Two things, I would read up on I-864 very thoroughly and read the poverty guidelines that is stated for your household along with what the joint sponsor income would have to be as well because I think with a joint sponsor he may be included as the household number as well. Email the embassy again to ensure you get an answer that matches. For me I first emailed them to see if they received my fiance's packet they said yes. The second time I emailed them about his packet 3 and they said as soon as they receive his packet from NVC them will send out his packet 3, but I could email them the ds-230 and as soon as they receive his packet them will send him his information. I emailed them again and asked was or was not his case there along with an emailed copy of the DS-230. They said they have his packet and that his interview will be scheduled sometime late july or early august. Emailed them a week later and come to find out his interview was scheduled for the early part of july. Email them again to see and explain the details of all you correspondance with them to get an straight answer from them. They are very inconsistent with their replies. If you can visit the embassy website as well and read up on the I-864 to clarify things for you.

I have a few things for you. The first is that once you can find a co-sponsor they need to fill out i-864a. That was the same problem one person had at the embassy. The co-sponsor filled out the wrong form. The i-864a is used in conjunction with the i-864 so that you meet income requirements. The other option is seeing if your assets can be converted into money times five the difference of your income for 2009 and poverty level or see if you could borrow the difference and put it in the bank. The last option is and I know you don't want it to come down to this but to wait until you file your 2010 tax return.

Help anyone

Someone received a blue slip for this one because the joint sponsor was married and they had to resubmit the tax return with the spouses name on it. So, if she is divorced, you may have submit something to that effect and it will show why on her tax forms she only goes by her maden name. I will try to cover all angles on this one because during my interview a lot of people got blue slipped. I hope this helps a bit.

He would need to have the difference of his income and the poverty level income times 5. So lets say the poverty level says he needs to be making $24,000 a year and his last year returns said he only made $22,000. The difference of $2000 he would need to have at least $10,000 in his account to satisfy immigrations requirements. I hope this paints a better picture for you.

My fiance and I went to the SSA office in our area last week Wednesday and we received the card yesterday. We filled out the application and submitted his passport along with his I-94. I don't if that helps much because he doesn't have a green card or EAD yet.

Why are they being so rahtid hole complicated. First they raise the visa fee to $350 and now they expect those who have their police record already to go back and pay another $3000+ for another record dated June 14th. If dem nuh waan no more yardies inna dem country then say so, stop making it more expensive and complicated. I needed to vent a bit because I am under a time crunch to get things done. Okay fast forward, so what date do they put on the record, the day you applied, the date they finished the search or when you go to pick it up?

You MIGHT, and I say MIGHT, be able to legitimately say it was a recruiting expense.

For those of you that set your date prior to being approved, weren't you nervous that something would delay the application? I was thinking as soon as Nigel gets his interview date I'll set a date a few months after that. The interview process in the UK seems to be pretty straightforward once you get to that point so I don't anticipate him having any hangups once he has it. But in the back of my mind I'm nervous that the old "what ifs" could happen. We could miss a piece of paper. The medical exam could show something weird that needs to be checked out. Something that delays his visa and causes the wedding date to be too soon. I know you can't offer me any assurances, but didn't this make you nervous at all? We're at the packet 3 stage so I anticipate an interview in late April or early May given recent timelines of other couples similar to us. So I am thinking a date of September would be good. But what if??? I may be too paranoid for that!

Ha, I was just complaining about this to my sister when I came upon this posting. I think we're all in the same frustration boat. Nigel and I were thinking we'd just do a simple ceremony at the courthouse as soon as he gets here and then plan for a religious ceremony and reception a few months out. But the more and more I think about it the more I realize it won't feel as special the second time around if we're technically already married. So then I decided I could be superwoman and plan a wedding in 90 days which we all know is almost impossible in the summer which is probably when Nigel will be coming here. So I'm back to square one. Nigel just got Packet 3 and will be sending it back in a few days so hopefully we'll have his interview date within a few weeks. I am thinking of using that as a guideline for picking a date since once he gets to the interview I can't imagine he won't get his visa. But you just never know so it's really taking a chance on losing a lot of money on deposits and things. In the end I'm sure it'll all work out but boy can it be frustrating along the way!

I did order my dress already since it does take 3-6 months to get it after buying. That makes me feel like I've done a little bit of planning. And I've been scouring theknot.com looking for ideas and reception sites so that when the time does come to set a date Nigel and I know exactly what kind of wedding we want.

Good luck ladies! As frustrating as this is it does help to know there are others in my boat :)

Nigel got packet 3 and sent everything in except for the IV-15 document checklist because he doesn't yet have his police report or medical results. But from what I've understood from everyone else on here he can just check those things off knowing he's in the process of getting them because they won't schedule his interview until they have that list. Is that right? Or does he really have to wait until he has everything in hand before he sends the checklist in? The police report will take another 40 days so I don't think we should wait knowing that the interview will be scheduled further out than that anyway.

Hi all....Just wanted to report that Nigel came here last Thursday and breezed through immigration with no problem at all. I know this doesn't mean it's the case for everyone but I wanted to let you know it wasn't the ordeal I was terrified it would be. The officer asked Nigel what he was here for and he told him to see his fiance and that was it. No problems or questions. I was so nervous after reading posts from others but Nigel had no problems so hopefully the people who get denied are in the minority rather than the majority. I'm not sure if he'll chance it again seeing as we're hoping for an interview date in May but we'll see.

