file the I129 while she is here but she would have to return to her country while waiting for the I129F to complete processing. Assuming that she already has a tourist visa.

That makes sense... i was wondering ours would have gone out on the same day since yours arrived before mine, but maybe they wait till they have a batch and send them all out together. Thanks for doing that research for us though! Another number to obsessively track the status of hahaha

 

I had given up all hope that we would get approved any time soon......this made my day.  Lucky we didn't have her extend at her job until November 30th.   Now we have to work hard and get her stuff through the embassy quickly.  I know appointments are very easy to get in Saudi Arabia.

You enter in the NVC tracking number and it will say either at NVC or in transit...it's doesn't give too many details but those two words were all i needed to see!!!
