Yes, The I-864 will not be needed until AOS. The I-134 is needed to be sent by the petitioner to you along supplemental documents showing that the petitioner can support you. These can include: a letter from employer (on employer stationary) stating that the petitioner has been employed for however long they have been, how much their salary is and their title. Other documents can include a bank statement signed by the bank officer including all accounts with the bank as well as how long they have been opened. The most recent federal income tax return is standard as well though some countries may require past years' returns.

Have you received the packet from the consulate with all of the information or are looking over the forms you believe you will need?

It is good to get a head start on the process but rememebr that each country is different. Until recently, DS-230 and DS-2001 were needed to be sent to my fiancee's country (Brazil), but now all documents will only be taken to the interview.

It seems to me to get married ASAP. Reason is you can't file for AOS until you get married. If you do it right, you will have your wedding planned before the visa interview, because for many countries, the K1 visa is issued within days or weeks of the interview (assuming you get it).

I don't agree with applying for the SSN as soon as your SO arrives because then after the wedding you might have to change the person's last name, possibly at additonal cost. I am going to wait until after the wedding to apply for the SSN.

Maybe it depends where you will get married, but I found out the other day that where I live, they only need a passport of the foreigner (along with a driver's license at least for me, the American) to apply for the marriage license. I can get married that same day assuming I have someone with the capacity to marry present and a witness or two.

Hi erveyone,

I was wondering what the process is like for K1 visa holdre studying. My fiancee will be coming with 2 1/2 years of undergrad studies (law) under her belt. I know univerisities are different and I have already begun contacting those in my area for specific info but wanted to know if anyone has started the process of having the K1 visa holder transfer credits and study at a U.S. university (undergrad).

On a side note, many universities in the area have links for transfer admissions and international admissions. Would K1 still qualify as international admissions since she would not have a green card (just K1) by the time she would start studying? I hope so since it seems like she only needs basic stuff such as TOEFL scores and transcripts translated and evaluated, along with letter of recommendations.

Both processes are viable. Obviously one is for a fiance and the other for a spouse. There's nothing wrong with her coming here on a visitor visa and marrying you but if she does, she must not overstay the time allowed on her I-94. She'll interview for the visa in Cuidad Juarez.

Regardless of whether or not USCIS finds out about your SO's intent to go from visitor to spouse visa, it still is fraud. I suggest using K1 visa OR marry her in Mexico and apply for K3.

It depends on the corrections you made to her. The K1 guide and USCIS I-129F instructions recommend making copies of everything sent in (at least the USCIS docuiments) and to bring that packet to the interview.

Making copies of original documents makes sense, but we did not resign any documents or change anything for that matter either. My fiancee just has her interview, and it appears as in many cases, during a 5-10 minute interview, the officer won't ask the beneficiary for the documents (G-325, I-129F) that have already been approved well before that date.

Request for Evidence. It's what you get if you forgot to dot or i's and cross your t's. If you do not give sufficient primary evidence or basic documents requested, you will get one. If you do not give enough secondary documentation (i.e. photos, letters, e-mails), you may get one. You obviously don't want one because it delays your case from being approved, so it's better to wait and have everything ready, notarized (what needs to be) and sent together after being checked several times.

I agree. Not to speculate, but based off of that same quote, it doesn't seem like the US citizen had real intentions to marry because to go through the entire process, it is hard to imagine someone would be unaware of the fact the K1 visa expires in 90 days. To say that the non-citizen should be happy and content for leaving a home country and likle yfamily and friends is absurd when the USC doesn't have any plans of continuing on his commitment to marry.

cheers...I ask because we have a set wedding date (so that family and friends have plenty of time to book flights etc) and given current VSC processing times we're potentially facing a situation I never thought we'd be in which is the visa being issued too fast!! Typical, lol...

If it comes to that we're planning on doing things like delaying the interview etc, etc, but obviously don't want to delay it for so long that our petition expires unsure.gif Ultimately just getting into the country is the main aim and everything else is moveable but would be nice if it all came together - just once wink.gif

Hi folks,

In just under one month I'll be off to the States again to see the boy and I'm very very excited biggrin.gif

However I'm also a little nervous about how to deal with Immigration when I get there, as this is the first time I'll be visiting since we filed our I-129F in November. I'm planning on travelling under the VWP and I'm also going to be taking extra evidence that I'm going to be returning to the UK - namely, a letter from my landlord proving tenancy, a reference letter from my employer saying I'm still employed, return ticket and credit card bill.

Should I take anything else?

I'm not intending to lie or hide the fact that we're applying for a K1, obviously, I'm just wondering how to bring the subject up?! Immigration, although they've got a lot better in recent years, still manage to make me nervous/angry every time I go through (and that was before our I-129F was filed!!) so I'm just wanting to be as prepared as possible smile.gif

Hey everyone

I've been told my Packet 3 is on its way so I'm getting prepared by doing as many of the forms as possible in advance.

I've just got a couple of questions that I hope some of you who have been through this already will be able to answer - mostly about employment and visit history. Here goes...

1. On my DS-157 it asks for my last 2 employers. My last 2 jobs (prior to my current job) were both with the same company (Disney) but in different lines of business and at 2 separate periods. Should I just list Disney twice?
2. In the same vein on the DS-157, for my earlier stint with Disney I can remember my supervisor's first name but not her last name (first-name company and they specifically won't give references, so I'm not sure I ever knew it). What should I put down?
3. For the DS-156 and the DS-230 they want your history of visits to the US. Should I include ALL vacations or just times when I entered on a visa? I can remember as far back as 1994 but not before that but I know I visited cos my granddad lived there...

