Is there anyone with the 2nd NOA received on March who knows if their case reached London Consulate already?

I got my NOA2 on Feb 24th and don't know if it's at the Embassy yet.

My family emailed me a copy of a letter from the Bureau of Consular Affairs stating that the NVC had sent out my case and it should reach the embassy with in a week. It included both case #s and what looks like a bar code. I don't know if they received the NOA2 or not...I will ask. Any one else get a letter like this?

Just talked to my family and its sounds like they do not have my NOA2 yet...very strange.

Yea, this is the letter (I thought) from NVC - I got it last week sometime. That's kinda weird they haven't got the NOA2 yet, you will need it for AOS.

That is strange - not sure why they are asking for relationship proof now, but it's good that you have everything saved! Hope it goes smooth for you and kicking.gif for now being able to check case status online. Of course, don't depend on it too much because mine still says "Case received and pending" and my NOA2 was issued 18 days ago!

I have maybe 3 photos they havent seen.. we added them but along with the old ones we also sended last time.
I'm better now though, but it took some time to get used to the thought, was surprised of my own reaction just cuz of a RFE :s

Anyways we will try to provide the same things again but add a bit more if we can..

thanks all for your help!! really appreciate it!!

i'm sorry to hear about the RFE shanira but i know things would be better don't worry...just try to provide more photos and other documents

Sorry to hear about the RFE. I know you've been waiting a long time already, but at least they have looked at it.

Anyone out there seen anything that indicates that it would hurt thier case to send the stuff they have from Dec? I don't see how it could, but I'm not a government bean counter.

Well if they need more proof that they met the requirements of meeting within the 2 year period before sending the original packet, then it would have to be pictures from a visit prior to their NOA1 date. Now the other stuff will definitely help them come interview time to show proof of an ongoing relationship.

I'm sure you will be fine, Shanira. Did you already send the stuff back out? It sounded like it on one of your comments - if so, way to go! If not, I'm sure you will get it out in the next couple of days. Did they need him to have a new passport already or just to apply for a new one?

So my fiance just received a letter from USCIS..
It was a RFE sad.gif
He have to get a new passport, because he got his old one before he was 18, so it wasnt valid for 5 years..

And we need to include more proof that we met, i just dont get it , we included pictures, tickets and everything..
oh well sad.gif

im just unlucky, first 2 lost petitions, i cant track my case and now this sad.gif

Hmm, funny they didn't send you an email. Well the passport is pretty simple, although it may take a couple weeks turnaround. As far as the proof, make sure you send boarding passes not just tickets, more pics (maybe some with family, friends), copies of his passport stamps, you can even include a notarized affidavit from someone you hung out with together stating that you two definitely met, they were with you, etc. I have seen where some people receive RFEs for something they included to begin with but were asked to send again. One of those funny USCIS things, I guess. Get on getting that stuff to send right on back!!!!! And at least you know they are looking at your case now and that it wasn't lost...AGAIN!!!! good.gif

Absolutely! Let's see another 65+ week and get October completely cleared out, and keep chunking away at November!

Anne, I used to never get mine done because I couldn't afford $70+ but since I've found her I usually go light in the summer, darker in the winter. I've put 2 colors in it foiled and only paid $65. She also cuts my mom's hair, my grandma's hair, and a bunch of others' that are friends of the family. I have recommended her to a lot of people! It's one of those shops where she knows everybody - I call to make an appointment and she starts asking about school, about Josue, my mom, etc. She has an amazing memory! If you're ever in the Lynchburg area drop me a line LOL!

By the way, the POE of entry for us will most likely be Atlanta - heard anything about their "level of harassment" there? I imagine it really depends on who you talk to and what side of the bed they woke up on, right?

Everybody have a great Monday!!! With setting these clocks ahead today, it's already 10:30 crying.gif I need more weekend!

You must include ALL applicable schedules for your tax returns to be considered complete. If all you had were 1040 and W-2's, so be it, but if there are any other forms you sent in, they should be included as well (otherwise it would not be a complete tax return).

