Okay, so I checked my bank account today and I see that the USCIS cashed my check. So I have a couple of questions now:

First, I was expecting them to forward my petition to the lockbox, but they only received my petition last Friday and already they've cashed my check. Plus, on back of the check, it is stamped "Vermont Service Center" Does this mean my case was not/will not be forwarded to the lockbox? That should save me the 6 to 8 week delay that was mentioned in another thread if so!

Second question: Which of the numbers on the back of the check is my case number? I see no numbers that start with any letters.

I-129F petitions for alien fiances are only processed at Vermont Service Center or California Service Center. They are not forwarded to any lockbox. It will stay at Vermont until it is approved.

Your receipt number that you can use to check your case status on the USCIS website should start with EAC.

It's not merely a technicality. The K1 IS a non-immigrant visa. If a K1 was an immigrant visa then they wouldn't need to adjust status after coming to the US. They would be permanent residents on arrival, like IR class visas.



What I wanted to know was whether the specific language "immigrant" was the key factor or if, perhaps additionally, the temporary stamp a K-1 might get is not actually an "I-551 stamp" but something different altogether. Don't K-1s who have an AOS interview get a stamp then that authorizes them to work while they wait for green card production (if they haven't already gotten an EAD)? Are these two stamps different things? Does a CR-1 or IR-1 get a different stamp to a K-1? Having never seen one, I'm curious.

I understand the difference between an immigrant and a non-immigrant visa. It's quite fair to use the word "technically" though, since no one comes on a K-1 WITHOUT the intent to immigrate. Anyone entering with one IS an intending immigrant, whether the visa classifies them as such or not.

Anyway I also wanted to know the actual regulations regarding K-1 work authorization, which I have since found: http://law.justia.co...2.54.2.1.1.html.

So I take it the stamp sometimes given at JFK is not considered equivalent to "an employment authorization document issued by the Service".

Should clear away any confusion on 'when you can work'.

To be clear - must have SSN and either EAD or GC, when coming in as K-1 visa holder.
Which also implies must file for AOS first, to get any EAD or GC.


On the I-9 List of Acceptable Documents, under "Documents that establish both identity and employment authorization" it has "3. Foreign passport that contains a temporary I-551 stamp or a temporary I-551 printed notation on a machine-readable immigrant visa."

Is it the "immigrant visa" bit that makes this insufficient for a K-1? Because it's technically a non-immigrant visa?

Congrats then! Now you can wait a week or two, then call NVC to get your DOS case number and check when it gets sent to the embassy. (You'll have to talk to a live person).

Every time I've called they regurgitated the exact same verbiage as the website.


The OP is further along in the visa journey than you are. They have already received approval for their petition. Your petition is still at USCIS, while the OP's case has moved on to the NVC.

For you, calling USCIS is just going to be an exercise in frustration and waste of time. The call center workers do not handle any cases and there's nothing they can tell you. They can't go look up your paper file and check it, so essentially, they have no more useful info than you. You'll just have to wait it out until you get an email or letter that your petition has been approved.

Based on filing a K-1 then pulling it midways through processing. Conveniently getting a tourist visa and then getting married. One minute not wanting to marry then back to wanting to marry. Wanting to move money around just so the petitioners income looks good. It all looks suspicious. I am not basing it on this thread but on all the threads that have been posted. Maybe it's just me but if I were the one handling this case, I would be very skeptical if they did all of this and prior to applying. That's just me. I just think it might be best to wait the 5 or so months for the K-1. I don't profess to know much about this but working with legal documents as part of my career, I tend to be very suspect of potential fraudulent info.


If you work with legal documents you should know that details are important.

SuicideBlonde (not the OP, but the OP's fiance) said they planned to get married, have the foreign spouse go back to Europe, and then apply for the K3. That indicates no intent to AOS immediately after the marriage.

Additionally, propagating incorrect information, whatever the context, is a bad idea. It's not illegal or fraud to enter as a visitor and get married. Period. It's only illegal to enter with immigrant intent on a non-immigrant visa, and apply for AOS. People should be corrected when they give incorrect information so that it doesn't result in misinformation being passed around. The threads here are not only for the benefit of the OP, but for all readers, who may be in different situations.

I was born in the US, but have lived overseas at times...I still put my birth date as the start of my time in the US, meaning I had been in the US for my entire life.


Thanks folks, this make sense. Of course the form doesn't ask when you became a citizen or permanent resident, it asks "have resided in the USA since"... Just another example of a simple, clear, self-explanatory government form...