Any help gratefully received :)

3) Documentation: Should we have friends and family write letters of support and should they be witnessed by a solicitor?

4) Our letters of Original statement should this be witnessed by a solicitor?

1) Use US based physical address if available and be sure you can receive mail at this address.
2) Parental information is requested on the form, I am unaware of a need for any information regarding grandmother
3) Not required for initial petition
4) Original signatures of petitioner and beneficiary required no notarization needed.

I was under the impression that you needed a U.S. address for the I-129F. At some point you will need to prove you have sufficient income(or get a sponsor) to support yourself and your intended. If you are not currently living in the U.S., it will be difficult for you to show an income. Perhaps I-129F is not the route you should use?

Re: Grandmother's information, if you don't know you can write "Unknown".

Nothing needs to be "witnessed by a solicitor". Many people here on VJ complete their own paperwork without the assistance of an attorney. The only paper that needs to be notarized comes later at the interview stage.

Yeah I spoke to a lawyer that wanted 2500$ for the process and I was like Uhhh NO. So I am doing it myself and just getting a few more answers will help greatly.

Ok, well I am a postgrad student living in London currently but will be returning to the U.S. I do have a permanent address there so I guess what I should list is my US address and leave it at that. After all, my bills still do go to that address and it is where I am registered to vote. I am only in London for a year (less than that now, a few more months).

I am having a joint sponsor for my boy. My mother is co-sponsoring him with me as I do not have the financial capabilities that she has. As I have been a student I do not have a Fed Income Tax for the past year and she claimed me as a dependent. Thankfully she really really really likes him! :)

So I am almost there! Thank you!

The G-325A asks for your residences for the last 5 years - not ones you only lived at for more than 6 months. I would be VERY WARY of including documents that sound like good primary evidence that you should use if it would clearly contradict what you list on the G-325A. I'm guessing that kind of internal inconsistency would raise red flags.

The last-5-years list can be annoying - I had to stretch mine on to an extra sheet of paper because part of my last 5 years were spent as a student and a mobile one at that.

Sounds like you might need to redo your G-325A.


This was my concern but I do not want to confuse with my temporary address and my permanent address in the States that I can and do receive mail at. I believe I have enough primary evidence now that I do not require the UK phone bill or UK bank statements. US items include:
Flight Itineraries
1 Boarding pass (I didn't know I was going to need these in the future)
2 Credit Card statements (different cards)
Bank statements (US)
Vonage Phone Bill (US number. Us Address.)
Photos
1 receipt (I threw them all out recently in a mad cleaning spree)

We are going to get an engagement ring tonight so we have the receipt in the UK and for the ring. I have been wearing my grandmother's as Vinny knew it had sentimental value so he arranged to get it from my Mom.

Yeah well they probably then figured that you moved. When you fill in the G325A they ask you where you where living( newest first I think it was).
So if you where actually registerd in the UK for living there sometime,they will see it on the G325A and they wont be looking at the phone bills all funny( which I dont think they would do anyway)


I haven't listed either of the UK address. I haven't lived at either one for more than 6 months. I am still in London so... yeah.

Just use old bills I guess. :)

I myself did not include any phone bills as soon as I pay them I shred them *lol*


*Laughs* I keep mine due to flatmate issues. I just don't want to confuse immigration because it has a UK address on the bill but I have not listed a UK address on my application as it's been less than a year.

I saw a couple remarks about primary evidence. What would this consist of?

I have my passport with my UK Visa and stamps of entering the UK.
I have bills in my name in the UK.
I have Bank statements with UK charges.
I might be able to find a couple Credit Card receipts about.
I MIGHT be able to find a boarding pass but not sure though I do have my cat's entire paperwork for entering the UK from the US.


Is this stuff good?

I hope this works as I listed overlapping dates but added the explanations of why that is (post-grad student) and the fact my mother will be co-sponsoring Vinny. Wish us Luck. I have had 2 addresses in the UK that I resided at as a post-graduate student. One I am still residing at with my Fiance presently. I do have a perm address in the US where I do receive mail and I have tied to accounts and phones, etc...

Should I list the UK addresses or not with a supplement page explaining the circumstances?

Hi, I sent our I-129F on 07 May 2007. The original submission was returned on the basis of confusion with regard to the check I sent. They had claimed it was UK sterling rather than US money even though it was written on a US check with a US address using US funds. I think the confusion was the fact there was a picture of Big Ben on the check. I have checks with pictures of iconic buildings around the world and this just happened to be the one I used.

I have resubmitted the package on 24 May 2007. My question is - how long does it normally take for them to cash the check and for it to clear? It still hasn't been cleared from my bank account.

They refused funds from the same bank TWICE! DO NOT send them another check from that bank. Get a US Postal money order, or a certified check from any Bank of America branch.

It makes no sense to try and send funds from the same bank a third time. Even a certified check may not be good in their eyes.


The bank is Wachovia. It's a national US bank. A large one at that. I think the confusion is because of the pictures on the check. I doubt it's the bank itself as it was never even submitted to them at all. But you may have a point, not risk it one more time. I can go to a Bank of America and get a certified check from them. I want a way to track this thing and money orders make me nervous. :(