Thanks again! It seems like a lot of paperwork. I am looking forward to being done with this process.

Speaking of paperwork, I was looking over the AOS package requirements the other day..... ranting33va.gif more forms
and photocopies...bla bla bla crying.gif I guess the process wont really end until Naturalization smile.gif

That's true! Because if you don't become a citizen you have to get your green card renewed every 10 years...my grandmother still does this (she came from Germany 50 years ago and Germany doesn't allow dual citizenship, so she just kept the green card status) and last time renewal came up she had to go to the USCIS local office (local for her being a 3 hour drive) 3 times because her fingers no longer make good prints. She was just telling me yesterday how not nice they are and how they hold it over you that they have this power...
Guatemala doesn't allow dual citizenship either from what I understand, but it would be the only possible way to get his parents over here, so we might go on to naturalization.

I know what you mean, "the hair high" you get after you have been to the salon! star_smile.gif

I think I needed some colours put in too, but I'll save that for another day. The salon's are so expensive where I live.

I've found a great lady near where I am who cuts and gives me highlights for $36 wow.gif right? I met Josue as a blonde (well with blonde highlights) and got them taken out for winter, but maybe it's time to get them back in. Something about the summer makes me want to go lighter!!!

Hmmm, well the only thing they asked for is 1040 and W-2s, I find it weird that they didn't say "and any other forms" or whatever. I wonder if it's because they only care about your income...because other than my W-2, I only had student interest paid and bank interest earned (maybe $20). I'm scared to just substitute the tax transcripts, though, what if they don't accept them????
CacerezFemaleGuatemala2009-03-08 17:47:00
K-1 Fiance(e) Visa Case Filing and Progress ReportsOctober 08 K1 Filers
Well since all it says on mine is 1040 & W-2 for 2 years that's what I'm going to send, for 07 and 08. It works out fine because like I said in 06 I didn't meet the minimum. That with the letter from my employer is pretty much all I'll put in there because I make more than the min required, so I won't have to mess with bank statements, savings, etc. I think I'll just not worry about the transcripts since they specifically ask for 1040 & W-2. If you do need the transcripts, they're super easy to get:

Hi Everyone,

Just received our NOA2 hard-copy yesterday and it seems like our petition was sent directly to the consulate in Trinidad. Below is a partial quote from the letter.....

" The above petition has been approved, and forwarded to your consulate. Please contact the consulate with any questions about visa issuance, or if you would now like them to forward the petition to a different consulate."

Nowhere is there any mention of the National Visa Center within the letter. I've seen samples of the NOA2 on this site and they do specifically reference the NVC. Has anyone else received a similar NOA2? Maybe I missed it, but I can't remember seeing anyone else on VJ reporting this type of response in the NOA2.

Thanks.

Edit: After I looked at my NOA2, it says the same thing, that it has been forwarded to the consulate, but I know that it did go through NVC first. You still have to call NVC to see if it's been forwarded and you will still get a letter from NVC maybe next week sometime saying that it has been forwarded to the consulate.

Thanks DavChels. I'll call NVC and check.

Anytime! And congrats on your approval, by the way!

Got a question about the I-134...I got copies from the IRS of my tax transcripts for 2006, 07, and 08. Only in 07, 08 did I meet the minimum requirements, and I still do at the same job. Do you think I should just leave 06 transcripts out? I've seen recomendations for 3 years, but what the embassy sent us was this:

2. Impuestos Federales (Formularios 1040 y W-2) Fotocopias de los impuestos federales pagados por su prometido(a) en los últimos dos años.

which says Federal Taxes (Forms 1040 & W-2) Photocopies of paid federal taxes by your fiance in the last 2 years.

Do you think I should even use the tax transcripts or just literally photocopy my 1040 and W-2 for 2007 and 2008???

After writing all this out, I feel like it's a dumb question with an obvious answer: forget the tax transcripts, just copy your 1040 & W-2 from 07 and 08, but opinions are welcome! (where's the smiley for pulling your hair out?!?!?)