I have mixed feelings about some of the answers I see here concerning the Moneygram issue. In my packet I just submitted a few days ago to the USCIS I included only 2 receipts with my paperwork where I sent a little money to my fiance. Not too long after I came back home from Pakistan I sent him $100 because I knew when he got paid and he had spent every bit of his money on our vacation together. I know he doesn't make as much money right now as I do & I wanted to give him a little something to tide him over until his payday. I have only sent him money 2 times but now everyone has made me nervous about it. My fiancee felt really bad because I sent him some and he says he should be sending me money. I maybe understand how the USCIS might view sending money but unless it was large amounts (like $800 or $1000) I don't see any harm.

Hey Faisal, I keep reading about AP (Administrative Processing) and it seems they are pretty strict with it. I think they are justing checking out everyone really good to make sure nothing is being hidden and someone isn't trying to scam to get into the country for wrong reasons or to do something bad. AP is HORRIBLE and just torture sad.gif but hopefully it will be over soon. It seems after the interview there is no set timeframe for giving the visa as its just a matter of getting thru security. Also do you mind telling me what did you send to ISL for packet 3 before getting your interview?? My fiance wants to send the DS-230 (part I), DS-156, DS-156K and the I-134 documents from me along with all supporting documents, police certificate and ORIGINAL birth certificate. I'm nervouse about him sending original birth cert. as they could misplace it. I thought maybe he could send a copy and a note saying that he will bring original to interview. What you think??? I can completely understand your worry as I am in the same place as you. Me & my fiance have filed for the K1 visa and his interview is in 15 days. If you want to do everything correctly you have to follow the immigration laws to ensure a permanent stay. We even had the congressman try to get it expedited based on pregnancy and they said it was not a reason to hurry the process through above others that are waiting. Sorry...

Q: Why worry about a pre-nup?
A: Love is blinding and look at the divorce rate in the US and I can assume by all the "help me she/he only married for the green card" questions in the forum that the divorce rate may be a little hire for mixed culture/race marriages.

On a more factual note though... the pre-nup is situational based on each individual. Don't let "love" fool you into not getting one. My case for example: I have been working since 15 years old, done almost 20 years active duty in the military. I purchased a home before my first marriage. I had a pre-nup. I got married a second time and had a pre-nup. Got divorced a second time. I started with a 15 year mortgage at about year 10 in the military and paid extra payments and it is already 100% owned by me. So a pre-nup ensured that the house stayed with me through 2 marriages. I guarantee I will not marry a third time without a pre-nup.

In Virginia, even though the house is in my name alone, if there was no pre-nup she would have been able to force the sale of the house and get at least half the profit -- or the judge may have even awarded her possession of the house and left me with the mortgage.

So a pre-nup just helps ensure that what you came into the marriage with you leave with. Anything gained or earned during the marriage should be a 50/50 split--unless otherwise agreed. Pre-nup or not you are still responsible for your beneficiary to NOT become a public charge.

Received the NOA1 and it states to review the info and contact the 1-800 # if any info was wrong. Well of course they had the spelling on her name wrong (ok so it was really me--spelled it everywhere on photos and biographic information for correctly--just not on the I-129F).

Did call the number and was of course dreading the wait on hold. Wow it was only 3 or 4 minutes. The lady took the case number and asked some silly questions, some twice, just to tell them there was a typo in the last name--on the NOA1 and the I-129F. She was not at the Vermont Service Center but someplace else. It was quick and painless--and a few days latter received an email that typo was noted and no further info was needed and no receipt of change would be sent, other than the email.

So hopefully, avoided an RFE coming in the mail.

I use calling cards to phone the Philippines. I plan on keeping one of each type of phone card I use. I then print my cell phone bill and highlight the 1-800 access number on my bill. That way there will be a corresponding call to the Philippines.

So hopefully the bills combined with a phone card with matching numbers that I am making calls to her--hopefully that will work for their needs.

Call the number on the NOA1 when you receive it with the case number (1-800-375-5283). Tell them what you forgot to put in the package and are mailing it off. Do a cover letter with the fiance's letter (hopefully she sent you two originals or more) if not send it in and have her send you another one. Send it in with a copy of the NOA1.

I spelled her last name on the application and called the number (got through fairly quickly whole call less than 15 minutes). Took care of everything on the phone told me what to mail in and received an email few days later saying info received, package corrected, and no further action to correct was needed. So thinking I prevented RFE. And if it doesn't catch up to your package -- well then at least you tried.

There is some good advice on here for you; I would be cautious and step outside yourself and listen or read your story. Your stated that he didn't want you to leave... you went there and went through the whole process. 5 visits between you over 18 months (some get married after 1 visit--not that there is any right or wrong # of visits). The point is everyone that has been through the visa process, regardless of what type of visa, knows it is alot of work and can be stressful in itself--not to mention takes a while to get approvals.

You guys went through this process together and for him to 'find out' that he is not ready when you gave up your life in your home country to join him--is pretty much proof that he is 'not ready'. I am sure it was hard and took a lot of guts for him to tell you that and send you home--if not then he is just immature and thats more proof he isn't ready. It is commendable to both of you that you returned to your home country instead of becoming an illegal.

