K-1 Fiance(e) Visa Process & ProceduresI-134 evidence
If he was doing the same work in the past, then tax returns will help show that it is a constant source of income. Letters from both employers, stating his pay and the frequency of his work. Pay stubs or other proof of income, ideally something that shows his year to date income.

K-1 Fiance(e) Visa Process & ProceduresDocumentation for packet 3/interview (London)
Go by the instructions given by the Embassy, not the form.

You get to keep the originals. In the unlikely case that they forget to hand back the originals, remind them :-)

You will complete part 2 of the DS-230 at the interview.

K-1 Fiance(e) Visa Process & ProceduresLetter from GP about asthma for medical
The alternative of course is to go to the medical without the letter, and only get the letter if they request it. Up to you whether any possible delay is worth that.

Sucks that every GP seems to have a different system; mine was happy to just print out my vaccinations.

K-1 Fiance(e) Visa Process & ProceduresCo-sponsor checklist ?

Is there some sort of checklist I can give my co-sponsor on what to fill out and ship me ? Cause I don't know where to start.

The instructions on the I-864 should be pretty clear, so tell your co-sponsor to read them and comply with them. But in general, they will need: proof of US citizenship/permanent residence (eg birth certificate or passport) and tax returns from the last year or three (either tax transcripts alone or tax returns with the accompanying W2s and schedules etc). They can also include the most recent pay stub showing year to date income and a letter from their employer. These latter may not be needed if their tax returns show income substantially above the required level.

K-1 Fiance(e) Visa Process & ProceduresProcessing times in London
You can book your medical as soon as you have your LDN number. So, today :-) Remember you will need to have your police certificate by the time you go to the medical.

Some people have received their interview dates before they have their medicals, it may be that it depends on the visa type. But the important thing is that nowadays they will cancel the interview if you turn up and they haven't received the medical results. (At least, that's what they say.)

I don't think London are as backlogged as some people seem to have said. I would go by the recent statistics. Now, the statistics include people who did not have their medical as soon as they could have, and people who did not send off the next lot of forms as soon as they could have. So, in general, you can expect it to be quicker than the statistics show. Having said that, 56 days represents what I think of as a "normal" timeline: up to a month to receive the interview letter, with the interview up to a month after that. However, they seem to be giving less notice right now.

K-1 Fiance(e) Visa Process & Procedureswhat to do I accidentally sent DS-2001 when I'm not ready for the interview?
Don't fret about it. Most likely you will receive the info from your fiance before they schedule your interview anyway. Have you had your medical yet?

If he's applied for his tax transcript then he should be receiving it soon, so I'm sure you'll have it in time for the interview. If, however, you receive your interview letter and have not received the tax transcript you can either reschedule the interview or attend it with the knowledge that they will probably require you to send them the tax transcript afterwards. Not sure which would be the better course of action.

K-1 Fiance(e) Visa Process & ProceduresHousehold Size
The household size would indeed be 6, with Heather not included.

The poverty guideline is indeed $29,990, however for the I-864 filed with Adjustment of Status you are required to prove 125% of that, ie £37,487, and I was under the impression that the UK generally require that same standard for the I-134. However, I could be wrong.

K-1 Fiance(e) Visa Process & ProceduresI-129F Part.B no.14 fiance's adress in U.S.
The answer to that question does not have to be known. Proof: If we look at the answer given to the equivalent question on the I-130 sample on the London Embassy's website, they have written "not known at this time""to be determined".

You can of course elaborate, for example write Texas and even the name of the town. And if it really bothers you then you can explain in a cover letter why it is not yet known. But the question can only be answered if you know the answer :-)

K-1 Fiance(e) Visa Process & ProceduresArgueing with my fiance about this form
I'm think that it probably doesn't matter. That is, if you check "partially dependent" but actually all children are considered "wholly dependent" then the powers-that-be will just automatically count them as wholly dependent regardless of what you wrote.
I think it's also not really relevant as the I-864 doesn't distinguish between partial and full support, it just counts all children (except in a few exceptional circumstances) and most embassies apply the I-864 standards to the I-134, and ignore anything extra/different. I couldn't say for Argentina specifically though.

K-1 Fiance(e) Visa Process & ProceduresIs the wedding allowed before the completion of process
If you can avoid all talk of it being a wedding/marriage then technically you should be fine. But it's very dicey. I guess there is no reason why USCIS should find out about it anyway. But if you decide to go ahead with this plan then make sure to tell ALL your wedding guests that this it is a religious celebration and NOT a legal wedding and that you are NOT married in the eyes of the law. Kind of an annoying thing to have to say at your wedding, I know, but you don't want too many references to you being husband and wife going around.

You can certainly visit your fiance in the US and stay with him for as long as you are legally allowed, so long as the border official allows you. But remember you are visiting your fiance and not your spouse, and avoid any talk otherwise. I don't know how long the visa process takes in Canada, but hopefully it won't be too long anyway :-)

K-1 Fiance(e) Visa Process & ProceduresCo Sponsor backing out im lost and frustrated
I shouldn't think the sponsorship should be the issue. With a security clearance you are supposed to report if you have close/continued/whatever contact with a foreign national, which your brother-in-law would have to do whether he was sponsoring your fiancee or not. So I wouldn't think the sponsorship thing should make any difference. But who knows with super top-level security clearance. Plus if his boss thinks it's a problem then his boss may well make it a problem, if you see what I mean :-/ I would try to get your brother-in-law to speak to the actual security people before vetoing the idea for good.