Thanks for the info.

I called back tonight and she said that our case was just put in today, and I should call back next friday to see if it has been sent yet. Then she gave me the LND #. I asked her about the case number and she said london would give him all of that. I was hoping for the case number so he could go ahead and get his medical appointment. I heard it would take at least 30 days to get his appointment. Has anyone else got their appointment yet? And if so how long was the wait? wacko.gif

You may want to call back before next friday. NVC also told me to wait 1-2 weeks to call back but I called back
and 2 days later the case had been sent good.gif
I am not sure what the average is for medical appointments in London. I know that there is a United Kingdom
Interview Thread on VJ that Laura started.
We were lucky-our wait was quite short for the medical but there does not seem to be many Swedes coming
to the US. In fact the Doctor told my fiance that he performed very few visa medicals.

On fev.24.09 we got the RFE. On fev.28.09 we Sent back to VSC the RFE.On March.03.09 they received the doc.and contact us by e-mail.Since March 03.09 our case got touch MARCH, 03,04,05,06.So I'm so excited ,nervous,and.............yous know all rigth....I don't know what this means....

I saw that...I wonder when they will fix it? I called NVC today and they received my case on the 3rd of March! That was so fast. They gave me my new case number and told me to call next Mon or Tues to check the status. The women said they usually only have it a week. I am so excited about how fast this seems to be happening. I emailed the embassy here earlier this week and she replied in 30 mins and she was very nice. I looked into Spirit airlines and we may fly to FLL and then get a Delta flight to Boston. How are you doing? How's Josue?

Spirit is still going to be the cheapest for us, but I would really like him to come back with me via Delta so we'll see. The other day it was almost $800, when I checked yesterday it was down to $400 something, and I have some miles I can cash in for a couple hundred off since I don't have enough for a whole ticket yet. Of course we won't buy it until we have the visa in hand. We're doing good, just counting down! I leave in 5 weeks to go down and be with him and his family for a week before he (hopefully!) comes back with me!!!!!

The NVC number will tell you if it has arrived to and left from NVC yet. They will give you a new case # starting with LND (if I remember reading correctly - mine started with GTM as it went to Guatemala City). When they tell you the date it has left, you can track it using the info I copied that's at the bottom of page 87 of this October forum. Then you can start contacting the London embassy to find out info for packet 3 (or 4 if London doesn't issue a packet 3). For Guatemala you have to have your interview letter in hand to take to the medical, so double check the rules for UK before you schedule your medical. Check out the Embassy Info at the top for UK if you haven't already, lots of good information specific to the country!

Josue D. C****

It worked! good.gif I don't know who made the final decision, because the first email we got that said May or June was in Spanish, but the reply to this one that gave us the date of 4/13 8am and attached packet 4 was in English. Someone who had gone through Guatemala last year said the ones at the front from Guatemala tend to be not as nice as the Americans who actually do the interview lol!

I haven't heard anything yet. We haven't contacted NVC but I'm probably just going to wait until packet 3 turns up on my doorstep. I am going to delay sending it back anyway as I have a trip to the US in April. Because we are having a few issues we aren't rushing anything.

While you are waiting for the Approval it feels like us against the world. Once you have progress something changes. Balvino and I feel it. He is away for a few days which I think is a good thing. This is hard and I think it will be harder once we are in the states but we love each other. Good Luck.

It'll change back once you get the packet and the interview date. Then it's "get your tail moving to get these papers done, that medical scheduled, those pictures taken, etc!!"

Anyone had luck with taking their own passport style pictures? I'm thinking about taking them of him once I get down there since we have a couple days before the interview.

