In your case since your divorce is on the process, I would recommend to wait after 5yrs before filing your US citizenship. I believe that filing after 3yrs ONLY applies if you are still legally married with your USC spouse. One of the requirement of filing after being 3yrs is the proof that you still live in one roof and still legally married. If you file after 5yrs, you don't have to submit any proof of relationship with your USC spouse but you are applying on your own which you only have to proof that you have been a legal resident and physically present here, and you meet the requirements to apply for USC.

The requirement is on the ROM form. The ROM application that we have here at California Embassy (Im in Seattle but California is our nearest embassy) doesn't require us to submit any pictures and fill-up a form as to why we didn't report our marriage within a year. I guess it depends on what state you file it from.

They only asked us to submit the following:

Marriage certificate
Photo ID(State ID, driver license etc.)
Birth certificate
$25 processing fee

It's only gonna take one day to do the report of marriage process. I was able to ammend my passport at the same day! I would suggest you ROM that day then apply for passport that day also. YOu won't get your passport the same day. They have to mail it to you and it will take atleast a few weeks or even months. Once you report your marriage that the same day, I believe that they'd be able to adjust your lastname on your passport too!



And YES, they will give you a copy of your ROM application but they will tell you that it should be available at the Philippine census after 6months.

btw, if we don't do the ROM what should I click on status, husband name? I'd like to write my husband info but I don't know if its going to make any confusion?

Hi Psalm...actually, they DID update the instructions. Look under the October 2008 new instructions under the heading "Execution of Affidavit" on the first page, first column. The new instructions are actually extremely clear. No notarization required because the form is signed under penalty of perjury. They changed the instructions to reflect the new form. Good luck!

hello, sorry to hear that error.

in philippines, middle name is the mother maiden name, if that person has two name like ur fiancee, she should put all that two names as first name, middlename is (mother maiden name), last name(father lastname), i think ur fiancee knew that? and it is found in the birth certificate, unless if there is error of her birth cert? am pretty sure that she knew what to put in middle name, maybe that time when she filled-up the form she was just excited :-). anyway, maybe it was honest mistake? hehehe

i pray that u will settle it when u fly to PI before her interview, am sure, the embassy will ask u affidavit of that errror or legal affidavit....

Has anyone noticed that the New I-134 Affidavit of Support form has changed (from the older one, especially the one I already had filled out) and nowhere is there to have it notarized? I am one of those examples who got married in the US, filed the Adjustment of Status (greencard) right away along with advance parole letter. It takes at most about 2 months to get this advance parole approved. So if you decide to do K1, you should consider this waiting part too, if you will be willing to wait for two months before you two will eventually be able to return to UK for family visit and quick non legal wed ceremony to fullfil your family's wishes.

But i really hope u will follow ur case to your senator/congressman. i would not let it happen that they made ur fiancee confess that u were married in spite the fact u were not legally married. she was intimidated and given no choice, i can see that. pls fight for that. But if filing k3 seems to be ur best option, then go for it.

My fiance also called yesterday and was told that CSC didn't have the case and that it had been sent to the NVC. Called NVC today and they haven't got it yet. Is it possible that my case will be in the record by Tuesday the 29th?
I didn't want to be too happy since I was afraid the CSC officer made a mistake, I just hope that information given was accurate.

Did she overstay at one of her visits? As far as I know one can only enter for max 6 months under B1/B2 visa. If she violated that term, she probably would find a problem with the K3 approval. Since I am not really sure of what you said pls help explain, thanks smile.gif

And he Told me What Are the Only Appropriate Vaccine I Can Have For Now!!! Well, well, well....I guess it took this post to get a result! Can you believe it, the NVC has finally received the file from USCIS...78 days after it was approved! Better way late than never, I suppose. Now for the rest of the journey....RexT

Well just because you finally get that NOA2 and it is approved doesn't mean anything is right around the corner. I got our approval Dec 22, last year and the NVC still hasn't received it. How's that for bureaucratic swiftness, eh? Seventy eight days....could have been walked to the NVC by now. Oh well....RexT

I would not think that it would cause a delay with the mail...having said that, I sure am hoping it is all back to normal by the end of the month. I have a flight to BKK on the 29th and sure hope I can get there. I have had this ticket purchased since last May! I am still waiting on our NOA2 and the time line indicates a mid-December comb through. I have my fingers crossed. It would be great to be able to go to the interview with her, but I doubt if it goes that fast even if it is looked at in a couple of weeks. Good luck. Rex

National Visa Center (Dept of State)Time line from USCIS to NVC
I received our NOA2 back on Dec 22. I went to Thailand for a month to see my SO and was looking forward to seeing at what stage everything was in upon my return. When I called the number to NVC and went through all the automation, I got an answer of the NVC not having any record of our paperwork! It has been 39 days as of today, Jan 30, 2009. Even snail mail doesn't go this slow. I am wondering if it got lost or misplaced or what???? Anyone had this problem and is there anyway I can find out more about it? Thanks....RexT
