What about biological father? Did you supply any documents to terminate his rights?
My first husband has no contact with his kids. My husband want to adopt my 9 years old, but we are afraid about the biological father's rights. I have full custody of both kids (9 and 17). The biological father lives outside the states (from what I know).



Normally in Georgia, you must publish in a local newspaper for two months your intention to adopt. This gives the biological father time to object if he so wishes.

However, since there is no biological father listed on the birth certificate (the space is blank), and it was sixteen years ago in the Philippines, there is no issue.

My impression is that because my step daughter is over 14, her desires basically trump everything else. That is why she has to go to the court on August 20, and personally sign in front of the Judge that she desires this adoption to take place.

So the other biological parent is not an issue in the Philippines? Assume there is another biological parent, my understanding that virgin births are not that common. Did adopt a one and two year old, new birth certificate showed us as the biological parents. Were born in the USA, but not in our town, used the town they were born in.

So wonder if your new birth certificate would reflect that as well. Never asked a friend that just adopted a baby girl from Ethiopia as to what her birth certificate says, will ask him later today. Seems ironic to me the really big deal the USCIS and the DOS makes of your place of birth. None of us had a choice in that. As a natural born US citizen, never had to make an oath to serve this country, well did when I was drafted into the military. Ha, was either that or going to jail, so wonder how valid that oath is. Immigrants make that oath freely, but still have to live with their place of birth. Especially if your home country demands you maintain your citizenship and requires you to have a passport of that country to visit your family.

So very curious what your new adopted daughter's birth certificate will look like.

When I met my wife, her ex abandoned his daughter, my stepdaughter now seven years before we met. But Venezuelan courts were only interested in his rights regardless of the conditions. Only counter we had to get his permission to bring her here was to forgive seven years of unpaid child support payments with another five to go.

See on other sections of this board, marriages with kids involved don't work out, but can develop a strong relationship with the kids even with problems with the parent of those kids. But if that parent goes, so do the kids. No consideration for the emotional stress those kids must go through. Really a crazy fouled up system in my opinion. Came to the conclusion when dealing with these self-proclaimed government agencies, the word family is not even a small part of their vocabulary.



Will let you know when I get the birth cert. We had no immigration issues or adoption issues so far. We were lucky it seems, in that the birth father is not even listed on the birth certificate from the Philippines, (it is just blank).

The bolded part of your comments about the instructions for the form N-600, (2e/f) don't talk about adopted prior to 16, they talk about "legitimated" by a biological parent prior to 16, a completely different issue.

A Child Born Outside the U.S. is a Citizen after Birth IF… The child was adopted by a U.S. citizen parent
AND... The child resides legally in the U.S. in the legal and physical custody of the U.S. citizen parent and meets the following conditions after February 27, 2001 but before his or her 18th birthday:

The adoptive parent adopted the child before his or her 16th birthday (or, in some cases, 18th birthday (my comment: in siblings case)) and had legal custody of the child and resided with the child for at least two years; OR....


I am not going to argue, I think I am right. I don't want you to be disappointed later. Go to Instruction for N-600 form. Paragraph 2, you have to apply to your child 2a and 2b and 2c and 2d and 2e or 2f, where 2f is not your case, and 2e says about 16 again. Of course, I can make a mistake. Check it again.

Dave, you are a good man for making a commitment to your daughter.

She will be able to derive US citizenship from you under the Child Citizenship Act. See my previous posts.

The adoption will terminate the child's legal relationship with her biological dad and his family. She will never ever be able to petition for any of them. Don't know if this is relevant or not to you. Just pointing it out since family relationships can be complex.



Thanks, they are aware of that, and I am sure that is one of the things the judge will talk to them about.