Apart from the rage boiling within (lol) I get the same thing sometimes with my fiance. He's complaining about going to get the medical (he hates needles) and I'm like "Are you freakin' kidding me!?!?!?!" because this is such a process and that is going to take all of, what, one hour??? My rage usually just turns out in annoyance. But I do feel bad for him because he lives 3 hours from the capital by bus (and I don't mean a nice greyhound, I mean a retired school bus) and he has to go there to do all of this, and a lot of it he can't do just in one trip. He is going to come get me when I arrive on April 9th, and we can't even take advantage of that time to do much of anything b/c it is a holiday in Guatemala. It is possible he may be able to do the medical that day, but it depends on when they set our interview date. The approved doctors, the bank where he has to go to pay the $131 ahead of time, of course the interview, everything is in the capital. And of course they don't issue the visa the same day, they make you come back at 3pm the next day to pick it up, grrrr. So he's looking at a possible 4-5 trips to the capital, including picking me up and dropping me off, in the next couple of months. But OH WELL it's about time he does some of this work, right? LOL!!! Yeah, I guess after giving birth to 2 babies you know real pain right?!? Pana is so beautiful and I am sooo happy that we will have such a gorgeous place to visit, but it is a hassle getting to the capital each time! Thanks! Chels, I wanted to ask you which number you used to contact NVC. There appear to be two or three numbers floating around this sit; one with 603 area code and the other (might) have been 201 area code.

I figure I could give a call late tonight or early tomorrow morning to see if it's arrived since Friday.

I feel for my fiancée as I have been pushing her to get everything ready for Packet 3. Having studied the guides, living and breathing this for months now, I am very familiar with it all. She has not studied it at all beyond what I've told her, so she just does whatever I tell her. On occasion she forgets the process for a step or neglects to do it and I feel the rage boiling up from within. Usually a half-second breather is enough, but boy do I have a latent aggressive streak in me!

I feel confident we can have it all ready to send in within the next three weeks.

I called 603-334-0700 which is the number on the description of the NVC Forum (before you even click to enter) here on VJ, it was 5pm on a Friday and I had to wait maybe 3 minutes then got connected to this fairly nice guy named Clark. Make sure you have your EAC# and your birthdate and your fiance's.

When we filled out our I129 application form, I was in the US and gave the USCIS my address in the US. Now I noticed that I did not provide the USCIS with my address in Brazil. Do you know if I should notify the USCIS of my address in Brazil? I know that they are first going to contact my fiance to let us know of the second NOA and I am wondering if at that time he can give them my address in Brazil.

The only time that Josue's address has come up was today in the email from the Embassy when we confirmed to what address they are going to send the packet. Once you get to that step I'm sure an email will take care of it.

original birth certificate (Chelsea)

I believe this is uncessary, as you had already established the legal citizenship of the Petitioner back at USCIS with either a copy of your birth certificate, passport, etc. No need to send this, or even a copy (though I had inadvertently did with the I-129F duplicate), as a Cosulate Officer shall not ask your fiancé to prove your American citizenship.

I have read, and I wish I had a link for you all, that the CO can ask for any of the originals of things sent in as copies with the I-129F packet. I had written on my birth certificate, name change order (I changed my name before the divorce went through to get my passport, start a new school year as my maiden name, etc.) and divorce decree the whole blurb about "This is a copy and I can provide the original if requested by any CO or official" or whatever.

Unless Consulate-specific, they are asked for, I am unaware of the beneficiary needing to produce the original of these, though I do understand the value in having a copy at least, and I do recall an aditional copy being required for AOS.

The rest of the list is very much aligned with mine, as well as other filers, minding that there are some Consulate specific nuances. How close are you to having it ready to send?

With Grace ours shall be ready in about three weeks time, so we can send immediately to the Consulate. An interview date sometime in April would work for us, and then it's just waiting till the summer to see each other. This very well could be the best summer vacation I have ever had.

As far as this, my plan is to compile the notebook and bring it over with me when I go April 9th. So technically I have about 5 weeks, but really the only thing lacking is getting the tax transcripts from the IRS, which should be here in about a week, and the letter from my boss. The bank thing I may not even worry about, but I probably will print the March statement of my savings account, only because I'm putting how much I have on the I-134.