K-1 Fiance(e) Visa Process & ProceduresMedical Exam
The Amman embassy website does seem to give the impression that it is the individual physicians you need to use, rather than their place of work. Try posting in the Middle East regional forum. Also, if you update your profile so that your country is Jordan then other members from there will see your posts if they use the portal, so you will be more likely to get useful responses.
Like I said, the embassy website does seem to indicate that the physician is the important thing, however I would like to make sure: maybe someone else from Jordan could tell you they had used a different physician and their medical was accepted by the embassy.

You probably need a Ukrainian specific answer. Some countries don't accept co-sponsors for K1, whereas some treat it exactly like the I-864 and so if the co-sponsor qualifies that's all that matters. So you probably need someone familiar with the Ukraine to tell you if your income is completely irrelevant or if it could be helpful in making the CO happier. Of course, if in doubt, go ahead and get together the new form and send it over :-)

K-1 Fiance(e) Visa Process & ProceduresK1 London Interview
8am or earlier I would say. Maybe read some of the most recent reviews (from the Embassy in general, not just K1) to see at what time the queue is becoming super long nowadays.

Book, drink, that's all fine. Credit cards and the like are all fine so the hotel key card should be fine too.

Personally I got out at lunchtime. It depends on when everyone gets there on the day: it's basically a first come first served deal.

The courier tends to deliver your passport as soon as the Embassy give it to them, so there isn't anyway to get it sooner. I think you can pay extra to get it delivered at a specific time, which might get it to you a couple of hours sooner ;) Not sure how long they are taking to process visa right now, they could process it the next day in which case you'd get it, what 2 or 3 business days after the interviews. Or it could be two weeks.
From what I remember the courier has to be paid by card and nothing else. Someone will correct me if I'm wrong.

You can read the POE reviews on here. It not only varies from airport to airport but also within each airport. Depends what time you arrive, how busy they are, who's on duty that day... So really you should probably allow plenty of time and bring a book in case you get through super quick! It might be that the bulk of your time is waiting in the main immigration line as usual. Your suitcases will just hang out, same as if you've all had to wait in line for ages on a normal trip... Although, I don't know if they would be taken somewhere else if you end up delayed for ages for some reason? I assume they do put cases somewhere eventually?

As for the interview...no need for nerves!!

K-1 Fiance(e) Visa Process & ProceduresWho Should File I-134?
As Inky says, your fiancé will bring it to the interview. If your income is sufficiently high, ie your tax returns all show a higherish income, then you probably don't need to send additional evidence, but otherwise you may want to send a recent pay check and recent bank statement to him nearer the interview date :-)

K-1 Fiance(e) Visa Process & ProceduresAffidavit of Support Questions
When you do Adjustment of Status, whoever submits an I-864 cannot be changed. Your co-sponsor will be considered a sponsor until the immigrant dies, leaves the country, becomes a US citizen, or works for 40 quarters. Assuming your fiance is a regular trustworthy individual, the sponsorship is no burden at all :-)

The I-864 filed with adjustment of status need not be the same as that filed with the K1 visa application. So, for example, if you need a co-sponsor at the K1 stage but are then earning more by the time you do adjustment of status, you can just file the I-864 on your own.

If at the time of the K1 interview the petitioner cannot prove adequate support then indeed you will need a co-sponsor. Not sure exactly what the process is for Canada.

K-1 Fiance(e) Visa Process & ProceduresIncome requirements applying to I-134

I've read that same 100% thing many times. I kinda think London would be okay with 100%. I recall an interview a few months back where they gave back the co-sponsor's I-134 and documents and said they didn't need them. He/she said but my fiance doesn't make enough. Embassy person said, "It's fine."

London doesn't even require an I-134. A sponsor can write their own if they include all the necessary verbiage. And if the beneficiary has enough money they can sponsor themselves without a US sponsor. so they aren't overly strict.

I've read some posts were people interviewing at London were required to meet the 125% level, so I think it would be wise to be prepared for that eventuality, even if the co-sponsor's details are withheld unless requested.
JoannaVFemaleUnited Kingdom2011-07-13 16:47:00
K-1 Fiance(e) Visa Process & ProceduresIncome requirements applying to I-134
It depends on the Embassy. You will be required to meet the 125% level when you file the I-864 when you adjust status, and so some Embassies require that for the K1 too. The I-134 is used for several different things and just because an Embassy uses it for the K1 doesn't mean that the requirements will be the same as when they use the I-134 in other circumstances. I believe (from other posts on this site) that London require 125% for the I-134.

(Remember, the I-134 is just a form that is used in this circumstance because it is convenient. The normal regulations that would apply for when one is using this for any other non-immigrant visa do not necessarily apply for K1, as although technically a non-immigrant visa you are, in practice, an immigrant.)

K-1 Fiance(e) Visa Process & ProceduresInterview date issue
Pretty sure a code is required. I had to change my interview date, and the first time I phoned I wasn't told anything about a code. The second time I phoned (after waiting weeks for a reply) they told me the code, and refused to believe it was possible that someone would have told me to email without one. So I assume that person is still working there

1) Find out if India allows co-sponsors for K1 visas: ask in the regional sub-forum.

2) If India doesn't allow co-sponsors, but you can find a someone willing to sponsor, then you could get married and then file for CR-1 visa, for which you will be able to use a co-sponsor.

3) If you can't find a sponsor, you may have to wait till you are able to sponsor her.