Dave... Sorry, but if you adopt a kid older 16, she cannot become a US citizen. It works only if child under 16, or between 16 and 18 when siblings adopted together. She should remove condition with her mother, and she will be able to apply for citizenship after 5 years from her first green card, Again, sorry... That is from my personal experience. My husband adopted my kids, oldest was 17 when we started, and I studied it. I knew he can become a citizen only if it will be made for all three kids in one day. Even if we had it so close and finished all cases at one day, we lost this possibility because our judge didn't like immigrants and signed the order after my son turn 18 (just three days!). We were mad, but couldn't change it. My daughters are citizens, I'm in process, and my son will apply after two years.
Still, your step-daughter can have some benefits being your daughter, but not for the immigration.

Must have been given bad advice from my attorney, since my stepdaughter was born and came from Venezuela, he said it had to be done there. Is there a biological parent involved with your adoption proceedings? That seemed to be the major hang up in our case.

Hope everything works out of you. Best I could do was to add my wife's name to my home deed myself, major obstacle was trying to find the form. Saved over $500.00 by doing that myself, and the register of deeds said it was perfect as she said these attorneys make many errors.



My step daughter is my wifes biological child. She came here on a K2 Visa with my wife. All that is needed to adopt here, (Georgia), is legal permanent residence for the child. They do no have to go back to their home country.

After all the DIY success I have had in the immigration process, I wanted to jump to the next level. My step daughter asked me to adopt her as she is the only one with a different last name. She just turned 16, and I was so honored that she asked me to go forward with it.

Every attorney in the local area wanted around $4000 for their expertise. I said why not try to do it ourselves, how much harder than immigration paperwork can it be. Well we studied the laws on step child adoption, researched the necessary forms and procedures, and went to work. We thought we were pretty thorough so we took our package to the county court house and filed. The filing fee was $205, and the clerk said she had never seen anyone try an adoption without an attorney. She also said that if the Judge rejected our forms that our filing fee would not be refunded.

We waited almost a month and nothing from the court, (I thought we had messed up big time). While in California on business two weeks ago, I got an email from my step daughter saying that we had gotten a letter from the court, and attached a scanned copy.

The letter basically had two provisions. First, on August 20th, my step daughter and wife have to meet the judge to discuss the adoption, (and to make sure it is what they want). Secondly, my step daughter must affirm (sign), in the presence of the court, a document that states that she wants to be adopted. This is a requirement in Georgia for any child over 14. My step daughter just turned 16.

Second paragraph of the letter says that all of us must be in court on September 6th to finalize the adoption. What is neat is that he waived the publication order, and the home study order, thus saving a bunch of time.

As soon as the adoption is final, she becomes a US citizen and can apply for her passport under the Child Citizenship Act.

Poor mom, she will have to remove conditions alone, and her daughter will beat her to Citizenship by over a year.

I just got married this Saturday.. yeah!!!!! lol ...

I am just wondering when you change my name after i get my marriage certificate...

I called the SSN office in Orlando and they said I can have a SSN no problem, BUT, my name won't change till I bring a copy f my green card.. When is this right? It sounds sound right to me as I have heard friend from another state that has applied for a SSN after getting married and have their name changed on their SSN..Not sure what to do.

The lady said even if I am married my name will come as it is on the DHS system, the same name is on my I-94 which is my single name.. :blush: :help: :wacko:

Anyone has experienced that?

I guess it depends on what state you were married in. Here, in Georgia, you put the name you want on the marriage license. As soon as the marriage is official, that is your new name. We got married four days after she arrived, so her Social Security card was in her married name at first issue.

When we applied for AOS we applied in her married name and her green card and EAD are in her married name.

Not yet, the letters are at our home, and all I have is JPEGs that my wife Scanned to me. I don't want to post the images because of all the privacy information that is on them. Once I get back home, I could post the text. In a nutshell, the first letter includes:

- "the evidence submitted with your form is insufficient. USCIS requires certain additional evidence to process your form."
- "All evidence should be submitted at the same time on or before 5 Dec 11."

2nd letter includes:
- "Your supporting evidence does not sufficiently establish that you and your spouse entered the marriage in good faith and the continue to share a life together.:
- "You submitted a copy of your DOD ID card, copy of your 1099 INT showing a joint savings account, copy of a voided check showing joint checking account, and evidence of joint car insurance."
- "Although these items begin to establish the indication of a relationship, they are not strong enough, as a whole, to establish that you and your spouse entered the marriage in good faith and continue to share a life together."