The embassy emailed Josue today and told him that the interview would probably be in May or June. Bummer, I'd really love for him to come back with me April 19th. Which is why I just wrote (with the help of Josue's native Spanish) an email BEGGING and PLEADING with them to schedule an appointment during the week of the 13-17, as the 9th and 10th they are closed for holiday. If not, it was worth a shot. But we emailed them Saturday and heard back today right around 4-ish, so hopefully they will get back with us soon. Who knows, maybe they'll surprise us with their "compassion." If not, like you said, ThaitoUSA, at least we'll be together for summer. This will definitely be the best summer vacation I've ever had...with a close second being last summer when I met him and fell head-over-heels in love! wub.gif

Oh, I did not think that the consulate needed my original birth certificate. Precisely for the reason that Thaitousa
stated. Also, it was not listed in the "Interview" checklist from the consulate. Hmmm. I guess I will double check
on that one.

I know that the NOA2 is required for the consulate. But again, it was my understanding that only a copy is
needed. I know that a copy is also needed for AOS. I have read on VJ that if for example you lose your
NOA2 it is very expensive to get a "new" original from USCIS.

Also, I know that the civil surgeon made a copy of Johan's vaccination record so that we can use it for aos, so
that is something to consider when the medical is done.

I'm not sure, everywhere I look it just says "birth certificate," doesn't say anything about whose. I hope you are assuming safely, I just thought better safe than sorry since I have seen that the originals need to be provided at the interview.

Thanks for the heads up on the vaccination record! Hadn't thought about asking for a separate copy, I just imagined we would get the results after the interview. Good idea, because you do need that for AOS.

Anne, I was putting together stuff for the interview and it looks like Johan needs the originals of everything that you sent in copies of with the original I-129F packet in case they ask for them at the interview. I guess that would be everything except if you sent copies of your passport he doesn't need to have your passport at the interview, but I am arranging a notebook to take to the interview. Let me know what you think, guys:

List of contents

Section I: I-129F packet with originals
  • copy of entire I-129F packet
  • original birth certificate (Chelsea)
  • original divorce decree (Chelsea)
  • original order for name change (Chelsea)
  • original boarding passes
  • original letter from Josue to Chelsea

Section II: I-134 Affidavit of Support with supporting evidence
  • I-134 (2 pages)
  • letter from boss on company letterhead
  • paystubs: Jan 09, Feb 09, (will also include) Mar 09 (couldn't find Dec 08 ohmy.gif )
  • Tax Transcripts 2006, 2007, 2008
  • bank deposits for year 2008 (maybe, haven't talked to bank yet to see if possible - not 100% needed)

Section III: Evidence of Ongoing Relationship
  • boarding passes from visit in Dec 08
  • boarding passes from visit in april 09
  • copy of Chelsea's passport - visa pages
  • phone logs Aug 08-present
  • chat logs yahoo messenger (don't have too many of these as we always use yahoo phone calls and rarely write - anyone think this will be a problem?)
  • a few screenshots from yahoo messenger at different dates (don't have too many of these either)
  • stamps from Josue's letters to Chelsea

I am also making a scrapbook with pictures (but this won't fit in the 3ring binder) from our 2 visits and depending on when the interview date is, I may make some premade pages and leave room for pics for our 3rd visit in April and just print out the pics down there...haven't decided yet.

Section IV: Interview Requirements
  • NOA1 original
  • NOA2 original
  • interview letter
  • police records - Josue
  • criminal records - Josue
  • original Birth Certificate - Josue
  • updated letters of intent - Josue & Chelsea
  • medical results (in a sealed envelope, I guess I will stick it in the back pocket of the notebook)

Any suggestions? I'm so nervous!

If you are sure of the date that your's was sent out, then it is definitely your's. It is possible that there could be more than one petition going to the DR at that time, but all of them would together.

That's awesome that you get to schedule your own interview! Will he come right away or does he have work to finish up?

