A Congressman/ Senator COULD help if the problem was different, HOWEVER, the OP clearly stated all he sent was an I-129f form and a check.

Not being rude, but he did not follow the instructions and no Congressional help is going to fix that.

MJ, I am sorry this happened to you, but maybe you could try the following: When we filed, I printed the instructions for filing from USCIS site so I would have it in front of me to make notes on it, and mark off what was done. I went step by step and did what the instructions said. When I got to a part that was N/A for me, I took a black marker and scratched that section out. It helped me to stay focused. I then printed the instructions from this site (as well as examples of the Letters etc) and cross referenced what I had done according to the USCIS site.

USCIS will not send and RFE for that much missing stuff. It is the government. They don't have to by nice. If that much stuff if missing they will just deny you and you will have to re-file. I am so sorry they waited so long to let you know.

If the reason for your denial is that you did not send the correct items, it is a timely but do-able fix. I wish you luck and hope it all works out for you.

My fiance is from Ireland. You do not need the skype stuff for the initial petition. You need to send proof of meeting in person AND if you have visited each other several times, that IS your proof of an ongoing relationship... continued trips to see each other (with photo proof) are much more convincing than some skype chats etc.....

We sent copies of all of our passport stamps and boarding passes labeled, with photos of us together from each trip, many of them in front of well known places.

19 months ago????? You are way way over the normal time frame. You should have called after 60 days. They are supposed to respond to you after 60 days. Did you miss something in the mail? Did you check your case status on the USCIS site? You need to place a service request.

I sent my response to the RFE in on Friday July 13th(crossing my fingers it wouldn't be bad luck) and it was rec'd on Monday July 16th. On Thursday July 19th I got the email that our application had been approved!! Yipeeee...now on to interview. Anyone who has been through this know how long it takes to get to interview?

Congrats to you! That is great. Go CSC, I hope VSC is as kind to me. Do you mind me asking what your RFE was for? You would be best informed to go to Portals and look up the info for your Country there. My fiance is from Ireland and they tend to get an interview on the quicker side. At 5 months and almost 3 weeks we got our RFE. Lucky for us, it is a quick fix. I sent my "long form" birth cert. from the hospital and they wanted either my state cert or all of my passport. Hindsight is 20/20. I should have sent all from the start, but thought it was overkill. I was born in Pennsylvania. Each state is different, the state birth cert is a tiny half piece of paper and I did not think it was enough info. So to be safe, send all of the pages of your passport.

Here is to hoping for a quick NOA2 after such a stupid mistake. Good luck to all.

This made me laugh.... Friend, I am at 5 months and 3 days... I called yesterday and do you want to know how that goes.... Let me tell you how that goes.... He asked what center I was at. I told him VSC. He said "let me look up your case...." "yes, you are beyond the 5 month goal, however, I have to look up and see what day Vermont is currently saying they are processing" HOLD..... Came back. "Well, VSC is currently processing files from 1/09/12.... so that means you are still within "NORMAL" processing times for that center and all you can do it wait. We will not file a service request unless the center is processing files after 1/24/12" (My NOA1 date).

This is absolutely correct. The timeline on VJ is just an estimate. The only number im worried about is 5 months, and thats from USCIS. So at 5 months and one day ill be calling. Some people get theirs approved faster and some slower. Its very inconsistant

I had a very nice phone call on my cell from the US Embassy Dublin today Aug 7th, they were checking i received my pack3, and if i was ready to send it back. I said i just did!. The lady said excellent see you soon. Was not expecting a call but it was a nice touch! Go Dublin Embassy!!



Yay! At least the Irish end of things runs a little smoother.

Unless something has changed, the US embassy site in Dublin said that the notice of readiness was not embassy specific. This is the one I found: http://photos.state....isa/ds_2001.pdf

The form is a DS2001

But if they send something different in Packet 3, obviously we will use that.

Thanks, I appreciate your suggestions. He currently has limited ties to Ireland as he's been living and working in London for the Olympics. So, he will return to Ireland in August sans job and is trying to find someplace to stay now. It is really an awful situation.

Right now the plan is for him to come mid October, so based on current timelines, we probably won't get our NOA2 until November. I wish we could get a definite answer about how to handle packet 3 if it arrives when he's here.


