They refused funds from the same bank TWICE! DO NOT send them another check from that bank. Get a US Postal money order, or a certified check from any Bank of America branch.

It makes no sense to try and send funds from the same bank a third time. Even a certified check may not be good in their eyes.


The bank is Wachovia. It's a national US bank. A large one at that. I think the confusion is because of the pictures on the check. I doubt it's the bank itself as it was never even submitted to them at all. But you may have a point, not risk it one more time. I can go to a Bank of America and get a certified check from them. I want a way to track this thing and money orders make me nervous. :(

I submitted a cashier's check from my bank. The case number was on the back and my bank, very nicely, kept track of it for me and when it was deposited I was informed. Not all banks are this accomodating. But cashier's check is one way of doing this.

Money order would work too, you would have to wait for the NOA1 to arrive in the mail. You mentioned it being sent back because of the incorrect amount. What amount did you send with the petition?



It was for the correct amount. They are saying it's not in US funds but it is. Drawn up on a US bank with my US address in US funds. I am looking at a certified check from the bank. I can go to my branch manager that is a friend of the family for assistance on this. The problem with all this is at this rate the application won't get done till January and I have to return well before it. We can't get married in England and apply for a spousal due to my status as a student visa and requiring a certificate of approval that takes 3 months to get. So trying to figure out all options so we know them.

have you tried calling your bank?


The bank provided the business card for us to submit with it. The check has never been presented to the bank as the USCIS has never submitted the check to be cashed.

I honestly don't know what to do about this and I am seeking any help or suggestions on the matter. I posted earlier about checks clearing but I have just found out the package was rejected again on June 9th, 2007 on the basis that the check was not in the correct US amount. I honestly don't know what to do as the check is written on a US bank with a US address in US funds for the correct amount, signed, dated, etc... The second time we did as USCIS suggested and included a business card for the bank and a post-it note declaring what it is. The only explanation we can think of is the check has a picture of Big Ben on it and says London at the top as they are checks that are novelty around the world.

We are looking at submitting a certified check this time. But I am very upset by this as it is clear that it is a US check. This has pushed our process back considerably. My Vis runs out in Dec but I need to return to the US in October. Does anyone have any suggestions? I am getting desperate here.

sorry, or file is a mess. Actually we originally submitted it in May but due to continued USCIS errors it didn't actually get into their system until July. So we are figuring it will be another 6 mths approximately for him to get his visa. The reason for this question has more to do with situations in London (living ones) than the visa process itself. As I said exploring options more than anything. I like having many and then figuring out the best one.

This is dodgey question at best but I am trying to explore all options due to unforseen circumstances that just happened today that is out of our control. We are in the midst of damage control because of it. Without going into massive detail of what happened what I am seeking to know and understand is what is the consequence of withdrawing our I-129F application that is in the queue for process (though another 6 months probably to any significant movement happens) and moving to the US, marrying in a couple months, and then filing for immigration. I know moving and marrying then filing is frowned upon but not impossible and a long time period for things to happen. But what I want to know is; if we already had our I-129F in, and withdrew it then married in the US and resubmitted under another process will it get us rejected? Like I said we are just exploring options right now.

I tried to post this once and it didn't seem to take so hopefully it doesn't post twice. Sorry if it does.

Currently we are still in the pending stage but I want to be prepared ahead of time so I have a few questions.

1) On co-sponsors. I have a job offer in Washington, DC that starts at the beginning of the year. Because it will be cutting it close with the time frame that our application should be reviewed I want to have a co-sponsor just in-case due to the small amount of time I will be in the job. It doesn't appear that the sponsor must live in the same household but I want to verify this. I will be moving to DC at the beginning of the year and the sponsor will be in FL.

2) Speaking of financial requirements where can I find the poverty line minimum or what the calculation for the 125% is based on?

3) Also, with my move, it says within 30 days, does this include during pending? I believe it does.

4) Originally we listed London as the Embassy for the interview; however, my fiance has returned to Ireland to spend time with his family before the possible move. USCIS said not to worry about notify the change now until the contact us later and notify change of embassies but the gentleman seemed a bit unsure. So thoughts?

5) When should an EAD be applied for?

6) Last question tongue.gif I am a bit confused on the paperwork aspect needed to be provided. The I-94 is done at passport control. So does this need to be stamped for 90 day work in order to get the SSN that is related to working? Trying to wrap my head around it.

Well good news we got our NOA2 yesterday so YAY!

We just found out that we can't get his vaccination records because they are spread out over several counties and with several doctors and a mess. What would be the best course of action here? Wait and deal with it at the official medical exam he has to do. Or should he go to a local doctor now, have a titre done, have any vaccinations done that he needs thus having a record to take with him to the official? If he has to do the titre and vaccinations at the official medical appt for immigration how long with that delay the process?

So for the past couple months with USCIS I tried to change my fiance's address and embassy to which I was given the answer of wait till it goes to NVC and handle it then. This was the response from 3 different reps at USCIS.

Tonight I just got off the phone with NVC which just got our package. I attempted to do what I was told and got the response at first of why wasn't it done prior to which I informed him of what happened and then told that we need to call both the london embassy and the dublin embassy to try to resolve this. Then I find out NVC has him listed as a British citizen though we clearly put he is an Irish Citizen on the application. Now we don't know what to do. The address we gave originally in London is a bad address due to former roommates that we do not get on with. He can't just keep flying back and forth between Dublin and London which was suggested.

Any advice anyone can give me? Also how long do you think will this turn of events delay us?