Well according to the Embassy info at the top of VJ under Guatemala it says that they only accept questions by email, and that there is no packet 3, only a packet 4 that includes all information all at one. Also this is what I have found on the website:

http://guatemala.use...quirements.html

But this was under "Immigrant Visa" info, and the K-1 is technically a non-immigrant visa, from what I understand, because it does not give PR status immediately upon entry. And it also says $380 USD but I thought it was only $131, and that it requires a I-864 and says nothing about an I-134, but I thought the I-134 was needed for the K-1 part, then the I-864 for the AOS part. This may be where the immigrant vs. non-immigrant has overlapped a bit on the embassy website. But it does give a link to the DS-230.

edit: forgot to ask you if you sent him the original of your birth certificate or does he just need his???

Interesting. It is classified under Immigrant Visa on the swedish embassy website but the interview checklist is
classified under non-immigrant visa unit and that is the department to which my phone call was transferred.
$380! That is pricey. I also thought it was around $130-that is the price for sweden.
Sounds like there is some overlap re: the I-134/I-864 forms. Have you found any VJ
people perhaps in the AOS forum from Guatemala that could give you an explanation?
How much is your medical? I think it is about $300 in sweden blink.gif
Only his original BC is required. He is going to come over here asap! kicking.gif

Well, I guess we may just have to wait for him to receive packet 3 - I read on VJ that it was $131 but maybe the $380 is for something different, because it also says you can pay at one of the windows at the Embassy but here on VJ it clearly says at a Banco Uno ahead of time and to bring the receipt to the interview.
From reading in the Embassy forum about the I-134 vs. I-864, it seems that the I-134 is strictly for the interview process prior to arriving in the US. For AOS an I-864 is needed. VJ user YuAndDan gave me very good information about how to get prior transcripts, they are free and I just called and used the automated system and they should be here in 10-15 days. Here's the link to my question: link
The medical will be $100 plus I'm not sure what vaccinations and/or x-rays he may need and whether or not those will be extra, so we'll see! There are only a couple people on here from Guatemala, and the two I've made contact with are still waiting for their NOA2's, but I'll have to see if I can get further information.

That's so exciting that he will be here soon!!!!

But then I was running around jumping and screaming omg! omg! omg!
When I called Johan I was talking soooo fast "we're approveeeeeeeed"!!

Yeah, well I was crying and Josue thought something was wrong, he said his heart dropped to his feet when he heard me call him crying, but then it registered to him what I was saying lol.

You got and sent your packet 3 really quick - how did they send it to you? Do you have your interview date yet? Guatemala doesn't send a packet 3, they send the interview date, approved doctors, forms, etc. all at one time but we are concerned about him not receiving the packet 4 due to the way addresses are down there. His address is "such-n-such avenue, in front of the Catholic Church," so as long as the mail carrier recognizes the name, he'll be fine. Otherwise, it may end up at any of the many other homes/business that are in front of the Catholic Church. Also, did you reach the embassy by email? We are planning on emailing the embassy today in hopes that they will tell us how they send the package - via national mail or Express, so he can go directly to the post office and hopefully they can keep an eye out for his package. Any ideas are welcome! Don't wanna come this far only to have things messed up!!!

Well, I cant take credit for packet 3 getting sent back to the embassy so fast--it was all Johan-he got all the forms
from the embassy filled out immediately. I had already sent him the I-134 and alot of the evidence. He sent it regular mail but it only takes one day from where he lives for mail to reach stockholm.
The embassy sent packet 3 out regular mail-small brown envelope.
No interview date yet but the online calendar is wide open. He is going to book the interview date on Monday after the medical appointment.
I did not email the embassy to find out if they rec'd and/or sent package 3 but I did wait on hold for 17 mins reading.gif
to speak with someone about if they rec'd the package and when package 3 was sent
and their "phone hours" are only 2 days a week for one hour wacko.gif

Sounds like a good idea to go to the post office and look out for the package!
Are the packet 3 forms on the embassy website? You may want to download them and begin filling them out-

My reaction was like that too!! At first I was afraid to get too excited because I thought it might be an rfe.
