Welcome!! addy19 Glad you found us.
Hang in there i think your NOA2 is right around the conner. About the RFE you know there is always exception to the rule but i dont think you should be worried about getting one this late. Just stay positive and make sure you have registered for email notifications at the USCIS site. I received my email the same day i got my NOA2 approval.

Come on VSC, keep the ball rolling. kicking.gif

laughing.gif laughing.gif .........

O.k, Here is another joke.
A little boy was in a relative's wedding. As he was going down the
aisle, he would take two steps, stop, and turn to the crowd. While
facing the crowd, he would put his hands up like claws and roar.
So it went, step ROAR step, ROAR, step,, ROAR, all the way down
the aisle. As you can imagine, the crowd was near tears from
laughing so hard by the time he reached the pulpit.

When asked what he was doing, the child sniffed and said, "I was
being the Ring Bear."

Ohh noes - i got laid off from work this week. im so worried that it will affect our app. i do however have some letters of employment i have from earlier that i got for the I-134, but i don't know if i should use them or wait for a new job. im kinda scaired. but im pretty sure i can find new work before Angela makes it to the US. Any one have any advice? should i use the letters of employment i currently have? how will it affect our app or will it even? i know for the AOS its definitely critical that i am employed. whats yalls thoughts.

thanks

-Joshua

I'm so sorry to hear about you job situation Joshua. I think trying to look for a co-sponsor now will be a very good idea. Just incase you get your approval before you are able to find another job. Using your old employment letter will get things a bit too confusing. Unless if you can have your old employer change the dates of your employment to show exactly when you started working there to when you were layed off. Then when you get your new job your can just get a new employment letter and send both of them in. So they can see that you have been working. Hang in there.

Welcome Maria Teresa, great to have you here.

I've also been gathering 'evidence' and all all my other paperwork. I want to be able to submit the check list as soon as I hear from the consulate. I received my police clearance this week, now just awaiting the unabridged birth certificate so Im getting there.
Just to recap what we need for interview:

DS-230
DS-156 - submitted online
DS156K
I-134 + pay stubs, letter of employment, 2008 tax return
Birth certificate
Police clearance
Letter of intent (I wouldnt be here if I didnt want to get married)
Evidence of ongoing relationship

What am I missing?

You pretty much got the most of it. I dont have my binder with me to verify but, I'll just add these:

copy of I-129F package that was sent off
Tax returns or tax transcripts for 2007 & 2006
DS 157 ( male only )
Copy of NOA2 approval letter
Passport photos ( I think )

Lets hope those at VSC gave us all a moment of thought when they were able to spend Valentines with their loved ones this weekend, and that they will get back into full swing on Monday and start churning out those approvals.

Go VSC!!!

Unfortunately we have to wait until Tuesday. Monday is a federal holiday sad.gif

I was thinking the same thing guys, weekend is over VSC should be back to work pushing those approvals. I even checked the uscis site this morning. I just thought to myself oh i love federal holidays...i'm home just chilling don't have to worry about work, slept till 9:00am on a weekday that's a luxury. K-1 Fiance(e) Visa Case Filing and Progress ReportsHow to deal with missing your fiance?
idea9dv.gif Well if use use your imagination you can have fun while waiting for your love to come. I've started going to the gym (good idea Victor&Cory) and rearranging & cleaning everything in the house from top to bottom. I'm painting the bathroom and hanging new pictures around different places (pick out some special ones of you two together to blow up and frame biggrin.gif ). Make room in the closets, drawers, and bathroom for when your honey bunny comes. One thing I do thats fun is I've gotten this blue storage box (my fiance's 'welcome home honey' box wub.gif ) and each payday buy something to go in it for him he will need when he arrives. As the petitioner until they get a job money may be tight on one salary and with the visa journey process; so stocking up on some things if its clearanced or on sale makes sense. I've told my fiance bring only clothes & important things. I've put things in his box stuff like men's facial wash, shower gel & scrubbie (they don't have those in his country; just good ole soap), razors, shave gel, new undies, and 'his' own set of keys to things. My fiance has never seen snow either so he is gonna freeze to death & yep got plenty of thermals, scarves, hats & gloves for him in that box too..LOL. Maybe you can think of something fun for you to do now to pass the time. Soon you'll be together forever and starting a new journey!! heart.gif

Best wishes for a super speedy visa journey!

Did you send it "International Priority" or "Regular" through FedEx? This sounds like priority, given the expected delivery time of 7 days. For this shipment, your expense was worth it, to expedite your Fiance's arrival.

For routine stuff, you may want to consider regular FedEx delivery, which is about 14 days and less than half the price.

All the best.

23rd delivery... They said that was the ECONOMY service! Priority was delivery today the 19th for $120 something. I guess it sounds like that was what others have paid so at least I'm not alone.