The letter then lists the following as "Good Faith Marriage" examples: Children as a result of your marriage, Evidence of a common residence, Joint financial resources, and health, financial, and estate planning arrangements with each other. I submitted evidence for everything except the Children because we did have any at the time. I wonder if I should submit the medical paperwork that documents our 3 miscarriages? Thats terrible if we have to do that.

The third page includes information about a required response during the designated time period and what the consequences will be if we don't respond in time.

Thats it, in a nutshell.



I hope this was a generic letter. I noticed it said you submitted your DoD ID card; did you not submit hers also? What about her TRICARE card? Is she the beneficiary of your Servicemans Group Life Insurance? If so, go to your servicing personnel office and get a letter to that effect.

They are not denying you, they are asking for a little more proof.

Short story. K2 step daughter was adopted by me and US Passport issued for her. K1 wife needs to remove conditions.

K2 name changed as a result of the adoption, so the childs name on the I751 does not match the name she entered the country on. However, the name of all children must be listed on the form.

Should we just submit the package with no mention of the K2 citizen? Should we attach a letter showing the adoption decree and copy of the US passport? Should we explain the name change on the I751?

I realize that the USCIS/DOS system should be integrated without me explaining, but somehow I doubt that it works that way.

What I am leaning toward is listing my daughters new name on the I751, and in the A number block putting "previously A XXX XX XXX". On the cover letter explaining in full the adoption and subsequant citizenship. Finally, attaching copies of everything.

Anyone else had to do this and what did you do?

So I've been getting the run-around from USCIS for the last three months now. Every time I search for my case using the online tool it says that my case doesn't exist. I call in and am transferred to departments where you can't leave voicemails and given email addresses that lead no where. Or as is my recent call put on hold for 45 minutes before finally being told that my case doesn't expire for another six months so they see no issue until that point. Even though I have yet to receive our biometrics appointment time. I tell them that per this group most received it shortly after filing their claim. The guy tells starts getting really rude with me repeatedly saying that I have six months and making it sounds as though I am an idiot.

Can I even file a complaint about this? Should I actually worry about whether my case will actually be worked?



USCIS is weird in so many ways. Concerning ROC, the case number on the NOA1 never ever worked in the on-line case tracking system. Only when we got the biometrics letter would the case number work, and it was a completely different number than the one the NOA-1.

I'm trying to keep calm, sis. But I'm all alone right now and I can't even talk to anyone except by VJ family. I didn't know that all the packages sit at an intake center and aren't picked up until later in the day. This gives me some glimmer of hope. Hopefully, tomorrow morning I'll see that the package has been delivered. This is making me relieve the I-130 days of agony. All these weird and negative thoughts are going through my mind. Like what if I never get to see my wife again. I know I absolutely cannot live without her. Just not possible.




Delivered doesn't mean anything. Ours was delivered and never acknowledged by Vermont for another two weeks. Then when you get the NOA1, the case number will not be recognized by the UCSCIS on-line case status web site. You won't even be able to use on-line status until you get the biometrics letter and then you will discover they have assigned a different case number. Nothing you can do except chill out and wait.

Hello vj members. What would be better to send out with our roc package. As for as payment, would it be better to send out a cashier's check or a regular check from our checking account. The reason why i ask is becaused with the regular check, uscis will delay things until the check clears. With the cashier's check from our bank, it won't delay the process. Also on the cashier's check, i want to have both of our names on it. On our regular checks from our checking account, we do have both of our names on it. I notice that on this website, i see members sending in cashier's checks. I just wanted to know which way is better. thank you everyone.




I always use a personal check because I can go online and can see when they cash it. I knew our ROC petition was in the system well before the NOA1, because they cashed the check.

Actually there is no standard. The offical waves his magic wand over the package and makes a decision. Like a dummy I did not read the guide and just threw together a  package of what I thought was good. I have been sweating bullets waiting for the inevitable RFE. Heck I had the responses ready.

