Sounds like my how my fiance and I were the first 18 months we were toghether... its gonna be a hard adjustment but the several months we are apart will be worth it to spend a lifetime together!

Its so easy and quick to do and makes a HUGE difference in the data out there and all of the calculations. Its so frustrating to see people not using their timelines. :bonk:

Not to mention how much more difficult it is to get assistance when asking a question as the "experts" on VJ have to ask questions about your situation instead of getting a quick summary of where you are in the process! Its a courtesy to those helping you! :blink:

Yes, you can start the process prior to her name change. I did that and they consider the marriage as acceptable evidence to change the name. I am slowly working my way through all my ID as its expensive to change. I will change my passport to ensure the name matches my petition.

From your post I understand that the process has already begun but the petitioner has moved since submitting your petition and is now residing in Canada. There is a great wiki on NVC processing for Canada. Fortunately we live in a country that lets you submit your documents electronically, huge time saver! :D

I have a US account at a US bank through the Royal Bank of Canada. This is not a US$ account but an account at a financial branch in the US. I went to my local branch to set up the account. It was relatively quick and painless to do so. I would highly recommend doing that. I received cheques and was able to send off my I-130 payment from there and just paid my I-864 Bill online painlessly. Its great!

My suggestion is always to error on the side of caution and get the police certificate. I lived in Japan for just uner 12 months but I provided a police certificate anyway. It took 3 weeks to get from Japan and was free of charge.

To me it wouldn't be worth the headache of a potential RFE especially as she will have to list her residence as she lived there for longer than 6 months, according to the DS-260 requirements.

I think the notary charges very. I'm in BC and they were ~$25-35 depending on who did them. It was a complete pain in the @ss but worth it! I sent a total of 7 letters with my I-130.

The Affidavit of a Bonafide Marriage can be done by anybody that knows the couple as long as it has been notarized. I sent a mixture of letters from my family here in Canada and his family there in the US. Also, I had my US husband do one.

This is the inforamation that I included in my letter. I can email you the blank template, PM me if you like! I completed a standard for most of my friends and family and then had them fill in a few blanks. Note, that many US Banks will have a notary that will notarize your letter for free or a nominal fee vs Canada. I spent oodles having them done here by family/friends.

I'm a college dropout and I was able to complete my forms. :lol:

You need patience and time to do this process... If in doubt check it out! Research is the key and ask questions!

Note: If your spouse has been denied entry or overstayed on a visa in the US you may need legal assistance if not and your case is straight forward you should be able to do this on your own. Save the money!

You should check with your consulate you may be able to do a Direct Consular Filing... This is much faster than applying for an IR-1/CR-1 Visa. As you don't have your country listed there is no way of advising you further on that.

Typically it takes 3 months for your paperwork to be completed. Check the guides for further info.

Just a reminder as I am Canadian and have seen my fiancé approximately 20+ times in the US in the last three years I have only received 2 stamps in my passport that were illegible and before the two and were dated outside of the two years from our submission.

I agree with many of the posters here... It really depends on your personal situation and even the time that you and your fiance have available to putting the paperwork together yourselves. My fiance and I decided to forge ahead and do the paperwork ourselves. VJ is a great source of information, love and support... We are open to hiring legal assistance should it be necessary but we would rather save on the attorney fees for a nice vacation!

I totally & completely feel your pain... all of us can relate to you on some level. The long wait and the missing of your SO can be very difficult to deal with and is an added stress on your relationship. That topped with inquiring minds and constant questioning regarding the process can be enough to make the calmest person completely loose it!

With that said my SO and I have relied on each other for the support that we need to get through the difficult times and what can seem like an endless wait. To pass the time try to focus on the truck load of paperwork that you will need to fill out after you receive you NOA2 and then for AOS, EAD & AP... this should help!

I previously entered the US on a K-1 Visa that expired before we were married. I am currently in the process of submitting my I-130, I don't anticipate any issues.

If you are living in Germany and do get married in the future and then decide to go to the US processing a Direct Consular Filing is an option for you, if they are processed at a consulate in Germany. They also tend to be much faster than filing in the US. DCF Guide

I agree with PP... You are better off to do some research on VJ and the internet and prepare the documents yourself. Save the money and spend some time completing the papers. The more familiar you are with the process the easier it will be on the both of you versus relying on a lawyer or document preparation company to tell you the details of what's going on. I checked out the website and unless you spend $800 or $1000 it looks like they do very little to help you do your package.

I speak from experience as I prepared my own K-1 papers (had to return to Canada prior to marriage) and have now prepared my own I-130 package for CR-1. It can be confusing at times, even frustrating, but it can be done!

Good luck! Spend the extra money on the wedding! I know you can do it!!

Technically they can deny you entry to the US... although, I have never heard of this happening.

I entered the US on my K-1 Visa through Buffalo, NY. I drove across the border with my car and belongings. I was asked to go to a building for processing. I was asked a few questions twice at by an agent and was finished and on my way.

Very painless… don't be nervous. :dancing: CONGRATULATIONS!!! :dance:

May I ask, by "contacting" did you mean phone, email, fax, or in person ? I was leaning towards email as then we can include the "release" permission form, along with a written request and NOA1 doc. Thanks for the good wishes - we can use all the happy thoughts !


Well, I went to each of their web pages to complete the form that they requested and added some supplementary information/summary of our information to ensure that the major case details were consistantly expressed. I then faxed each representative and followed up within a few days. I did receive letters from 2 of the 3.

I hope they had a hand in helping to get my NOA2 faster... If not, it didn't hurt my case at USCIS at all!