I am still reeling blink.gif from paying FEDEX $111.63 to mail my fiance everything he will need for his interview (at some point). It was being shipped from VA to Pakistan and I wonder if anyone else has faced this kind of shipping fee for their documents overseas???. Good lord I wonder if DHL would have charged the same?? unsure.gif Anyway, I sent pics, I-134 plus supporting documents, and proof of relationship (newer signed affidavit of intent, cards, original tickets, copies of I-129 etc.). It was 13x11x2" weighed 3.25 lbs and I mailed it Friday the 16th & he should have it on Friday 23rd. I'm just wanting him to get it so he can get his medical and wait for packet 4 & hopefully get an interview date soon. I'm prepared for AP since it is Pakistan but I'm becoming extremely nervous with all the terrorist activity in his area of Lahore. sad.gif I was so freaked out about him having to go to the police station to get his certificate and the bombings at police stations there in his city around the same time!! OMG he says its a part of paki life but I've never gotten used to it........sooooo scary. I guess it's no different than people going off & shooting each other here but still. wacko.gif I'm gonna be a nervous wreck on his interview day at the embassy. Please pray that all will be safe. I will be forced to cancel my wedding in November of this year. My parents will incur significant financial losses, as well as my family and friends who have already purchased tickets to attend the ceremony and reception.

You had people buy flights already? significant financial losses? There have been so many discussions here advising people to not do what you noted... There are several couples that have waited over a year to get the NOA2... betting on a visa in 7 months or less is like playing the lotto.... not a safe bet when dealing with USCIS. If VSC keeps up at this pace.. you may not get to NVC until sometime in Sept... or later... wacko.gif

I agree... Planning the wedding seven months from filing is really asking for having to reschedule. We did plan the wedding as well, but we allowed nine months, even though the VJ statistics I was looking at back then showed an average time of five months to get the visa for Germans. I didn't know back then how much the service center processing times fluctuate, and how unreliable the statistics therefore are, but I still wanted to play safe and leave more time. So we planned for October... and there was a time in June when I thought we might have to reschedule. Even though I disagree with most VJers who think you absolutely can't plan anything, since I think everyone can calculate their risks and decide to take them or not, and certain consulates are less likely to give you trouble than others, I would never have dared to gamble on the best case scenario. And retrospectively, I wish I had at least forbidden my family to book their flights from Germany early on... That really added to my stress when waiting for NOA2.

Michele R, I would look at the Russian timelines very closely, and see how realistic getting him to the US by November is. If you see it's unrealistic, better adjust your plans now, or you'll go crazy and not enjoy the wedding planning at all. I wish you good luck. You have only waited a bit over three months, and maybe you will get lucky and be one of the first to be approved among April filers. I really hope that happens for you.

Thanks - for the first two months of waiting it seemed realistic. Now, of course, it does not. If there is no word by Aug. 14 all bets are off given the long processing time in Moscow to follow. I have already resigned myself to this. What is funny is that I was basing my estimates on my friends' expereinces with this (I did not start taking full advantage of Igor's list until just recently to see all of the posts about the differences in these two centers). I used to live in Oregon and now understand that the reason they all got their approvals in 3 months was because they were feeding into a different center. Someone asked on the "I,m Outraged" thread how we would all feel if we did not have Igor's list and VJ - my answer was the same. Given the discrepancy between my experience and my friends' experience in Oregon - I would have figured it out. Anywho - I am not setting another date until after we have a visa in hand. At this point, there is also a good chance that I may change jobs and move back to Moscow in the fall - what to do in that situation, God only knows. I will cross that bridge if and when I get to it.

P.S. We actually wanted to plan the whole thing for December to give ourselves a little more breathing room, then the Russian Orthodox Church said no - the last day we could get married before a very long holiday season was the day we went with.

yep, it was indeed wacky - wish I knew then what I know now - just discovered the forums section of this site not too long ago and was basing my estimates on people I knew personally that had much better experiences ... when I read what happened to Mara my stomach hit the floor. I will not set another date until we have the visa in hand... in the meantime I see no reason why there should be such differences in processing times, even if I don't personally benefit from any changes that may come about

It's been 203 days and no answer!!!! We are still waiting, there is no update on nothing, isnt this weird? I can't log in USCIS website to see my case, can something being updated?

FYI - I sent this letter to the USCIA Ombudsman today and have posted it on the "I'm Outraged," February, March, and April VSC threads. I used to work for the fed government and we had an ombudsman - waves of voices made a difference and shook things loose. Feel free to cut and paste if you are interested in taking action.

To Whom It May Concern:

In April of this year I applied for a K1 visa for my finance. Because I am a resident of Virginia I was required to submit my application to the USCIS center in Vermont. Since I have applied for this visa, the processing times at the VSC have slowed dramatically (to over 180 days).

When I contacted the USCIS today, they said that the VSC was processing applications from December 30, 2008 and that my application would not be reviewed until October 22 of this year in the best-case scenario (more than 180 days after I submitted my application). Meanwhile, residents of states that feed into the USCIS servicing center in California are being processed within 66 to 100 days.