Did you get the message from the automatic service or did you speak to a live operator...I spoke to a live operator and had them pull my case up...It doesn't give you the option on the phone you have to hit the option that says you never received anything from them and it's been over sixty days or something...

That's what I did and once the live operator came over the phone they pulled my file and told me that it was still being processed...but I swear by that me calling and pulling my file made them look into it...because the very next morning...it was approved via email...for NOA2...

I think the best option would be for the USC to go visit thier SO in he/her country. Does it really matter which country you ultimately meet in? Does it really make sense to take a risk and have your SO come to the US and get denied regardless of how low that risk is? The SO will ultimately be coming to the US *hopefully* when the visa is approved anyway..


I already explained my reasons for why this isnt an option for us but ill put them here again:

As far as me going over there we have many reasons. The biggest one is I have a 4 year old son from my first marriage who I share joint custody with my ex husband, I have him Sat-Tues my ex has him Wed-Fri. Every moment I have with my son is special to me and even those 3 days apart I have already kills me. I could never leave my son for weeks and go to another country even if it is to see the man I love, I love my son more and because of the agreement and the days we split taking him with me is not an option( my ex is a major pain and anything he can do to make life more difficult he will so asking him to keep my son on "his" days would get me a big Fat No). Other smaller things include my job, my home, and the fact im scared to death of airplanes. All in all even with the K1 pending its easier for us for him to come here.

When you get the NOA2 you still have a while before they will give you an interview date...so at the time it is not an issue...Also if he has been in the US before it shouldn't be a problem...I mean how long does he plan to stay...

and as far as flying...It's funny because I had only flown once 3 years ago before I went to the UK....I flew to the islands which was about a 4 hour flight...and now I have flown to UK 3 times...and I look forward to it now each time...and you don't have to stay there forever...I usually do 4-6 days or so...You could leave on a Wednesday and come back on a Sunday...ticket prices are around $400 bucks these days to Heathrow or Gatwick...

So it's okay if you go...and when it comes time for the interview do you plan on going with him...then you might have to fly anyway...I mean he can go by himself, but for moral support and making sure the consular knows that you are committed then go along....

Also I guess only by him coming to the US is the proof of meeting in person....

Well in either case I wish you the best of luck...

I also have a child...but if you can work something out...Then that would be great...Where there is a will there is a way...just think positive...

Please caution and take some sound proof advice...I mean under your circumstances and not to be the one to judge...what is the big rush...and let's say you really like her and she really likes you...back on not speaking english and her profession...do you want to risk filing the papers now...and get denied...because of those 2 challenges...or will you want to take the time to work on the language of both parties together...and maybe her find a basic job or school so even in 6 months or so you start filing...you can build your time line on at least trying...to convert and make changes, by the time you go to your interview they would appreciate that...

The way it looks now it might slap you in the face...is she working now...are you sure that she is no longer a prostitute and I hope that's not under the circumstances you met her...and make sure she takes some ob/gyn testing before putting yourself out there...

I recommend that for any couple...don't just wait on USCIS to tell you to get a medical review for foreign fiance...both parties should have it done once they know they want to continue to see each other...because I have seen it before where the foreign fiance might be A+++++ Health, but the US Citizen might not be and you won't know until it's too late...

It's not uncommon for someone BC to be messed up in Jamaica. I think they intentionally mess them up so you have to go back pay the extra money to get it fixed. With one of my brother's, his birthdate is wrong. He is actually a month early than he thinks :rofl:. I would get it fixed just in case when you go for your interview they try to pull a fast one on you for that. They will find any and every excuse to slid you the blue slip and waste your time and money.

I went all out to make sure I was organized. I had a 1/2" 3-ring binder and bought lots of plastic sleeve covers to put the papers in. Within the binder, I had 3 sections - forms, evidence of having met in past 2 years, and evidence of ongoing relationship. I made a table of contents for each section, and also stuck post-its where needed to give some context to the evidence I was including. I know, I'm ####### blush.gif

Do you happen to know if it is ok to tell immigration you'll be getting married then going back to your own country (on a tourist visa or VWP), if you have evidence to support it? Or, is it legal but immigration still might not let my fiance in the country if they know we're getting married? I have read on the France and Japan consulate websites that it is ok to get married and then return to country of residence, but a friend of mine talked to a lawyer who said you still cannot say anything about marriage at the port of entry or immigration will get suspicious anyway.

That is our backup plan if the VSC doesn't get a move on I129Fs and we have to cancel it.

My fiance had his packet 3 sent from Sydney, and on the form apparently the consulate hand-wrote in "to-be" Spouse for that question. So he filled out my information and put our projected date of marriage. We figure the date is in the future so we're obviously not married yet, plus they must have wrote in "to-be" for a reason. Just our take on it. Did they do that on yours too?

Did you already buy the flights?? My fiance is from Australia and although most of the flights stop through LAX, we bought one that actually goes around the other way, stopping in Korea and then straight on to JFK (for the sole purpose of most likely getting the EAD). If you can't find a flight like that from NZ, you could always get one to Asia or Europe or something and then one from there to JFK. (Of course, only if you haven't bought them yet).

So, is the fact that you have a K1 pending not known to the immigration officers? I had assumed that info would come up on their computer screen or something and then they'd ask more questions - maybe not?

As the process is not a short one, I would suggest that you send the I-129F out as soon as you possibly can. I really wish we had started our application earlier, but so it goes... good luck in your application, and don't hesitate to ask any more questions! I found the best way was to take small white sticky labels, write the information for each photograph on them, and then stick them to the back of the photos. No damage to the photos, and they can't fall off like post-its might. star_smile.gif