 

I did not submit multiple bank statements - I submitted a cover letter from our credit union stating we had a joint account, and provided the current months statement only.

 

I did not submit letter from friends or acquaintances.

 

I did not submit joint mortgage or home ownership documents. The house was in my name when we married and remains in my name.

 

I did not submit joint utility bills as our utility company will only  permit one name on an account.

 

The package was submitted on Nov 9th and we got our approval letter two days ago.

 

 

However, if I had to do it again, I would have submitted much more. I have been sweating bullets for months. I just knew an RFE was coming.

I'm a citizen with a pending I751.

 

 

Don't get me going there. My daughter is a US citizen waiting for her green card also. Stupid USCIS would not let my wife remove conditions unless my daughter did also, K1 and K2 linked in the computer and they could not separate them).

 

At an infopass appointment, I  even showed them my daughters US passport and explained that she derived citizenship when I adopted her.

 

They just didn't care.

Wife and daughter submitted ROC paperwork in Oct 2012. No RFE, no problems and ROC approval letter received May 5th 2013. Approval letter said to expect green cards within 60 days. Still no friggin green card(s) and USCIS won't talk to me because my wife and daughter are in the Philippines til the 30th.

USCIS website still say "initial processing".

 

Heck, wife can apply for citizenship in Sept.

Wife and daughter finally got back from the Philippines.  Approval letter dated 2 May and still no green card.  We called USCIS Monday and the level one lady was actually helpful.  She submitted a service request, apologized and told us she gave VSC fifteen days to respond as to why the cards were never produced.

 

Status today online changed from "initial review", to "card prodcution ordered".

 

Now - next month have to start the whole citizenship thing.

Was shocked when approval letter arrived today, since ours wasn't accepted until Nov 9th. Was really worried about an RFE since the only bank stuff I submitted was a letter from our credit union saying we had a joint account and one bank statement.

Tier 2 just wanted to play games. She said to resubmit and not even tell them about my K2 daughter. Her point was that Des is a US citizen and USCIS should not even be involved at this point. I have an infopass appointment on Thursday in Atlanta. At least there I will have a live person to yell at.

Bottom line is that my wifes green card expires in four weeks, and I hope Atlanta can extend it.

Ok folks I am getting antsy and almost ready to call. Sent package USPS Priority Mail with delivery confirmation on the 19th. It was delivered to the USCIS Vermont Center on the 22nd. Address used was:USCIS Vermont Service Center
75 Lower Welden Street, P.O. Box 200, St. Albans, VT 05479-0001 per the instructions.

Wondering if USPS makes a difference vice using FedEx or UPS. Still no check cashed or NOA 1.

I also wonder how closely they look at the package before cashing the check and issuing the NOA 1. I had to explain why my K2 stepdaughter was not included in the petition. I adopted her and enclosed a copy of her US passport to show she was now a US citizen and didn't need to remove conditions.



Well, USCIS sent the entire package back. They insist that my K2 stepdaughter must pay biometrics. They ignored the fact that she is now a US citizen. I attached a letter explaining her adoption, a copy of the adoption decree, and a copy of her US passport. Waiting for tier 2 now and p1ssed.

I have sent it using USPS. I have read it some posts that people did have problem with FedEx as the USCIS address is PO Box and FedEx sometimes returns it as they can't deliver. I wanted to be on the safer side so tried USPS but didn't knew that my wish for being on safer side will create issues.

Were you able to talk to them? Sending through USPS makes any difference?



I haven't gotten through to them, but will let you know when I do.

I am having the same issues. I have sent the application on 23 and still no check cashed or NOA. Can you please updated us how did your discussion went on calling there 800#. That would help me in deciding my next move. Any other VJ'er who can assist us , we would really appreciate all the help!




Did you use regular USPS or a shipping service like FedEx, or UPS?

We never heard anything about adjudication from Vermont, nor that the case got transferred.  However, our approval letter came from the field director in  Atlanta.