I find this inequity unacceptable, given that all applicants pay the same application fee. After having researched this issue, I do not think that it is caused by a difference in the efficiency of VSC employees versus CSC employees, but more likely by a misallocation of workloads vis a vis resources by either the USCIS or its subcontractor Northrop Grumman. Furthermore, I do not understand why processing times are increasing while the volume of applications is decreasing (as your office itself noted in its June 2009 report to Congress).

Unless steps are taken to remedy this inequity immediately, which is unlikely given my conversation with USCIS today, I will be forced to cancel my wedding in November of this year. My parents will incur significant financial losses, as well as my family and friends who have already purchased tickets to attend the ceremony and reception. As I am sure you are aware, these misfortunes pale in comparison to some other people standing in line at the VSC under far worse circumstances, while May and June filers begin to be approved at the CSC.

I realize that my application is currently within the USCIS' “normal” processing time. Nonetheless, today when I called for the first time I was told that my application will be adjudicated around October 22, more than 180 days after my submission. Further, it is not "normal" for residents of one state, like Virginia, to arbitrarily receive such significantly inferior service from the USCIS than residents of California or Oregon. Why isn't the I-129F workload distributed more evenly among these centers and why can't files be sent from one center to another when one center falls significantly behind another?

It is infuriating to see large numbers of people who filed their petitions in May and June being approved by the CSC before all of us who filed our applications in January, February, March, and April at the VSC. While I know that the memebership of the primary tracking site for I129F petitions (VisaJourney) does not comprise the entire pool of I129F applicants, its membership pool does represent a statistically valid number of applicants and it is therefore possible to ascertain broad trends in visa processing extracted from its data. On top of this, USCIS' own bulletins display the existing inequity, albeit on a more publicly digestible magnitude.

Ironically, my fiancé is more peaceful about this issue, noting that the USCIS seems to me no more equitable or effective than its counterpart agency in his largely corrupt country of the former Soviet Union. In fact he advised me to not to send this letter, for fear of the type of retribution one would encounter in his country for voicing concerns about a what seems to be a systemic problem that no one has an interest in or incentive to correct.

As a patriot and former federal government employee, however, I assured my fiancé that things were different in America. I sincerely hope that your office will propose and implement a long term solution to this problem, rather than simply add my letter as a tally mark on a count of "Top Ten Complaints in the Ombudsman E-Mail Box" for inclusion in an annual propaganda piece, like they would in the former Soviet Union. It is hard enough to wait six months plus for adjudication. Adding the knowledge that people in different states are waiting half the time you are for no apparent good reason is like adding salt to an open wound. I hope that future customers do not have to suffer from an inequality that does not seem too complex to solve.

i have asked this question b4 but cant remember the answer if my life depended on it, but I own roofing company so i dont really have a letter from employer, and all i have are my 2008 tax's are my personal and company's 1040... i should be good with that right?

If you are self-employed (own your own company), you need to provide *3* years of tax records. Technically if you are not self-employed you could likely get away with 1 year, but I am not going to chance it. Because it is about proving you can support your fiance/wife, you need to show that. I would suggest providing any evidence of net worth that would help show the ability to support (bank records, property ownership, etc).

Dave

Well here is the thing, i have only been self employed since September 2008, and b4 2008 I did not make enough money to cover the poverty rate, so will i be fine just taking the 2008 taxs or will i need to have a co-sponser

I am afraid that I can't answer....it really is up to the Consular Officer at the embassy. Key thing is how much did you make in 2008? If you made 200% or 300% of the Poverty Level for your family (you, spouse, any dependants), then you probably will be ok. If you just barely meet the requirement (125%) you may need a co-sponsor... In either case present any evidence you have that you can support your fiance...

i reported a little over $20,000 in 2008, so I dont think that is over 200%, im going to try and contact the consulate to see what they say, but just incase i cant get in contact with them what form will the sponsor need to fill out? the I-864?

Contacting the consulate is the best move - they are the ones that make the decision, so their advice is most important! As for co-sponsor form, I am not sure - hopefully someone else here knows.

For the tax documents (other than W2s and 1099s) are you guys sending all the other accompanying docs? Like, worksheets, state tax forms, etc?

Yes, since my taxes are complicated, I am sending ALL schedules and worksheets. I don't think I am sending state taxes, since I don't think they are an issue...

You should be fine with Tax transcripts. The information is for proof of sufficient income, so you probably don't need to send all the schedules (let alone worksheets). Of course, it does not hurt.

I am sending Tax *transcripts* for 2006, 2007, & 2008. You can request these from the IRS - just go to their website. These are official and contain all the pertinent facts from your 1040. And they are free I think. If not free, really cheap, but I don't remember paying anything. They arrived in my mailbox in only a few days, and I did not need to look for the files and make copies...point, click, check the mailbox...

hi everyone,

just a quick question for FEB 09 filers, has anyone received their NOA2 yet. myself and fiance are still waiting and i was just wondering if anyone else was in the same situation.

hope we hear soon, smile.gif

There have been quite a few approvals from the first half of Feb (up to about Feb 12). None from the later half, but they should be starting to come over the next 1-4 weeks... You should not be worrying yet...
