Electronic = Anything you've filled out on the computer to print off, make sure you keep it. The idea is that you can create an exact copy of what you send to USCIS, partly for when you get to NOA2 stage and partly because if the worst comes to the worst it's always good to have a backup!

One thing I would absolutely categorically stress here is to take your time. The process takes months to complete once you apply, an extra few days going over everything isn't going to make much of a difference! The guides on here are wonderful but there are others and I found it quite useful to google around since I'm the type that asks for second opinions all the time.

It might also help to go over things with a friend sat with you. The forms are daunting when you consider how much is at stake!

If you still have doubts, then don't worry. So long as you've taken your time and made sure everything is okay, you should be fine. When Lorie and I went to submit ours, I put the folder into the box and sealed it straight away. otherwise we knew we would constantly worry!

I haven’t had my visa interview yet (it is on April 17th), however, I wanted to know, hopefully after I get a visa, how much time I have before I need to arrive in the USA? I read somewhere it said 6 months. Is it true?

When issued, the visa is typically valid for six months. This has been known to change but shouldn't be less than six.

Please remember that the I-129F is not a visa.

It's a petition for someone so that this person can file FOR a visa in their respective country. All the NOA2 / I-797 is a notice of approval.

After approval the case is sent to the National Visa Center where it is assigned a processing number. With that processing number, you can book things like your medical, however it is only when you receive packet three and send packet four that you begin the process of applying for the visa.

This is why there are two fees. One for the I-129F petition, and another when the beneficiary books their appointment with the consulate and they have to pay for the visa

i heard that after the nvc gets the file and sends it on to the embassy but before you receive writen conformation of the embassy receiving it that you can start the process by calling for your mnl number from the nvc and using it to do your online paper work like the156 k156 157 but so far that is all i herard was wondering if that where true because it wont be long and i will be going through this as well anyone out there know


Certain people have done this yes. You can call NVC for your numbers to get things like the medical booked. I don't know about the DS forms but I *believe* so

I remember reading that the USCIS wanted to make more things electronic, although, it's hard to make some of these things 'electronic' (such as requiring a physical signature) but then, you could submit an electronic petition, which then generates a receipt with a barcode, which you print out, then send to them with a signature on it...

The K1 is supposedly quicker but not by much. The CR1 also has the added benefit of giving you work and travel authorisation from the point you step foot in the USA

Let me address the last part first...

The purpose of the K1 as I understand it, is to lawfully enter the United States with the intention of marrying and seeking permanent residency through a change of status, when you enter under a visitor visa, you do not enter with the intent to remain, so that's where the big difference comes from. It's not impossible to marry under a visitor visa and adjust, but apparently it can cause major major issues since you entered the USA with 'false intentions'.... (you can still come in and marry, so long as you leave afterwards, i.e. you can't come in, marry, apply to adjust your status and stay there forever more)

if you want to get married first, you'll need to apply for a CR1 visa and then wait outside the USA before you can settle... (you can still visit!)

By the way, you can visit the USA all you want while you're waiting for the process to go over, what she might have been referring to though is the fact that Immigration officials will scrutinise you further since there will be a fear that you will enter the USA with the intent to remain, so if you embark on the process and decide to visit your USC Fiancee, make sure to bring good proof of ties to your homeland! You will need to return home for the interviews and medical etc, as well as ensuring you don't over-stay your visitor status in the USA

I'm sorry, I don't know about your biological father, but if you were adopted and this is the reason why you don't know, I don't see this as a problem since the USCIS accepts adoption certificates.

It does seem like a backwards process sometimes, (and expensive too!, you've got the cost of the I-129F petition, then when that bits done, you have to get a medical, THEN pay AGAIN at the embassy for the actual visa, THEN once you marry have to pay about 1000 dollars to adjust status to get a two year conditional residency THEN apply for removal of conditions..... and you can't work when you enter the USA on a fiancee visa until your work authorisation comes through which you can only apply for once you're applying for adjustment of status....)

Yup, they sure make you work for it.....

As for getting married while I'm still here - I thought that was illegal? Or is it only illegal to get married on a tourist visa and then stay in the country while you wait for the adjustment of status? To be honest, if the length of time that I have to be away from my fiance is the same with the K1 process as it is with the K3, then I'd rather do K1 so that we have more time to plan our wedding. From what I can gather from the K1 flowchart on this site, there is more paperwork and waiting to do after we're married before I'll be able to work in the US, but I don't mind as long as I am with my fiance. So unless filing for K3 means I can be with him sooner, I think I'll stick with K1. If I'm wrong with this though, please tell me! I feel like my head is about to explode :(

The guides to explain a lot and yes there is a lot of waiting around. Wedding plans are complicated since you only have 90 days to get married, and you must make sure you do that. When you get married you can then file for Adjustment of status, and with that you can file for the temporary work permit (EAD). Those typically take around 3 months to come through, at least at the moment they are!. Realistically, you're probably looking at about 4 or 5 months after you enter the USA before you can work, I say that because I'm sure you'll want to plan things, have things like your Social Security Number in hand although 4 might be pushing it a bit

Someone with more experience may give you a better answer here, but I don't believe you will have a problem. You were admitted to the country, not denied, you just went through secondary processing. Yes, it's pressing and not that pleasant but overall, it's not that bad assuming they didn't grant entry with conditions (Such as "You cannot stay for more than 30 days on this visit")

However, USCIS can ask you whatever they want and you have to comply. I mostly meant that later on they will ask for documents like your tax returns and bank statements and all kinds of things. You'll get used to it.


As said above, you're going through a legal process so they really can ask for anything they want.

Please don't forget to read the guides on the forum. Now is the time to get it right rather than waiting an extra five months and finding you either have to send a substantial amount of evidence or even be declined for not filing properly

Your I-129F needs your meeting story. Lots of people put this on a supplement page.
You will need G325a biographic forms for both you and your fiancee BOTH of which are signed by you and your fiancee, they must be original signatures
Two letters of intent to marry, one for you, one for your fiancee, again containing original signatures
Passport photographs, proof of nationality for you both and evidence of having met within the required timeframe....

Thanks for the pointer. We're both fairly confident that there's nothing amiss, since we've been fairly comprehensive in the documents we've printed and forms we've filled out etc. The filing fee error was pretty much a miscommunication. I knew the actual fee but I couldn't double-check it before it went out, in contrast to the other forms where both pairs of eyes saw what was filled out. Fingers crossed.


That's fair enough! I'd rather annoy the ####### out of someone telling them to check something, than not do it and see them RFE'd or declined later. but it sounds like you've been thorough!