But you are starting life all over again. If he is truly in love with you and is truly ready for a lifelong commitment that is expected from marriage... then he should have no problem giving up his life here in the US and moving to Australia to be with you. Until then I would just continue to re-build your life there and/or at least make him come there and marry you then apply for K-3 visa--that way you know for sure he is ready.

My fiance recieved a letter stating she could schedule an interview on 7/26/10, she couldn't seem to make a connection so I called from here and got an interview for 8/27/10, which doesn't give us alot of time to prep but I thought we could get it done.

Anyway, my question is they said she'd be emailed a letter confirming her interview but she hasn't recieved it yet, will it be mailed through regular post or should I call back and ask them to resend it?

Secondary is where they dont let you across the border right away. it's also where you will ultimately go to activate your visa. Its a separate building next to where you cross and speak to the border guards.

The first two times i was refused i was photographed, fingerprinted etc. So on the third try to cross the border i was prepared to automatically go to secondary. Like you said NIk&Heather, being mentally prepared for that helps immensely.

I had everything organized paperwork wise and was handing it to the CBP officer inside before he even asked for it. Secondary is rather routine now for me and i'm very used to it lol.

the only thing they asked me ( btw it was in secondary every time) was how long i was staying for and when my interview was. And if my rent was paid for the month and proof of that.


In Mexico they just send you an open appointment letter so we can go any day they are open between 8-10am so we will not be able to give them an exact date, hope this will not be a problem. After the interview he doesn't plan on going back to Mexico so he will not have any "proof of ties" as they call them. I was really hoping use flying in together and showing the NOA2 would replace the possiblity of them asking for proof of ties or a return flight already booked. When he came in on his tourist visa last September the officer just asked the reason for his trip and who he would be staying with and approved him for 6 months stay, which he stayed for 5 months. Can anyone else shares there experiences of their SO coming in after receiving the NOA2 but waiting on the interview?

and to be technical, it's 180 days total in a year. However there has been discussion on when the Year commences and ends for the purpose of visitation.

make sure to bring ties..like does he have an apt or a house he will have to pay rent for. is it a temp leave from his work and will he be going back? any children he will leave behind while he is in usa? Will he have enough money to support himself while he is in the usa?

these are all things they will probably ask. to be on the safe side i waited for my noa2, thus all i had to say was "i'm waiting for my interview date"


We were just approved for our NOA2 I plan to go visit my fiance in Mexico and have him come back with me while we wait to go to his interview. I see you mentioned you did the same and said you are going to wait on your interview, did you have a return flight? Did they ask you any other questions?

Just wanted to share my experience. My fiance came in on his tourist visa in September and stayed about 5 months. We filed for the K1 visa while he was here and got approved about 2 weeks after he left. So sending the paperwork to file for the visa while your SO is here visiting you has no bearing on getting your NOA2 but of course as others mentioned your SO will have to go back to their country for the actual interview and visa approval

I have never done anything like this in my life, so I am totally new at this. I have posted some threads over on the Russia-Ukraine Forum. But they recommended I come here for some additional advice...

My Future wife currently resides in Ukraine (She is amazing!) I am filling out the I-129F Form as well as the G-325A Form.
From what I learned so far, I have to send this I-129F Petition to my closest US NCICS.
My question(s) are:
1. What do I need to include with this form?
2. Does she send one to her local U.S. Embassy in Ukraine?
3. Does the G-325A form go with this first form?

1. Full name and address of employer: Does not all fit in that little box. The name of her company barely fits... What do we do? Do they want the full address? City, Street, # etc.
2. A#. She does not have an "A" Number. She has a tax ID #... (10 digits)

Notify the embassy and tell them you no longer wish to continue with the relationship. This way the visa will get flagged if she should try to use it in order to enter the U.S.

I have read a few cases where the beneficiary got the visa, told the petitioner that he/she changed her mind, then entered the U.S. anyway and stayed with friends/family. They were just looking for an ticket to get to the U.S. and the relationship was the means to that end. Once the visa has been obtained, there is no reason for them to continue with the relationship so they let them down easily and tell them that they've had a change of heart.

Ok, We have all our documents ready.
1. Cover letter
2. Check for $455.
3. I-129F
4. G-325A For both w/ Passport style photo
5. Copy of Birth certificate for me (and passport)
6. Letter of Intent from both
7. Proof of Having Met
8. Proof of ongoing relationship
9. Final decree of divorce from both
Check, checked and triple checked! Then I will check it a few more times.

Now How do I separate all of these documents? Use manila folders? Pocket folders? Send a Dewey decimal system? lol... How did you guys organize it all?