Jkw777 - Since you're from the UK you don't need a visa to enter the country for a visit. Nigel came from London a few weeks ago and had no problem at all. He had already gotten packet 3 at that point. I can't guarantee it'll be the same for you but if you don't have a history of long stays in the US or overstaying a visa you should be fine.

Ditto on the reply above. Nigel came to visit me just a few weeks ago and didn't have any problems at all coming through immigration. He brought all his supporting documents just in case but didn't even need to pull them out because the officer just asked the usual questions. It seems we are taking a chance each time our fiances come to visit us but I've heard more positive experiences than negative from the forum.

Miranda - When Nigel came over after we'd received our NOA2 he didn't have any problems at all. He didn't even bring much evidence with him because he didn't believe me that he would ever encounter problems. So we were very lucky. I would say tell your fiance to bring whatever he can but if he doesn't have any past overstays or strange travel patterns he'll probably be fine. No, I'm not saying this is a guarantee, but it's not worth stressing yourself over needlessly. Good luck!

john_and_marlene - Our wedding date is September 30. Nigel's interview is April 18 but he has to give 4 weeks notice at work and will probably do so at the end of April. He'll probably end up coming in mid-June which puts us just over 90 days until the wedding. We'll just do a quickie courthouse thing to make him legal but then we have a religious ceremony and reception planned for September. I would have preferred to get married only once but our situation isn't "normal" so I'm rolling with the punches. We could have waited until he got his visa to start planning but there's no realistic way to plan what we think is a decent fall wedding in the Washington, DC area with only 4-6 months notice. This way we got the date and location we wanted and are safe if anything changes because of the clause we put in the contracts regarding the deposit. And I sleep a lot better at night knowing I don't have to throw things together at the last minute!

Nigel and I set a date after he received packet 3 and was waiting for his interview date. But I required the folks at our reception site to allow us to transfer our deposit in full to another date if anything were to go wrong with the visa. I definitely wouldn't put down any big deposits if you lose them with a date change because that is always a possibility. We also set our date almost 10 months out from the date we submitted our 129-F since things were moving along well. I would say your best bet is to see how visas are moving along in your situation and then see if you can hold dates rather than risk losing any deposits.

We personally didn't even bring tax returns to the interview but I didn't have a co-sponsor so I don't know if that is a different situation. I just filled out the form and had a letter from my boss stating my position and salary and another letter from my bank stating how much I have in savings.

I concur that an attorney is not necessary if your case is pretty straightforward. Many people advised Nigel and I to get an attorney and I was considering it before I found this site. But after finding the site there was no need for an attorney. You'll get all the advice you need on here as well as a step-by-step guide. And as long as you can double and triple check your paperwork to make sure you have all your boxes checked I'm sure you'll be fine.

Nigel had a letter from my employer and bank and London didn't ask for anything else. If you have the tax returns handy I would say print them out and take them. But if not and you're not self-employed you probably won't need them.

Hello,

I married overseas in January and am in the process of completing the 1-130 for my husband. One of questions on the 1-130 (Section D, question 2) asks if I have ever filed a petition for this or any other alien. Over ten years ago, I had filed a Petition for Alien Fiance with another person, but the relationship ended without us following through on the filing (though the initial petition had been approved). And now I don't even have copies of the forms with information about the place or date of filing.

Any suggestions about what I should write for this question on the 1-130?

Hello,

I have just gotten copies of photos of our wedding and honeymoon to include in our I-130 package. I have two questions:

1) Some photos are printed with a date on the front, but the date is wrong (in fact the date is still in the future!). The camera must have been programmed wrong for the date. Do you think there will be a problem with submitting photos with 05-30-2009 on them?

2) Should I just clip the photos to the back of the last page in the packet? And write our names and the dates on the back?

Ok, now you supply more information. For the CR1 it would be in the country of legal residence, or the home country if they return to the home country. On the I-130 you will indicate their address abroad along with where they apply for the visa. Check out the example form here on VJ: http://www.visajourn...-Form-I-130.pdf

I read in the instructions that NVC will send your petition to the country where the marriage took place for an interview for a K3 visa. However if your marriage took place in the US, then the petition is sent to the country of your spouses citizenship for the interview.

For CR1 visas, the petition will be sent to the appropriate consulate depending on your spouses residency status in the country he/she is living in. If the spouse meets the residency requirement they may interview in the country of residence. However I have read instances where individuals were allowed to interview at a consulate in the country where they are currently living but the petition was then sent to the spouses country of citizenship in order for the visa to be issued. I suspect that legal residency status may have been an issue in those instances.


Thanks-- that is very useful. I think the concern will come down to residency requirement. My spouse lost his residency card and has petitioned to have it replaced but he has been told his record cannot be located. It has been many years since he first moved there. We are looking at the option of re-applying for the residency (which seems silly as he plans to move to the US), but we also might have to consider having him go back to his country of citizenship (UK) to finish the proceedings from there.