If the Packet 3 arrives when he is here, you could have a relative or friend fax you guys all of the contents of Packet 3 to you in the states. Look it over and makes sure you understand everything. Go ahead and send the letter of readiness from the states, BUT I would have your fiance sign the bottom in blue ink so they know it is a valid signature. I am not sure how strict they will be. Your other option is to just wait until he goes back to Ireland. You can actually get a copy of the letter of readiness from the US embassy site. I can try to find the link for you if you want. I already printed it for Ray and he has it with him ready to send back. (We had heard that the some people got a packet 3 without the form in there so to be safe we printed one)

I agree with Neetz, Your fiance will have to be a little more prepared when going through the POE if you already have your NOA2. Ray visited here in April when we were still at NOA1 stage. They asked him a lot of questions... They were nice about it, but they wanted to know if he had a job, return ticket etc... it went smoothly over all, but I would just be sure your fiance still has ties to Ireland if you are at the NOA2 stage when he visits.

Ray already did his medical too... We are not too worried about it, but maybe should have waited a bit. We never dreamed it would take this long. They were flying through those December petitions... Now with us getting the RFE, I am scared we wont be able to get married in October. Do you have any idea on average how long it takes from NOA2 to interview? I assumed once you got your packet 3 and sent your notice of readiness back, they would schedule you within the next month.

That timeline is just an estimate provided by this site. It is not from USCIS and is just an "educated guess" for lack of better word. USCIS CAN take up to 60 days to respond to an RFE. If approved, most cases then go to NVC, but it may be different for Canada. From NVC they go to the embassy. I would suggest checking out the Canada Portal for better info on that. Good luck. We got an RFE too and are still waiting....

Several years ago I was in a relationship with a man who was moved to Italy for his government job. He asked me to move there with him. I agreed and placed my house for sale, gave away my pets, sold much of my stuff... We loved each other and I thought had good intentions.

I visited him shortly before my move and things were BAD! This was a man I knew for years and loved dearly. He was unsure about the move and was not being honest with me. I found out from one of his friends that he was having reservations! He did not want to "lose" me but was not sure he wanted me there in Italy. I was so mad at first, I gave up so much for him already. BUT.... I had agreed to do it. That is life, you have to take chances some times. Some work out some don't.

My point is, your fiance did give up a lot to come be with you. But I would hope that was a conversation you both had and came to that decision. Life is life and bad things happen. However, if you had second thoughts, it should have been communicated to him prior to him coming. Jitters are one thing, being unsure of a life together is another.

The most unfortunate part is your case, and many others like yours, is that, it makes the process so much harder for the rest of us who have no second thoughts, have found the right person and just want to be together.

I hope for your karma sake and his, you both did not intent to scam the system. As for me, if it had not been for my previously mentioned relationship I would not know my now fiance. Karma is good to those who are good... Good luck in life.

Start getting your stuff ready for after the NOA2. I am 4 months after NOA1 tomorrow! We all feel your pain. The first month was horrible, then we were ok for months 2 and 3, we knew we just had to wait. But now that it has hit month 4.....Posted Image We are going crazy..... I am a January filer, and recently the approvals have SLOWED.... I found myself stalking this site looking at Igor's list to see if any other January people were approved. DO NOT do that to yourself. Chill out and think of your wonderful future. Chat with some cool peeps on here, it helps to have a thread for your filing month, I love my fellow January filers (we have a thread we keep each other motivated with) AND, if you find yourself fighting more with your fiance or only talking about visa visa visa, I would recommend saying, I love you, but lets cut this call short and refocus our energy for tomorrow night. It helped us to stop focusing on the negative and look toward the positive. One day this will all seem like no big deal...

well I got a case number in just 12 days, others got theirs in under 10 just last week... I don't see a huge slow down there! After almost 6,5 months waiting 10-20 days is nothing :)

Hang in there people and support each other as much as you can! we have one person in our January family who passed 200 days mark yesterday and we are all rooting for her and others still waiting... we have been there so we know it's tough but once you get your NOA2 in a few days you will feel so much better, I promise! :) Good luck!



Thanks for the back-up Sabi! I think 10-12 days is pretty darn fast for NVC. I'll take it over the 195 I've already waited. In fairness, i think they were backed up over a month ago, but I think things seem to be back on track for them.

Maybe I am coming from a very different relationship, but am I the only person who thinks it is a problem if you have to question if he has even filed? And you can't have a conversation about it without inducing anger? This is marriage we are talking about here! If you have doubts about this phase, what doubts will enter your relationship when it comes to moving? Money? and the countless other things that come up in marriage?

If he really has filed correctly he would have needed signed documents from you. He should have sent the packet and the money to Texas NOT California. If his intentions are good and he is just confused and frustrated, maybe you could suggest he join this site and read read read the info so that he can file correctly and you can begin your lives together.

Trust me, my good friend got an RFE for divorce papers and has been waiting another additional 2 months on top of the 5-6 she already waited! This isn't Vegas, don't gamble with your immigration.
